  • FOREWORD

    This report provides an overview of juvenile court dispositions in Pennsylvania during 1991 and summarizes information provided by county juvenile probation departments.

    The report would not be possible without the funding support of the Pennsylvania Commission on Crime and Delinquency, and the information supplied by the courts of common pleas and juvenile probation departments (,f this Commonwealth.

    The format of this report has been redesigned with the assistance of a committee developed with the help of the Pennsylvania Council of Chief Juvenile Probation Officers. This dedicated committee included Earl Stoudt, Chief Juvenile Probation Officer in Lancaster County; Kenton Scott, Chief Juvenile Justice Officer in Jefferson County; Regis Tyber, Assistant Director of the Westmoreland County Juvenile Probation Department; James Boylan, from the Juvenile Court Judges' Commission, and Linda Bender, Sharon Chamberlin, John Lemmon and Marcy Szumanski from the Commission's Center for Juvenile Justice Training and Research at Shippensburg University.

    In an effort to enhance the presentation of data, new tables, graphs and charts have been included. Others have been modified or deleted. Although the report focuses primarily on delinquency dispositions, please note that information has been included this year on dependency cases which have been referred to juvenile probation departments. While county children and youth agencies handle the overwhelming majority of cases involving dependent children in the Commonwealth, some juvenile probation departments provide services to children who are alleged to be dependent on the basis of ungovernibility or chronic truancy.

    The information contained in this report is of value to all individuals, agencies and organizations having an interest in Pennsylvania's juvenile justice system. However, it is not intended to reflect the total workload of juvenile courts or juvenile probation departments.

    It is with great pleasure that we dedicate this report to the judges, probation officers, and other professionals who work on a daily basis in the interest of their communities and the young persons who have been entrusted to their care.

  • PREFACE

    This report is a compilation of the data collected from the juvenile probation departments in the Commonwealth of Pennsylvania. A sample of the statistical card used to collect the information can be found in the appendix.

    As in the past, to avoid confusion regarding the unit of count used in tabulating Juvenile Court statistics and to improve the understanding of how data can be interpreted please note:

    1. The primary unit of count is the "DISPOSITION". A "DISPOSITION" is defined as a referral disposed by the probation department and/or the court. Within a single delinquency referral, a youth may be charged with a number of offenses which may include a number of petitions, anyone youth may be involved in a number of dispositions within a calendar year. In addition, a youth may be referred on more than one occasion and receive only one disposition. Dependency dispositions reported on pages 34 and 35 include only referrals to probation departments alleging dependency which are not accompanied by allegations of delinquency. Therefore, one is cautioned NOT to attempt to interpret the data as:

    a) the number of youth who are processed by the court;

    b) the number of offenses charged to juveniles.

    2. There are times when you will see the word "CASE" used to describe the data. In this report the word "CASE" is used interchangeably with the word "DISPOSITION";

    3. Therefore, the "UNIT OF COUNT" refers to a case disposed by a juvenile court and/or probation department. The term" DISPOSED" means that some definite action/decision has been implemented or that some treatment plan has been decided upon or begun;

    4. The statistical system is constructed to collect up to a total of the four (4) most serious offenses per delinquency disposition;

    5. The Commission collects additional information on "PLACEMENT REVIEWS", "DISPOSITION REVIEWS", and selected special conditions attached to a disposition. The "DISPOSITION REVIEW" is a hearing conducted before the court regarding a previous disposition which did not result in out-af-home placement. A "PLACEMENT REVIEW" is a hearing conducted before the court regarding a previous disposition which did involve out-of-home placement. The outcome of reviews are reported only on pages 36 through 39 and are NOT included in any of the other tables.

    6. The data in the Secure Detention section on pages 24 through 27 were collected pursuant to the Commission's monitoring responsibility under the Coleman Consent Decree. This information should not be compared with the dispositional detention data collected and reported prior to 1989.

    NOTE: Chester County data were unavailable for 1991. Data from 1990 have been inserted to more accurately reflect the state totals and allow for comparisons to previous years.

  • DELINQUENCY DISPOSITIONS

    The information in this section includes those cases referred to juvenile probation with alleged delinquent offenses. Disposition and Placement Reviews and dispositions involving children alleged to be dependent are not included.

    There were approximately 31,000 delinquency related dispositions in Pennsylvania during 1991. This total includes 300 cases processed by Chester County in 1990. The 1991 information from Chester was unavailable, therefore their 1 990 data were included throughout this report in order to allow for comparisons to previous years.

    Probation was the most frequently utilized disposition (22.3%) followed in descending order by Informal Adjustment (16.4%), Placement (11.7%), Consent Decree (9.8%), Warned/Counseled (9.6%), Complaint Withdrawn (9.0%)' Other (4.6%) and Dismissed Not Substantiated (4.5%). All remaining dispositions totaled 12.1 %. The disposition of Transferred to Criminal Court still remains around 1 % of the total. Probation with Day Treatment is listed as a separate disposition rather than being included in Probation as it was in the previous reports.

    When comparing these figures to previous years, note that the disposition and placement reviews are not included. The reader is directed to TABLE 4A of previous years' reports for an accurate comparison to the table on pages 10 and 11.

    There was a 4.1 % increase in delinquency dispositions from 1990 to 1991. Dispositions of new charges in Philadelphia county decreased by 7.5% and Allegheny county dispositions increased by 9.1%.

  • TIME LAPSE FROM REFERRAL TO DISPOSITION FOR DELINOUENCY CASES, 1991·

    Time lapse information is calculated from the date of referral to the date of disposition. As with all the previous tables, disposition and placement reviews and dependency cases are not included. This year, the dispositions are grouped into one of two categories, formal and informal. A disposition is counted in the formal category if a date was located in the Date of Hearing field on the statistical card (an example of the card is included in the appendix) indicating that a formal court hearing was conducted.

    The median is used in place of the mean or average for better accuracy in reporting. The mean can be affected by one extreme case that required a long time to dispose, while the median would not be affected. The median is defined as the value above and below which half of the cases fall.

    A disposition of placement refers to an out-af-home commitment for the juvenile. Placements account for 11.7% of the total dispositions of new referrals.

    Institution, Privatfl refers to private sector facilities which typically house twenty-five or more juveniles. The open settings of the Youth Development Centers operated by the Department of Public Welfare are counted in the Institution, Public column. Secure, Public placements are the secure Youth Development Centers, with Alternative Rehabilitation Communities and Concern providing the Secure, Private facilities. Vision Quest placements are reflected in the Outward Bound, Private category unless the group home facility is specifically reported on the data card. The Youth Forestry Camps are counted in the Outward Bound, Public category.

  • DELINQUENCY OFFENSES

    The four most serious offenses, alleged and substantiated, per disposition are collected. For the report, they have been collapsed into categories. Grouped into the Person category are offenses such as simple assault, aggravated assault, rape, robbery, etc. Property offenses include burglary, all thefts, criminal trespass, vandalism, and other related offenses. All of the offenses (up to four) and their counts are reported in the two data tables.

    The most serious alleged offense per disposition was used to create the line chart on page 23. It shows the trends, from 1987 to 1991, of rape, robbery, aggravated assault and drug offenses. While aggravated assault has the largest increase from 1987 to 1988 (15.9%); robbery has decreased since 1987, and rape, as a most serious alleged offense, has remained fairly constant. Drug offenses increased sharply from 1987 to 1989 ( a 96% increase) and then began to decline from 1989 to 1990 (a 13.2% decrease).

  • SECURE DETENTION

    The federal class action suit Coleman v. Stanziani, Civil Action No. 81-2215, was settled via Consent Decree in 1986. In that settlement, the Juvenile Court Judges' Commission was assigned responsibility for monitoring compliance with the terms of the Consent Decree and the Standards Governing the Use of Secure Detention.

    Detention information appearing in the Disposition Report was extracted from the Coleman database housed at the Center for Juvenile Justice Training and Research. The tables, and more detailed information on detention use, can be found in the biannual monitoring reports the Juvenile Court Judges' Commission submits to the Attorney General, the Juvenile Law Center, and all other counsel to the litigants in the Coleman case.

    In accordance with the Consent Decree, all counties, except Philadelphia, must report their secure detention use to the Juvenile Court Judges' Commission. This is accomplished statewide through the detention centers. Each month 20 of Pennsylvania's 21 secure juvenile detention centers report their detention admissions along with Statements of Facts and Reasons that accompany each admission. Philadelphia County is not included in this reporting system.

    To avoid confusion in the interpretation of the data contained in these tables, the reader should note the following:

    The unit of count is the admission of a juvenile to a secure detention center;

    A juvenile admitted to a secure detention center in the county of residence who is transferred to another secure detention center without release is counted as two admissions.

    STANDARDS GOVERNING THE USE OF SECURE DETENTION UNDER THE JUVENILE ACT

    Circumstances under which secure detention may be authorized on the basis of an alleged offense or on the basis of an alleged offense and the child's current status with the court or prior record.

    Circumstances under which secure detention may be authorized on the basis of a child's status as an absconder or fugitive; on the basis of a child's record of failing to appear at previous juvenile proceedings; or because of extraordinary circumstances which require secure detention to prevent a child from ebsconding.

    The child is an absconder from an institution or other placement to which he/she was committed as a result of a previous adjudication of delinquency.

    The child presents extraordinary circumstances requiring secure deter.';on to prevent him/her from absconding.

    Circumstances under which secure detention may be authorized on the written request of the child or child's attorney.

    Circumstances under which secure detention may be ordered pending disposition, subsequent to a finding that a child committed a delinquent act 0; is a delinquent child.

    Circumstances under which secure detention may be ordered following disposition pending transfer to plecement.

    Since the Coleman Consent Decree went into effect in 1 986, admissions to secure detention in Pennsylvania have increased each year. In 1987 there were 5,875 admissions and in 1991 there were 9,800 admissions; This represents a 67 percent increase in statewide secure detention use. This does not include Philadelphia County, where secure detention activity is controlled by the settlement in Santiago v. City of Philadelphia, Civil Action No. 74-2589.

    There has been an increase of 16.3 percent in detention admissions from 1990 to 1991. The average length of stay for all counties reporting under Coleman remained fairly constant at slightly more than 15 days. The Coleman Monitoring Reports show the fluctuations in the individual counties in total admissions and average length of stay.

    The chart on page 27 shows utilization rates in secure detention centers in 1991. It should be noted that a number of these centers provide services to several counties on a regular basis. York County appears twice because the facility relocated mid-year and increased the licensed bed capacity. In the 1 5-bed facility the rate was 87 percent for the time period of January 1, through June 17, 1991. From June 18 through December 31, 1991, the 92 percent rate applies to the new 24-bed facility.

    In 1991, the Commission began collecting information on dependency dispositions which are processed by juvenile probation departments. These figures do not reflect the total number of dependency cases in the Commonwealth nor do they represent the total number of dependency cases handled by juvenile probation departments. A dependency case is defined as a new referral which is processed by the juvenile probation department and does not have accompanying delinquency allegations.

    Only the counties that reported dependency dispositions are shown in the tables in this section.
