Key changes to note ‐ General  Donor/Donee(s) no longer required to fill 

in their contact details in the LPA Form.  This will be provided for in the LPA Application Form 

Witnesses and/or Translators are also no longer required to fill in their contact details in the LPA Form 

Legislation has been amended to remove the notification of a named person when an application is made to register an LPA

Where a translator is used, he/she will have to be the witness to the Donee(s)’s statement

The Annex to Part 3 (Part C in the existing LPA Form) no longer has its own page numbering sequence.  The pages in the Annex are now part of the total number of pages in the new LPA Form 2 (2014)

The LPA Certificate is now consolidated in the last page of LPA Form 2 (2014) 

The Statement of Independence has been summarised.  Instead of listing out the relationships* to the donor and/or donee(s) which will disqualify the professional from acting as the Donor’s LPA Certificate Issuer, reference is made instead to Regulation 7 of the Mental Capacity Regulations which sets out disqualifying relationships 

 *These relationships are: (a) A donee or replacement donee named in the lasting power of attorney or any other lasting power of attorney made by the donor (whether revoked or not); (b) a family member of the donor or such a donee or replacement donee; (c) a director or employee of a donee or replacement donee who is a licensed trust company; (d) a business partner or employee of the donor or such a donee or replacement donee; and (e) the owner, director, manager or employee of a care facility where the donor lives or is cared for (where applicable) or a family member of such a person
