The Police Jury of the Parish of Ouachita, State of Louisiana met in regular and legal session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana on Monday, June 1, 2009 at 5:36 p.m., and was duly convened by Mr. Shane Smiley, President, who stated that the Police Jury was ready for the transaction of business. department. Discussion ensued. The president indicated that this item was on his agenda and asked if there was any objection to taking the matter up at this time. There was no objection. Discussion ensued again. The following resolution was offered by Mr. Smiley and seconded unanimously by the jury.

RESOLUTION NO. 09-49

A RESOLUTION ORDERING AND CALLING A SPECIAL ELECTIO N TO BE HELD IN FIRE PROTECTION DISTRICT NO. ONE OF THE PARISH OF OUAC HITA, STATE OF LOUISIANA (THE “DISTRICT”), TO AUTHORIZE THE LEVY, ASSESSMENT AND COLLECTION OF A SPECIAL TAX THEREIN; MAKING APPLICATION TO THE STATE BOND COMMISSION IN CONNECT ION THEREWITH; AND PROVIDING FOR OTHER MATTERS IN CONNEC TION THEREWITH.

BE IT RESOLVED, by Ouachita Parish Police Jury (the “Governing Authority”), acting

as the governing authority of Fire Protection District No. One of the Parish of Ouachita, State of Louisiana (the “District”) that:

SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and

under the authority conferred by Article VI, Sections 26 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5 and Chapter 6-A of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the Parish on SATURDAY, OCTOBER 17, 2009, between the hours of six o’clock (6:00) a.m., and eight o’clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

Shall Fire Protection District No. One of the Parish of Ouachita, State of Louisiana (the “District”), through its Governing Authority, be authorized to renew the levy, assessment and collection annually of a special tax of 19.11 mills on the dollar of assessed valuation of all the property situated within the limits of

the District for a period of ten (10) years, commencing in the year 2010 and ending in the year 2020, for the purpose of maintaining and operating the Fire Protection District’s fire protection facilities and obtaining water for fire protection purposes? The amount reasonably expected to be collected from the levy of this Special Tax for the first year will be approximately $6,783,185.00.

SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in The Ouachita Citizen, a weekly newspaper of general circulation within the Parish, published in West Monroe, Louisiana, and being the official journal of the Police Jury, once a week for four consecutive weeks, with the first publication to be made not less that forty-five (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as “Exhibit A ” and incorporated herein by reference the same as if it were set forth herein in full. SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, Police Jury Meeting Room, Ouachita Parish Courthouse, 300 St. John Street, Monroe, Louisiana, on ______________, October ______, 2009, at ____________ O’CLOCK (_____) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election. SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law. SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefore as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on March 19, 2008, as provided in Section 3 hereof. All registered voters in the Parish are entitled to vote at the special election, and voting machines shall be used. SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized empowered and directed to take and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Voting Rights Act of 1965, as amended.

SECTION 7. Furnishing Election Call To Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Commissioner of Elections, the Clerk

SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the special tax provided for herein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application. The president asked for a motion to recess the regular meeting in favor of the Personnel Committee Meeting. A motion was offered by Mr. Jackson, seconded by Mr. Blade to recess the regular police jury meeting and reconvene as the Personnel Committee. Motion passed without opposition. PERSONNEL COMMITTEE MEETING The chairman, Mr. Blade called the Personnel Committee meeting to order at 6:00 p.m. The chairman recognized Mr. Cammack. Mr. Cammack spoke regarding a travel request of the Registrar of Voters to San Diego, California and noted that there was sufficient budget. Motion offered by Mr. Calhoun, seconded by Mr. Jackson to approve the travel request of the Registrar of Voters. Motion passed without opposition. PUBLIC WORKS COMMITTEE MEETING The chairman, Mr. Mack Calhoun called the Public Works Committee Meeting to order at 6:05 p.m. The chairman recognized Mr. Murray, Public Works Director. Mr. Murray indicated that he had no items. A motion to adjourn was offered by Mr. Jackson, seconded by Mr. Blade. The committee meeting was adjourned at 6:06 p.m. A motion to reconvene the regular police jury meeting was offered by Mr. Blade, seconded by Mr. Caldwell. Motion passed without opposition. HOMELAND SECURITY & EMERGENCY PREPAREDNESS AGENCY: Mr. Butch Beckham, Director Mr. Beckham reported that the river was falling and should be below flood stage by June 6, 2009. Discussion ensued. Ms. Moore requested that the distribution of sandbags be addressed as well as an alert system for the parish. Ms. Moore asked that Mr. Beckham follow up on these two items and report back to the jury at its next meeting. LIBRARY: Ms. Cheryl Mouliere Ms. Mouliere spoke regarding the new libraries. 911OFFICE: Mr. Craig Lott Mr. Lott requested permission to attend the annual NENA meeting in Fort Worth, Texas, on June 6-11, 2009. Motion offered by Mr. Blade, seconded by Mr. Caldwell to approval the travel request of the director. Motion passed without opposition. ORDINANCE NO. 8934 (INTRODUCTION)

AN ORDINANCE CREATING ROAD LIGHTING DISTRICT NO. 39 (FIDDLERS CREEK) WITHIN THE PARISH OF OUACHITA, STATE OF LOUISIANA, AND DEFINING AND DESCRIBING THE BOUNDARIES THERE OF.

WHEREAS, Chapter 7, Title 48 of the Louisiana Revised Statutes of 1950, as amended, authorizes parish governing authorities to create road lighting districts; and

WHEREAS, this Police Jury, acting as the governing authority of the Parish of Ouachita,

State of Louisiana, now wishes to create a road lighting district within the Parish with such boundaries as are hereinafter set forth;

NOW, THEREFORE: BE IT ORDAINED by the Police Jury of the Parish of Ouachita, State of Louisiana,

that: SECTION 1: By virtue of the authority conferred by Chapter 7, Title 48 of the

Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, a Road Lighting District be and the same is hereby created within the Parish of Ouachita, State of Louisiana, which Road Lighting District shall comprise and embrace all of that territory within Fiddler’s Creek Subdivision, as recorded in the records of Ouachita Parish, Louisiana.

SECTION 2: The Road Lighting District hereby created shall be known and designated

as "Road Lighting District No. 39 of the Parish of Ouachita, State of Louisiana" (the "District"), and as thus created shall constitute a public corporation and political subdivision of the State of Louisiana, of which this Police Jury shall be the governing authority, and the District shall have all the rights, powers and privileges granted and conferred by the Constitution and Statutes of the State of Louisiana to such political subdivisions, including the authority to incur debt and to levy taxes.

SECTION 3: The official seal of the Parish of Ouachita, State of Louisiana, be and the

same is hereby adopted as the official seal of the District and the official journal of this Police Jury shall be the official journal of the District.

Mr. Jackson asked Mr. Cammack to update the jury on the Energy Efficiency Grants. Mr. Cammack spoke regarding the meeting held last week with Bill Land, Architect. Mr. Cammack informed the jury about the various items within the courthouse and courthouse annex that could be addressed with the grant monies. Mr. Cammack stated that he had contacted outside vendors to assist in the application process. Discussion ensued. No action was taken on this matter. Mr. Jackson asked Mr. Mitchell to speak regarding the Fidelity Bond Insurance Coverage on parish employees. Mr. Mitchell informed the jury that the policy covering the Treasurer was $200,000 and the policy covering other parish employees was up to $100,000 which is with the Travelers’ Insurance Companies.

Shall Road Lighting District No. 10 of the Parish of Ouachita, State of Louisiana (the “District”), through its Governing Authority, be authorized to assess and to adopt a resolution providing for the assessment of an annual service charge of $100.00 per parcel of immovable property located wholly or partly within the boundaries of said Road Lighting District for a period of ten (10) years, beginning with the year 2009, and ending with the year 2018, for the purpose of paying utility charges for road lighting and maintaining and operating road lighting facilities and equipment. The amount reasonably expected to be collected from the levy of the Service Charge for the first year will be approximately $4000.00.

STATE BOND COMMISSION IN CONNECTION THEREWITH; AND P ROVIDING FOR OTHER MATTERS IN CONNECTION THEREWITH.

BE IT RESOLVED, by Ouachita Parish Police Jury (the “Governing Authority”), acting as the governing authority of Road Lighting District No. _____ of the Parish of Ouachita, State of Louisiana (the “District”) that:

SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and

under the authority conferred by Article VI, Sections 26 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5 and Chapter 6-A of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the Parish on SATURDAY, OCTOBER 17, 2009, between the hours of six o’clock (6:00) a.m., and eight o’clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

PROPOSITION (ROAD LIGHTING DISTRICT SERVICE CHARGE)

SUMMARY: 10 YEAR $____ ANNUAL SERVICE CHARGE FOR THE PURPOSE OF PAYING UTILITY CHARGES FOR ROAD LIGHTING AND MAINTAINING AND OPERATING ROAD LIGHTING FACILIT IES AND EQUIPMENT. Shall Road Lighting District No. ______ of the Parish of Ouachita, State of Louisiana (the “District”), through its Governing Authority, be authorized to assess and to adopt a resolution providing for the assessment of an annual service charge of $ _____ per parcel of immovable property located wholly or partly within the boundaries of said Road Lighting District for a period of ten (10) years, beginning with the year 2009, and ending with the year 2018, for the purpose of paying utility charges for road lighting and maintaining and operating road lighting facilities and equipment. The amount reasonably expected to be collected from the levy of the Service Charge for the first year will be approximately $_________.

SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in The Ouachita Citizen, a weekly newspaper of general circulation within the Parish, published in West Monroe, Louisiana, and being the official journal of the Police Jury, once a week for four consecutive weeks, with the first publication to be made not less that forty-five (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as “Exhibit A ” and incorporated herein by reference the same as if it were set forth herein in full.

SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, Police Jury Meeting Room, Ouachita Parish Courthouse, 300 St. John Street, Monroe, Louisiana, on ______________, October ______, 2009, at ____________ O’CLOCK (_____) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election. SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law. SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefore as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on March 19, 2008, as provided in Section 3 hereof. All registered voters in the Parish are entitled to vote at the special election, and voting machines shall be used. SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized empowered and directed to take and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Voting Rights Act of 1965, as amended.

SECTION 7. Furnishing Election Call To Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Commissioner of Elections, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Ouachita Parish and the Registrar of Voters of Ouachita Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law. SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the special tax provided for herein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.
