Legacy Academy Charter School is founded upon three core beliefs:

1. Every child deserves a rigorous education delivered by highly effective teachers2. A culture of accountability and high expectations develops learners and leaders3. Excellent schools are deeply and broadly tied to the communities they serve

The mission of Legacy Academy Charter is to prepare students to become confident, competent, responsible and successful individuals in our global and technology-based society by providing a rigorous academic program, school-family-community partnerships, and a strong teacher-student relationship. Using an interdisciplinary science, technology, engineering, art and math (STEAM) curriculum aligned with Florida Standards, the purpose of the School is to improve student learning, increase learning opportunities for students and to encourage the use of innovative teaching methods. Students attending the School will develop critical thinking and problem-solving skills that will equip them to learn and to contribute to the 21st - century economy.

The vision of Legacy Academy Charter is to be a leader in STEAM education locally, in Florida and nationally, by developing a community of students with a desire to learn. Our students will be well educated, socially aware, scientifically literate and respectful. These attributes will help our students be successful in middle and high school, college, in their careers, and in their communities.

The educational philosophy of Legacy Academy Charter School is based upon the maximum connection and continuity between school, home and community to prepare students with strong academic and higher order skills. Continuity between home and school is facilitated through parent volunteering, communication and home visits.

At the center of the School's philosophy is the belief and expectation that every child can and must learn. This will be reflected in the enhanced opportunities offered to students throughout the academic spectrum. The students will be guided by teachers and staff that believe in and share the mission and vision of the School, as well as by parents, community, and business volunteers. Teachers will be given the tools, resources and empowerment to impact student learning to a maximum degree. High academic achievement will be attained through a curriculum rooted in solid educational research aligned to the Florida Standards, continuous assessment of data related to student performance, and an analysis of student learning gains. Core curriculum will integrate aspects of leadership development and character education.

This Student Handbook has been written to give direction and to cover the majority of situations that might occur in a school setting. If you have any questions regarding the expectations provided in this handbook, please contact the administrative team of Legacy Academy Charter School.

Please read this entire Student Handbook completely. The School also requires all students and parents to read the School District Student Code of Conduct via the Brevard Public School website. Students and parents will be given an Acknowledgement Form/Signature Page that mandates the signature of the student and parent/guardian. This signed Acknowledgement Form/Signature Page must be returned to Legacy Academy Charter School and will be placed in the student file.

Student Responsibilities

Understand and know the Legacy Academy Charter School expectations. Believe in yourself and your ability to achieve success and excellence. Display positive Character Traits such as respect, honesty, empathy, trust,

responsibility, integrity, kindness, and cooperation. Have pride in yourself and your work - a good work ethic. Come to class on time and prepared with books, pencils, notebooks, etc to

participate in class. Be organized and plan your time wisely. Keep your parent(s) involved in your school activities.

All students are under the supervision and direction of the school Principal, or designee, and the immediate supervision and direction of the teacher or other members of the school staff (as applicable) to whom such responsibility may be assigned by the Principal during the following times:

1. When attending school.2. When engaged in a school-sponsored activity on the school premises or away from the

school premises on a school sponsored event.3. During the 30 minutes prior to the start of school or the 30 minutes after the end of the

school day when a student is on the premises for attendance. There is no formal supervision earlier than 30 minutes prior to the start of school or later than 30 minutes after school dismissal. Students must be picked up within 30 minutes after school dismissal unless they are involved in a supervised after-school activity.

Achieving Academic Excellence

Grade Reporting - Interim reports and report cards will be distributed in accordance with Brevard Public School district calendar.

Homework will be an extension of the activities started in the class by the students under the guidance of their teachers and continued at home. Home and school will guide students as they learn and begin to grow and achieve independence. This growth and academic development will vary with each individual student. Therefore, the amount of time each student may require to spend on homework and projects will vary from one assignment and/or project to another. Generally, homework may be assigned Monday - Thursday and should not exceed the following guidelines:

Kindergarten: 20 minutes of reading, conversation with parent/guardian and review.First Grade: 20 minutes of reading and 10 minutes of additional homework and review.2nd Grade: 20 minutes of reading and 15 minutes of additional homework and review.3rd Grade: 30 minutes of reading and 25 minutes of additional homework and review.4th Grade: 30 minutes of reading and 30 minutes of additional homework and review.5th Grade: 30 minutes of reading and 45 minutes of additional homework and review.6th Grade: 30 minutes of reading and 45 minutes of additional homework and review.

Note: These times should include focused independent reading in a self-selected or teacher- selected material and long-term project work. Homework is generally not assigned on Fridays or over vacation.

Homework assignments will vary during the week and some assignments may require more time than others. We recognize that there will be a variety of learning styles in each classroom. For example, in third grade, we expect the majority of students to complete the homework assignment in approximately 30 minutes. For those students who work more slowly, it is our recommendation that they spend no more than 60 minutes of focused work on assignments. After 60 minutes, the parent/guardian should sign the homework assignment and put a notation on the homework paper indicating to the teacher that the assignment presented some difficulty to the student.

In the event that a student is unable to complete an assignment because they do not know how, please review the directions to make sure that the directions are understood and provide assistance as needed. If the student continues to have difficulty because they do not understand the concept, please attach a note to the assignment for the teacher. Although homework is intended to reinforce the skills a student has already learned, it also serves as a measure of how well a student understands the concepts previously taught. The teacher may discover that several students are having struggles with a new concept and more time must be allocated to teaching this concept for the entire class. If your child is consistently having a difficult time finishing

homework in the timeframe indicated above, please notify your child's teacher. For some students, homework may need to be modified. Legacy teachers are willing to modify homework if they are made aware of the issue. Please either call or meet with the teacher or place a note on your child's homework paper.

At Legacy Academy Charter School, homework is expected to meet certain standards. Occasionally, a student may be asked to redo a poorly completed assignment or a homework assignment that does not meet expectations. Check with your child's teacher for the expectations of that class.

Parents/Guardians are expected to support students by doing the following:

Providing the appropriate time for student homework completion Providing a quiet space and the resources for student homework completion Providing clarity on homework directions (as needed) Providing encouragement for student independent work Ensuring the student does the homework and not the parent

Homework assignments will be posted on the Legacy Academy Edline site located on the school's website.

Honor Roll - Legacy Academy Charter School will issue the following special awards each grading period to eligible students.

1. Principal's Honor Roll - Student's who earn all "A" grades on their report cards in academic subject areas and exemplary conduct/effort grades will be eligible for this award and will receive this special award at our Awards Assembly.

2. Honor Roll - Students who earn an "A" or "B" grades or all "B" grades on their report cards in academic subject areas and satisfactory (A or B) conduct grades will be eligible for this special award at our Awards Assembly.

3. Perfect Attendance - Students who have perfect attendance for the nine weeks grading period will be eligible for this special award at our Awards Assembly.

4. Kindergarten Honor Roll - Students who attain mastery in the top 25% of the class will be recognized at our Awards Assembly.

Study Skills - The following study skill tips will help students achieve academic excellence:

Arrive at school on time with all necessary supplies and prepared to work hard; Make sure you understand all assignments given to you by your teacher; Ask for assistance and help from your teacher or school staff if assignments are not

clear; Designate a specific quiet place at home to study that is away from the TV, radio or

other distractions; Take home all books and materials needed to complete your homework assignment; Review and proofread your assignment after completion; Make sure you are well rested so you can be alert and attentive in class; Be confident and have pride and respect for yourself, peers and adults at Legacy

Academy.

Legacy Lions - Leading the PRIDEPromotion Requirements - The criteria for promotion are established by the State of Florida. Therefore, in response to the Elementary and Secondary Education Act (ESEA), the Florida legislature passed Florida Statute 1008.25 regarding student progression, remedial instruction, and reporting requirements. This legislation is intended to eliminate social promotion and ensure that students' promotion from one grade to the next is determined, in part, upon proficiency in reading, writing, mathematics, and science and that each student and their parents are informed of the student's academic progress.

As a part of FS 1008.25, students must participate in the statewide assessment program. Students who do not meet specific levels of performance in reading, writing, science, and mathematics for each grade must be provided with additional diagnostic assessments to determine the nature of their difficulty and their areas of academic need. For each student with identified and diagnostic deficiencies, the teacher will develop a Progress Monitoring Plan (PMP) in consultation with the student's parent/guardian. Also, as a way of communicating ongoing progress, a progress report will be sent home each grading period prior to the distribution of report cards. Legacy Academy Charter School follows the BPS Student Progression Plan.

Technology - Legacy Academy Charter School students will have the privilege of using computers and the internet for academic purposes only. Students are not allowed to bring any computer applications, including games, to the school for any reason. School computers and workstations may not be altered without the direct approval of the principal, or designee.

Vandalism (renaming, trashing or moving files, illegal copying, etc), intentional copyright violations, or attempted access to secured data will result in disciplinary action, which may include restitution to the school. Parents and students should be aware that as with any school property or activity, the appropriate use of the internet connection would subject the student to disciplinary action. Inappropriate internet activity include accessing, downloading and distributing inappropriate materials, vandalism, or any other use incompatible with district or individual school policies.

Acceptable Use: Use the computer or internet to research and to learn. As a student, I agree to follow the rules of appropriate behavior while on the internet. These rules are:

---I will not copy material and state that I wrote it.---I will only use web sites that are suitable for students at Legacy Academy Charter.---Passwords given to me are for my use only; I will not give them to anyone else.---I will not cause any damage to computers or change how they are set up.

Privileges: Use of the internet at Legacy Academy Charter School is a privilege. My Principal and my teachers are the decision makers when it comes to whether or not I may use the internet. If my behavior on the computer or internet is inappropriate, I may lose this privilege.

Vandalism: Any violation related to computer or internet policies will result in disciplinary action, including detention, suspension and/or the withholding of internet access.

Textbooks - Textbooks are the property of Legacy Academy Charter School and are issued for student use. The textbooks are the responsibility of the student and/or parent and must be returned at the end of the school year in good condition. Please provide a cover for your book and do not write or highlight in your textbook. All damaged or lost books must be paid for before another textbook is issued.

Field trips will be educational in nature and considered a part of the core curriculum. Scheduled field trips provide an experience generally not possible within the classroom, allow for cultural enrichment, and take advantage of the resources outside of the classroom.

Field trips are considered to be the lesson plan for that particular day and all students are expected to participate unless there is a compelling reason given by the parent(s). If a parent/guardian chooses to restrict their child from participating in a scheduled field trip, the parent must realize that it is not possible for us to provide alternate plans for their child on that date. If the student does not participate in the scheduled field trip and comes to school, he/she will be placed in another classroom, most likely at another grade

level due to grade levels usually attending field trips together. The student will be assigned class work to complete. Parents/guardians are expected to pay the cost associated with the field trip, such as transportation, entrance fees, and lunch. All funds for field trips must be paid on time.

It is the school policy that parental permission be granted before any student can accompany his/her class on a field trip. Written permission must be on file at the school before a student will be allowed to participate in a scheduled field trip.

Field Trip Chaperones - Parents are encouraged to volunteer as field trip chaperones. Please contact your child's classroom teacher or school administrator for information regarding chaperone responsibilities. Chaperones will receive Legacy Academy Charter volunteer hours.

At the discretion of the Principal, students with an excessive number of disciplinary infractions in a given marking period, may be denied the opportunity to participate in a school field trip.

Attendance Policy

To comply with the State of Florida legislation entitled, Habitual Truancy Procedures, Section 232.19 F.S., and Brevard Public Schools (BPS) Student Progression Plan, Legacy Academy Charter School has developed the following attendance policies:

We expect all students to attend school on a regular basis; We encourage the commitment of students, parents, and staff to work together to ensure

compliance with school attendance expectations; and We expect students to be on time to school, notify school when absent, make-up

assignments missed, and to turn in assignments on time.

Failure to comply with the attendance policy and expectations may result in disciplinary action. An Absence Notification Form is provided at the end of this handbook. Absences should be reported to the school by the parent/guardian as soon as possible.

School Calendar

Legacy Academy Charter School will follow the Brevard Public School district calendar for all student holidays and teacher work days. Weather and Emergency Related School Closings will also follow the BPS recommendations published to the general public.

Procedures for Reporting Absences

1. Teachers shall record student absences each period of the school day and report those absences to the school office.

2. Parents/guardians will be notified each time their child is absent to the greatest extent possible.

3. When a student has been absent for three consecutive days and the school is not able to ascertain the reason for the student absences, the absences will be investigated, if determined necessary, by the school Principal.

Absences must be reported in writing, on the Absence Notification Form, to the school by the parent/guardian as soon as possible. Failure to report and explain a students' absence(s) shall result in an unexcused absence(s). The school Principal has the final authority in determining acceptability of the reason for a student absence.

A student who is absent more than nine (9) days within a semester or more than four (4) days within a nine (9) week period for schools on a block schedule, will not receive a passing grade for the semester.

Legacy Academy will maintain accurate attendance records, track absences and follow attendance reporting procedures prescribed by the district. Any student who fails to attend school regularly and/or has no excuse for the absence shall be referred to the appropriate school administrator. Disciplinary action shall include notifying the student's parent/guardian. Chronic truancy and/or a student with at least five (5) unexcused absences will result in a referral to the appropriate school administrator. Students identified as physically or mentally impaired and eligible under the Individuals with Disabilities Education Act (IDEA) or Section 504 of the Rehabilitation Act of 1973, and are exhibiting a pattern of non-attendance, will be referred to the appropriate administrator or staff to review the attendance records and make the appropriate recommendations.

Absences not counted in the nine days/four days attendance policy are: court dates; illness with medical documentation; religious holidays; and chronic and extended illness. Student absences for religious purposes shall not prohibit the student from receiving perfect attendance recognition.

A student is considered to be present at school, if they are away from school on a school day and engaged in an educational activity that is a school approved instructional program or activity. Students must be in attendance a minimum of four hours of instructional time to be considered present for the school day.

Kindergarten students are required to be in attendance a minimum of 162 days, as a criteria for progression to the first grade. The school Principal may, in consultation with the teacher, deny promotion of the student, based on this criteria.

The school will establish an Attendance Appeal Committee to implement the appeals process. A uniform set of procedures has been developed by the district's attendance committee. Students are entitled to an appeal once the student has been absent more than nine (9) days within a semester or more than four (4) days within a nine (9) week period for schools on a block schedule. Individual schools will publicize the availability of the appeals process which will be scheduled at the discretion of the school Principal.

Make-Up Work - All Legacy Academy students are expected to make-up class work missed during an excused absence. For absences due to illness of student, illness of an immediate family member, and death in the family, the student has two days to make up the work for each day the student is absent, not including the day the student returns.

Principals may grant extensions to make-up time limit for extenuating circumstances. Also, the Principal shall determine, in consultation with teachers, whether a student should be granted the opportunity to make-up schoolwork and work missed for an absence due to out-of-school suspension.

Dismissal - A parent/guardian must send a written request to have a student excused from school early. The written request must be sent with the child on the morning of the dismissal and must include the time and reason for leaving. Students may not be dismissed from school during the last thirty minutes of the school day, except in cases of emergency. Legacy Academy discourages early dismissal. The school will not accept phone calls to request early dismissal from school, unless there is an extreme emergency. Students will only be dismissed to parents/guardians or persons listed on the student's Emergency Card. A photo identification will be required for the student to be dismissed.

For purposes of safety, only the adults listed on the Emergency Card on file at Legacy Academy Charter School, as being authorized, will be permitted to remove the student from the school. There will be no exceptions to this policy. Extreme emergencies may require the school to seek alternate authorization.

Parents/guardians must come in person to add names to the Emergency Card. It is the responsibility of the parent/guardian to maintain updated information on the Emergency Card. A note sent with the student, a fax and/or phone call from the parent/guardian will not be accepted for updating contact information on a student. No exceptions to this policy.

At no time is a teacher permitted to release a student from class for early dismissal. All students will be released through the school office.

The Legacy Academy Principal or designee shall permit a child to leave school only in the custody of one of the following adults:

Parents of the student with photo ID Adult listed on the Emergency Card, with a photo ID Law Enforcement Officer Authorized worker from the Department of Children and Families

Parents must notify the Legacy Academy office regarding any change in the student's normal transportation. Students should be picked up immediately in the school's designated area.

Late Arrival

Students late to school must obtain a late pass from the office. Tardies for doctor/dentist appointment or unusual emergency will be excused. The office will issue a late pass for students to go to their class. Students will not be permitted to enter their classroom without a late pass from the office. Students must be signed in by the parent/guardian.

Tardy Policy

A student is considered tardy when he/she arrives after the beginning of the school day or when the student is not in their assigned seat when the tardy bell rings. The tardiness will be excused when the reason given is acceptable to the principal or the designee.

Students who accrue three or more tardies during each quarter will receive a detention and will not be eligible for perfect attendance. For example:

First tardy during the quarter - tardy pass Second tardy during the quarter - tardy pass Third tardy during the quarter - tardy pass and detention Fourth tardy and above during the quarter - tardy pass and detention

The process will start over at the beginning of the next quarter. The pattern outlined above will be repeated for each of the four quarters of the school year. Students with an accumulated total of 15 tardies, absences or early dismissals are considered out of compliance with our attendance policy and may be subject to further disciplinary action.

Truancy

Truancy, not attending school; or leaving school without proper permission, is considered unacceptable behavior that will lead to disciplinary action. In such instances the parent/guardian will be contacted, a parent conference will be scheduled and the appropriate disciplinary action will be taken.

Trespassing

Students are not to enter or remain on the Legacy Academy school campus without proper authorization. Violators of this policy may be subject to suspension and/or arrest for criminal trespass. Any student on campus while on suspension and/or expulsion are subject to additional disciplinary action and arrest for criminal trespass.

There is no supervision earlier than 30 minutes prior to the start of the school day or later than 30 minutes after dismissal. Students must be picked up within 30 minutes of dismissal unless they are involved in a supervised after school activity or attend the Before/After School Program.

Severe and Inclement Weather

We ask that parents remain patient during rainy day dismissals. The goal of Legacy Academy staff is that all students are dismissed safely. Please remain in your car and have your Parent Pick Up card(s) ready. There will be no office check outs during severe and/or inclement weather.

Dismissal/Final Bell

Parents please remain in your car during dismissal. Please display your Parent Pick Up card(s) with the student's name and grade on the right hand side of your dashboard. Legacy school staff will work efficiently to execute a safe and quick dismissal. An announcement will be made each day for students to exit the building.

Withdrawals from School

A parent who wishes to withdraw a student from school must report to the school office for the student to receive a clearance to withdraw. The withdrawal form must be signed by all of the student's teachers and required staff. These required signatures indicate that the student is cleared regarding textbooks, library books, and any other school equipment that might have been in their possession and that the student is cleared for payment of outstanding balances for school services such as lunch. The school will process withdrawals no later than the day following the withdrawal date.

Custody Matters

If there are custody matters involving a student, please provide Legacy Academy with the original certified written court documents. Birth parents who share equal custody will have access to students and their records unless we have a court document to the contrary. Please do not list non-custodial parents on the Emergency Card unless that parent is permitted to pick up the student from school.

Emergency Cards - An Emergency Card must be completed for each student. Up to date information provides our school office the information necessary to contact parents/guardians in the event of an emergency. Therefore, it is very important that the school is notified immediately if there is a change in address or telephone number(s) at home and/or at work. The School also needs current addresses and telephone numbers of child-care providers and the person to contact in case of an emergency.

Please note that parents/guardians are required to notify the Legacy Academy Charter School office whenever there is a change in home, work, or cell phone numbers or other emergency contact information. This includes changes to a student's medical history or any other condition that affects the student's participation in school programs.

Medications - In order for students to receive their prescribed medications during the school day, a Medication/Treatment Form must be completed. This form requires the signature of the doctor prescribing the medication and the parent/guardian signature. Whenever possible, prescription medications should be administered at home. Medications intended for the administration to a student during the school day must be transported to and from school by the parent/guardian and meet the following guidelines:

All medications must be presented in the original packaging with the manufacturer and/or pharmacy label intact.

Loose medication, such as cough drops, pills, etc., should not be sent to school and will not be administered to your child.

School and/or clinic staff will not administer medication to your child if the label has been altered in any manner.

Over-the-counter medications may only be administered to your child for up to ten days, unless authorized by a doctor. All over-the-counter medication without a doctor's note on file, will be properly disposed of after 30 days.

A Medication/Treatment Form must be completed for any medication to be given at school, including cough drops and over-the-counter medications.

As you complete the Medication/Treatment Form, please be sure that your instructions match the label on the medication bottle.

All medications are subject to inspection and inventory when brought to the school. All medications provided to the school must be picked up by the parents at the end of the

school year. Accidents - If an accident occurs, a trained staff member will administer initial treatment of minor injuries. The student's emergency contact will be notified by phone whenever treatment is administered. In the event of a more serious accident, the EMT's will be called and dispatched. The emergency contact will be notified immediately.

Student Illness - Please follow the guidelines listed below:

Students with a fever of 100°F or higher upon arrival at school will not be allowed to stay, unless a doctor's note is presented stating that the student is not contagious.

Students who have diarrhea or are vomiting will not be allowed to attend school. Students with highly contagious illnesses, such as pink eye, chicken pox, or measles, will

not be allowed to attend school. Students who develop a fever of over 100°F, have diarrhea, or start to vomit while at

school, must be picked up by a parent/guardian as soon as possible.

Clinic - Legacy Academy will have a room designated as a "clinic area". Students who are ill or injured will be allowed admittance into the clinic. Students will return to class after they have been treated or have rested in the clinic for a time not to exceed 10 minutes (unless it is discerned by clinic staff that the student needs more than a 10 minute rest time or the student is waiting to be picked up by a parent/guardian). Parents will be notified and asked to pick-up students with an elevated temperature, injury untreatable with band-aids or ice, and/or any urgent nature. Student medical records are the property of the school.

Physical Education - All students are expected to participate in physical education activities during the school day. A written statement must be provided from a physician stating the reason a student is not able to participate in physical activity and the timeframe regarding non-participation. In the event a student is ill or has been ill and cannot participate in physical education activities, please provide a note to the teacher so that the student can be temporarily excused from participation.

Students who participate in after school sports or club activities must purchase student insurance.

Dress Code

The Legacy Academy Charter dress code policy is an important part of the environmental culture of the school. It is the responsibility of the parent(s)/guardian(s) to ensure that their children come to school properly dressed. Students are expected to wear the school uniform every day. The school colors are black, gold, and purple. The school mascot is the lion.

Uniform tops are available only through the school vendor. All shirts must be of the type and color designated by the school. Clothing exposing the torso or the midriff, either front, back or sides, is not allowed. Tub tops, spaghetti straps, see through blouses, low backs, or sleeveless shirts are not permitted. Only school approved uniform t-shirts or white shirts can be worn underneath polo shirts. A shirt that is worn underneath the polo shirt must not extend beyond the sleeve or the bottom of the polo shirt. The school-approved logo must be worn at school and while attending school-approved activities and field trips. Uniform tops must be either black, gold, purple or white.

Uniform bottoms may be purchased at local stores that carry uniform style clothing. All uniform bottoms must be worn at the natural waist, be in good repair, and be of appropriate size. Pants, capris, shorts, skirts, and skorts must be secured at the waist. Shorts, skirts, and skorts must reach the top of the knee. School approved pants, capris, shorts, skirts, and skorts must be worn at school and while attending school-approved activities and field trips. Uniform bottoms may not have embellishments, embroidery, patches, or holes. Skinny-style pants are not allowed.

Underwear may not be visible. No leggings, athletic wear, pajama pants or other non-approved apparel may be worn while attending Legacy Academy Charter School. Overly large, overly long, tight fitting clothing is not acceptable and/or appropriate dress. Mini-skirts, mini-dresses and short-shorts are not acceptable and cannot be worn to school.

Solid color jackets may be worn in cool weather. Hooded jackets, sweatshirts, sweaters, and jackets are required to be in compliance with the school uniform colors. Trench coats are not permitted.

Failure to wear any part of the school uniform will result in disciplinary action, including detention, parent notification, etc.

The following dress code guidelines shall be enforced: Hair must not cover the face and must be neat and clean. Hair styles and hair colors that are disruptive are prohibited, i.e., no designs or styles that

will cause undue attention or distraction from the educational environment, as determined by administration, will be permitted.

Symbols, shapes, or signs shaved into the hair are prohibited. Shoes shall be worn at all times while at school and be securely fastened to the feet.

Heavy military type boots, shoes with metal tips, steel toe shoes, cleats, flip-flops, house slippers and shoes with wheels are not allowed.

Students must wear tennis shoes (athletic sneakers) while participating in PE class. Fish net stockings, gang-related colors or other inappropriate leg wear is not acceptable. Clothing and items that contain offensive slogans and/or pictures are not permitted. Jewelry or clothing which display or suggest sexual, vulgar, drug, gang, weapons, or

alcohol-related wording or graphics, or which provoke violence or disruption in the school, are not permitted.

Dog collars, spiked jewelry, or any accessories deemed inappropriate by the school administration, are not permitted.

Sunglasses are not allowed during the school day unless prescribed by a doctor. Hats, curlers, bandanas, or wallet chains are not permitted.

Dress Down Days - Occasionally, the school may allow students to refrain from wearing their school uniform. These times may include during school spirit week or at other times designated by the school administration. However, during these "dress down days" the same guidelines listed above shall apply, i.e., tank tops, clothing with offensive symbols or writings, skinny pants, etc. are not permitted.

Consequences for Dress Code Violations - Blatant violation of the Legacy dress code policy will result in immediate contact with the student's parent/guardian to bring a change of clothing or to remove the student from the school to go home and change clothes.

Personal and School Property

Legacy Academy Charter School is not responsible for the loss or damage to a student's personal items. We recommend that items not required for educational purposes be left at home. It is a good practice to label all clothing with the student's first and last name. Money and all other valuable items should be left at home. The school assumes no responsibility for loss or theft of such items.

Cell Phones/Paging/Electronic Equipment - Electronic devices, games, I-Pods, toys, etc., are not allowed in the school unless special permission has been given by an administrator. Any item deemed to be unsafe or inappropriate for the school environment will be confiscated and held in the office until the decision is made for parents to retrieve the item. All unclaimed items will be placed in the "Lost and Found" bin and will be discarded at the end of each month.

Cell phones are permitted at school but must be turned off and out of sight during the school day. Cell phones are a distraction and disruption to the learning environment. Cell phones that are visible to school staff are subject to being confiscated unless they are being used as a part of the teacher's classroom activity/assignment. If a student refuses to turn over the cell phone to a teacher or school staff, the teacher or staff will not attempt to take it from the student but will check "defiance of authority" on the referral form. The student will then face additional disciplinary action. The school Principal or designee will confiscate and tag the cell phone for storage. The cell phone will be returned only to the parent.

Students may turn their cell phone ON after school hours.

Office Telephone Use - Students are not permitted to use the office telephone unless it is an emergency and the use has been approved by school staff. All telephone calls originating from the school will be strictly supervised.

Students will not be called to the office to receive personal calls. In the event of an emergency, school staff will deliver messages to students.

Book Bags/Folders/Personal Items - All book bags, backpacks, folders or any other personal items must not display patches, entertainment insignias, obscene words, gang signs, or any other item that would be deemed inappropriate, offensive, or reflect negatively on Legacy Academy. Rolling book bags, roller blades, skateboards, and tennis shoes with integrated skates are not allowed. Students will be provided an area in their classroom for book bags.

Care of School Property - All students are expected to respect the school building and property. Trash containers will be provided throughout the school building and grounds for proper disposal of debris. Defacing or marking school property is a serious offense and will result in out-of-school suspension or possible arrest. Any student who misuses school property will be required to make full restitution for any and all damages.

Search of Person or Property - If a student is suspected of being in possession of items considered harmful or dangerous, he/she will be given an opportunity to surrender those items voluntarily. If the student fails to comply, they will be searched by the Principal or designee.

Bullying and Harassment - There is a no tolerance policy for bullying and harassment. This includes electronically transmitted acts of bullying.

Legacy Academy Charter School will prohibit all acts of harassment or bullying. We have determined that a safe and civil school environment is necessary for students to learn and achieve high academic success. Bullying or harassment disrupts a student's ability to learn and a school's ability to educate its students in a safe environment.

"Bullying or harassment" is defined as any gesture or written, verbal, graphic, or physical act (including electronically transmitted acts - i.e. internet, cell phone, personal digital assistant (pda), or wireless hand held device) that is reasonably perceived as being motivated either by any actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical, or sensory disability or impairment; or by any other distinguishing characteristic. This type of behavior is considered bullying or harassment whether it takes place on or off school property while under the supervision of school personnel, at a school-sponsored event, or in a school vehicle.

"Bullying or harassment" is behavior that meets the following criteria:

Is directed at one or more students; Substantially interferes with educational opportunities, benefits, or programs of one or

more students; Adversely affects the ability of a student to participate in or benefit from the school's

educational programs or activities because the conduct, as reasonably perceived by the student, is so severe, pervasive, and objectively offensive as to have this effect; and

Is based on a student's actual or perceived distinguishing characteristic (as described above), or is based on an association with another person who has or is perceived to have any of these characteristics.

Bullying is not teasing and can take on many forms. It may be difficult to tell the difference between playful teasing and bullying. Teasing generally involves two or more friends who act together in a manner that appears to be fun to all of the people involved. Usually they tease each other equally, however, it never involves physical or emotional abuse.

Types of bullying or harassment includes:

1. Verbal bullying which includes derogatory comments and name calling2. Physical bullying such as hitting, kicking, shoving, and spitting3. Social exclusion or isolation4. Spreading lies and false rumors5. Taking of money or other personal items6. Damage of personal items or property by students who bully or harass7. Threatened or being forced to do things by students who bully or harass8. Racial bullying or harassment9. Sexual bullying or harassment10. Cyber bullying or harassment via cell phone or the internet

Other examples include the following:

Sexting - As defined in Florida Statutes 847.0141(1)(a) sexting is the use of a computer, or other devices capable of electronic data transmission or distribution, to transmit or distribute to another, any photograph or video of any person, which depicts nudity.

Cyber-bullying - Is defined as the willful and repeated harassment and intimidation of a person through the use of digital technologies, including, but not limited to, email, blogs, texting on cell phones, social websites (e.g., MySpace, Facebook, Twitter, etc.), chat rooms, sexting, instant messaging, or video voyeurism.

Cyberstalking - As defined in Florida Statutes 784.048(d) means to engage in a course of conduct to communicate, or to cause to be communicated, words, images, or language by and through the use of electronic mail or electronic communication, directed at or about a specific person, causing substantial emotional distress to that person and serving no legitimate purpose.

Appropriate remedial actions and consequences for a student who commits one or more acts of bullying or harassment range from positive behavioral interventions to suspension or recommendations for expulsion, as set forth in the approved code of student conduct. Remedial measures shall be designed to correct the inappropriate behavior, prevent another occurrence of the behavior, and protect the victim of the bullying and/or harassment.

The School may impose disciplinary sanctions when the alleged bullying, cyberbullying, harassment or discrimination takes place off campus provided that a nexus exists between the off campus conduct and conduct at a school or during a school sponsored event. This will be determined on a case-by-case basis after reviewing the facts and circumstances unique to each situation. If a sufficient connection exists, appropriate discipline shall be imposed in accordance with district/school policy and as provided for in current law.

Students must notify the Principal or appropriate school staff when bullying or harassment occurs.

Emergency Procedures - If the school has to close or be dismissed at an unscheduled time due to an unforeseen emergency, we will follow the Brevard County District guidelines for all emergencies and/or closings.

Fire Drills, Evacuations, School Lockdowns - To comply with state and district guidelines, Legacy Academy will conduct regular fire drills, evacuations and lockdowns. Specific procedures and signals have been established for all types of drills and safety areas have been designated in the school. All teachers are equipped with instructions for fire drills, evacuations and lockdowns. Drills will be practiced with students on a regular basis. Parents are not permitted to enter the building or remove a student during a drill.

Inclement Weather - Legacy Academy will follow the guidelines set forth by Brevard Public Schools in the event of severe weather. Please listen to the local television or radio news for continuous updates.

Gang Symbolism - Student behavior, dress, signing or symbolism that is intended to represent gang affiliation will not be tolerated at Legacy Academy or at school-sponsored events. Violation of this policy may result in discipline, suspension, or a recommendation to the district for expulsion.

Halls/Corridors - Students should be in the halls only at the beginning and close of the school day and while moving from one class to another, unless a teacher, administrator or staff person has given permission for the student to be in the hall. There should be no more than one or two students out of a class at a time. Students should have a hall pass when not in the classroom.

Solicitation - Solicitation by any student or parent on school property for any reason except authorized by school administration is strictly prohibited.

Visitors - All visitors are required to sign-in at the front office and to wear a visitor's pass. A driver's license or other form of ID must be shown in order to receive a visitor's pass. Legacy staff will escort anyone without a pass directly to the office for identification.

Parent Contract/Student Contract - A parent/guardian must sign the Parent Contract agreeing to the terms within. All students are required to sign the Student Contract also agreeing to the terms written, including the District Code of Conduct, and the Legacy Academy Charter School Student and Parent Handbook.

The failure to comply with the terms of the Student Contract may result in one or more of the following consequences:

After-School Detention In-School Suspension Out-of-School Suspension Alternative Behavior Contract Recommendation to the School District for Expulsion

Discipline Policy

The Code of Conduct exists to protect the rights of all students and adults and to establish a safe environment where students can learn and teachers can focus on quality teaching. Legacy Academy Charter School administrators and staff are committed to protecting these rights. Respect, civility, and responsible behavior are essential components of the daily expectations at Legacy Academy.

School administrators and staff have a Zero Tolerance Policy for bullying, harassment, gang affiliation, fighting and disrespect for school personnel. In the event of one or any of these infractions, the parent/guardian will be contacted regarding immediate disciplinary action. Legacy administrators and staff will hold students and parents accountable for any actions or behavior that interferes with the learning environment and/or the day-to-day operations of our school.

The School must have proof that every student and parent/guardian has had an opportunity to read the School District Code of Student Conduct and the Legacy Academy Charter Student Parent Handbook. All parents/guardians must sign and return the Acknowledgement Form page provided the first week of school.

Discipline is progressive in nature and is designed to modify the unacceptable behaviors students may exhibit. Parents are an integral component of the school's discipline policy. Prepared, Attitude, Respect, Responsibility = PARR is based on the Positive Behavior Support Plan designed by the Florida Department of Education.

The school discipline policy is implemented school-wide and is designed to deter inappropriate student behavior. Rules are posted in each classroom and anyplace where students must behave within a structured environment. Teachers are responsible for minor disciplinary infractions that may occur in the classroom. If the behavior of the student does not improve, parents are notified and a conference may be requested. If misbehavior continues, the administrative staff will be asked to become involved. All students must follow the school-wide discipline policy as posted in each teachers classroom. Additionally, students must follow the rules as posted in each teacher's classroom.

After-School Detention (Disciplinary Detention) - After school detention will be held at the times designated on the notice of infraction. The student must bring their copy of the detention slip, signed by the parent, to the after-school detention session. Students who miss an after-school detention due to a medical appointment will be permitted to serve their detention on the following day. A note from the medical provider, including the time and date of the appointment, will be required.

Failure to serve a disciplinary detention after one rescheduled detention, will result in further disciplinary action. If the student is absent on the day of the detention, the detention will be rescheduled. If a student is consistently absent on the day of their detention, the Principal will determine an appropriate consequence for the student. Arriving late to any detention constitutes the same penalty as a missed detention.

In-School Suspension - The Principal may choose to provide an In-School Suspension as an alternative to Out of School Suspension. Students will be required to complete all work assigned by their teacher during the school day. Students on In-School Suspension must abide by all guidelines established by the Principal.

Out of School Suspension - A student will receive Out of School Suspension if the Principal determines that such action is appropriate as a consequence for a student infraction. The School will notify the parent(s)/guardian(s) via cell phone and/or home phone and letter.

Expulsion - Severe infractions of the School's Handbook and/or District Code of Student Conduct may result in a recommendation for expulsion. Only the District School Board may expel a student from the school system.

School Assemblies - Respect for people and property is the expectation during school assemblies. Unacceptable conduct includes whistling, talking and shouting during a program or assembly. No food or drink will be allowed during a school assembly, except during any event in which food or drink has been approved by the Principal.

False Alarms - Pursuant to the 1991 Uniform Fire Code Section 13.203, false alarms shall not be given, signaled, or transmitted or caused or permitted to be given, signaled, or transmitted in any manner. Under the law, false alarms are misdemeanors subject to a fine. Such action or involvement by a student will result in disciplinary action, which includes detention, suspension, or expulsion or arrest. Bomb threats are considered felonies.

Misrepresentation - Misrepresentation by cheating, copying, plagiarizing, counterfeiting, forgery, or using false identification is considered a serious offense. The penalty for the violation of any of the above mentioned offenses will result in one day of in-school suspension or out-of-school suspension.

Public Display of Affection - Public displays of affection includes hand-holding, kissing, hugging, etc., and are not appropriate at school. Students are expected to refrain from this type of behavior or risk disciplinary action by the Principal.

Referrals - Staff and faculty will use a referral for any student whose actions disrupts the school environment. Examples include infractions such as: profanity, destruction of property, misrepresentation, stealing, disrespect, insubordination, fighting, and being under the influence or possession of alcohol or drugs. In the event a student receives a referral, the Principal or designee, will assign the appropriate disciplinary consequences and contact the parent/guardian.

Theft - The offense of theft may result in a suspension from school for a period of up to ten (10) school days. The student will be required to replace or pay for the item(s) stolen. Also, the appropriate legal authorities may be contacted.

Tobacco/Smoking Regulations - Legacy Academy promotes and maintains a smoke-free environment. Students are prohibited from smoking or using tobacco products or from having tobacco in their possession. This includes chewing tobacco, any nicotine alternative to cigarettes,

Vapor cigarettes, E-cigarettes, etc. at any time during the school day, including before and/or after-school, or at any school sponsored event. Violations will have the following consequences: (1) after-school detention; (2) out-of-school suspension; and (3) notification to proper authorities.

Staff, teachers and parents are prohibited from smoking on school property. No Exceptions.

Drugs, Weapons or Firearms - Legacy Academy Charter School is a Drug Free Zone. The use or possession of drugs on school property or at school sponsored events will not be tolerated. Violation of this policy will result in immediate notification to the proper authorities. Violators will be prosecuted to the fullest extent of the law.

The school prohibits any student or visitor from bringing a firearm or weapon on school grounds, except law enforcement officers as defined in Chapter 943, Florida Statutes. This includes, but is not limited to, possessing or carrying a firearm or weapon on his/her person, in a vehicle, container, or other conveyance.

Morning Drop-Off - Students arriving with parents prior to the start of school must be escorted to the Before-School Program reception area. If a student is observed on school grounds more than 30 minutes prior to the start of school and is not enrolled in the Before- School Program, they will be placed in the Before-School Program. The parent will be charged the daily rate for that day.

Students may not be dropped off at the school more than 30 minutes prior to the start of the school day unless they are enrolled in the Before-School Program. No exceptions. Students must be dropped off in the designated areas where supervision is available.

Walkers and Bike Riders - Walkers and bike riders may leave the school premises upon dismissal for the student's grade level. Kindergarten through second grade students will only be permitted to walk or ride a bike home if accompanied by an adult or sibling enrolled in grades three through six. Parents must provide written consent for their child to walk or ride a bike.

Parents who permit their child(ren) to walk or ride a bike to school should accompany their child(ren) on one or more trips to the school to ensure that the student is familiar with the appropriate route he/she should follow when traveling to the school. All walkers and bikers must observe appropriate traffic and pedestrian rules and traffic laws. Legacy Academy will not be responsible for the student's property left on the school premises.

Students who bring a bicycle to school are expected to park and lock them in designated areas before school begins and to leave them there until school is dismissed. The school accepts no responsibility for loss or damage.

After-School Dismissal - Upon school dismissal, students enrolled in the After-School Extended Learning Program will be escorted to the appropriate program area by a teacher or other school personnel. Parents must park and enter the school to pick up a student enrolled in the After-School Program. Check out procedures will be distributed at the time of Before and After-School Extended Learning Program registration.

Students who remain on the school campus longer than 30 minutes after school is dismissed will be placed in the After-School Extended Learning Program. Parents will be charged the daily rate for that day.

Parent Pick-Up and Carpools - Parents are encouraged to form and join carpools to reduce traffic during afternoon pick-up times. The following protocol should be observed when waiting to enter or exit the school grounds:

Private Vans, Buses, etc. - Legacy Academy does not regulate, condone, or authorize the use of private transportation providers for student transportation to and from school. Any use of services by private bus companies is a strict agreement between the parent/guardian and the transportation provider and is in no way condoned or authorized by the School. The use of private bus providers is solely at the parent's/guardian's risk.

Lunch - Lunch is served by class during their scheduled time. The school will use a food vendor and for a set fee, each student may choose from a selection of hot and cold items for a balanced meal. Parents may pack a lunch for their child and are encouraged to send a healthy lunch. Parents are not allowed to bring lunch for other students.

Legacy Academy participates in the federal Free/Reduced Lunch Program. Applications for free and reduced lunch will be sent home on the first day of school.

Before and After-School Programs

The Before and After-School Extended Learning Programs at Legacy Academy Charter School is a service provided to parents who require before and after school supervision of their children. The program is reserved only for those students who attend Legacy Academy and will focus on meeting the needs of individual students, by providing a safe, fun and enriching environment. The Before and After-School Program will be a time for students to grow, learn, explore and experience success.

Before School Program - The Before-School Program will provide some time for students to review their assignments prior to the start of school. This will not be a supervised homework session. The Before-School Program will start at 6:30am. All students who arrive at school more than 15 minutes before the start of the school day are required to go to the Before-School Program. Parents will be assessed the appropriate fees. Failure to comply will result in no supervision for the students and the appropriate authorities will be notified.

After-School Extended Learning Program - The After-School Extended Learning Program is designed to provide supervised care for students who must remain more than 30 minutes after the school day has ended. The daily program will provide a snack, a quiet space and period for supervised homework assistance, structured indoor activities, and outdoor play and activities. Students will participate in special activities, such as arts and crafts, music, dance, opportunities to enhance their computer skills and educational STEAM enhancements on a weekly basis.

Students who remain on the school site more than 30 minutes after dismissal are required to attend the After-School Program. Parents will be assessed the appropriate fees. Failure to comply will result in no supervision for the students and the appropriate authorities will be notified. The After-School Program will start at 3:30pm and end at 6:30pm each school day.

Before and After-School Extended Learning Staff - All staff members are screened according to our school's guidelines. All activity leaders are at least 18 years old. The Program Director is responsible for supervision of the After-School Extended Learning Program.

Snacks - Snacks are provided daily for all participants. If your child has an allergy or special needs, please contact the Program Director. Data and information regarding your child's special needs must be kept in your child's file. In these cases, the parent is responsible for providing their child with a nutritious snack.

Fees - Fees must be paid in advance. There is no partial pay for partial use of service.

Late Pick-Up Fee - Please ensure that your child is picked up on time. A late fee of $1.00 per child/per minute will be charged after 6:30pm. Repeated late pick-up will result in the withdrawal of your child from the program.

Registration - Registration for your child(ren) will be considered complete when the following requirements have been met:

Parent Acknowledgement Form and Registration Form must be completely filled out and signed.

Registration form must contain two emergency contacts. These contacts must be local, reliable, and available to pick up your child(ren) in case you are not available.

All fees must be paid in advance. Registration fees are non-refundable.

Parent Expectations

Parents are the student's first teachers. Listed below are the school's expectations for parental participation in the team effort to ensure success in educating your child.

Provide your child with a good breakfast before they leave for school; Make sure they are appropriately dressed for school; Bring your child to school on time and pick them up promptly; Please avoid picking up your child early during the school day and taking long vacations

during school time; Read all information sent home by the school; Make every effort to attend school events related to your child, such as Open House,

Teacher-Parent Conferences, Parent Meetings, classroom events, fairs, etc.; Volunteer for important events such as field trips, special school meetings, etc; Check your child's homework on a regular basis; Please do not do your child's homework for them, but monitor the time set aside for them

to do it; Verbally support our teachers as you discuss school matters at home. If you are

concerned about a teacher's actions, please discuss these matters with the teacher rather than your child; and

Please communicate with your child's teachers on a regular basis.

Communication - Good communication between home and school is very important and is integral to the educational success of your child. When you call the school, please inform the office staff of the reason for your call. You will then be directed to the appropriate staff person who will provide you with the assistance you need. Our teachers are required to return your phone call within two working days. Teachers post their weekly homework and class assignments on the school's website.

Official school information will only be provided via the school's website, the school's official Facebook page, call outs made from school personnel, the newsletter or the Student/Parent Handbook. Unauthorized Facebook pages and other forms of communication that is not sponsored by the school should not be relied upon as accurate or as a representation of official school information. If you have any questions regarding school events, please contact the school Principal or designee.

Many parent questions are easily answered by communicating directly with the teacher, educator in charge of the program, or school administrator. Each situation should be initially addressed at the level the initial action was taken with appeals moving to the next level in the chain of command. The best and easiest way to communicate is by email. Next a phone call would be appropriate.

Website - The school's website is where all official information may be found regarding school activities. The school newsletter and other important information will be posted on the website.

Parent Conferences - Parent conferences may be scheduled at the request of the school or at the request of the parent. Parents requesting conferences with school personnel should make their request in writing or by emailing the teacher directly using the school email address. School personnel will get in touch with the parent and arrange a mutually agreed upon time for the conference. Conferences requested by the school will give a specific time and date for the meeting. All parents and visitors must sign-in at the front office upon entering the building for a visitor's pass before proceeding to the classroom.

Please note that teachers are not available for unscheduled conferences during the day because they are instructing students. Parent conferences will not be held during the school day, unless authorized by the teacher. Conferences held during the day will be scheduled during the teacher's planning period. All other parent conferences will be held before school or after school ends for the day.

School Conference Tips:

Advise your child that you and the teacher are having a conference to talk about academic and social matters to ensure a positive and productive school year.

Bring some of your child's work to the conference. It helps both the parent and the teacher to have examples of schoolwork to look over together. Tangible examples reduces the need for guesswork.

Let the teacher know in advance about any specific concerns you would like to discuss. This will allow the teacher to gather student work and any other information prior to the conference.

Please be on time to the conference. Maintain the focus of the conference on your child and remember that you are a partner

with the teacher and school. We all want what is best for your child. End the conference in a positive manner.

Grievance Procedures

In the event of a disagreement between a parent, student, and staff, please follow the procedures listed below so that the situation can be resolved in a satisfactory manner.

1. Attempt to resolve the situation with the teacher. The teacher should be the first step in the communication regarding the situation.

2. If the situation cannot be resolved with the teacher, please contact the Principal.

Volunteering

Parents who have students attending Legacy Academy Charter School are expected to volunteer a total of ten (10) hours each school year per family. Research shows that parents who participate in the classroom and school are better equipped to support their child's schoolwork. The research also shows that children whose parents volunteer at school have a better attitude and higher academic achievement than children whose parents do not participate at school.

Volunteer opportunities include preparing bulletin boards, copying materials for teachers, making certificates, attending field trips, organizing and coordinating events and fundraisers, outdoor activities, etc.

All food donated for parties or other activities must be prepackaged and purchased from a store bakery. Homemade items are not permitted.

There are two classifications of volunteers, Level A PLUS and Level A. Please refer to the BPS website for instructions on how to apply.

Volunteer - Level A PLUS - Must be fingerprinted at District and School Security Office, located at Brevard Public Schools, 2700 Judge Fran Jamieson Way, Viera, Florida 32940. 321-633-1000, ext.500. Volunteers receive a sexual predator check with every sign in and receive a Level II Background criminal history search.

Direct one-on-one supervision of students is permitted as long as Level A PLUS volunteers are under the oversight of a District/School employee. This applies to all non-contractual tutors, non-contractual mentors, chaperones for out-of-county field or athletic trips, chaperones for overnight field or athletic trips, field trip drivers, and athletic team drivers.

The Level A PLUS volunteer status is valid for 5 years and allows a volunteer to do the following:

1. Parents are to ensure that their child arrives to school on time. Students are expected to be in their seats at the beginning of class as published in the Student/Parent Handbook. A student arriving after this time will be considered late and will be issued a tardy slip.

3. The School believes that parents are integral to their child's educational and social life. 4. Parents are to ensure that their child is wearing the approved school uniform as stated in the Student/Parent Handbook. Students arriving at the school without the proper attire (approved school uniform) will be disciplined, as stated in the Student Handbook.

5. Parents are expected to provide a lunch each day for their child. The school participates in the free/reduced lunch program. Eligible students will receive free or reduced lunch per the provisions of the National School Lunch Program.

6. Parents/guardians must agree to volunteer a minimum of ten (10) hours per school year. All volunteer hours must be completed prior to the end of the school year.
