As I read one reaction after another, I felt that the principal issue was being missed. It is true that a fair component of the petrol / diesel prices comprises of taxes of the Centre and the States. The question is whether one should go in for a drastic reduction in taxes and soften the impact of the crude oil price hike or pass on the entire rise to the consumer. A reduction in taxes and duties will reduce government revenue which in turn will result in some government spending being slashed. I would prefer that option because it is well accepted that government spends its money unreasonably. However, the long term solution lies in finding means to reduce consumption of petrol / diesel. The need is to develop better public transport systems, and also encourage use of alternative sources of energy. While on shortages, I was amused to read of the blame for world’s rice shortage being placed on India’s ban on rice exports. I understand one being concerned about global food shortage but to criticise Indian policy which is aimed at creating stocks for its own people is uncalled for. Many a time I think that some parts of the western world have not realised that India ceased to be an imperial colony more than 50 years ago. They possibly need a reminder. On the brighter side, the results of the twelfth standard examinations have just come in. When I see these youngsters, read their expectations and ambitions, I feel that we must provide them every opportunity to grow. In our profession, we should not remain employers and principals, but we must become mentors. We at the Society are doing our bit for students. The launch of the students’ forum, which is scheduled for 28th June 2008, is in this direction. Over the past eleven months, I have been communicating with you. I have enjoyed writing this communiqué, and I hope you have enjoyed reading it. I now hand over the baton to Ameet Patel, who will communicate with you from next month. Good bye for the moment ! Dear Members,

The much awaited petrol hike was announced, and with it the usual gameof passing the buck started. As I read one reaction after another, I felt thatthe principal issue was being missed.

It is true that a fair component of the petrol / diesel prices comprises of taxesof the Centre and the States. The question is whether one should go in fora drastic reduction in taxes and soften the impact of the crude oil price hikeor pass on the entire rise to the consumer. Enrolment of Members forInternational Tax and Finance (ITF)

Study GroupsThe International Taxation Committee has been conducting two StudyGroups — ITF-1 & ITF-2 — for deliberations in the field ofInternational Taxation and Finance. The Groups run on a self-studybasis. Members of the Groups are expected to make presentationsbefore their respective Group and in the process enrich theirknowledge and share their experience with fellow members. Non-Groupmember speakers are invited only to introduce certain specialisedsubjects, which the Group members can then take up for further study.

Members of the Groups in the past have immensely benefitted fromthese deliberations. In the larger interest of members of the Society,the Committee has decided to invite new members to both the Groupsif they are willing to contribute and share their knowledge andexperience with fellow Group members. The profile of the respectiveGroups is as follows.

● ITF-1

ITF-1 was established about eighteen years ago. The deliberations inITF-1 are at an advanced level and members are expected to havebasic knowledge (including issues and case laws) and experience ofthe subject.

● ITF-2

The objective of ITF-2 is to introduce members to the field ofinternational taxation and enable them to acquire basic knowledge ofModel DTAAs through self-study and Group-study.

The Groups run on self-financing basis. Initial contribution of eachmember would be Rs.1,000.

Members desirous of joining either of the Groups may forward awritten application by way of a letter to the Assistant Event Managerat the BCAS office. The application should clearly state the name,address, BCAS membership number, contact particulars (including e-mail ID) and the current practice/work profile. The member should alsomention if he/she would like to participate and assist in administrationof the Group. The application along with a cheque for Rs.1000 shouldreach BCAS office not later than 30th June 2008. Existing ITF studygroup members should send their cheque for Rs.1000 with their nameand membership number written on its back to continue themembership.

The application of a member desirous of joining ITF-1 should alsomention the topics on which he/she would like to make presentationsand share knowledge and experience with fellow Group members.

Full-Day SeminarPost-Budget Controversies on Service TaxUnion Budget has proposed various changes in the arena of service taxand CENVAT Credit. Some changes are fundamental and have far-reaching implications. After initial reactions, time has come to take stock,share experiences and find solutions. This in-depth seminar aims toachieve these goals. The participants should have basic knowledge ofservice tax law and procedures. The seminar aims at coveringcontroversial issues in an interactive manner. The faculty will draw fromtheir experience and also suggest practical tips.

In the pre-lunch session, CA S. S. Gupta will take the participants throughthe amendments in CENVAT Credit Rules, 2004 with practical illustrationsand examples on applicability of Rule 6. He would also addressparticipants’ queries and provide his expert comments.

The post-lunch session will witness a panel discussion on two importantservices, viz., lease and information technology services. Both theseservices have significant elements of overlap with the VAT Laws. CA RajatTalati will discuss and elucidate the VAT principles pertaining to theseservices and CA Puloma Dalal will throw light on service tax principles.In the end some case studies highlighting the overlap between the twolaws and solutions to these overlaps would be presented by experts.

Right to Information ClinicBCAS Foundation operates Right to Information (RTI) Clinic on aregular basis. RTI Clinic is operated by Mrs. Hema Sampat, aresearch scholar on the subject of RTI, Mr. A. K. Asher, Advocate& RTI activist and Mr. Narayan Varma, past President, BCAS.

The Clinic provides help and guidance to BCAS members as alsoto non-members, i.e., all citizens, for making applications under theRTI Act and also assists in resolving any related difficulties on thesubject of RTI.

The RTI Clinic operates on every 2nd, 3rd and 4th Saturdayfrom BCAS office — 11 a.m. to 1 p.m.

A.P. (DIR Series) Circular No. 42, dated May 28, 2008

Trade Credits for Imports into India — Review of all-in-cost ceiling

This Circular has revised the all-in-cost ceiling in respect of TradeCredits, with immediate effect, as under :

External Commercial Borrowings Policy : Liberalisation

Presently, borrowers proposing to avail ECB upto US $ 20 million forRupee expenditure for permissible end-uses require prior approval ofthe Reserve Bank under the Approval Route.

This Circular has relaxed the above limit of US $ 20 million for Rupeeexpenditure under the approval route as under :

(i) Borrowers in infrastructure sector can avail ECB upto US $ 100million.

(ii) Other borrowers can avail ECB upto US $ 50 million.

The all-in-cost ceilings in respect of ECB have been revised, withimmediate effect, as under :

Reporting under FDI Scheme — Revised procedure

This Circular has made the following changes in respect of reportingthe details of the issue of shares/convertible debentures :

1. Form FC-GPR has been revised.

2. A standard format for reporting receipt of monetary considerationfor issue of shares/convertible debentures has been prescribed.Upon receipt of this report, the concerned Regional office of RBIwill allot a Unique Identification Number.

3. A format for KYC report on the non-resident investor from theoverseas bank remitting the amount has been prescribed. This

report has to be submitted along with the report of receipt ofmoney.

4. The annual report of all investments will now have to be sub-mitted before July 31 every year, instead of June 30.

A.P. (DIR Series) Circular No. 45, dated May 30, 2008

Foreign Exchange Management (Deposit) Regulations, 2000 —Credit to Non-Resident (External) Rupee Accounts

This Circular permits credit of proceeds of demand drafts/bankers’cheques issued against encashment of foreign currency to the NREaccount of the NRI account holder, provided such credits are sup-ported by relevant encashment certificates.

External Commercial Borrowings (ECB) by Services Sector —Liberalisation

This Circular permits borrowers in service sector viz. hotels, hospitalsand software companies to avail ECB upto US $ 100 million, perfinancial year, under the approval route for the purpose of import ofcapital goods. This is in addition to the existing facility for availingtrade credit up to US $ 20 million per import transaction, for a periodof less than 3 years.

Risk Management and Inter-Bank Dealings — Commodity HedgingExposures of domestic oil refining and marketing companies

This Circular permits domestic crude oil refining companies to hedgetheir commodity price risk exposure, subject to certain terms andconditions, in respect of :

1. Domestic purchases of crude oil sales of petro-products —Hedging is permitted on the basis of underlying contracts linkedto international prices on overseas exchanges/markets.

2. Anticipated imports of crude oil — Hedging is permitted on thebasis of their past performance upto 50% of the volume of actualimports during the previous year or 50% of the average volumeof imports during the previous 3 financial years, whichever ishigher.

Overseas Investments — Liberalisation/Rationalisation

This Circular has further liberalised the provisions of Notification No.FEMA 120/RB-2004 dated July 7, 2004, in the following cases :

1. Overseas Investment in Energy and Natural Resources Sectors— Indian companies can invest in excess of 400% of their networth as on the date of the last audited balance sheet, afterobtaining prior approval of RBI, in the energy and natural re-sources sectors such as oil, gas, coal and mineral oil.

2. Investment in Overseas Unincorporated Entities in Oil Sector —

(a) ONGC Videsh Limited and Oil India Limited are permittedto invest in overseas unincorporated entities in oil sector (forexploration and drilling for oil and natural gas, etc.) withoutany limits.

(b) Subject to certain conditions, Indian companies can investup to 400% of their net worth as on the date of the lastaudited balance sheet in overseas unincorporated entities inthe oil sector. Investments in excess of 400% of their networth require prior approval of RBI.

In case of capitalisation of exports — the time limit for obtaining priorapproval of RBI has been aligned with the time limit provided for inthe Foreign Trade Policy. Thus, prior approval of RBI for capitalisationof export proceeds will be required only where the exports remainoutstanding beyond the period of realisation prescribed by the ForeignTrade Policy.

Export of Goods and Services — Payments of claims byInsurance Companies — Write-off.

This Circular permits banks to remove from their XOS statement,outstanding export bills settled by insurance companies which are

regulated by IRDA. The concerned exporter will have to submit anapplication, supported by documentary evidence from ECGC/insurancecompanies registered with IRDA confirming the settlement of the claimand surrender of relevant export incentives.

Export of Goods and Services — Realisation of Export Proceeds— Liberalisation

This Circular has enhanced the present period of realisation andrepatriation to India of the amount representing the full value of goodsor software exported from the present period of six months to twelvemonths from the date of export. There has been no change in theperiod of realisation in case of exports by an SEZ unit or exports tooverseas warehouses.

Deferred Payment Protocols dated April 30, 1981 and December23, 1985 between Government of India and the erstwhile USSR

The Rupee value of the special currency basket has been fixed atRs.60.5828 with effect from May 13, 2008 as against the earlier valueof Rs.58.6670.

Members desirous of sharing and gaining knowledge are invited to jointhe Study Circles. The fee for each study circle has been kept at Rs.300for the year. Details of the Study Circles are given in the table alongside.

This scheme started last year, has received encouraging response withmany members having taken its benefit. It facilitates members to receiveBCAS publications at their doorstep. All members, journal subscribers,students and non-members can take benefit of this scheme. Briefmodalities of the scheme are as follows :

➠ Rs.2500 to be kept with the Society as an imprest cash in youraccount. Non-member will have to pay additional Rs.250 for accounthandling charges.

➠ The base level would be Rs.250 which needs to be reple-nished again to Rs.2500 by the person opting for the scheme.

➠ Publications/Conference papers/CDs costing less than Rs.250would be sent to you as soon as published/released, along withEnglish Edition of the Budget Publication (a set of 5 books).

The BCAS Foundation has started an Academic Book LendingFacility for ‘PE II’ & ‘Final Level’ Chartered Accountancy students.This facility is meant to assist all those students who have in themthe capability to achieve great heights but have not been able torealise their dreams due to constraints.
