Our firm represents, and hereby files this Transfer Request on behalf of, BDMG WARWICK
OWNER, LLC, MOORPARK INVESTMENTS AB WARWICK, LLC, MOORPARK
INVESTMENTS WARWICK, LLC, BTR WARWICK OWNER, LLC, KASZTL WARWICK,
LLC, JK WARWICK OWNER, LLC, NEIL WARWICK LLC, WARWICK BEDFORD OWNER,
LLC, SK WARWICK OWNER, LLC, and NEIL AB WARWICK, LLC, each a Delaware limited
liability company (collectively, “Current Owner”). Current Owner is the current fee owner of The
Warwick Apartments, located at 1131 University Boulevard West, Silver Spring, Maryland 20902. On
behalf of Current Owner, we hereby request that Special Exception CBA-2187, which was originally
granted to Israel Bimblich on or around May 16, 1967, and was subsequently transferred to BRE Silver
MF Warwick MD LLC (“Current Special Exception Petitioner”) on August 9, 2017, be transferred to
Current Owner.
Current Owner hereby confirms that it agrees to be bound by the terms and conditions of Special
Exception CBA-2187.
A written request for consent was sent to the last known address of Current Special Exception
Petitioner on or about May 26, 2021 and was delivered on June 8, 2021 (USPS Tracking #
9410811899560236121244). As of the date hereof, we have not received any response from Current Special
Exception Petitioner. As per the business entity records on the Maryland State Assessments and Taxation,
Current Special Exception Petitioner was forfeited in 2020. Given the above, despite our best efforts, we
will be unable to obtain written consent from Current Special Exception Petitioner.
Please find enclosed the following documents:
1. Request for written consent from Current Special Exception Petitioner
2. Special Warranty Deed to Current Owner.
3. A list of abutting and confronting property owners.
4. A check for $220 made out to Montgomery County
