When do The Rights Occur
• Automatically, whenever a work is created• But for Qualification these must be present it should Be Original exhibit degree of labour, skill and Judgement
Who Owns a Piece of work?
Any one who has created the work is the owner BUT if created under the part of employment Employer Company will be the owner
Can Copyrights Exchange Hands?
YES Like any other free assets, copyrights can be sold or transferred by the owner
Duration of Copyrights
For literary, dramatic, musical or artistic works
70 years from the end of the calendar year the writer or producer died (in case of collective work the last living shall be considered)
Sound Recordings and broadcasts
50 years from the end of the calendar year in which the work was created and released
Films
70 years from the end of the calendar year in which the last principal director, author or composer dies.
Typographical arrangement of published editions
25 years from the end of the calendar year in which the work was first published.
Broadcasts and cable programs
50 years from the end of the calendar year in which the broadcast was
made.
Restricted acts
• Copy the work.• Rent, lend or issue copies of the work to the
public.• Perform, broadcast or show the work in public.• Adapt the work.
Infringement
Violation of the intellectual property rights is called infringement
Punishments in case of InfringementThe punishments vary from country to countryIn USA• The legal penalties for copyright infringement are:• Infringer pays the actual dollar amount of damages and
profits.• The law provides a range from $200 to $150,000 for each
work infringed.• Infringer pays for all attorneys fees and court costs.• The Court can issue an injunction to stop the infringing
acts.• The Court can impound the illegal works.• The infringer can go to jail.
