III. INCIDENT DETAILS On 06-01-17, at approximately 2251 hours, LVMPD Officers Herasimtschuk and Puana responded to the 1700 block of Eddingham Court to investigate a report of gunshots being fired in the area. Upon officers’ arrival they made contact with Cindy Angulo-Ortiz in front of the residence at 1703 Eddingham Court. Angulo-Ortiz stated she had been involved in a domestic disturbance with her boyfriend, Francisco Suarez-Maldonado. Officers were advised Suarez-Maldonado fired gunshots into the air before he drove away from the area in a Chevrolet Silverado truck. Angulo-Ortiz also advised officers Suarez-Maldonado threatened to, “Shoot it out with police” if the opportunity presented itself. While officers where speaking to Angulo-Ortiz in front of the residence, Suarez-Maldonado returned to the residence and stopped his truck in the street in front of 1703 Eddingham Court. Officers issued numerous verbal commands to Suarez-Maldonado to exit the vehicle, but Suarez-Maldonado did not comply. Suarez-Maldonado then fired his handgun at Officers Puana and Herasimtschuk. Officers Herasimtschuk, Hinckley, Puana, and Rycraft returned fire, striking Suarez-Maldonado. Officer Harris, who deployed his rifle, did not fire any rounds at Suarez-Maldonado. Officers approached the truck with medical personnel and determined Suarez-Maldonado was deceased. The area was secured as a crime scene with crime scene tape and witnesses were identified and separated. Upon arrival of investigators, Detective Rivera conducted a briefing. Detectives Alsup, Jex, Leavitt, Mendoza, Patton, and Penny were assigned to interview available witnesses and conduct weapon countdowns. IV. BODY WORN CAMERAS Officers Herasimtschuk, Hinckley, Puana, and Rycraft were wearing body worn cameras at the time of the incident, and all cameras were activated. All body worn cameras were collected by Sergeant MacDonald and secured. Body Worn Camera Footage The body worn camera footage captured by the officers’ cameras depicted the officers’ contact with subjects at 1703 Eddingham Court where they obtained information about a domestic altercation involving Cindy Angulo-Ortiz and Francisco Suarez-Maldonado that occurred prior to officers’ arrival. Angulo-Ortiz advised Suarez-Maldonado was armed and fired gunshots into the air before he left the area. BWC footage also records witnesses who indicated that a battery had occurred between Angulo-Ortiz and Suarez-Maldonado, specifically that Angulo-Ortiz was pushed to the ground by Suarez-Maldonado. Video footage showed Suarez-Maldonado returned to the scene in a Chevrolet Silverado and stopped in the middle of the street in front of 1703 Eddingham Court. Officers issued numerous commands to Suarez-Maldonado to exit the vehicle; Suarez-Maldonado was heard yelling at the officers and Suarez-Maldonado was observed ignoring their commands. The footage confirmed the officers’ positions and perspectives at the time shots were fired. V. SCENE WALK-THROUGHS The purpose of the scene walk-through is to help investigators develop an understanding of the scene, including identifying officer locations at the time deadly force was used, identifying potential physical evidence and re-creating a timeline of the incident.

On 06-02-17, at approximately 0307 hours, Officer Rycraft provided a walk-through of the scene in the presence of the following persons:

Officer Rycraft parked his patrol vehicle in the middle of the street. Officer Rycraft observed Suarez-Maldonado fire in a northwest direction at Officers Puana and Herasimtschuk. Officer Rycraft feared the officers’ lives were in danger and fired five to ten rounds at Suarez-Maldonado. On 06-02-17, at approximately 0314 hours, Officer Hinckley provided a walk-through of the scene in the presence of the following persons:

Officer Hinckley retrieved his rifle from his patrol vehicle parked in front of 1693 Eddingham Court. Officer Hinckley observed Suarez-Maldonado point his gun out his vehicle window towards Officers Puana and Herasimtschuk. Officer Hinckley believed Officers Puana and Herasimtschuk’s lives were in danger and fired his rifle at Suarez-Maldonado. On 06-02-17, at approximately 0330 hours, Officer Herasimtschuk provided a walk-through of the scene in the presence of the following persons: 1) Lieutenant O’Brien

Officer Herasimtschuk moved to the southwest side of a vehicle that was parked in the driveway of 1693 Eddingham Court. Suarez-Maldonado fired numerous shots at Officers Puana and Herasimtschuk. Officer Herasimtschuk feared for his life as well as Officer Puana’s and returned fire at Suarez-Maldonado. On 06-02-17, at approximately 0340 hours, Officer Puana provided a walk-through of the scene in the presence of the following persons: 1) Lieutenant O’Brien 2) Detective Alsup 3) Detective Colon 4) Director McLaughlin 5) CSA Supervisor Schellberg 6) LVPPA representative Officer Nicholas 7) LVPPA attorney John Harper

During the walk-through, which was not video or audio recorded, Officer Puana relayed the following information: Officer Puana was standing on the sidewalk when Suarez-Maldonado arrived. Officer Puana moved to the northwest side of a vehicle parked in the driveway of 1693 Eddingham Court. Officer Puana told Suarez-Maldonado numerous times to exit the vehicle. Suarez-Maldonado fired numerous shots in the direction of Officers Puana and Herasimtschuk. Officer Puana feared for their lives and fired at Suarez-Maldonado. VI. JL: I can. Uh, I took a Public Safety Statement for…from Officer Frank Rycraft, R-Y-C-R-A-

Uh, “Did you discharge your firearm?” “Yes.” “If so, in what direction?” “I was north of the vehicle and fired south.” “Approximately where were you located when you fired?” “Midway at my vehicle, 20 feet

from the Suburban.” “How many shots do you think you fired?” “I reloaded, so…at some point I reloaded. Not

sure if I jammed or ran out.” “Is anyone injured?” “Officers, no.” “If so, where are they lo…located?” “No officers injured.” “Are there any outstanding suspects?” “None.” Uh, “If so, what is their description?” “None.” “What direction and mode of travel?” “None.” “How long have they been gone?” “No one.” “What crimes have they committed?” “None.” “What type of weapon do they have?” “None,” to outstanding suspects. “Is it possible the suspect fired rounds at you?” “Yes.” “If so, what direction were the rounds fired from?” “From the vehicle east of the officer

towards the west.” “How many shots do you think the suspect fired?” “I heard two or three after he

presented.” “Approximately where was the suspect located when they fired?” “Sitting in his vehicle,

from driver’s seat.” “Do you know if any other officers discharged their firearms?” “Yes.” “If so, who are they?” “I think Officer Hinckley, but I don’t know everyone else’s name.

JL: Yes. Uh, I received a PS…uh, Public Safety Statement from Officer Travis Puana,

phonetically Paul-Union-Adam-Nora-Adam, P# 15345. His call sign was . I asked, uh, Officer Puana the following questions and, uh, notated the following responses:

Uh, “Did you discharge your firearm?” “I did.” “If so, in what direction?” “I fired directly at the suspect.” “Approximately where were you located when you fired?” “I was barricaded behind a white

SUV, approximately 15 yards away.” “How many shots do you think you fired?” “Three.” “Is anyone injured?” “No injuries to officers, but he was killed.” “If so, where are the…they located?” “Suspect loaded…located in driver’s seat of his

silver pickup.” “Are there any outstanding suspects?” “No, sir.” “If so, what is their description?” “There were no outstanding suspects.” “What direction and mode of travel?” “No other suspects. This is the boyfriend of the

victim. He was the only suspect.” “How long have they been gone?” “Suspect was gone from residence for approximately

20 minutes.” “What crimes have they committed?” “This gentleman threatened his girlfriend with his

rifle, and her friend, and fired outside the structure of the home.” “What type of weapon do they have?” “He had a AR-15 rifle and handgun. The handgun

he fired at us.” “Is it possible the suspect fired rounds at you?” “Yes, sir, absolutely. I felt the concussion.” “If so, what direction were the rounds fired from?” “He fired from inside his vehicle, and

Involved and witness officers were photographed by CSI personnel for appearance purposes and their weapons were photographed for identification purposes. Guerrero, P# 15290, and I arrived at the above location at 0100 hours. Uniformed LVMPD officers along with detectives from the Force Investigation Team (FIT) were present when we arrived. Also present was Crime Scene Analyst Supervisor P. Schellberg, P# 5413, and Senior Crime Scene Analyst (SCSA) E. Stephens, P# 5158. We were later joined by Clark County Coroner Investigators T. Brown and M. Otero. THE SCENE: The scene was along a section of the 1600 and 1700 block of Eddingham Court between 1683, 1693, and 1703 Eddingham Court on the west side of the street and 1682, 1692, and 1702 Eddingham Court on the east side of the street. Vehicles #1, 2, 3, 4, 5, 6, and 8 were stopped or parked on the street and vehicles 7 and 9 were parked in driveways. Items of evidence were recovered from: vehicles # 1, 7, and 9; the street pavement; the front yard, driveway, and/or sidewalk of 1693 and 1703 Eddingham Court; and inside the residence at 1692 Eddingham Court. Vehicle #1 Vehicle #1, a gray 4-door pickup truck, was stopped facing north with its engine running in the middle of the street in front of 1693 Eddingham Court. The body of the decedent was slumped over in the driver’s seat. On the right front seat next to the decedent was an “ANDERSON MFG” AM-15 semi-automatic tactical rifle, CAL .223/5.56 mm, serial # 140559556, with a 7.62 x 39 barrel and a “BSA” scope (Item #49). The rifle had a cartridge with the headstamp “Tulammo 7.62 x 39” (Item #51) loaded into the chamber and a 7.62 x 39 “C PRODUCTS DEFENSE” magazine (Item #50) with sixteen (16) cartridges, all headstamped “Tulammo 7.62 x 39”, (Item #52) in the magazine well. The rifle’s safe/fire lever was set to the fire position. There were also three open boxes of Tulammo 7.62 x 39 mm cartridges and extra magazines on the seat next to the rifle. Loose cartridges from the boxes were scattered on the seat and floorboards. One of the loose cartridges (Item #53) found on the driver’s side floorboard and four loose cartridges (Item #54) found on the interior running board/edge of the passenger’s (right) side front floorboard were recovered at the scene. On the driver’s seat, under the decedent’s left hand, was a black Springfield Armory U.S.A. XDS-45 ACP, .45 caliber semi-automatic handgun, serial # XS600189 (Item #46) with a “SPRINGFIELD ARMORY XDS-45” magazine (Item #47) loaded into the magazine well. Both the handgun and magazine were empty and the slide of the handgun was locked open. The vehicle had several apparent bullet or bullet fragment impacts and/or holes. After the removal of the decedent and the two visible weapons, the vehicle was sealed at the scene and transported to the CSI garage for processing.

Street Pavement Adjacent to Vehicle #1 On the street in front (north) of vehicle #1 were three cartridge cases, all bearing the headstamp “45 AUTO” and an unknown symbol/design (Items # 29, 30, and 31). On the street pavement northwest of the vehicle was a tooth bearing apparent blood (Item #48). There was an apparent bullet impact to the street pavement (designated as “H”) west of the left front corner of vehicle #1. In the street, below the driver’s (left) side of the vehicle was a bullet (Item #37). Vehicle #2 Vehicle #2, a 4-door sedan LVMPD black and white patrol vehicle, was parked facing north in the middle of the street in front of 1683 Eddingham Court. Street Pavement Adjacent to Vehicle #2 There were four cartridge cases, all bearing the headstamp “SPEER 14 223 REM” (Items #1, 2, 3, and 4) on the street pavement on the right (west) side of vehicle #2. On the street pavement in front (north) of vehicle #2 was a bullet fragment (Item #36). Vehicle #3 Vehicle #3, a 4-door SUV LVMPD black and white patrol vehicle, was parked facing north on the east side of the street in front of 1682 Eddingham Court. Vehicle #4 Vehicle #4, a 4-door SUV LVMPD black and white patrol vehicle, was parked facing north on the west side of the street in front of the south end of the property at 1703 Eddingham Court. Vehicle #3 had an apparent bullet impact (designated as “C1”) to its left rear quarter panel and corresponding impact “C2” to the back of the left side rear window. Street Pavement Adjacent to Vehicle #4 On the street pavement on left (west) side of the vehicle #4 was a cartridge case with the headstamp “SPEER 9mm LUGER +P” (Item #21). On the pavement in front (north) of vehicle #4 and south of vehicle #5 was a black “SIG SAUER P226 9MM” 20-round capacity magazine (Item #43) loaded with thirteen (13) cartridges, all bearing the headstamp “SPEER 9mm LUGER +P” (Item #44). Vehicle #5 Vehicle #5, a 4-door SUV LVMPD black and white patrol vehicle, was parked facing north, just west of the center of the street and in front of 1703 Eddingham Court. Vehicle #6 Vehicle #6, a 4-door SUV LVMPD black and white patrol vehicle, was parked facing south at the east curb of the street in front of north end of the property at 1702 Eddingham Court. Vehicle #7 Vehicle #7 a white 4-door crossover, was parked facing west in the front (east) driveway at 1693 Eddingham Court. Vehicle #7 had an apparent bullet impact “D” to the back of its left rear quarter panel on the left side of the rear cargo door. This vehicle also three had corresponding impacts starting with “E1” to its upper right rear quarter panel, “E2” to the forward end of the right side rear window, and “E3” to the back of the window of the right side rear door. On top of the right side of the hood was a cartridge case with the headstamp “SPEER 9mm LUGER +P” (Item #18) Vehicle #8 Vehicle #8, a white 4-door pickup truck, was parked facing north at the east curb in front of the north end of the property at 1692 Eddingham Court. This vehicle was on the right (east) side of vehicle #1. Vehicle #8 had an apparent bullet impact “A” to the exterior left side of the truck bed above the back end of the left rear wheel well. Vehicle #9 Vehicle #9, a black 4-door pickup truck, was parked facing east in the front (west) driveway of 1682 Eddingham Court. Apparent bullet impact “F1” went through the top of the left front (driver’s) door window. There was a corresponding impact (“F2”) to the interior of the right side front door. A bullet (Item #42) was recovered from underneath the right front (passenger side) floor mat. 1693 Eddingham Court There was a cartridge case with the headstamp “SPEER 9mm LUGER +P” (Item #5) on the ground of the entryway sidewalk to this residence. with the headstamp “SPEER 9mm LUGER +P” (Item #35) was on the dirt of the front yard on the south side of the entryway sidewalk. There were fifteen (15) additional cartridge cases, all with the headstamp “SPEER 9mm LUGER +P” (Items #6 through 20) on the driveway. These fifteen cartridge cases included the aforementioned cartridge case (Item #18) on the hood of vehicle #7 which was parked in the driveway. Bullet fragments (Items #38 and 39) were found on the driveway on the north side of vehicle #7. Rock Landscaping Area and Sidewalk between 1693 and 1703 Eddingham Court There was a cartridge case, bearing the headstamp “SPEER 9mm LUGER +P” (Item #22) on the west sidewalk between 1693 and 1703 Eddingham Court. In the rock landscaping area between the two properties were six (6) more cartridge cases with the headstamp “SPEER 9mm LUGER +P” (Items #23 through 28). 1703 Eddingham Court There were trash cans at the southwest corner of the driveway at 1703 Eddingham Court. On the driveway adjacent to these trash cans was a bullet fragment (Item #40). On the exterior east facing wall directly above the trash cans was an outdoor light fixture. There was an apparent bullet impact designated as “G1” to the wall on the south side of the light fixture. Impact “G1” corresponded with another impact, “G2”, to the light fixture. On the rock landscaping area of the front (east) yard and north of the entryway sidewalk were seventy (70) cartridges, all bearing the headstamp “Tulammo 7.62 x 39” (Item #45). On the front yard, just west of these cartridges was a Toyota key fob (not recovered). Also on the front yard, northwest of the cartridges, were three cartridge cases bearing the headstamp “45 AUTO” and an unknown symbol/design (Items #32, 33, and 34). 1692 Eddingham Court This residence was located on the east side of the street. There was an apparent bullet hole, designated as “B1” through the front, west facing window of the home office. This apparent bullet hole was directly east of vehicle #1. Hole “B1” lined up with another hole, designated as “B2”, which went through a straw hat by the east wall of the room. “B2” corresponded with “B3” which went through a plaque and into the west wall. Hole “B4” exited the west wall of the hallway bathroom. After exiting the west wall, the bullet had apparently hit a towel hanging from a hook on the back of the bathroom door. The towel with the hole through it (“B5”) and a bullet with fabric attached to it (Item #41) were on the vanity countertop. A final impact, designated as “B6” was in the back of the bathroom door. THE BODY: The body was that of a 27 year old male adult identified as Francisco Suarez-Maldonado (DOB 12/3/1989). The decedent was seated in the driver’s seat and slumped over to his right side. His head was partially on the vehicle’s driver’s side sun visor which was on his lap. The sun visor had apparently become detached from the vehicle by a bullet impact through the windshield. His right hand was by the outside of his right knee. His left hand was between his leg on the top of a Springfield Armory U.S.A. XDS-45 ACP, .45 caliber semi-automatic handgun, serial # XS600189 (Item #46) on the seat. The decedent was dressed in a gray t-shirt, gray pants, and red sneakers. Clipped to the front waistband of his pants was an unknown brand white metal and red pocket knife with a tiger emblem bearing apparent blood and with a 4 inch blade (Item #55). apparent bullet impacts/holes; the perspective views of the LVMPD officers and the suspect from the reported positions during the incident; and the scene as described above. EVIDENCE: CSA I G. Guerrero, P# 15290, recovered the following aforementioned items and impounded them into evidence: four (4) cartridge cases with the headstamp “SPEER 14 223 REM” (Items #1 through 4); twenty-five (25) cartridge cases with the headstamp “SPEER 9mm LUGER +P” (Items #5 through 28 and 35); six cartridge cases bearing the headstamp “45 AUTO” and an unknown symbol/design (Items #29 through 34); bullet and/or bullet fragments (Items #36 through 42); a black “SIG SAUER P226 9MM” 20-round capacity magazine (Item #43); thirteen (13) cartridges bearing the headstamp “SPEER 9mm LUGER +P” (Item #44); ninety-two (92) cartridges bearing the headstamp “Tulammo 7.62 x 39” (Item #45 and items #51 through 54); the Springfield Armory U.S.A. XDS-45 ACP, .45 caliber semi-automatic handgun, serial #XS600189 (Item #46); the “SPRINGFIELD ARMORY XDS-45” magazine (Item #47); the tooth bearing apparent blood (Item #48); the “ANDERSON MFG” AM-15 semi-automatic tactical rifle, CAL .223/5.56 mm, serial # 140559556, with a 7.62 x 39 barrel and a “BSA” scope (Item #49); the 7.62 x 39 “C PRODUCTS DEFENSE” magazine (Item #50); and the unknown brand white metal and red pocket knife with a tiger emblem bearing apparent blood and with a 4 inch blade (Item #55). Refer to the Evidence Impound Report and Impounded Firearms Information Report submitted by CSA I G. Guerrero for further details. CORONER/MORTUARY: Clark County Coroner Investigator M. Otero, examined the body at the scene and pronounced death at 0530 hours. The decedent was wrapped in a new white sheet and placed in sealed body bag (seal # 537484). The body was transported to the Clark County Coroner/Medical Examiner’s Office by Davis Funeral Home employees. SEARCH WARRANT AT 1703 EDDINGHAM COURT: CSA I G. Guerrero, P# 15290, assisted detectives in the execution of a search warrant at 1703 Eddingham Court. Refer to the Crime Scene Investigation Report submitted by CSA I Guerrero for further details. DIAGRAM: A diagram of the crime scene was completed by SCSA E. Stephens, P# 5158. End of report. X. THIRD PARTY VIDEO AND PHOTOGRAPHIC EVIDENCE Ring™ Video Doorbell Surveillance Camera FIT detectives located a Ring™ Video Doorbell surveillance camera at 1703 Eddingham Court. FIT detectives submitted an administrative subpoena to Ring to obtain any video surveillance footage that may have been captured and stored in the company’s cloud memory storage.

Video footage showed Suarez-Maldonado argue with Angulo-Ortiz outside of the residence in front of his truck that was parked on the front lawn. Suarez-Maldonado fired gunshots from a handgun into the air prior to driving away from the area. The camera continued to record the officers’ arrival and conversations between officers and residents. The camera did not capture the officer-involved shooting. XI. AUTOPSY On 06-02-17, at approximately 0800 hours, under CCOCME case 17-05788, an autopsy was performed on the body of Francisco Suarez-Maldonado at the Clark County Office of the Coroner/Medical Examiner by Doctor Gavin. The following persons were in attendance: 1) Forensic Assistant Andrea Singer 2) Detective Alsup 3) Detective Colon 4) SCSA Smith The following items of evidence were impounded: 1) One (1) buccal swab kit. 2) One (1) white sheet with apparent blood. 3) One (1) gray short-sleeve t-shirt, unknown size and maker, with two (2) defects in upper

left back and bearing apparent blood. 4) One (1) pair of gray “Nike” sweatpants, size XL, with a defect on the right side and bearing

apparent blood. 5) One (1) pair of red “Fruit of the Loom” boxer briefs, unknown size, bearing apparent blood. 6) One pair of red “Nike” shoes, unknown size, bearing apparent blood. 7) One (1) copper fragment. 8) One (1) lead fragment. 9) One (1) bullet.

The following wounds/injuries were noted on Suarez-Maldonado: 1) Gunshot wound below left ear, indeterminate range. 2) Gunshot wound below left ear, indeterminate range. 3) Gunshot wound of left posterior shoulder, indeterminate range. 4) Intermediary object injury. Officer Peter Herasimtschuk Lieutenant O’Brien contacted the LVPPA on 06-03-17 at 1000 hours and was advised Officer Herasimtschuk was declining to provide a statement to FIT investigators. Officer Frank Rycraft

Lieutenant O’Brien contacted the LVPPA on 06-03-17 at 1040 hours and was advised Officer Rycraft was declining to provide a statement to FIT investigators.

Witnesses Cindy Angulo-Ortiz On 06-02-17, at approximately 0300 hours, Detective Jex conducted an audio recorded interview with Cindy Angulo-Ortiz at 1703 Eddingham Court. Also present for the interview was Officer Jonathan Ruiz, P# 15359, and Jennifer Angulo. Below is a summary of the interview; for complete details refer to the interview transcript. Angulo-Ortiz stated Suarez-Maldonado and several guests were at the residence to have a pool party and barbeque. Angulo-Ortiz stated Suarez-Maldonado started drinking shots of alcohol and beer, and she told him not to drink too much. Suarez-Maldonado, who was swimming with one of the guests, got out of the pool and tried to throw Angulo-Ortiz into the pool but she did not want to swim because the water was cold. Suarez-Maldonado started to get another guest into the pool and Angulo-Ortiz stated she got upset with Suarez-Maldonado and went back into the house and sat at the table. Suarez-Maldonado came in and Angulo-Ortiz did not want to be with him and decided to go upstairs, but Suarez-Maldonado stopped her. Angulo-Ortiz ran to the downstairs bathroom and locked the door. Suarez-Maldonado banged on the door. Angulo-Ortiz opened the door to stop him from banging on it because she did not want him to wake the children. Angulo-Ortiz stated they argued again and Suarez-Maldonado head butted her. Angulo-Ortiz stated she got very upset and punched Suarez-Maldonado in the mouth. Angulo-Ortiz stated she attempted to leave the bathroom area, but Suarez-Maldonado stopped her. The argument continued until Suarez-Maldonado left the bathroom area and went upstairs. Angulo-Ortiz followed him. She stated Suarez-Maldonado told her to stay downstairs. Angulo-Ortiz stated Suarez-Maldonado started to load his handgun and rifle. Suarez-Maldonado told Angulo-Ortiz to go downstairs or he was going to shoot her. Suarez-Maldonado also stated he was going to take the children with him. Angulo-Ortiz stated she felt Suarez-Maldonado was suicidal and attempted to talk him out of leaving. She stated Suarez-Maldonado finally came out of the bedroom and pointed the rifle at her. Suarez-Maldonado told her he was not going to take the children when he left and not to follow him.

Angulo-Ortiz’ friend, Susan [Hidalgo], attempted to talk to Suarez-Maldonado, who came out of the bedroom and pointed the rifle at Hidalgo and told her to get out of the way. Angulo-Ortiz stated she told all the guests to leave the residence. Angulo-Ortiz stated Suarez-Maldonado went downstairs and attempted to leave the residence. She tried to talk him out of leaving and he pointed the rifle at her again and told her he would shoot her. Suarez-Maldonado walked outside and Angulo-Ortiz stated she was trying to hold him from leaving. Suarez-Maldonado pushed Angulo-Ortiz to the ground. She got up and again tried to hold him back from getting into his pickup truck. Angulo-Ortiz stated Suarez-Maldonado fired the handgun in the air as he got into the pickup truck and pulled away. Angulo-Ortiz stated LVMPD officers arrived shortly after and she told them Suarez-Maldonado was suicidal. She told officers Suarez-Maldonado had described to her the only way he was going to be stopped was by the police and he was going to shoot it out with the police. While Angulo-Ortiz was talking with officers, Suarez-Maldonado pulled down the street and stopped in front of the residence. Angulo-Ortiz stated she went back inside as officers talked to Suarez-Maldonado. She stated she was watching from the window of the residence and saw Suarez-Maldonado sitting in the pickup truck and observed officers fire at Suarez-Maldonado. Angulo-Ortiz stated she stayed inside the residence until officers made contact with her. Estela Alvarado On 06-02-17, at approximately 0313 hours, Detective Mendoza conducted an audio recorded interview with Estela Alvarado at 1703 Eddingham Court. Below is a summary of the interview; for complete details refer to the interview transcript. Alvarado attended the pool party at 1703 Eddingham Court. Cindy Angulo-Ortiz and Francisco Suarez-Maldonado were involved in an argument inside the residence. Angulo-Ortiz returned to the pool area and told everyone to leave immediately. As everyone stepped out, Alvarado and Susana Hidalgo stayed inside with Angulo-Ortiz. Alvarado saw Suarez-Maldonado standing on the stairs with blood coming from his mouth. Angulo-Ortiz began crying, and Suarez-Maldonado, who was armed with a long rifle, told everyone to get out of the house. Suarez-Maldonado threatened to shoot and kill everyone if they did not leave. Suarez-Maldonado pointed the rifle at Alvarado, Angulo-Ortiz and Hidalgo. Suarez-Maldonado continued to point the rifle at everyone as he went downstairs. Suarez-Maldonado left the residence with the rifle and also a handgun. As Suarez-Maldonado was outside, he shot the handgun approximately three times in the air. Everyone exited the residence and neighbors began exiting their homes. Suarez-Maldonado fled the area in his dark colored truck. Police arrived and made contact with Angulo-Ortiz and Alvarado. Angulo-Ortiz informed the officers Suarez-Maldonado fled the area with two guns and was suicidal. As the officers spoke with Angulo-Ortiz, Suarez-Maldonado returned to the residence in his vehicle. Officers instructed everyone to return to the inside of the residence as they spoke to Suarez-Maldonado. Alvarado and Hidalgo stayed outside next to a vehicle. As Alvarado heard the officers talking to Suarez-Maldonado, she heard Suarez-Maldonado tell the

officers to shoot him because that is what he wanted them to do. Again the officers instructed people to go inside the house. Alvarado and Angulo-Ortiz entered the residence and watched the incident through a bedroom window. Alvarado stated she heard the police instruct Suarez-Maldonado to calm down and multiple times to put down the gun. Suarez-Maldonado repeated several times for the officers to shoot him. Alvarado then heard gunshots. She looked outside and saw Suarez-Maldonado laying forward in his truck. Alvarado was unable to see if Suarez-Maldonado shot a firearm at the officers. Susana Hidalgo On 06-02-17, at approximately 0327 hours, Detective Mendoza conducted an audio recorded interview with Susana Hidalgo at 1703 Eddingham Court. Below is a summary of the interview; for complete details refer to the interview transcript. Hidalgo stated she arrived at 1703 Eddingham Court and attended a pool party. Cindy Angulo-Ortiz became angry due to Francisco Suarez-Maldonado wanting to push her in the pool. Suarez-Maldonado and Angulo-Ortiz went inside the residence. Angulo-Ortiz returned to the pool area and was crying and told everyone they had to leave her house. As everyone prepared to leave, Angulo-Ortiz informed Hidalgo that Suarez-Maldonado had an AR rifle. Hidalgo saw Suarez-Maldonado at the top of the staircase and he was holding a rifle. Hidalgo stated Suarez-Maldonado pointed the rifle at everyone and yelled at everyone to get out of the house. Suarez-Maldonado exited the residence and placed the rifle in his vehicle. Hidalgo said she saw Suarez-Maldonado fire several rounds in the air from a handgun. Suarez-Maldonado fled the area in his truck. A few minutes later the police arrived and spoke with Angulo-Ortiz. As Angulo-Ortiz continued to speak with the officers, Hidalgo saw Suarez-Maldonado return to the residence in his truck. Hidalgo stated Suarez-Maldonado refused officers’ instructions to exit the truck. Hidalgo entered the residence and continued to watch the events through a bedroom window. Suarez-Maldonado pointed the handgun out of the driver’s side window towards the direction of officers. Hidalgo said she saw Suarez-Maldonado fire shots at the officers first and they returned fire. Hidalgo heard multiple gunshots and saw Suarez-Maldonado’s body leaning against the steering wheel. Saiquandra Coleman On 06-02-17, at approximately 0410 hours, Detective Mendoza conducted an audio recorded interview with Saiquandra Coleman at 1703 Eddingham Court. a rifle. Coleman saw Suarez-Maldonado put the rifle in a truck. As everyone exited the residence, Coleman saw Suarez-Maldonado fire approximately five times in the air then leave the area. Officers arrived and spoke with Angulo-Ortiz. The officers placed crime scene tape in the area due to the shooting. Coleman stated after some time Suarez-Maldonado returned to the scene in his truck. Angulo-Ortiz informed the officers Suarez-Maldonado returned and that was his vehicle. The officers drew their weapons and instructed Suarez-Maldonado to exit his vehicle. The officers instructed everyone to go back into the house and they did. Coleman went upstairs and continued to watch the incident through the bedroom window. Coleman heard the officers tell Suarez-Maldonado to put up his hands. Coleman stepped away from the window for a moment and then heard multiple gunshots. After the gunshots stopped, Coleman saw Suarez-Maldonado laying on the steering wheel of his truck. Jennifer Angulo On 06-02-17, at approximately 0244 hours, Detective Mendoza conducted an audio recorded interview with Jennifer Angulo at 1703 Eddingham Court. Jennifer Angulo was at 1703 Eddingham Court earlier with her sister, Cindy Angulo-Ortiz, and Francisco Suarez-Maldonado. Angulo stated there were several friends at the residence at the time she left. While at home with her mother, Refugio Ortiz, Angulo received a phone call from Angulo-Ortiz stating something bad had happened at the house. Angulo-Ortiz informed them she and Suarez-Maldonado had “got into it” and Suarez-Maldonado left the house with guns and wanted to kill himself. Angulo and Ortiz returned to 1703 Eddingham Court. When they arrived the police were on scene and were talking with Angulo-Ortiz, Susana Hidalgo and Estela Alvarado in the front yard. Angulo saw Suarez-Maldonado return to the area in his vehicle. The police instructed everyone to go inside the house. Angulo periodically looked through the upstairs bedroom window as officers made contact with Suarez-Maldonado. Angulo heard gunshots and saw Suarez-Maldonado slumped over in the truck. Angulo stated Angulo-Ortiz had told her Suarez-Maldonado wanted to commit suicide and she knew this was going to happen. Carlos Ocampo On 06-02-17, at approximately 0135 hours, Detective Jex conducted an audio recorded interview with Carlos Ocampo at 1693 Eddingham Court. police arrived Suarez-Maldonado drove up the street and stopped in front of his [Ocampo’s] residence. Officers immediately gave commands to Suarez-Maldonado to exit the vehicle and show his hands. Suarez-Maldonado did not comply with the officers’ commands. Ocampo stated he heard Suarez-Maldonado state, “It’s over… This is the end... Tell my mom I love her.” Ocampo also observed Suarez-Maldonado bleeding from his mouth. Ocampo stated he and his wife went back inside to move their children whose bedroom faced the street. While in the bedroom with his children, Ocampo stated he watched Suarez-Maldonado pull out a handgun and shoot at the officers and the officers returned fire. Kristina Ochoa On 06-02-17, at approximately 0138 hours, Detective Mendoza conducted an audio recorded interview with Kristina Ochoa at 1693 Eddingham Court. Below is a summary of the interview; for complete details refer to the interview transcript. Ochoa stated she and her boyfriend, Carlos Ocampo, were inside their residence located at 1693 Eddingham Court when she heard approximately three gunshots. Ochoa also heard a woman screaming. Ochoa and Ocampo went outside to see what was happening. Ochoa saw her neighbor, who she knew as Cindy [Angulo-Ortiz] and some of Angulo-Ortiz’ family members in front of their residence located at 1703 Eddingham Court. Ochoa heard Angulo-Ortiz instruct her family to find Frank [Suarez-Maldonado] because he was going to kill himself. Ochoa stated Suarez-Maldonado was Angulo-Ortiz’ boyfriend and also lived at 1703 Eddingham Court. Ochoa stated she knew Suarez-Maldonado for approximately two years. Ochoa said another neighbor called the police due to the gunshots being fired in the area. The officers arrived at 1703 Eddingham Court and were talking with Angulo-Ortiz and her family. As Ochoa and Ocampo returned to their front door, Ochoa said Suarez-Maldonado arrived in his truck and stopped in front of their residence. Ochoa said she looked at Suarez-Maldonado’s face and noticed there was blood coming from his mouth. The officers talked with Suarez-Maldonado, who refused to exit his vehicle. Ochoa and Ocampo entered their residence and continued to watch the incident from a bedroom window. Ochoa heard Suarez-Maldonado tell the officers he wanted to ask them for a favor and stated, “This is the end.” Suarez-Maldonado also stated, “There is no going back.” As the officers continued to talk with Suarez-Maldonado, Ochoa stated Suarez-Maldonado shot at the officers while they were positioned in front of Ochoa’s vehicle. The officers exchanged gunfire with Suarez-Maldonado. After the incident, Ochoa saw Suarez-Maldonado slumped over the steering wheel of his truck and was bleeding. Kim Ralphs On 06-02-17, at approximately 0219 hours, Detective Leavitt conducted an audio recorded interview with Kim Ralphs at 1732 Eddingham Court. scream, "Don't shoot! Don't shoot!" As she looked to a home across the street, she observed Angulo-Ortiz screaming as a full size pickup truck left the neighborhood at a high rate of speed. Ralphs believed Angulo-Ortiz had been shot because of the sound in Angulo-Ortiz’ voice as she screamed, "He'll kill me!" Ralphs observed her husband, who had walked toward the commotion at 1703 Eddingham Court, while she called 911 to report the incident. Ralphs observed two LVMPD police cars pull into the neighborhood and make contact with the group. Ralphs returned to the inside of her residence after the police arrived. She remained inside until she heard more gunfire. She returned to her balcony and observed people, who she believed were police officers, had taken cover behind vehicles. Ralph Randall On 06-02-17, at approximately 0159 hours, Detective Leavitt conducted an audio recorded interview with Ralph Randall at 1732 Eddingham Court. Below is a summary of the interview; for complete details refer to the interview transcript. Ralph Randall was asleep inside his residence at 1732 Eddingham Court when he was awakened by his wife. His wife woke him to tell him she heard gunfire that she believed came from the residence next to theirs. As Randall woke he heard what he believed to be a large caliber, possibly rifle, fired. Randall went out onto the balcony of his residence, which faced toward the west, and observed people around a residence on the west side of Eddingham Court, south of his residence. Randall stated he heard a female screaming and believed she had been shot. Randall left his residence and headed toward the commotion [1703 Eddingham Court] when he contacted a young Hispanic male that he believed to be approximately 16 years old. As he talked to the male, he observed a female [Cindy Angulo-Ortiz] who was out of control and yelling to not shoot anymore, and telling other people it was none of their business as she moved in and out of the home. The male explained to Randall there had been a pool party and things had gotten out of control and somebody fired “blanks” from a weapon. Randall flagged down two police vehicles that arrived and informed the officers he had heard shots fired and there were weapons involved in the situation. Once the officers began to investigate the situation, he returned to his residence. Approximately fifteen minutes after Randall returned home, he heard a single gunshot followed by a large volley of rounds fired. When he looked back out toward the residence where the police were he saw officers that had items he believed to be firearms pointed toward a vehicle. Randall did not go back outside after that. Officer Yant. Below is a summary of the interview; for complete details refer to the interview transcript. Officer Harris was on duty and driving within NEAC boundaries when he heard patrol units on an illegal shooting call request a Code Red over the radio. Officer Harris self-dispatched to the call and upon arriving deployed his rifle. As Officer Harris ran toward the other officers, he realized he did not have a magazine inserted into his rifle. Officer Harris returned to his vehicle, grabbed a magazine and loaded his rifle. As Officer Harris ran back toward the other officers, he observed a subject [Francisco Suarez-Maldonado] point a firearm out of the driver’s side of a truck and fire three to four rounds at officers. Several officers immediately returned fire. Officer Harris was unable to fire his weapon due to being in a possible crossfire situation where he was unsure if other officers were in his backdrop. After the shooting, Officer Harris took a position north of Suarez-Maldonado’s truck and watched Suarez-Maldonado through the magnifier optic on his rifle. Officer Harris observed a K-9 unit arrive with a shield and approach Suarez-Maldonado’s truck. Officer Harris then observed the same K-9 unit escort medical personnel to Suarez-Maldonado’s truck where Suarez-Maldonado was pronounced deceased. Jose Lopez On 06-02-17, at approximately 0510 hours, Detective Leavitt conducted a non-recorded interview with Jose Lopez. The interview was conducted at 1713 Eddingham Court. Below is summary of the interview. Lopez resided at 1713 Eddingham Court on 06-01-13. Detective Leavitt contacted Lopez at his residence with the assistance of Officer Rachel Sorkow, P# 15746. Lopez spoke Spanish and Officer Sorkow, who was not an LVMPD certified Spanish speaker/translator, was able to translate. Lopez had a Ring™ Video Doorbell, a motion activated audio/video recording device, located next to the front door, facing south. Lopez used his personal cell phone to access the Ring application. No motion activations took place to enable audio or video recording until uniformed LVMPD officers contacted the residence after the officer-involved shooting. Lopez stated he heard gunshots earlier in the night, followed by a female yelling. Most of the yelling was in English, which Lopez didn’t understand, except for when the female yelled, “You tried to kill me!” in Spanish. Lopez did not go outside or attempt to see what happened. A short time later Lopez heard more gunfire, but again did not see what had happened. Spencer Kinney On 06-02-17, at approximately 0715 hours, Detective Leavitt conducted a non-recorded interview with Spencer Kinney 1682 Eddingham Court. Below is summary of the interview. Kinney resided at 1682 Eddingham Court and was inside his residence when one of his sons informed him police were outside with guns pointed at a vehicle. Kinney and his son headed to

an upstairs bedroom with a window that faced Eddingham Street. As both looked out the window, they immediately heard gunshots and they laid on the floor to avoid stray gunfire. Both Kinney and his son stayed prone on the floor until after all the gunfire had ceased. Neither of them witnessed what had taken place. One of Kinney’s vehicles, a truck parked on his driveway, was impacted by a bullet. Kinney did not provide a written or audio taped voluntary statement. XIV. TIMELINE The below timeline is a reconstruction of events which transpired on 06-01-17 in relation to the fatal officer-involved shooting that occurred at 1703 Eddingham Court.

FORENSICS REQUESTS/RESULTS Firearm Examinations On 06-15-17 an LVMPD Forensic Laboratory Request was submitted on Officers Herasimtschuk, Hinckley, Puana, and Rycraft’s firearms and Francisco Suarez-Maldonado’s firearm for function tests and ballistic comparison evidence. On 07-12-17 Forensic Scientist Anya Lester, P# 13771, submitted the Report of Examination: Firearms & Toolmarks. The following evidence was examined and the results are reported below.

Results and Conclusions: Firearms The Daniel Defense rifle was examined, test fired and found to be operational with no noted malfunctions. This rifle has a barrel length of approximately 17 ⅝ inches, an overall length of approximately 32 ⅝ inches and a trigger pull of 6 ¾ - 7 ¼ pounds. The submitted magazine (Lab Item 2) has a capacity of 31 cartridges. The Sig Sauer pistol was examined, test fired and found to be operational with no noted malfunctions. This pistol has a barrel length of approximately 4 ⅜ inches, an overall length of approximately 8 ¼ inches and trigger pulls of 3 ¼ - 3 ¾ pounds single action and 8 ½ - 9 pounds double action. The submitted magazine (Lab Item 4) has a capacity of 20 cartridges. The Heckler & Koch pistol was examined, test fired and found to be operational with no noted malfunctions. This pistol has a barrel length of approximately 4 1/8 inches, an overall length of approximately 7 ⅜ inches without the flashlight and approximately 8 ⅝ inches with the flashlight attached. This pistol has a trigger pull of 5 - 5 ½ pounds. The submitted magazine (Lab Item 6) has a capacity of 15 cartridges. This pistol has a barrel length of approximately 4 ½ inches, an overall length of approximately 7 15/16 inches without the flashlight and approximately 8 ¾ inches with the flashlight attached. This pistol has a trigger pull of 7 ¼ - 7 ¾ pounds. The submitted magazine (Lab Item 8) has a capacity of 18 cartridges. The Springfield pistol was examined, test fired and found to be operational with no noted malfunctions. This pistol has a barrel length of approximately 3 ⅜ inches, an overall length of approximately 6 ⅜ inches and a trigger pull of 7 ½ - 8 pounds. The submitted magazine (Lab Item 10) has a capacity of 7 cartridges. The Anderson Manufacturing rifle was examined, test fired and found to be operational with no noted malfunctions. This rifle has a barrel length of approximately 9 ⅝ inches and an overall length of approximately 24 ½ inches and a trigger pull of 6 ½ - 7 pounds. The submitted magazine (Lab Item 47) has a capacity of 31 cartridges.

Cartridge Cases Five evidence cartridge cases were microscopically compared to the test fired cartridge cases from the submitted evidence firearms. Based on these microscopic comparisons, the following was determined:

One cartridge case (Lab Item 11) was identified as having been fired by the submitted Daniel Defense rifle.

One cartridge case (Lab Item 27) was identified as having been fired by the submitted Glock pistol.

One cartridge case (Lab Item 30) was identified as having been fired by the submitted Heckler & Koch pistol.

One cartridge case (Lab Item 35) was identified as having been fired by the submitted Sig Sauer pistol.

One cartridge case (Lab Item 45) was identified as having been fired by the submitted Springfield pistol.

The remaining cartridge cases were not compared for identification at this time. NIBIN Representative images of test fired cartridge cases from the Springfield pistol and the Anderson Manufacturing rifle were entered into the National Integrated Ballistic Information Network (NIBIN). NOTE: Associations from the database will be reported separately. The evidence is returned to secure storage. ---This report does not constitute the entire case file. WITNESS CANVASS On 06-02-17 and 06-03-17, Detectives Leavitt and Jex conducted a witness canvass of the residences in the neighborhood nearby 1703 Eddingham Court. No additional witnesses were identified.
