In the G. O. read as 1st paper above orders were issued that in deserving and exceptic cases suitable and qualified Typists and . Stenographers in th Secretariat who are graduates and who possess the pres.ribed lest qualification may be promoted as Upper Division Clerks on the advice of the Public Service Coinmission about their suitability for promotion after conduct ing a test therefor: It was also ordered iu th : G. O. read as second paper above that the persons who were so promotel as Upper Division Clerks will take rank below the juniormust Upper Division Clerk at the time of their promotion .
2. With or view to further liberalising the conditions of recruitment to the Secreturiat information regarding themethods prevalent in other States for promoting Typists and Steno graphers as Upper Division Clerks was obtained and the wiiole question was co sidered by Go.ernment in consultation with the Kerala Public Service Commission . As a result Govern ment are pleased to pass the following orders in supersession of the G. Os. read as 1st and 2nd paper above :
(i) Typists - Typists with four years aggregate service in the Secretariat and Office of the Public Service Com mmission and Typists ond Clerks in all Departments with 4 years' aggregate service irrespective of graduation qualification will be allowed to compete in the written test of the Coninission for selection as Lower Division Clerks in the Secretariat, the Public Service Commis sion's 0.l.ce and in such other ultices where the scale of pay of Lower Division Clerks is Rs. 30-125. Theage limit for recruitment in the case of the above persons will be 32 years on the 1st July of the year in which applications are invited by the Commission with the

usual relax tion for Scheduled - Castes and Tribes and Backward Classes. They will take their chance for appointment purely on the basis of merit and considered against open competition vacancies and not against appointments in reserved turns.
(ii) Stenographers - Every 15th vacancy of Upper Division Clerks in the Secretariat will be reserved for the Steno graphers of the Secretariat. Suitability of the Steno graphers for appointment as Upper Division Clerks will be tested by the Con :mission by a written test. Steno graphers with 8 years total service and with Account Test (Lower ) qualification will be allowed to appear for the test. A minimum of 50 % of the total marks should be secured by a candidate to be successful in the test. From among those who pass, such number as is adequate for the vacancies of Upper Division Clerks arising from time to time will be selected for appointment in the order ofmerit . Rules of reservation will not be applied in these appointa.eats, and there will be no age restric tion .
3. Persons appointed as Lower Division Clerks adopting principles enunciated above will take rank below the juniormost Lower Division Clerk at the time of their joining duty and persons appointed as Upper Division Clerks, below the juniormost Upper Division Clerk at the time of their joining duty.

NOTIFICATION In exercise of the powers conferred by the proviso to
Article 309 of the Constitution of India , the Governor of Kerala hereby makes the following further ameadments to theKerala State and Subordinate Services Rules, 1958, namely :
AMENDMENTS. • In the said rules - 1. In Schedule to Part I, in list III,
" Other Backward Classes in the Kerala State " - (i) between items 4 and 5 the following shall be
inserted as 4 A , namely : * 4.A. Arayavathis
(ii) between items 57 and 58 the following shall be inserted as 57 A , namely :
" 57 A. Sakravar (Kavathi )" . 2. In Partit,
(a ) in Rule 10 (i) in sub-rule (a ) for the words "minimum general
educational qualifications , the words " educa. tional or other qualifications" shall be substituted .
( ii) in sub -rule ( c ) in clause (1) of the proviso, for the words and abbreviations " a degree of B. A., B. Sc., or
B. Com .", the words " a degree of a recognised University shall be substituted . (iii) after sub-rule (c ), the following shall be inserted as
sub -rules (d ) and (e ), namely : " (d ) the upper age limit prescribed in the special

" ( e) In the case of a candidate who is an Ex serviceman , the period of his service in the Defence Forces shall be excluded in computing his age for appointment."
(b ) In Rule 31, the following sentence shall be added at the end of the sub - rule (e ) , namely :
" He shall also be eligible to draw increments in the time- scale of pay applicable to him from the date of commencement of his probation but shall not be entitled to arrears of pay unless otherwise ordered by the State Government."

SPECIAL RULES - ISSUED.
PUBLIC (RULES) DEPARTMENT G.O.MS. No. 1031. Dated , Trivandrum , 4th December 1959.
NOTIFICATION In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India , the Governor of Kerala
hereby makes the following special rules for the post of the Director, Tourist Department, namely :
RULES. 1. Constitution . The post of Director, Tourist Department
shall form a distinct class in the Kerala General Service. 2. Appointment.-- Appointment to the post shall be made by
transfer from any other class or service, or by direct recruit ment.
3. Qualifications.A candidate for appointment as Director of Tourist Department shall possess the following qualifications :
1. ( i) A degree of B. A., B. Sc., or B. Com , of any recognised University.
(ii) Good command of English language and good conversational ability .
(iii) Good general knowledge,personality and polished manners.
(iv) Good knowledge of Indian and European etiquette und habits and manners. (v ) Good knowledge of catering and furnishing and
up -keep « f bungalows. II. Travelling experience at least in India.
III. If recruited direct, must not have completed or will not con plete 40 years of age on the ist July of the year in which applications for appointment are invited
IV . If appointed by transfer, must not have completed 53 years of age on the date of first appointment.

4. Reservation of appointment.-- The rules of reservation of appointment (General Rules 14 to 17) shall apply to pointments by direct recruitment.
5. Probation . - A person appointed as the Director of Tourist Department shall be on probation for a total period of two years on duty within a continuous period of three years.

NOTIFICATION In exercise of the powers conferred by the proviso to Article
309 of the Constitution of India and in supersession of all exist ing orders on the subject, the Governor of Kerala hereby makes the following rules, namely :
RULES 1. Constitution : The post of Town Planner shall form a
separate class in the Kerala General Service. 2. Appointment: Appointment to the post shall be made by
direct recruitment or for special reasons by recruitment by transfer from any other class or service .
3. Qualifications : A candidate for appointment as Town Planner (a ) if he is to be recruited direct, must not have completed
or will not complete 45 years of age on the 1st day of July of the year in which the selection for appointment is made :
(b ) i. Must hold a Degree in Civil Engineering of a recog nised University and
ii. must have had 7 years experience in Town Planning work Or
i. Must hold a Diploma in Civil Engineering of a recognised University or Institution and ii. must have had 10 years experience in Town Plan
ning work Or i. Must be a Member or an Associate of the Town
Planning Institute , London and ii. must have had 7 years experience in Town Planning
work Or i. Must be an Associate or Licentiate of any Institution
or Association of Architects recognised by the Government, and ii. must have had 7 years' experience in Town Planning

Engincers, India , and il. must have had 10 years experience in Town Plan
ning work Or i. Must be an Associate Member of the Institution of

This industrial dispute between the above parties was referred tome by Government for adjudication under section 10 ( 1) (c) of the Industrial Disputes Act, 1947 (Central Act XIV of 1947 by order No. 37188 /L2/59-1 / L & LAD dated 2-7-1959. The question relerred for adjudication relates to:
(i) Denialof employment to Sri Gopalan, Checker . (ii) Arrear wages, if any, due to him .
In pursuance of the summons issued to the parties they have filed their respective statements and during the course of trial of the case the parties have jointly filed a compromise petition settling the dispute between them and it is given below as an 'Annexure '.

“ ( 1) Denial of employment to Sri Sreedharan Nair , (Con ductor ), and (2 ) Wages to Sri C. Sukumaran (Conductor) for the period during which he was kept under suspension " .
On 2-11-1959 to which date the case stood posted for evidence the parties have jointly filed a compromise petition settling the dispute between them and it is given below as an " Annexure" .

AWARD (1 ) This is a reference by the Government of Kerala
(Order No. 52645 /L4 /58 dated 11-9-1958) under Section 10 (1 ) (d ) of the Industrial Disputes Act of 1941 (Central Ac: XIV of 1947) for the adjudication of an industrial dispute between the Managing Director ,Kottayam Orient Bank Ltd., Kottayam and the workmen of the above Bank represented by the All Kerala Bank Employees' Union , Trivandrum in respect of the following matter :

" Denial of Accountant's post to Sri Janardhana Panicker." (2 ) The Union filed their claim siateinent on 28-10-1958 .
The management sulmitted their written stateinent on 7-11-1958. A replication was put in by the union on 6-12-1958 . In l- a ling evidence the union has examined three witnessesWW1 to Ww3 and marked Exts. W1 to W5. The managment in their turn has examined three witnesses EW1 to EW3and proved Exts. El to E12 .
( 3) The union stated their case as follows : Sri A. K. Janardhana Panicker is the Accountant in the einployer Bank . He was appointed as clerk at the Vaikom Branch of tha Orient Central Bank on 1s September 1949. On 2nd May 1951 he was transferred to the Ernakulam Branch where being the seniormost he was working as the Accountant. His signature was registered with the Agency Banks along with that of the Agent for issuing Drafts. From 2-5-1951 onwards Sri A. K. Janardhana Panicker was designated as Accountant and he was enjoying the benefits attached to that post. Asevidenced by letter No 535 ) dated 8-10-1951 from the Head Office, Sri A. K. Janardhana Panicker was drawing his overtime allowance at the rate of Rs. 3 per day as against Rs. 2-5 ) paid to ordinary clerks. In January 1957. A. K. Janardhana Panicker was trans ferred to the Kootlickal Branch by Head Office Order No. 96 dated 3-1-1957. In the abovesaid order the managementrefused to maintain his designation . Sri A.K. Janardhana Panicker reported or du'y at Koottickol on 21-1-1957 and the agent of the Koottickal Branch in his letter No. 337 dated 21-1-1957 had requested the Head Office to clarify his designation . Inspite of the abovesaid letter the Head Office kept silent over the matter. In May 1957 Sri K. S Krishnan Nair, Accountant at the Palai Branch took leave and Sri A. K. Janardhana Panicker was transferred to the Palai Branch in Sri Kris'ınan Nair's place and was asked to attend the work of the Accountant. Towards the en 1 of June 1957 Sri Krishnan Nair was transferred to the Kalaketty Branch . Then the Agent at Palai Branch asked Janardhana Panicker to work in the counter and a mu :h junior clerk to him Mr. Joseph was asked to work as accountant . Janardhana Panicker protested against the action of the Agent and made representation before the management, but the management did not do anything in the matter . Janardhana Panicker was working as accountant ever since he was trans ferred to the Ernakulon Branch . It was Sri Janardhana Panicker who prepared the half yearly returns of the Bank for 1957 as Accountant at the Palai Branch . Nevertheless he was denied his overtime allowances and status as an acciuntant. A person who is much junior to him in service is now working as accoutant in the Palai Branch . The Manageinant has unlaw fully demoted Janardhana Panicker overlooking his valid claims. This action of the manag,ment was illegal and unwarranted . Therefore the union prayed that an award be passed directing the management to restore Janardhana Panicker to his former place as Accountant with all arrears due to him as overtime

allowance at the rate of Rs. 3 per day . The union also submitted that th y were entitled to get their costs in this adjudication .
(4 ) The contentions of the management as embodied in their written statement were these . The management have denied all the contentions of the union 'except these specifically admitted by them . According to them there are only three calegories of employees in the Bank namely officers, clerks and peons There is no category of employees knwn as accoun'ants.
A Clerk is allowed to wurk or must be prepared to work either in the accounts, ledg r, or cash section for the sake of con venience or expediency . When a clerk is asked to work in accounts section in a particular work , it is not a promotion nor is it considered a regular post. A clerk who has been doing the work of an accountant in a particular Branch can be transferred to another branch to do purely clerical work . The places of those who are doing the dities of accountants, cashiers, or ledger clerks are interchangeable. Those who are working as accountants, ca -hiers or clerks get a uniform scale of pay. Sri Janardhana Panicker was a cleark originally at the Vaikom Brinch and then he was transferred as a clerk to the Ernakulam Rranch where he wasworking in the Accounts Section . He was allowed to work in the Accounts St ction not because he was the seniormost clerk 'at the Ernakulam Branch . He was allotted that work on the ground of exp diency. The le ter dated 8-1 -1957 had no significance except that the agent was given a direction that Sri Janardhana Panicker would work in the accounts section . Janardhana Panicker has admitted in his letters that he was only a clerk and was not designated as an accountant when he was working in th :' accounts section. Sri Janardhnni Panicker was transferred from Ernakulam Branch to Koottickal Bran h on 21-1-1957 and he was working as a clerk there till 3-6-1957 without protest. Extra overtime allowance was used to be given to clerks who were working in the accounts section , not becausetey were appointed to a higher post or grade but because it was in consideration of extra and responsible work in consolidating various statements ets. In tie absence of such work . Sri Janardhana Panickerwis entitled to get only the rate allowed to cle :ks who have no extra work to do. No order appointing Sri Janardhana Panicker as an accountant either in the Ernakulam or any other Branch was ever given to him . If atall he was allowed to sign drafts when he was in charge of the accounts section at Ernakulam , it was only to complete certain formalites which in itself does not confer a superior status. When an employee works either as a clerk or works in the accounts sectio and so long as the emoluments are the same and the places are interchangeable, it does not invove the question of pro notion or demotion. Liability to tr.nsfer from one section to another is an ordinary iecident of service. And transfer fron one section to another without affecting one's salary butwith less chances to work and earn overtime wages cannot be considered as involving any alteration of the conditions of service. Even assuming, but not admilling, that there was change in designation , a mere change .

in the designation of an employee without affecting his service conditions would not give rise to an industrial dispute even . The fact that in the new section , the concerned workman would have less chance to earn overtime wages n ust be held to be irrelevant as an employee'has no right to claim cvertime work . The employee's designation has not been shown in the transfer order as it was not necessary. The clerk who was in the accounts section in any Branch of the Bank is not in any way superior to any other clerk in the matter of rank or grade or salary . Sri K. Joseph was working in the accounts section when Sri Janardhana Panicker was transferred to the Palai Branch . K. Joseph had put in 8 years' service and he is a graduate in Arts and Commerce whilst Sri Panicker is only an E.S. L. Certificate holder. Experience and qualification are factors to be taken into consideration in the matter of allocation of work . The allocation of work to employees is purely an in ternal matter and it is within he discretion of the management. The demand of the union to appoint Sri Panicker as an accountant and to pay him arrears of overtime allowance at the rate of Rs. 3 cannot be allowed under any circumstances. The action ofthe Bank was consistent with the practice and pro cedure followed from the very inception of the Pnk . The management therefore prayed that their contentions be upheld .
(6 ) In the replication filed by the union they have con troverled all the contentions raised by the management. They added further that Janardhana Panicker has never admitted in his letter that he was not designated as accountant; that accountants were recognist d as a category of employees in the Bank ; that the post of an accountant is superior to that of a clerk ; that demotion of an accountant to the post of a clerk is a clear alteration of the conditions of service; that the appoint ment of Sri K. S. Joseph as accountantoverlooking the claims oí Sri Pani ker is against all established conventions and social justice; and that therefore the demand of the union to maintain the status quo with regard to Sri Panicker is only just and legal.
(1) In the light of the pleadings the issue was settled as follows : (i) is the denial of an accountant's post to Sri Janardhana
Panicker by the employer Bank justified ? (ii) To what relief is Sri Janardhana Panicker entitled
if the denial is found to be (a ) justified or (b ) not justified ?
(iii) Costs. (8 ) Issue (i) . On behalf of the union it was argued by Mr. K. P. Chellappan Nair that Sri Ja ardhana Panicker was an accountant or the
an ' ever since 1951; that the accountant's place is one of status

and dignity which carried certain rights and privileges; that the denial of the accountant's place to Sri Panicker when he was transferred from Koottickal to Palai Branch is an alteration of his conditions of service ; that it amounted to a demotion . As against this Mr. M. C. Varugis the learned counsel for the management urged that in the employer Bank there is no category of employees designated as accountants that according to the rules of service of the Bank there are only three categor.es of employees viz., officers, clerks and peons; that Janardhana Panicker wasnever appointed as an accountant at any time and that the Agents of the respective Branches allot thework to clerks according to their discretion . Now the whole issue hinges on the question whether there was a category of employees called accountants in the employer Bank and if so whether that place was denied to Mr. A. K. Janardhana Panicker. In the claim statement of the union they have admitted that Sri Panicker was transferred from the Vaikom Branch to the Ernakulam Branch in 1951. Ext. El is the order of transfer . It is dated 24th April 1951. The designation of Janardhana Panicker as shown in the transfer order is 'Clerk ' so that it is safe to infer that in 1951 Sri Janardhana Panicker was only a clerk in the Employer Bank . Ext E7 is the Rules of Internal Organisation Staff Regulations and Rulesof service of Orient Central Bank Ltd., Kottayam . WW1and WW2would admit that these rules are in force and that all the employees of the Bank are bound by it. These rules came into force on 1st September 1916. We do not come across a category of em ployees in Ext. E7 called Accountants. Rule 32 reads as follows : - " Salary scale increments , allowances and giades ofemployees of agents and clerical staff are to be in creased or reduced at the discretion of the management in con sideration of change of time, status and position of the in stitution ." Similarly Rule 14 lays down " All employees shall while they are in the Bank's service, serve the Bank in its business in such capacity and at such place as they may from tiine to time be directed" . The union has not produced the order appointing Sri Panicker as Accountant. As per the pro visions in Ext. E7 promotion , transfer and assignment ofwork is purely a management function . Sri Janardhana Panicker was working in the account section in the Ernakulam Branch for 5 years and 5 months i e., from May 1951 uptill October 1956 . Ext. E2 is an application for privilege leave for one month by Panicker to the Managing Director of the Bank. It is dated 13-9-1956 . The designation put down by Sri Paaicker himself in Ext. E2 is " Clerk , Ernakulam Branch." Ext. E3 is another application from Mr. Panicker to the Managing Director for the extension of his Privilege Leave for a few days more. I. Ext. E3 also Sri Panicker styles himself as Clerk . Ext. E4 is the order d.ted 9-1-1957 transferring Sri Panicker from Ernakulam Bianch to Koottickal Branch . Ext. E6 is the order dated 30 h May 1957 transfer ing Sri Panicker from Koot ickal Branch to Palai Branch . In either of these orders has Sri Panicker been designated as accountant. Ext. E8 and E9 are the acquittance
roll of the Bank for the relevant periods. In both these books the designation given to Janardhana Panicker is Clerk . Ext. E10 is the true copy of a requisition dared 4th October 1956 from the Ernakul m Branch to the Head Office for the supply of some specimen signature cards in the aboves and requi ition Sri Jarardhana Panicker is described as a clerk. Ext. 612 is the reply sent to the Agent, Palai Branch from the Managing Director dated 27th July 19 7 regarding a representation for warded to the Head Office from Sri Janardhana Panicker. The reply stated that Janardhana Panicker was posted Palai Branch as a ledger clerk; that there are only three categories of employees in the Bank viz., officers, clerks and peons; that whether one is designated accountant or cashier nevertheless he is also included in the category of clerks all of whom have a uniform pay scale; that all clerks have to be prepared to work in the cash section , accounts section or ledger section ; that there is no understanding that onewill be put in the same section always when he is trans erred or is working in the same office and that orertime allowance at an increased rate is given to the accountant not because he is appointed in a higher grade but only in consideration of the extra work he has to do in consolidating various statem nts, Reserve Bank Returns etc. EW2has sworn to the fact that it is the ag nt of the Branch who allots the work of the clerks under hun. The manage nent has not ellected any change in the emolu nents drawn by Janardhana Pani. ker. That fact is admitted by WW : 1, 2 and 3 . There were clerks and cashiers in the Bank who were drawing higher salaries than those working in the account section As against the above, th : union has relied on the following items of evidence . Ext. W1 is a certificate issued by the Agent of the Ernakulam Branch in favour of Janardhana Panicker on 18-1-1957. It is stated in the certificate that Janardhana Panicker worked under the agent as a clerk and accountant for six years. Ext. W2 is the letter sent to the Agent of the Erna kulam Branch by the Managing Director on 8-10-1936 in reply to his letter No. 4640 dated 4-1 1-1956 . The reply concluded w.th the statement that Sri A. K. Janardana Panicker leave would be the accountant at the Ernakulrm Branch and that SiMuhan Das who was promotod as 'accountant in view of his qualifications would be junior to Sri A K. Jan ardiana Panic er. Ext.W3 is the copy of the transfer o der i sued to Janardhana Panicker by the Agent of the Ernakulam Branch on 16-1-1957. The order stated that Sri A.K. Janardhana Panicker, Accountant of the Branch is relieved from duty on 18-1-1957 . Ext. W5 is a circular issued by the Managing Director to Sri N.Mohan Das on 2nd July 1956 in rely to his representation regarding hs promotion . The circular stated that in con sideration of his having secured his B. Sc. Degree examination , the managen.ent would give him a promotion in his grade as accoun ant and enhancement in his salary with effect from 1-1-1956 in accordance with the scale allowed to graduates.
From a comparison of the foregoing evidence the conclusion that dawns upon me is that there was a desigaation called accountant

in the service of the Bank and that it fell under the general category of clerks. It was then argued by Mr. Chellappan Nair that denial of that place to Janardhana Panicker at Palai Branch was an a teration of his conditions of service and that it was unjustified . It is very clear from the Rules of service which I have quoted above that promotion or transfer from one grade to another was purely a management function . It has been laid down in a series of rulings that even a change in the designation would not amount to an alteration of the conditions of service.
(Vide 1954 (1 ) LLJ 877 at 881, 1955 ( 1 ) LLJ 634 and 1957 ( 1 ) LLJ 373) . Lastly it was urged by Mr. Chellapp in Nair that one K. S. Joseph was asked to work in the acount section at Palai Branch in preference to Sri Janardhana Panicker. It has come in evidence that Sri K. S. Jos ph is more qualified . Joseph is a B. A., B. COM ., whereas Sri Panicker was only an E. S. L. C. WW2 was a clerk very much junior to Sri Panickerwen be was working at the Ernakulam Branch . But now WW2 is promoted as an A - sistant in the Head Office. Mr. Panicker has not raised any complaint against this act of the management. Eventhough Joseph was given the work of accountant in the Palat Branch Sri Janardhana Panicker's emoluments have not been affected. It is true that some extra allowance is given to the accountants for the extra work they do. In the light ofthe foregoing facts and circunstances. I hold that the denial of acc vuntant's post to Janardhana Panicker by the Employer Bank is justified. Issue found against the union .
( 9) Issue No. (ii) In the light of my finding on issue No. (i) Janardhana
Panicker is not entitled to any relief. Issue found accordingly . (10) Issue No. (iii)
In the circumstances of this case, I do not make any order as to costs. Both parties will bear their respective costs. Issue found accordingly .

(2) The union filed their claim statement on 29-12-1958 . The M nagement pit in their counter un 7-1-1959 On the abovesaid date the management also filed a peti'ion to implead Sri Yousuf Hamsa the Moppen in the company on the ground that he is a necessary and proper party in the adjudication. Notice of this petition was given to the union and Sri Yousuf Hamsa and after he ring all the parties Sri Yousuf Hamsa wis im ; leaded as an additional pa ty by my order dated 7-4-1959 A replication was submitted by the union on 16-1- 959. The union has examined two witne ses and marked Exts . W1to W3. The management on their side examined one witness and marked Exts El to E3.
(3) When evidence in the case vas being recorded , the par ies seemed to hae resolved their differences and on 18-11-.959 the followig compromise petition signed by the

1. This dispute was referred to this Court for adjudication by order No. 36063/L5 /53-1 of the Labour and Local Adminis tration Department, Government of Kerala dated 19-6-1958 . The only issue referred to adjudication is "whether or not the non-employment of driver P. Kunhammad by the proprietor of Udma Gods Transport is justifiable ? In either case, to what relief the employee is entitled to ? "
2. The Union filed its statement of the case on 14.8-1958. The management did not accept notices from this Court and was finally declared exparte on 24-10-1958 . The union evidence

was recorded on 4-11-1958 and an exparte award was passed on 8-11. 958 and the sa ne was published in Kerala Gazette No. 47 dated 2-12-1958 . The management filed a petition to set aside the exparte award on 28-11-1958 and the same was allowed Subsequently the management filed their reply statement on 7th March , 1959.
3. In the statement of the Union , it is contended , that the driver ShriKunhammad was employed under the minagement on 14.10-1955 , and was dismissed on 3-11-1957. The dismissal of the worker was without assigning any reason . Even the salary due to the worker for five months from June, 1957 up to the end of October, 1957 was not paid. The driver was getting a monthly salary of Rs. 121 besides Re. 1 daily ba ta . The Union makes a prayer for the reinstatement of the worker with back wages and continuity of service .
4. In the reply statement of the management, it is .con tended that the driver was employed only on 3-1-1957 and was in th - ir service till 3-11-1957 . He was employed in lorry MDX 2713 and the permit to the management wus issued only on 3-11 1957. The driver was paid at the rate of Rs. 100 per month . According to the managment they have paid all the salary amounts du- to the driver and nothing is due to him . There was no arrangement to pay him any daily batta . He was paid an. ad hoc allowance of Rs. 10 mnt.ly. It is contended by the
management that they have not dismissed the worker. He ceased t ) come from 3-11-1957. He was sent for by management but refused to come for work . The worker, was only employed temporarily and he was not a pernianent worker under the management. The worker,when in service, was very irregular in his work and has been warned several times and during his absence the man gement had to employ others. According to the management the driver is not entitled to any relicf and the dispute has only to be dismissed . The union did not file any rejoinder.
5. The Union examined the worker and did not mark any documents. The monagement exainined the proprietor and marked Exts . M1 to M4.
6. The union contends that the worker was in the service of the management from 14-10-1955 to 3-11-1957 . On 3-11-1957 the proprietor refused employment to him on asking his .5 month arrears of salary accrued from June 1957. He was paid monthly Rs. 120 besides Re. 1 daily batta. According to the union the r -fusal of employinent is unjustifiable viewed from any aspect of the matter. The proprietor on the other hand con tends that the worker was in his employment only from 3-1-1957 to 3-11-1957 for a period of ten months. The salary of the worker was only Rs. 100. He was not paid any daily batta . According to the proprietor the worker has been paid all his arrears or salary and nothing was due to him . The proprietor contends that the worker refused to come for work from 1-11-1957. Two or three personswere sent for to call the driver but he refused to join work . The worker sent word through

thern stating that he was not joining duty . Therefore the pro prietor employed other persons. Suosequently the lorry was also sold andhe is not having any transport business at present.
7. The shortmatter that arises for consideration is whether it is a case of denial of work by the proprietor to the worker or the worker 'abandoning work and gomg away. The pro . prietor in his evidence has stated that he sent two or three persons to fetch the driver But in spite of that the driver did not come. Nothing written has passed between the parties re garding thismatter. I really the proprietor did send two or three per ons asking the driver to join duty he could at least have exainined one of them which he did not do. If any such person is available hewould have given the true version of the mater. The lorry driver was paid monthly Rs. 100 and it is notlikely that any one would carelessly avoid to attend the work and cause the loss his employment. The worker was all along anxious to get work and the union has taken all the trouble to get his reinstatement. From the circumstance I am of opinion that it is a case where the proprietor has terminated his appointment without he service of any charge sheet or show 'cause notice and also without justifiable reasons,
8. The Union contends that he was in the employment of the proprietor from 14-10 1955 to 3-11-1957, for a period 2 and odd years. These cannot be true. The work - r concerned was the driver ir lorry umber MDX 2713. The proprietor got the G perinit for the lorry Ext, M2, only on 3-1-1957 . She was not owning the lorry previous to that period . The service of the worker as driver under the proprietor cannot be traced for any period earlier than the date on which the proprietor becoming the owner of the vehicle . The worker was in the service of the proprietor only for a period of len months. There is no question of way reinstatement. The lorry MDX 2713 was already sold . According to the proprietor the monthly salary of the worker was only Rs. 100 with an allowance of Rs. 10. Ext M3 is an account book mai tained by the proprietor from which it is seen that themonthly pay of the worker was only Rs. 100 with an allowance of Rs 10 Theworker was not given any notice be fore terminating his service. So he is entitled to one month's notice pay.
9. This dispute was declared exparte at first and subse quently on the application of the proprie or the same was set aside on paymeot of Rs. 25 cost. Now the Union Secretary Advocate Sri Krishnan Nair has led a bill showing the expenses incurred by him for co ning to Cout in connection with the ex parte matter. According to the bill the total expense actually mut by him comes to Rs. 58 P. 52 out of which Rs. 25 was paid on 6 2-1959 when the exparte was set aside. Actually Mr. Krishnan Nair, the Advocate for union bad to meet the expense shuwn in the bill. He had to come to Calicut from Kasargode twice in conne tion with the exparte matter . The unpaid portion of the bill comes to Rs. 33 nP . 52 .
10. Towards compensation for sevice for one year I award onemonth's salary and also notice pay for one month . The
union has to incur Ils. 58.52 in connection with the setting aside of the exparte matter of which Rs. 25 was paid . The proprietor also will pay th balance of Rs. 13 np . 32. So altogether I award Rs. 33nPs. 52 to the uniun . The proprietor, U. M. Ummer, UdmaGoods Transport, Kalnad Villac, Kasargode Taluk will pay the same on the date of the award becoining entorceable .
11. The Union contends that from June, 1957 ihe pro prietor has not paid he alary of the worker. It is vehemeatly opposed by the prop irtor. According to him all arrears of salary has been paid . The matter referred to adjudication is only regarding the non-employment of the worker. So the question of the arrears of salary is left open The union is at liberty to move the matter before the appropriate authority and get the reliel, if they think, it is advisable to do.
12. The proprietor Sri C. M. Ummer, Udma Transpo ts, Kaload Village,Kasargode Caluk will pay Rs. 233 P. 52 io the Union on the date ofthe award beco nin enforceable Parties to suffer their respective costs in this proceedings. This dispute was referred to adjudication by order No. 66104 /L5 /58 1 of the Labour and Local Administration Department of the Government of Kerala dated 19-11-1958. The issues referred to adjudication are the following:
(1) Non -employment of Sris . M. K. Narayana Kurup, M.K. Gopalan , P. anaran and C. K. Kannan . (2 ) Back wages from 1-1-1958 to 30-10-1958 to Sri C. K , Kumaran . (3) (a ) Non -emyloyment of Sri C.K.Kumaran .

2. In the statement of the Union it is contended that the four workers whose names are referred in issue No. 1 were dismissed by the management from 10-10-1957 and Sri C. K.Kumaran the worker whose name is referred to in issue No, 2 was dismissed from 1-1.1958 . The first four workers were paid R. 2-50 daily and the last one was monthly paid employee on Rs.60. All of them have put in long years of service under the management. All of them were dismissed by the minagement without any charge sheet and e quiry . The only reason for their dismissal is their joining the Badagara Taluk Oil MJI Workers' Union . After joining the union the
workers complained to the authorities that the management is not keeping wage-Register in the mill. Following this the Assistant Labour Officer inspected the mill and found several irregularitits. The labour officer took action against the management after the inspection . From 10-10-1957 the manage ment locked out the factory. The officers of the labour Depart ment took up the matter and arranged conciliation conferences. In the agreement that followed the management undertook to open the mill and provide work in rotation . But the manage . ment refused to give work to the four dismissed workers . Sri C , K. Kumaran took leave from 9-11-1957 to 31-12-1957 for treatment. He presented for work on 1-1-1558 but was refused employment. The union prays to reinstate all the workers with back wages and continuity of service .
3. In the reply statement of themanagement it is contended that the first four workers were not in the employment of the management. They were not the workers under the manage ment. The management mill is a very small one with three permanent workers. The management used to engage casually the first four workers , when there is extra work . They have worked in the mill for a very few days. They have no claim whatsoever for reinstatement. Shri C. K. Kumaran was an employee in the mill till 8-7-1957. From 9-11-1957 he has not turned up for work . It is not correct to say that he was dismissed on 1-1-1958. He is not also entitled to any relief. The union also filed a rejoinder controverting the allegations
in themanagement statement: 4. After recording the union evidence in part it was
possible to settle the matter on terms and conditions given in the compromise deed given below as Annexure. The manage ment agree to pay the first four workers Rs. 150 each and the fifth worker Rs. 600 in full and finalsettlement of all their claims. I pass the award OD terms and conditions given in the Annexure and the same shall become enforce ble after 30 days of its publication in the Government Gazette . Calicut, V. U. JOSEPH 14-11-1959. PROCEEDINGS. The Civil and Gradation list of the Ministerial staff of the
Public Works Department as on 1-4-1954 was approved by Gov ernment provisionally in G. P. read as first paper above. The list was published in the Government Gazette and circulated among the staff of the Public Works Department, inviting appeals, if any, to be presented within one month after such publication .
2. The representations so received from the staff were care fully examined with reference to their service particulars and other relevant orders and appropriate decision taken on them by Government. The decisions taken have been communicated to the persons concerned under intimation to the Chief Engi neer (General and Projects ) .
3. On the basis of the decisions taken on the petition and on the proposals made by the Chief Engineer, necessary cor rections have been made in the Civil and Gradation list. Gov ernment are pleased to declare the Civil and Gradation list of the Public Works Department as on 1-4-1954 as final, subject to the modifications and corrections so made.
4. No more petitions questioning the rank or seniority in the final list will be entertained .
5. The following cases require mention . The rank of Sri K , Gnaneswaran (item 412 in the provisional list ) just below G. 2802
Sri. P. K. Daniel item 441 in the provisional list was refixed in G. O.MS.218 |PW . dated 26-3-1959 with reference to the date of his joining duty as clerk i. e., 11-12-1952 . But it was subse quently reported that, the date of joining duty is 4-12-52 and so the refixation of rank ordered in the G. O , referred to is not necessary . Sri Gnaneswaran is therefore assigned the rank he is given in the provisional list. Based on the refixation of rank ordered in the case of Sri Gnaneswaran, Sri K. Narayanan Nair was declared senior to Sri Gnaneswaran in G , O. MS. 218 PW ., dated 26-3-1959. As there is no change in the rank assigned to Sri Gnaneswaran , orders in respect of refixation of rank of Sri Narayanan Nair also is cancelled .
6. A copy of the final list is forwarded to the Superintendent of Government Presses for publication in the Gazette . He is requested to furnish 50 copies to the Public Works (Establish ment A ) Department and 500 (five hundred ) copies to the Chief Engineer (General and Projects) .

G. S.R. 1176 - Ess. Com /Sugar - In exercise of the powers conferred by clause 7 of the Sugar ( Control) Order, 1955 , the Central Government hereiy directs that unless otherwise permitted by the Central Goverrment:
(a) all sugar manufactured by vacuum pan process with effect from 1959-60 season shall be sold by a producer packed in new A Twill jute bags, each bag being 44 ' long 261' wide and weighing 2 : 5/8 lbs.
(b ) each such bag shall contain ? maunds and 30 seers (102.6 Kilograms) ( a maund being of 82 2/7 1b.:) or , alternatively 100 Kilograms (2maunds 27'17 seers) sugar nett. The first alternative shall continue for a period of 2 years with effect irom the 1st November 1959.
(c) each such bag shall bear on it the name of the place where the producer carries on the business of manu facturing sugar by vacuum pan process, the quality of sugar at the lime of delivery in terms of the Indian Sugar Standards in force at the time ofmanufacture . the quantitative contents of the bag, and the season of production of the sugar contained therein and that each bag containing sugar manufactured at the following vacuum pan sugar factories shall also bear , after the name of place of manufacture, the words as shown against each :

Bye-laws for the collection of License fees fixed under : section 80 of the Panchayats Act II of 1950,
1. No place within the Panchayat area shall be used for any one or more of the purposes mentioned in the table of license
fees appended , without a license from the Executive Authority of the Panchayat
2. Applications for licenses shall be made in writing to the Executive Authority , in the prescribed printed form , which can be had at the Panchayat Office on payment of 12 np. each , along with the license fee prescribed for, as per the table of license fees annexed .
3. Every licensee shall observe the following directions : (i) He shall at the close of every working day cause the
place to be cleaned . (ii) He shall at the saine time cover all refuse , frag
ments of animal or othermatter which have fallen or been deposited upon any part of the place or premises to be collected and placed in a suitable receptacle to the satisfaction of the Executive Authority.
4. The licensee shall cause every part of the internal surface of the walls of any building and every floor and pavement upon the said premises to be kept at all times in good order and repairs so as to prevent the absorption therein of any liquid , filth or refuse or any noxious or injurious matter, which may be splashed or may fable therein .

2 5. The licensee shall cause every drain or means of d :a'nage
upon or in connection with the said premises to be maintained at all times in good order or repair. 6. No person suffering from eruption of skin of any sort or
affected with leprosy or open sore shall be employed on any premises used for the trade.
7. The licensee shall put a sign -board containing his name Together with the No. and purpose of the license, in a conspicuous part of the place in respect of which the license is granted .
8. A breach of any these byelaws shall be punishable with a fine which may extend to fifteen rupees and in case of a continuing breach with fine which may extend to five rupees for every day during which the breach continues after conviction for the first breach .
