SYNOPSIS OF EVENTS:

On February 17,2007 at approximately 0010 hours at 423 Cleveland Street #4, Kyle L Brennan waspronounced dead by Clearwater Fire Paramedics after shooting himself in the head with a .357 Revolver.

SOURCE OF ACTIVITY:

Dispatched.

INVESTIGATIVE ACTION TAKEN:

I was dispatched to a suicide at 423 Cleveland Street The call screen notes advised that a white male hadshot himself in the head and was not responsive I arrived on scene and met with Clearwater FireParamedics, Jerome Mourelayos and Shawn Becker Paramedics advised that the white male, identifiedas Kyle T Brennan, was pronounced dead at approximately 0010 hours ..

I spoke with Kyle's father, Thomas M Brennan .. Thomas advised that he was at the apartment earlier thatevening with Kyle, Thomas and Kyle had watched a movie and Thomas left the residence atapproximately 1700 hours to go to work Thomas went over to the Fairgrounds in Tampa to sell somereading literature. Thomas returned home later that evening and attempted to open the :front door ..However, there were three Crystal Spring, 5 gallon water jugs with a light green cap, blocking the frontdoorway. Thomas pushed open the door and called out for his son, Kyle. Thomas advised there was noanswer and he could smell a faint odor of gunpowder Thomas then went into his bedroom and discoveredKyle lying on the ground. Thomas went over to Kyle and noticed the gunshot wound to his head .. Thomaschecked his arm and realized he was unresponsive Thomas immediately called his chaplain, Denise Afternotifying Denise about the situation, Thomas called the police.

Thomas advised that Kyle has been suffering from Depression for the last 6-7 months. Kyle was living inVirginia with his mother until he ran away from home approximately 2 months ago Kyle had traveled tovarious states and eventually ended up in Clearwater Kyle contacted Thomas and decided to stay at theresidence. Kyle was only living at the residence for one week Kyle was subscribed a prescription ofLexapro 10 mg ..for his depression. However, Thomas advised that Kyle was not taking his medicationThomas stated that he did not believe in psychiatric medications because of his religious beliefs .. Thomasencouraged Kyle to stop taking the medications and took the prescription bottle :fromhim approximately 3days ago Kyle was scheduled to return to Virginia on Monday to move back with his mother Thomasadvised that he was working full time and did not feel that it was beneficial to leave Kyle alone at the

told Kyle there was a firearm inside the residence The Revolver was stored in a green army bag. Thefirearm was unloaded and the rounds were kept in a separate location Thomas could not rememberexactly where he stored the ammunition.

The apartment has two main bedrooms and a common dining area Thomas' bedroom is located on thesoutheast comer ofthe residence .. Kyle's body was found in Thomas' bedroom. I then went into thebedroom and observed Kyle lying on the ground neat the foot of the bed Kyle was slumped over onto hisleft side .. His head and left arm were resting inside a plastic laundry basket Kyle's left arm was positionedup near his forehead .. Kyle's right arm was postioned near his chest I noticed the revolver was near hislight hand. The entry wound appeared to be in Kyle's right temple and there was significant blain matterscattered on the ground and against some boxes near the east side of the bedroom. Paramedics had cutthe back of Kyle'S shirt and used that area to conduct their assessment. Kyle also had a small huntingknife, which was enclosed in a leather case on his belt

I went into Kyle's bedroom, which is located on the northwest comer ofthe residence I noticed thatKyle's bags were all packed up and placed on his bed .. His bed did not have any covers or blankets on iand there were two pillows on top of the mattress There was a small file folder on Kyle's bed SgtMcAuley took a look inside the file folder and advised that Kyle had written a letter to the FBI in referenceto some sort of police corruption. There was also a small black plastic bag and some white lope placed onthe floor by the bed. .

I went back out and retrieved Kyle's prescription medication from Thomas' vehicle. The Lexapro 10 mg..was issued out on 1112412006.. The prescription was issued by Doctor Stephen McNamara for a quantity

of30 pills, reference Rx 7019079. There were approximately 16 pills inside the bottle Thomas advisedthat Kyle would only take the medication sporadically or when he felt like he needed it

I conducted a canvass of the top floor and attempted to contact the neighbors. I knocked on apartment#5, which is located directly east of Thomas' apartment. There was no answer at the door I then wentover to apartment #6, which is directly south of Thomas' apartment and located next to the stairwell. Awhite male, identified as Ian W Shilliganson, answered the door. Shilliganson advised that he went tosleep at approximately 2200 hour s and did not hear any noises until I knocked on the front door ..

Corporal Faulk requested a PCSO Forensic Technician to respond out to the scene Corporal Faulk alsonotified the medical examiners office at approximately 0044 hour s

PCSO Technician J McCabe arrived on scene and processed the area; please see McCabe'ssupplemental report for further information The medical examiner, Marty Scholl, arrived on scene shortlyafter and conducted her investigation. I retrieved the firearm and noticed it was a Taurus 357 Revolverwith a 5 round chamber. There was one spent casing and 4 live rounds inside the chamber The serialnumber for the I urus was #OC44668

Scholl then rolled Kyle onto his back and lifted up his shirt I noticed there was some writing on hisstomach which stated, "Look inside." There were two rounds in Kyle's left pocket and a folded up piece

On 02-17-2007 at approximately 1500 hours, I was contacted by the Clearwater Police DepartmentCommunications Center and advised that the deceased father, Thomas Brennan, had contacted the policedepartment At this time, Mr Brennan had additional questions as to whether he was able to move toanother residence .. Mr. Brennan wanted to be sure that he spoke with an Officer prior to leaving theresidence I advised the Communications Center that I would be coming on-duty on this date at 1600hours and that I would review the investigation and contact Mr. Brennan.

On 02-17-2007 at approximately 1610 hours, I reviewed the initial investigation that was completedby District II Officer Jonathan Yuen I noted that there were no signs of foul play observed within theresidence and that the Medical Examiner's Office was contacted and responded to the scene District SixMedical Examiner's Office Investigator Marti Scholl responded and conducted her investigation at thescene, As a result of this, I contacted the District Six Medical Examiner's Office on this date atapproximately 1620 hours and requested that Investigator Scholl contact me regarding this incident

On 02-17-2007 at approximately 1640 hours, Investigator Scholl contacted me back and confirmedthat there were no signs of foul play noted and that the evidence at the scene suggested that Kyle Brennancommitted suicide with a firearm, At this time, the autopsy has been completed and no signs of foul playwere noted during the procedure" Investigator Scholl requested that Next-of-Kin contact the District Six

Medical Examiner's Office on 02-18-2007 after 0800 hours so that funeral home procedures could bediscussed,

On 02-17-2007 at approximately 1645 hours, I made telephone contact with Kyle Brennan's father,Thomas Brennan at [727J 482-1817. At this time, Mr Brennan advised that he was making arrangementsto move to another residence on Permsylvania Avenue in Clearwater Mr. Brennan advised that due to tincident that had occurred, he was not able to remain at his current apartment Mr ..Brennan advised thatdid not want to move out of the apartment until he contacted the Police Department I advised Mr.Brennan that he was free to move from the apartment and that we did not have any reason to maintain

On 02·23-2007 at approximately 1600 hours, I attempted to make telephone contact with District SixMedical Examiner's Office Forensic Investigator Marti Scholl At this time, I wanted to inquire about anycontact that would be made with Kyle Brennan's Doctor who had prescribed the Lexipro medication tohim At this time, I was advised that Investigator Scholl would not be back in the office until 02-26-2007 Irequested that Investigator Scholl contact me on Monday 02-26-2007 via my department cell phonenumber"

On 02-26-2007 at approximately 0930 hours, Investigator Marti Scholl contacted me" At this time,Investigator Scholl confirmed that she would be contacting Kyle Brennan's doctor so to discuss hisdiagnoses and medication prescribed" Investigator Scholl advised that she would contact me once thisinformation was obtained

On 03-05-2007 at approximately 1400 hours, I received a voice-mail message from Detective CarlBrown with the Albemarle County Police Department in Charlottesville, Virginia Detective Brownrequested that I contact him at [434] 972-4038 regarding this investigation,

On 03-05-2007 at approximately 1510 hours, I attempted to make telephone contact with Detective

Brown at which time I received his voice-mail system, I left a message requesting that Detective Browncontact me via my department cell phone"

On 03-05-2007 at approximately 1550 hours, I made telephone contact with Investigator Scholl whoconfirmed that she had spoke with Kyle Brennan's Doctor/Psychiatrist The Doctor was identified as DrMcNamera who is based out of Charlottesville, Virginia The Doctor confirmed that Kyle Brennan hadbeen exhibiting early signs of Schizophrenia to include paranoia and delusions and that he did prescribeLexipro to Brennan" Dr, McNamera advised that Lexipro should be administered on a long term andregular basis for the proper results to be attained, Dr, McNamera advised that he was not aware of anymajor side effects if one was to suddenly stop taking Lexipro.

On 03-05-2007 at approximately 1635 hours, I made telephone contact with Thomas Brennan, At thistime, I advised Brennan that I wanted to meet with him an an effort to learn additional history informationabout Kyle Brennan. Thomas Brennan agreed to meet with me at his new residence on 03-07-2007 at1100 hour'S..The new residence address has been confirmed as 403 Pennsylvania Avenue in Clearwater.

While on the telephone with Thomas Brennan, I received a return call from Detective Brown with theAlbemarle County Police Department Detective Brown left a voice-message requesting that I contact hisdepartment cell phone number of [434] 531-5463..

That he took a Missing Person Report on 01-23-2007 whereby Kyle Brennan was reported missing byhis mother, Victoria Britton [Albemarle County Virginia Police Department report #2007-00765]That Kyle Brennan left his residence on 11-27-2006 and removed approximately $SOOOOO from his ow

bank account., That Britton received a telephone call from an FBI Agent in Des Moines, Iowa, That Britton was advised that her son had been at the FBI office and had advised that he was beingfollowed by persons who were after him,, That the FBI Agent was identified as Special Agent JeffAtwood., That Brennan appeared as ifhe had not been eating, was emaciated and appeared to be having delusions,, That Brennan, at the time of his encounter with the FBI, had approximately $5000,00 on his person, That Brennan did provide his home telephone number to the FBI and then left the office,

, That the FBI contacted Brennan's mother in Virginia and advised of Kyle Brennan's arrival at their office,, That Brennan then traveled to San Diego, California and stayed with his Aunt from 01-0S-2007 until01-15-200T, That Brennan then traveled to Maui, Hawaii whereby he contacted the police after an altercation with anunknown male, That Brennan then traveled back to California to stay with family members, That Brennan then traveled to Clearwater Florida at which time he began to stay with his father" That he [Detective Brown] spoke with Kyle Brennan's brother, Scott Brennan, on 03-02-2007 and thatScott Brennan had concerns that their father [Thomas Brennan] may have had something to do with hisbrother's death because his father is a Scientologist and does not believe in medications for mental illness,

Detective Brown agreed to E-mail me the narrative of the Missing Person report that was completed aswell as an E-mail message that was sent to him from Kyle Brennan's brother, Scott Brennan The followingis the two e-mails that were forwarded to me by Detective Brown;

11127/06 Kyle left home while his parents were at work He had cleaned out his bank account ofapproximately $SOOO.OO Although he had never left like this before his mother stated they felt he mightreturn in a couple of weeks. When Kyle still hadn't returned Mrs. Britton stated she did call the Police butwas told there would have to be more information regarding Kyle's condition to enter him into NCIC asendangered

On 01107/07 Mrs, Britton received a call from an FBI agent (Anderson ?) from the Des Moines, IAoffice, He told Mrs. Britton that Kyle had walked into their office stating he was being followed and "theywere after him", The FBI realized that he was delusional and in need of treatment Kyle was wearing a

There wasn't any report on file at that time ..The agent continued trying to talk with Kyle when he

told them he had to leave or "they would find him" The agent asked who would they call if he got hit by abus and Kyle gave the agent his home phone number That is when the agent notified Mrs. Britton abouther son The agent also advised that Kyle had over $5000 ..00 in cash on his person and it was apparent hewasn't eating and seemed emaciated His mental state was deteriorated Kyle left the office and the FBIagent told her they kept watch on him until he disappeared again.

On 01108/07 Kyle showed up at an Aunt's residence in San Diego, CA. He stayed with this Aunt until01115/07. The Aunt stated he was very paranoid and kept saying "they were hunting him down" The Aunttried to get Kyle to seek mental help and that's when he left and has not been seen or heard fiom since.Mrs Britton received a Sprint cellphone bill on 01/22/07 where Kyle purchased a cellphone. The phonenumber is, The phone numbers he had been calling were mainly to the FBI office in DesMoines, while he was still in that area ..The last call on the bill was dated 01112/07 and that was to theAunt's cellphone in San Diego ..

Mrs ..Britton fears for her son's safety as well as for those who may come in contact with him.Particularly those in an authority capacity. She has tried calling the cellphone but Kyle will not answer thecall Mrs Britton feels that if Law Enforcement attempts to call Kyle he may throwaway the phone I alsosuggested Mrs ..Britton see if she can contact Sprint and advise them of the situation and see if they cantrace any calls made as to their location of origin.NCIC entry needed with National broadcast with last known location being in San Diego, CA Kyle has acurrent passport and could possibly continue south of the border.

On 03-06-2007 at 1100 hours, I met with Kyle Brennan's father Thomas Brennan and Thomas Brennan'swife Wendy Brennan at 403 Pennsylvania Avenue Thomas Brennan then advised me of the following;

That he is divorced from Kyle's mother and currently resides in Clearwater with his wife, WendyBrennan..That in 2003, Kyle moved to Leigh Acres Florida with him so to finish school...That Kyle graduated from school in 2004 and then moved back to Virginia to stay with his mother inDecember, 2004 ...That Kyle had been prescribed and began to take Lexapro in August of 2006 for symptoms ofdepression..That Kyle left home in Virginia approximately two months ago and traveled to several states on his own.· That approximately one week prior to the incident, Kyle contacted him from San Francisco and advisedthat he was "Out of money"

· That he made anangements to have Kyle fly to Tampa International Airport at which time he [Thomas]paid for the flight ticket.. Ihat Kyle arrived in Tampa at which time he picked him up and they went to dinner...That he agreed to allow Kyle to stay at his apartment located at 423 Cleveland StreetThat he and Kyle spoke of Kyle's depression and that Kyle advised him that he didn't like taking the

medication that had been prescribed to him. [According to Thomas, Kyle advised him that he had not beentaking his medications on a regular basis]

· Ihat approximately one day after Kyle arrived in Florida, he [Thomas] came home and found that thedoor to the guest bedroom was closed ..[Ihis was the bedroom that Kyle had been sleeping in since hisarrival]· Ihat he called out to Kyle at which time he [Kyle] answered; "1'11be right out."

· That he then learned from Kyle that he had placed furniture in front ofthe interior ofthe bedroom door...That Kyle did not tell him why he had done this.That three days prior to the incident, he and Kyle spoke and agreed that Kyle would improve his daily

nutrition and stop taking the Lexapro· Ihat he [Thomas Brennan] does not believe in psychiatric medication due to his religious beliefs ..· Ihat he did not force Kyle to stop taking his medication and that the decision was a mutual agreement· Ihat he then placed the Lexapro medication in his vehicleThat for the next three days, Kyle was eating and sleeping better and appeared to be very positive .

..That the firearm utilized in this incident originally belonged to his [Thomas'] Grandfather

..That the firearm and ammunition had been stored in his bedroom night stand within a green army style bagThat he never advised Kyle ofthe location of the firearm nor did Kyle ever speak ofthe firearm.· Ihat during the time that Kyle was staying with him, Kyle never spoke of suicide· Ihat his wife was in New Y OIk during the entire time that Kyle was in Clearwater.· Ihat Kyle was scheduled to return back to Virginia on 02-19-2007 so to reside with his mother

Thomas then advised me of several pages of hand written notes that belonged to Kyle..Ihomasadvised that Kyle brought these items with him when he arrived from California, Thomas consented to metaking the hand written notes so that I could make copies of them I advised Thomas that I would return thenotes to him on 03-07-2007

On 03-06-2007 at approximately 1400 hours, I received a telephone call from Kyle Brennan'sbrother, Scott Brennan WIM, 04-02-·1977. During this time, Scott advised that he did not trust his fatherand that he believed that his father was hiding facts of this incident from the family and the police I inquiredif Scott had any specific knowledge that would indicate criminal activity was involved in this incident Scottadvised that he was not aware of any specific facts however; he believed that his father was responsible forKyle's death Scott was very angry that his father would take the medications away from Kyle once hearrived in Florida. I then explained to Scott that based on the final count ofthe recovered medications itwas evident that Kyle was not taking his medications on a regula! basis or as prescribed Scott theninquired about the following;

·If! had interviewed his father's new roommate, "Jerry"·Why did "Jerry" notify Kyle'S mother of the death.· The family in Virginia had received Kyle's property back from Florida to include his lap-top computer.Scott advised that he had reviewed his brother's computer files and found that files had been removed fromthe system approximately two hOUlSafter Kyle had been located ..

That he had researched Kyle's cell phone records on line and learned that Kyle had made a call to theClearwater Police Department on 02-05-2007. According to Scott, the call lasted for eight minutes ..

Scott then advised that I could access Kyle's cell phone records on line so to review the activity thatwas taking place. The cell phone number was identified as [319] 504··3658 with service being provided bySprint. I was instructed to go to the website of Sprint com and then enter into the Personal wireless sectionThe user name was identified as The password was identified as . I advisedScott that I would follow-up on these areas of concern with his father on 03-0T-2007. I also advised thathe would need to make arrangements to have the computer sent to the Clearwater Police Department sothat I could have the proper review completed. Scott advised that he would have the computer shipped tome **It should be noted that this was the first knowledge of Kyle Brennan being in possession of acomputer upon his anival to Clearwater**

On 03-06-2007 at approximately 1530 hours, I copied and reviewed the hand written documents thatwere provided to me by Thomas Brennan ..There were a total of 38 hand written pages that documentKyle's concern and anger towards members of his family, police corruption and persons that he hadcontact with in school. Please see documents for additional information I have forwarded copies to thePinellas County Sheriff's Office Property and Evidence Section for future reference ..

On 03-07-2007 at approximately 0920 hOUlS,I met with Thomas and Wendy Brennan at 403Pennsylvania Avenue At this time, I gave the original hand written documents back to Thomas I thenspoke Thomas about the computer that he had mailed back to the family in Virginia after Kyle's death.Thomas advised that he did not review, remove or alter any files within Kyle's lap-top computer

Regarding the phone call being made to Kyle's mother from "Jerry", Thomas advised that he asked hisclose friend, Jeny Gentile, to contact Victoria Britton and advise her of the incident because he was toodistraught to speak with anyone ..Thomas advised that on 02-17-2007, he called Gentile after calling hisChaplain Denise and the police and requested that Gentile respond to the apartment for support. Thomasadvised that Gentile has never resided at the apartment on Cleveland Street Thomas confirmed that Gentilewas at the residence when the Officers arrived at his apartment on 02-17-2007.

On 03-12-2007 at 0900 hours, I eceived and reviewed the recording that was requested of theClearwater Police Department Communications Center I reviewed the recording and noted that Kylespeaks of concern for his own safety Kyle advised that he believed that his family may be trying to harmand/or kill him Kyle advised that he wanted to place the call in the event that anything ever happened tohim Kyle also speaks of previously meeting the Sheriff in Clearwater and that the Sheriff appeared asthough he would help him [Kyle Brennan] with his situation Kyle speaks of the fact that he was trying toimprove his lite and had been through a difficult time Kyle confirmed that he was calling from Hawaii awas planning on moving to Clearwater soon DUling the recording, Kyle does not speak of any specificperson who may bring harm to him This recording will be forwarded to the Pinellas County Sheriffs OfficeProperty and Evidence Section for future reference

On 03.,12-2007 at approximately 1030 hours, I faxed a written request to the Pinel1as County 911Center regarding the call that was placed to the center by on 02-17-2007

On 04-05-2007 at approximately 1005 hours, I returned the call to Victoria Britton and provided anupdate for this investigation Britton spoke of wanting Thomas Brennan charged with a crime because ofthe tact that he had left a firearm within the residence when Kyle arrived in Clearwater. I explained thestatute requirements under the following Florida State Statutes;

.FS.S ..790..17: Furnishing weapons to minors under 18 years of age or persons of unsound mind andfurnishing firearms to minors under 18 years of age prohibited. Within this section, the law prohibits selling:hiring, bartering, lending, transfening or giving any minor under 18 years of age any dirk, electric weaponor device or other weapon, other than an ordinary pocketknife, without permission ofthe minor's parentguardian, or selling, hiring, bartering, lending, transferring or giving to any person of unsound mind an

electt ic weapon or deviceOI

any dangerous weapon, other than an ordinary pocketknife. Due to the factthat; IJ Kyle Brennan was twenty [20] years of age at the time of this incident and; 2]The firearm was notprovided to him, this statute does not apply ..

. F.S S 790.174: Safe Storage of Firearms Required. Within this section, the law pertains to the properstorage and security of a firearm so that minors, under the age of sixteen [16], will not have access. Due toKyle Brennan's adult age at the time of this incident, this statute does not apply.

During this conversation with Victoria Britton, she advised that Kyle's condition was poor when hearrived in Florida. Britton believed that Thomas Brennan knew that Kyle was suicidal and that he shouldnot have allowed a firearm to remain within the residence Britton advised that Thomas Brennan wanted tosend Kyle to Narc-Anon for treatment however; he then contacted her on 02-16-2007 and advised herthat Kyle would need to leave his apartment and return to Virginia

I advised Britton that I had no evidence within this investigation to suggest that foul play was involvedalso advised Britton that I would have Kyle's computer evaluated once it was sent back to me fromVirginia.

On 04-06-2007 at approximately 0900 hours, I received a telephone call from Kyle's Step-Father,Rick Britton Rick Britton was equally concerned at the fact that Thomas Brennan would not be chargedcriminally for this event I explained the facts and circumstances ofthe incident and reiterated the fact thatthere was no evidence suggesting criminal intent. At this time, Rick Britton advised that he was concernedabout the fact that files had been deleted from Kyle's computer immediately after the report of his death I

advised Britton that the family would need to ship the computer to the Clearwater Police Department sothat I could have the proper evaluation completed by the Florida Department of Law Enforcement Brittonadvised that he would make arrangements to ship the computer to my office,

On 04-25-2007 at approximately 0830 hours, I obtained a voice-mail message from Rick Britton thatwas date/Time stamped for 04-24-2007 @ 1558 hours The original call came from telephone number[434] 923-0786. Within the message, Britton requested that I contact him as he was making arrangementsto bring Kyle's computer to Florida.

MEDICAL EXAMINER'S OFFICE INFORMATION:

I have received and reviewed the District Six Medical Examiner's Office Report of Autopsy for thisinvestigation I noted the following results;

AUTOPSY FINDINGS:

1 Perforating gunshot wound of head2 Extensive craniocerebral injuries

CAUSE OF DEATH:

Gunshot wound of head

MANNER OF DEATH:

Suicide

The Report of Autopsy has been forwarded to the Clearwater Police Department Records Section soto be added to the original case file.

INVESTIGATIVE CONCLUSION:

The investigation revealed that Kyle Brennan had been exhibiting early signs ofSchizophrenia to includeparanoia and delusions and that Lexapro had been prescribed, Kyle's doctor, Dr McNamera advised thatLexipro should be administered on a long term and regular basis in order to attain the proper results Theinvestigation revealed that Kyle was not taking his medication as prescribed This was confirmed during theoriginal investigation at which time a count of the Lexapro pills was completed, Dr McNamer a alsoadvised that he was not aware of any major side effects if one was to suddenly stop taking the medicationLexapro

During the investigation, Kyle's father Thomas Brennan was cooperative with Investigators andprovided information as requested" At this time; there is no evidence to suggest that Thomas Brennanwithheld pertinent information and/or acted with any criminal intent I have advised the family that I wouldhave Kyle Brennan's computer evaluated at the Florida Department of Law Enforcement however; I havenot yet received this item,

At this time, the status of this investigation will be changed from Active to Inactive, Once Kyle'scomputer is received from the family, I will make the proper anangements to have it evaluated by theFlorida Department of Law Enforcement Computer Section

SfA Mendez advised that she had locateda grouped file that had been titled; "Suspicious Activity" within the computer and appeared to have beencreated post incident, [Completed on 09-09-2007] S/A Mendez advised that due to the type ofprogram

he search within Kyle's computer for any suicide letters,That contacted Jerry Gentile because he knows that Gentile is proficient in the use ofcomputersThat on 02-,18-2007, JellY Gentile's daughter, Taylor, came to the apartment on Cleveland Street and

took custody of the computer so to bring it to Jerry Gentile [ was not sure as to why Gentile'sdaughter picked up the computer instead of Jerry Gentile picking up the computer himself]That Geny Gentile then reviewed the computer on an unknown date and located and printed some files

out for himThat the files included writings about Kyle's diet and caloric intake, a weekly to do list and a file that

documented Kyle's previous contact with the FBI, local Police Departments and a private investigationservice This same file also had a list of additional law enforcement agencies and other locations that Kylewas planning on contacting. That Gerry Gentile printed the documents out that he had copied and provided copies to him once thecomputer was returned to him later on the same date [02-18-2007]That the file names, including the dates created, were hand written on the documents that were provided

to him by Jerry GentileThat these mentioned documents were provided to me on 03-06-2007 when I met with him at his

residence on Pennsylvania Avenue in Clearwater **Note** I advised that he had provided mewith several documents on 03-06-2007 however; he did not provide these computer related documents tome on 03-06-2007 or OJ-07 -2007 when I returned to the residence to provide the original documents tohim then apologized and advised that he thought he had provided the computer relateddocuments from Jerry Gentile to me I then inquired as to why did not tell me ofthe fact that JerryGentile had accessed the computer after I specifically asked him on 03-07-2007 ifhe had accessed Kyle'scomputer advised that he did not recall me asking him this specific question and again apologizedfor any misunderstandingsThat he believed that he mailed Kyle's computer and property back to family in Virginia on Monday

On April 21, 2008, Detective Bohling requested that I assist with this case by processing a cellulartelephone .. I utilized Paraben Device Seizure 2.0 to attempt to forensically analyze the phone Noacquisition of data could be accomplished with Paraben Device Seizure 2 O .

An examination of the cellular telephone revealed that there was a Sandisk microSD card in the telephone ..Utilizing Accessdata Imager, I created a forensic image of the microSD card Utilizing Forensic Toolkit2.0, I forensically analyzed the microSD card image I was able to obtain multiple image and video files Ireturned the telephone and MiclOSD card to Detective Bohling on May 7, 2008.. I gave Detective Bohlingtwo compact discs containing one HTML Forensic Toolkit 20 report and one PDF Forensic Toolkit 2.0report I gave Detective Bohling one compact disc containing the Forensic Toolkit 2.0 case file, theAccessdata Imager image file of the microSD card, one HTML Forensic Toolkit 2 0 report, and one PDFForensic Toolkit 2.. 0 report.

On 04-09-2008 at approximately 1015 hoUI'S,State Attorney' s Officer Investigator Douglas Barryanived at my office and provided Kyle Brennan's cell phone that had been mailed to him from Kyle's fon 03-21-2008. The cell phone was identified as a Samsung model SPH-A920 with an assigned serialnumber of 02809964554 ..This cell phone will be provided to Detective Will Smith with the ClearwaterPolice Department's Economic Crimes Unit for evaluation and Forensic Analysis Investigator Barryreviewed all of the incoming and outgoing calls for Kyle Brennan's cell phone. Please see InvestigatorBarry's supplement report within report #SA08-27 for the detail listing of calls ..

On 04-21-2008, I met with Detective Will Smith and requested that he attempt to retrieve any and allinformation, photographs and videos from Kyle Brennan's cell phone for this investigation. Detective Smithforensically reviewed the cell phone and copied the results onto compact disks. Please see DetectiveSmith's supplement report for additional information

On 05-07-2008, Detective Smith provided Kyle Brennan's cell phone back to me as well as thecompact disks with the forensic report results of his findings I have printed out copies ofthe HTMLForensic Toolkit 20 report and the PDF Forensic Toolkit 2.. 0 report which have been included within theoriginal case file I have also printed out copies of the photographs that were retrieved from the cell phoneand included them in the original case file The compact disks that were provided to me by Detective Smithregarding the Forensic review of the cell phone have been included in the original case file Regarding thevideos and photographs that were retrieved from the cell phone, I reviewed them and noted that theyconcur with the findings of Investigator Barry Please see Investigator Barry's supplement report withinSA08-27 for additional details. On 05-07-2008 at approximately 1230 hours, I checked my voice-mail messages and obtained avoice-mail message from Geny Gentile that was date/time stamped for 05-07-2008 @ 1214 hours Thecall came from telephone number [301] 351-3584, Within the message, Gentile requested that I contacthim at [301] 351-3584,

On 05-07-2008 at approximately 1238 hours, I made telephone contact with Geny Gentile andadvised him that I needed to interview him regarding this investigation Gentile apologized for not retuthe calls to me sooner at which time he explained that his home office is based out of Maryland. Gentileadvised that he had also been out of the country for his employment and that he was not not attempting toavoid me I advised Gentile that after today, I would be out of the office until 05-28-2008 I advisedGentile that I would contact him after 05-28-2008 so that arrangements could be made for us to meet atthe District II Station fOl an interview. Gentile advised that he is only home on Saturdays and Sundays ashe travels to Maryland on Monday mornings and returns to Clearwater on Friday nights.

On 08-10·2008 at approximately 2025 hours, I made telephone contact with Denise Gentile via herlisted telephone number of [727J 647-3602, Denise advised that she was currently out ofthe state and thatshe would contact me back on 08-13-2008, Denise was very apologetic for not calling me back soonerand advised that she has been dealing with a family emergency"

On 08-18-2008 at approximately 0730 hours, I checked my department voice-mail system andobtained a voice-mail message from Attorney Lee Fugate This voice-mail message was date/time stampedfOI 08-14-2008 @ 1412 hours and came from telephone number [813] 224-9281" Within the message,Fugate advised that he is representing Denise Gentile and that he wanted to be present during the time ofher interview. Fugate advised that he would be out of the office during the week of 08-18-2008 however; I

could contact his Secretary on 08-18-2008 @ [813] 221-1010 and arrange for an interview with Deniseduring the week of 08-25-2008., Within the message, Fugate advised that Denise will fully cooperate withthis investigation however; she was somewhat concerned due to the recent internet postings regarding thisincident.

On 08-27-2008 at approximately 1600 hours, I attempted to make telephone contact with Attorney LukeLirot as I had not received a 1 eturn call from 08-18-2008. At this time, I spoke with a male who advisedthat Lirot was currently out oftown on business I requested that Lirot contact me when he returns to thearea.

+ Kyle Brennan was diagnosed by Dr Stephen McNamara as having exhibited early signs ofSchizophrenia to include depression, delusions and paranoia As a result, Kyle was prescribed to take oneLexapro l Omgper day.

+ Kyle's Lexapro prescription was last known to be filled on 11,·24-2006 for thirty [30] pills+ Kyle had been residing with his mother and Step-father in Virginia up until11-27-2006 at which time heleft the residence on his own accord+ Kyle had in his possession several thousand dollars that he had withdrawn from his bank account at thetime he left Virginia+ Kyle's mother advises that Kyle had never left home before however; after a couple of weeks, she didcontact the Police Department in Virginia and was advised that there was not enough information regarding

Kyle's condition to be entered into the NCIC System as Missing and Endangered+ On or about 01-07-2007, Victoria Britton received a telephone call hom FBI Special Agent JeffAtwood in Des Moines, Iowa who advised that Kyle had walked into his FBI office on that date DUlingthis time, Kyle advised Special Agent Atwood that he was being followed and that "They were after him"

Special Agent Atwood contacted authorities in Charlottesville, Virginia in an effort to see if Kyle had beenlisted as Missing and/or Endangered. Special Agent Atwood learned that no report had been filed SpecialAgent Atwood obtained Kyle'S home telephone number from Kyle prior to him leaving the office and thencontacted Victoria Britton to advise of his contact with her son Wben Kyle arrived at the FBI office, it isreported that he had in his possession over $5000.00 in cash and appeared under nourished andemaciated.+ On or about 01-08-2007, Kyle was reported to have arrived at his Aunt's residence in San Diego,Califomia during which time he remained with his Aunt until approximately 01-15-2007 It is reported thatKyle had told his Aunt that persons were hunting him down It is reported that the Aunt believed that Kylewas acting in a paranoid manner during his visit with her+ Victoria Britton reporter that on or about 01-22··2.007,she received a cell phone bill in Kyle's nameindicating that Kyle had purchased a cell phone. Victoria Britton reviewed the tolls on the bill and noted

that Kyle had numerous calls to the Des Moines, Iowa FBI office The last call on that specific bill isreported to be on 01-·12··2007which was made to Kyle's Aunt in San Diego, California+ Victoria Britton filed a Missing Persons report for Kyle with the Albemarle County Virginia PoliceDepartment on 01-23-2007/Report #2007-00765+ It is reported that Kyle left San Diego, California and then traveled to Maui, Hawaii where he wasinvolved in an incident whereby the Police were contacted+ Kyle then returned to California and contacted his father, Thomas Brennan, via telephone and advisedthat he was out of money Thomas Brennan was residing at 423 Cleveland Street, apartment #4 at thattime. Thomas Brennan then made arrangements with Kyle to fly into Tampa Florida so that he could 1esidewith him in Clearwater Thomas Brennan and Victoria Britton, who are divorced, did discuss this matter atwhich time it was agreed that Kyle would stay with Thomas Brennan in Clearwater Florida+ Kyle arrived in Florida in early February 2007 at which time Thomas Brennan and Kyle spoke of hisdepression and the fact that Kyle was not taking his prescribed Lexapro on a regular basis According toThomas Brennan, Kyle advised that he did not like taking the Lexapro Thomas Brennan advised thatapproximately one day after Kyle arrived in Clearwater, he [Thomas Brennan] carne home to theapartment and found that the door to the guest bedroom was closed Thomas Brennan advised that helearned that Kyle had placed furniture in front ofthe interior of the bedroom door however; Kyle did nottell him why he had done this+ According to Thomas Brennan, he and Kyle agreed that Kyle would stop taking the Lexapro medicationand start utilizing better nutrition habits and vitamins to assist with his well-being Thomas Brennan placedthe Lexapro medication into his own vehicle at which time Kyle appeared to be improving his eating andsleeping habits.+ Thomas Brennan advised that he did not force Kyle to stop taking his Lexapro and that the choice to

stop taking the Lexapro was a mutual agreement Thomas Brennan advised that Kyle had not been takingthe Lexapro on a regular basis prior to his arrival in Clearwater Florida This was confirmed to be credibleat the time of Officer Jonathan Yuen's arrival on 02-17-2007 during which time there were 16 Lexapropills located within the prescription bottle. As noted prior, this prescription was filled on 11-24-2006 with astart count of 30+ The review of the Pinellas County 911 Center records indicate that the original 911 call was placed at00:01: 17 by telephone munber The call was dispatched

ThomasBrennan returned home neat midnight on 02-17-2007 and noted that there were five-gallon CrystalSprings water jugs up against the interior ofthe entry door to the apartment Thomas Brennan called out tohis son however; there was no answer Thomas Brennan advised that upon entry, he could smell the odorof gunpowder Thomas Brennan then went into his bedroom and located Kyle on the floor with anapparent gunshot wound to the head Thomas Brennan checked for signs of life and noted that Kyle wasunresponsrve* Thomas Brennan then contacted his friend, identified as Denise Gentile, and advised her of his findings

Denise Gentile advisee. to call 911 which written 911 records indicate* DUling my interview with Denise Gentile on 08-·27-2008, she confirmed that Thomas Brennan did stop ather residence on the way home flam work on 02-·16-2007 at approximately 2300 hours Thomas Brennanremained at her residence for a short time, borrowed a book from her and then left the residence to gohome. Denise Gentile advised that approximately 10 minutes after Thomas Brennan left her residence, hecalled her and advised; "Oh my God Denise, Kyle shot himself" Denise advised that Thomas Brennan alsoadvised; " Kyle committed suicide" and asked her; "What do I do?": Denise advised Thomas Brennan tocontact 911 at which time Thomas Brennan advised; "Okay" and immediately hung up the telephoneDenise advised that Thomas Brennan sounded as though he was "hyperventilating" when he contacted hervia telephone Denise advised me that although she is a Church of Scientology member, she is not anAdvisor or Chaplain at the organization+ Denise Gentile confirmed during her interview that she asked her husband, Geny Gentile, to go toThomas Brennan's apartment after Brennan called her so that he could support Brennan Denise alsoconfirmed that Thomas Brennan did stay at her residence with her and hei husband after the investigationwas completed at Brennan's apartment+ During my interview with Gerry Gentile on 07-13-2008, he confirmed that Thomas Brennan did call hiswife Denise Gentile on 02-16-2008 and advised that he had returned home and found his son hadcommitted suicide Geny confirmed that he went to Thomas Brennan's apartment at which time the Policewere already on scene In fact, Geny advised that when he did anive, an Officer questioned him aboutwho he was and the fact that he was not allowed near the apartment Gerry Gentile, during my interviewwith him, also confirmed the tact that no one else was with Thomas Brennan [With the exception of thePolice Officers] when he arrived at the apartment Gerry confirmed that when he met with Thomas Brennanoutside the apartment, Brennan's "Hands were shaking really bad" and that Brennan advised him; "1can't

Geny advised that he told Kyle'S mom that Kyle had passedaway at which time a male then came onto the telephone asking him; "Who is this?" Gerry believed that the male may have hungthe telephone up before Thomas Brennan had a chance to speak with him Geny advised that ThomasBrennan may have contacted another family member via cell phone immediately after the phone call toKyle's mother however; he could not be positive of the person he contacted+ DUling my interview with Geny Gentile, he confirmed that Thomas Brennan spoke with his wife [DeniseGentile] the day after Kyle was discovered in the apartment and asked her ifhe [Gerry Gentile] couldreview Kyle's computer to "See if there's anything on there that would help me understand whathappened." Gerry confirmed that the computer was brought to his residence by Denise Gentile's Daughter,Taylor on 02-18-2007.. Gentile advised that later on that same day, he reviewed the contents of thecomputer. [This would be consistent with the computer being accessed on 02-18-2007 as identified byFDLE Special Agent Barbara Mendez during her forensic review of Kyle Brennan's computer]+ Gerry Gentile confirmed that he entered into the "My Documents" directory and attempted to print filesof interest however; he noted that the files were in a Microsoft WOIks program. Gentile advised that he cannot open files from Microsoft Works in any of his computers and that the laptop computer did not have aprinter driver that was compatible to the printer he had at his residence ..As a result, Gentile advised that he

copied the Microsoft Works files onto a thumb drive Gentile advised that he then accidently copied thecontents ofthe thumb drive back onto Kyle Brennan's computer Gentile realized his error and then erasedthe files that he had accidently copied back onto Kyle Brennan's computer Gentile printed out copies of allof the files that he had copied and provided copies ofthese same documents to Thomas Brennan Ireviewed the documents that Gentile brought with him to the interview and noted that the following fileswere accessed on Kyle Brennan's computer on 02-18-2007;

+ Gentile provided the printed copies of the documents to me at which time the documents were consistentwith the documents that Thomas Brennan's Attorney, Paul B Johnson, mailed to me on 11-28-2007,+ I received Kyle Brennan's computer via mail from Kyle's family on 09-13-2007. I transported thecomputer to the Florida Department of Law Enforcement in Tampa Florida on 09-13-2008 at which timeSpecial Agent Barbara Mendez completed a forensic review of the hard drive The forensic reviewindicates that Kyle Brennan's computer was accessed on 02-18-2007,02-21-2007,02-24-2007,02-26-2007 and 09-09-2007 ..Special Agent Mendez advised that a review of the files indicated noevidence that any files in question had been deleted ..However; Special Agent Mendez advised that she hadlocated a grouped file titled; "Suspicious Activity" that appeared to have been created on 09-09-2007

This specific file is believed to have been created by Kyle Brennan's Sister-in-Law Mia Brennan during herreview ofthe computer in Virginia, Due to the type of program that was utilized to access and move thisfile, [Identified as Bigfix exe] the file can no longer be accessed for review,

+ Ihis investigation revealed that Kyle Brennan contacted the Clearwater Police Department on02-06-2007 @ 0309 hours from his own cell phone I ordered the recorded phone call and reviewed theentire conversation between Kyle and the Dispatcher during which time Kyle speaks of concern for his

own safety Kyle advised within the conversation that he believed that his own family may be trying to harmand/or kill him and that he wanted to place the call to the Police Department in the event that anything everhappened to him. Kyle also spoke of previously meeting with the Sheriff in Clearwater and that the Sheriffappeared as though he would assist him with his situation Kyle spoke of the fact that he was trying toimprove his life and had been through a difficult time Kyle spoke of the fact that he was currently in Hawaii

and was planning on moving to Clearwater soon. During the recording, Kyle did not speak of any specificperson who may bring harm to him.

+ I have reviewed the contents of Kyle's cellphone after submitting the item to Detective Will Smith for aForensic Review I noted no signs of foul play within the photographs and videos located within thecellphone+ I have reviewed the crime scene photographs and noted no signs of foul play. District Six MedicalExaminer's Office Investigator Marti Scholl responded to the original scene on 02-17-2007 and did notobserve any signs of foul play or suspicious activity on the body or within the apartment The photographsof the scene confirm the fact that the hand written words; "Look inside" were observed on Kyle's stomacharea There was also written documentation within Kyle's front right pocket that read as follows; [Typed

* There was a paper located in Kyle'S front left pocket that read; "11:00". There were also five [5] unfiredWinchester 357 bullets located within Kyle's front left pocket+ The firearm located at the scene was identified as a Taurus 357 Magnum Revolve! that had four [4]unfired rounds within the cylinder and one spent casing within the cylinder.+ The Pinellas County Sheriffs Office Forensic Section did process the firearm, all of the ammunition, thespent casing and the listed notes for finger prints however; there were negative results for ridge detail onthese items ..

INVESTIGATIVE CONCLUSION:

After a thorough investigation that included numerous interviews, document reviews, recording reviews,cellphone/cellphone records review and a forensic computer review, there is no evidence to suggest thatthere was any violation of Florida State criminal statutes As stated in my supplement report dated for07-27-2007, the following Statutes were reviewed and considered for this investigation;

F..S.S..790.17: Furnishing weapons to minors under 18 years of age or persons of unsound mind and

furnishing firearms to minors under 18 years of age prohibited ..Within this section, the law prohibits selling,hiring, bartering, lending, transferring or giving any minor under 18 years of age any dirk, electric weaponor device or other weapon, other than an ordinary pocketknife, without permission of the minor's parent orguardian, OI selling, hiring, bartering, lending, transfening or giving to any person of unsound mind anelectric weapon or device or any dangerous weapon, other than an ordinary pocketknife ..Due to the factthat; 1] Kyle Brennan was twenty [20] years of age at the time of this incident and; 2]The firearm was notprovided to him, this statute does not apply ..

FS.S. 790174: Safe Storage of Firearms Required. Within this section, the law pertains to the properstorage and security ofa firearm so that minors, under the age of sixteen [16], will not have access ..Due toKyle Brennan's adult age at the time of this incident, this statute does not apply

As stated in my supplement report dated 07-27-2007, the investigation revealed that Kyle Brennanhad been exhibiting early signs of Schizophrenia to include paranoia and delusions and that Lexapro hadbeen prescribed. Kyle's doctor, Dr. McNamera, advised that Lexipro should be administered on a longterm and regular basis in order to attain the proper results. The investigation revealed that Kyle was nottaking his medication as prescribed The original Lexapro prescription was assigned to Kyle Brennan on11-24-2006 for 30 pills. At the time of the original investigation on 02-17-2007, there were 16 pills foundwithin the prescription bottle ..Dr..Mcl-lamera also advised that he was not aware of any major side effectsif one was to suddenly stop taking the medication Lexapro .

The review of the physical evidence and statements provided by persons involved in this incident areconsistent with the District Six Medical Examiner's Office findings of Suicide. The Sixth Judicial Circuit of

the State Attorney's Office has also conducted an independent review of this incident and concurs with thefindings of this investigation as well as the District Six Medical Examiner's Office investigation.

At this time, the status of this investigation will be changed from Active to Closed/Other The computer,computer case and photographs that were mailed to me by Victoria Britton were delivered back toBritton's Attorney, Luke Lirot, on 11-06-2008 at approximately 1120 hours I delivered the listed items toAttorney Luke Lirot's office located at 2240 Belleair Road, suite # 190 in Clearwater I received
