    Few things are more heart-wrenchingfor a parent than to have their childwrongfully taken by their spouse –sometimes even moved to a diff erentcountry. Tere’s almost always a nastyght aferwards. Can you get your childreturned?

    A recent case decided by BC's appeal

    court shows that the abduction can beundone and your child can be returnedto his or her country of residence. Tatcountry’s courts can then deal withcustody and access issues – like whichparent your child is better off  living with.

    Here, Carla (all names changed), aCanadian, married Pete, an American, inAlberta in 2010. Te next year they had achild, Josh, in Alaska, then moved to livein Washington where Pete found work.In 2013, the family moved to Billings,Montana, when Pete was transferredthere by his employer.

    Tey intended to make Billings theirpermanent residence. But the house theyplanned to move into wasn’t t to live in.So afer a few days’ stay, Carla told Peteshe wanted to take little Josh and live ather parents’ place in Elko, BC, while Petegot the house xed. Pete was okay with

    that. Carla only took along a few clothesand toys for Josh, consistent with a shortstay away.

    But a few months later, things changed.Te marriage broke down. Carla, whonow had a job as a heavy duty mechanic,didn’t want to return to Montana, anddecided she’d stay in BC with Josh.

    Once Pete found this out, he went tocourt to get Josh returned to Montana.

    Afer many legal twists and turns, thecase reached our BC appeal court. Carlaargued that Josh would be at serious riskof harm if returned to Montana. Petedisputed this. Carla also argued that afew days’ stay in Billings wasn’t enough to justify having to take her 3 year old son

    back to Montana. Ultimately, our appealcourt said Carla had to return Josh toMontana within two weeks – a court therewould sort out the custody and accessissues aferwards.

    Te law dealing with these situationsis a treaty (international agreement) oninternational child abductions, called theHague Convention.  It’s signed by manycountries, including Canada and theUnited States. One overriding objective of

    this treaty in child abduction cases is to helppromptly return a wrongfully abductedchild detained in another country.

    What mattered more here than Carla’s(and Josh’s) very short stay in Montanawas that both Pete and Carla had intendedfor Billings to become their permanentresidence when the family moved there– Josh of course was too young to decidethis for himself.

    Legally, Josh’s habitual place of residencewas the United States, not Canada. So, inline with the treaty’s objectives, Josh neededto be returned to Montana for a court thereto deal with the domestic issues.
