JOINT NOTICE OF REMOVAL

TO THE CLERK OF COURT OF THE UNITED STATES DISTRICT COURT FOR

THE DISTRICT OF SOUTH CAROLINA:

PLEASE TAKE NOTICE that, pursuant to 28 U.S.C. §§ 1331, 1441, and 1446, this

action is being removed from the Circuit Court for Beaufort County, South Carolina to this

court. Removal is proper on the following grounds:

I. On June 25, 2013, an action was commenced in the Court of Common Pleas for

Beaufort County, South Carolina, captioned, Kerri Ray v. Francis M. Simon and Beaufort

County, C.A. No. 2013-CP-07-1643. The defendants were served on June 27, 2013, and jointly

remove this action.

II. The Complaint asserts federal questions over which this court has original

jurisdiction under 28 U.S.C. § 1331, and the action is one which may be removed to this court

by the defendants pursuant to 28 U.S.C. §§ 1441 and 1446. This action is removable because the

Complaint alleges claims under the Civil Rights Act of 1964, 42 U.S.C. A. §§ 2000e, et seq.

(“Title VII”).

III. This Notice of Removal is timely filed under 28 U.S.C. § 1446(b) in that it is filed

within thirty (30) days after the receipt of pleadings by both defendants.

IV. Copies of all process and pleadings served to date are attached to and filed with

this Notice of Removal.

V. Written notice of the filing of this Notice of Removal will be promptly served on

Plaintiff.

VI. A true and correct copy of this Notice of Removal will be filed with the Clerk of

Court for the Court of Common Pleas for Beaufort County, South Carolina, as provided under

28 U.S.C. § 1446(d).
