FUNDING SUMMARY

: House File 2492, as amended by H-8466 appropriates a total of $568.0 million from the GeneralFY 2019Fund. This is a decrease of $351,000 compared to House action. This Bill also appropriates a total of $16.9million from Other Funds for FY 2019. This is no change compared to House action. This documentprovides highlights of Amendment H-8466 (Senate Amendment).

NEW PROGRAMS, SERVICES, OR ACTIVITIES

Requires the Judicial Branch and the Department of Corrections to study the effectiveness and recidivismrates of persons assigned to the specialty courts of the Judicial Branch. The study shall be done incooperation wtih the Division of Criminal and Juvenile Justice Planning (CJJP) of the Department of HumanRights, and the Judicial District Departments of Correctional Services.

FUNDING FOR PROJECTS AND PROGRAMS

Directs the Division of Criminal Intelligence to employ an additional 3.00 FTE positions to assist in theprocessing and analysis of DNA evidence in the Crime Laboratory.

CHANGES TO PRIOR APPROPRIATIONS

Increases funding to the Department of Public Safety for the Iowa State Patrol by $1.8 million compared tothe House action.

SIGNIFICANT CODE CHANGES

Requires nonreversion of appropriated funds for the Criminalistics Laboratory Fund through the end of FY2020 for the purposes designated.

Provides that a small claims court case commenced on or after July 1, 2018, shall not involve damages orvalue in excess of $6,500. The amount shall revert to $5,000 if a court finds the $6,500 amountunconstitutional.

General Fund appropriation to the Department of Justice (DOJ) for theOffice of the Attorney General for salaries, support, maintenance, andmiscellaneous purposes.

DETAIL: This is a decrease of $600,000 compared to House action.

Requires the Department of Justice (DOJ) to be subject to an agreed-upon procedures engagement performed by the Auditor of State toidentify sources and uses of discretionary funds of the Department,including but not limited to legal settlement funds controlled by theDepartment. The Auditor of State shall complete and file the writtenreport of the Auditor’s findings and recommendations with the GeneralAssembly and the Governor’s Office by February 1, 2019. TheDepartment of Justice is required to reimburse the Auditor of State forthe agreed-upon engagement.

General Fund appropriation to the Department of Corrections forgeneral administration, including salaries and the adjustment of salariesthroughout the department, support, maintenance, employment of aneducation director to administer a centralized education program forthe correctional system, and miscellaneous purposes.

DETAIL: Under current law, a small claims court case shall not involvedamages or value in excess of $5,000. By increasing the jurisdictionalamount for small claims court, the section expands the jurisdiction of aMagistrate or a District Associate Judge to hear and assess judgmenton certain actions, including county and city violations.

FISCAL IMPACT: This provision is estimated to have a two-part fiscalimpact. First, the increase in jurisdiction is estimated to have anegative fiscal impact on the State General Fund due to a loss of filingfee revenue. The filing fee for small claims is $85, and the filing fee fora District Court civil petition is $185. In FY 2017, there were 58,525small claims case filings. It is unknown how many District Court civil

3 27 thousand five hundred dollars or less for actions commenced on3 28 or after July 1, 2002 2018. When commenced under this chapter,3 29 the action is a small claim for the purposes of this chapter.3 30 4. The district court sitting in small claims has concurrent3 31 jurisdiction of motions and orders relating to executions3 32 against personal property, including garnishments, where the3 33 value of the property or garnisheed money involved is four five3 34 thousand dollars or less for actions commenced before July 1,3 35 2002 2018, and five six thousand five hundred dollars or less4 1 for actions commenced on or after July 1, 2002 2018.4 2 5. The district court sitting in small claims has concurrent4 3 jurisdiction of an action for abandonment of a manufactured or4 4 mobile home or personal property pursuant to section 555B.3,4 5 if no money judgment in excess of four five thousand dollars4 6 is sought for actions commenced before July 1, 2002 2018, and4 7 five six thousand five hundred dollars or less for actions4 8 commenced on or after July 1, 2002 2018. If commenced under4 9 this chapter, the action is a small claim for the purposes of4 10 this chapter.4 11 7. The district court sitting in small claims has concurrent4 12 jurisdiction of an action for the collection of taxes brought4 13 by a county treasurer pursuant to sections 445.3 and 445.44 14 where the amount in controversy is five thousand dollars or4 15 less for actions commenced on or after before July 1, 20034 16 2018, and six thousand five hundred dollars or less for actions4 17 commenced on or after July 1, 2018, exclusive of interest and4 18 costs.4 19 8. The district court sitting in small claims has concurrent4 20 jurisdiction of motions and orders relating to releases of4 21 judgments in whole or in part including motions and orders4 22 under section 624.23, subsection 2, paragraph “c” and section4 23 624.37, where the amount owing on the judgment, including4 24 interests and costs, is five thousand dollars or less for4 25 actions commenced before July 1, 2018, and six thousand five4 26 hundred dollars or less for actions commenced on or after July4 27 1, 2018.4 28 #___. JURISDICTIONAL AMOUNT REVERSION —— SMALL4 29 CLAIMS. The jurisdictional amount in the section of this4 30 division of this Act that amends section 631.1 shall revert4 31 to five thousand dollars if a court of competent jurisdiction4 32 declares the six thousand five hundred dollar amount4 33 unconstitutional.4 34 #20. Title page, line 1, after system, by inserting4 35 providing penalties,

petitions involve damages or property valued between $5,000 and$6,500. Since the amount of cases within this value is unknown andmay also vary from year to year, the estimated reduction in filing feesto the General Fund ranges from $875,000 to $1,800,000.

Second, the expansion of the jurisdiction of Magistrate and DistrictAssociate Judges will remove some of the caseload burden fromDistrict Court Judges. At this time, it cannot be determined how muchof a shift in caseload burden may occur. The Judicial Branch hasindicated that it would be necessary to hire additional Magistrates toreach the increased caseload burden in small claims courts. The costof an individual Judicial Magistrate position is $51,447, and the cost ofa District Court Judge position is approximately $190,000. Currently,there are nine District Court Judgeship vacancies and two Magistrateposition vacancies. Due to the current vacancy levels, the JudicialBranch would only experience a cost savings from the jurisdictionchange if it determines that enough of a workload shift has occurred torequire fewer District Court Judges and more Magistrate positionsinstead.
