CLOSED SESSION The Council Members recessed into Closed Session at 5:32 p.m. and reconvened at 6:38 p.m. with all members of Council present. City Attorney Salinas reported the following:

I . CONFERENCE WITH LEGAL COUNSEL — PENDING LITIGATION Pursuant to Government Code Section 54956.9(a), 54954.9(b)(3)(c)

a. CPO Enterprises, Inc. v. Steiny and Company, Inc., et al.

On item 1(a), the City Council received a report by the City Attorney with respect to a dispute between a sub-contractor and a contractor that did business with the City and the City is named as a nominal party in that case. Upon completion of that report, a motion made by Vice Mayor De Witt and seconded by Council Member Hurtado and on a vote of 5-0, the City Council authorized the City Attorney's Office to represent the City in that litigation and defend the City's interest.

2. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION Pursuant to Government Code Section 54956.9(c)

One (1) - Potential Case

On item 1, the City Council received a report with respect to the possibility of anticipated litigation in the future. Upon completion of that report, there was no reportable action taken in connection with that matter.

Item 3 has to do with a homeless situation within the City of South Gate. This matter was not discussed in closed session because an earlier meeting scheduled today was continued and there was nothing to report. The substance of this matter was not discussed in closed session.

4. CONSIDER THE EVALUATION OF PERFORMANCE OF A PUBLIC EMPLOYEE Pursuant to Government Code Section 54957 and 54957.6

a. City Manager

Item 4(a) is an opportunity for the City Manager to discuss certain ongoing activities and goals of the City Manager and upon completion of that report, there was no reportable action.

5. CONFERENCE WITH LABOR NEGOTIATOR Pursuant to Government Code Section 54957.6

Item 5 involved negotiations with SGDMA, but those matters had been resolved and there was no need to discuss in closes session.

The City Council issued a Proclamation in memory and honor of late Assembly Member Marco Antonio Firebaugh in his ten year anniversary of passing.

APPRECIATION The City Council presented Certificates of Appreciation to South Gate students who completed the Students Run LA Marathon on Sunday, February 14, 2016.

COMMENTS FROM THE AUDIENCE Nick Godoy, 8611 San Gabriel Avenue informed Council that the street

sweeper failed to sweep at 3:00 a.m. Mr. Godoy spoke with Ray Valenzuela and was informed that there was a new driver that wasn't familiar with the route yet.

He also mentioned that the Council issues certificates and plaques to different groups, teachers and kids, but we are forgetting the most important people, World War II Veterans, Koreas' Anniversary and Memorial for the Police Officers in May.

Ms. Medina, 8630 Zamora Avenue, Los Angeles thanked the City of South Gate and Councilwoman Davila for allowing her to provide information of importance to South East L.A. residents.

THE AUDIENCE CONT'D South Gate resident thanked Mayor and Council Members for acknowledging the legacy of Marco Antonio Firebaugh. She shared her experience as a formerly undocumented student and beneficiary of AB 540. She encouraged this City to continue supporting South Gate youth.

Mayor Morales asked the South Gate resident to talk about her background and what schools she attended.

South Gate resident grew-up in South Gate. She was two-years old when she came to the U.S. She went to State Street Elementary, South Gate Middle School, South Gate High School, UCLA and recently completed her Masters at Clark University in Massachusetts.

REPORTS AND COMMENTS FROM crry OFFICIALS Mayor Morales asked if City staff have anything to report.

Captain Arakawa mentioned that the Police Department's 6th Annual Youth Summit is set for Saturday, April 9th.

City Treasurer Martinez stated that the Car Show went well.

Council Member Bernal attended her first neighborhood meeting at the Calden Court Apartments. She attended the HUB Cities meeting and they will be having a long overdue retreat on Saturday, April 23rd. The HUB Cities will be having an RFP for legal services. She attended many of the Azalea festival activities and her daughter will be ready for Miss Azaleita. She mentioned that Baskin Robbins on Atlantic and Tweedy is now opened. She might not be attending next Council meeting due to the arrival of her son.

Council Member Davila attended all of the Azalea festival activities.

Council Member Hurtado stated that he wasn't able to attend some of the Azalea festival activities because he coaches the South Gate High School softball team and they are having tournaments. He was present during the Volunteers of the Year.

He added mentioned that the Five Fast Car Wash is opened for business; Aldi is expected to open around April 20th; Tacos el Gavilan in May and AT&T. Flame Boiler is expected to open in June; Stake and Shake opening in August. Two more businesses are expected to open soon too (Pizza Studio and Jimmy John's Sandwiches).

REPORTS AND COMMENTS FROM CITY OFFICIALS

CONT'D Vice Mayor De Witt mentioned the last time the City of South Gate had a president visit was in 1964 (President Johnson). He believes that California maybe come in play in this coming election. He is asking his colleagues to consider inviting the different candidates to make an address to our residents.

Mayor Morales participated in the Solvang 50 mile race a couple of weeks ago. He mentioned that the Miranda Productions have a fashion show every year and give out a scholarship. Every year the Miranda family allows the Mayor to review the applications and pick out a scholarship winner. Last year, he had an opportunity to do it because former Mayor Gonzalez couldn't attend. The Miranda family gave out an $800 scholarship. He got a little too excited and offered a $500 scholarship to the runner-up.

CONSENT CALENDAR Mayor Morales asked if any member of the City Council, City staff or the public wished to remove or pull an item from the Consent Calendar. There was no request from the public or staff to remove any items on the consent calendar. Mayor Morales requested to pull agenda item 5 and Council Member Bernal requested to pull agenda item 8.

Agenda Items 2, 3, 4, 6, 7, and 9 were unanimously approved during Consent Calendar by motion of Mayor Morales and seconded by Vice Mayor De Witt.

DEVELOPMENT The City Council unanimously adopted Resolution No. 7698 entitled — A Resolution of the City Council of the City of South Gate making a determination of public convenience or necessity for the sale of beer and wine for off-site consumption for Aldi grocery store located at 5830 Firestone Boulevard, during consideration of the Consent Calendar.

CITY MEMBERSHIPS The City Council unanimously adopted Resolution No. 7699 entitled - Resolution of the City Council of the City of South Gate authorizing participation in a joint service delivery cost comparison project with cities in the Gateway Cities Council of Governments, during consideration of the Consent Calendar.

4 PERSONNEL RECRUITMENT & SELECTION The City Council unanimously adopted Resolution No. 7700 entitled — A

Resolution of the City Council of the City of South Gate amending Resolution No. 6454 (Salary Resolution and Position Classification Plan) reclassifying one Assistant Engineer position to an Associate Engineer position, updating the job specification for the Associate Engineer position in the Public Works Department, and updating the job specification for the

& SELECTION CONT'D Code Enforcement Officer in the Community Development Department, and updating the salary pay tables, during consideration of the Consent Calendar.

LEGAL OPERATIONS The City Council unanimously approved the Attorney Representation Agreement (Contract No. 3197) (with a $30,000 cap) with the Law Offices of Lyon Legal to perform an analysis and make recommendation on whether each Professional and Mid-Management Association (PMMA) position should be classified as exempt from the Fair Labor Standards Act (FLSA) or not exempt from FLSA, by motion of Mayor Morales and seconded by Vice Mayor De Witt; an

a. Authorized the City Manager to execute the Agreement in a form acceptable to the City Attorney.

Mayor Morales asked City Manager to summarize this item. City Manager stated that the City has legal services provided by the Office of the City Attorney; the City Attorney then makes recommendations of various law firms depending on the specific issue that is presented. This particular issue is being handled through our human services department regarding the Fair Labor Standards Acts adopted in the 1930's and it's been amended several times. The Fair Labor Standards Acts handles everything from minimum wage, hours of employment, work type safety, etc. Tonight's specific issue has to deal with our management level employees that have been characterize as FLSA exempt meaning that they are not eligible for overtime and treated as managers which affects their ability to accrue and expand leave time.

City Manager stated that staff is asking this law firm to review the appropriateness of whether or not certain employees should be classified as overtime or as management employees. The penalties are significant if they have been mischaracterized.

WATER The City Council unanimously approved a Subrecipient Agreement (Contract No. 3198) with the Gateway Water Management Authority (GWMA) to receive $221,427 in WaterSMART and Energy Efficiency (WSEE) Grant Funds from the Unites States Bureau of Reclamation (USBR) necessary for the design and construction of the Advanced Meter Replacement Project, during consideration of the Consent Calendar; and

a. Appropriated $221,427 in WSEE Grant Funds to Account No. 411-731-71-9554 to fund the Advanced Meter Replacement Project; and

b. Authorized the Mayor to execute the Subrecipient Agreement in a form acceptable to the City Attorney.

7 BICYCLE PATHS/

PEDESTRIAN WALKWAYS The City Council unanimously received and filed a report on the Bicycle Transportation Plan as staff is in the process of researching and pursuing grant funds to implement its recommendations, during consideration of the Consent Calendar.

8 SURPLUS PERSONAL

PROPERTY MGMT The City Council unanimously declared the items on the attached vehicle and miscellaneous items list and the bicycle list as surplus property, by motion of Council Member Bernal and seconded by Council Member Davila; and

a. Authorized U.S. Auction Services to sell these surplus items at auction; and

b. Authorized the City to donate 78 additional surplus bikes to a local non-profit for refurbishment and distribution to South Gate residents.

Mayor Morales asked City Manager to summarize this item. City Manager stated that annually we bring surprise items to the City Council for distribution to an auction. A large portion of items are bicycles. Staff would like a local non-profit refurbish the best bicycles and distribute.

Mayor Morales commended Councilwoman Bernal for pulling this item. This is a great program to give back to the community.

Council Member Bernal would like to know how the City accrues these bicycles. Captain Arakawa stated that the bicycles are from a number of contacts in the field. They are abandoned, from people taken into custody and never return to claim the bike, some are used in crimes. There is a process to allow the rightful owner to claim the bike.

8 SURPLUS PERSONAL

PROPERTY MGMT CONT'D Council Member Bernal asked if the non-profit organization has been contacted. City Manager stated no. Staff is trying to structure the program.

City Treasurer Martinez stated that the Boy Scouts is a non-profit organization and maybe some of the bikes can be donated to them as part of their project to earn their badges.

Vice Mayor De Witt wants to make certain these bikes have brakes.

MINUTES The City Council unanimously approved the Special and Regular Meeting minutes of February 9, 2016, during consideration of the Consent Calendar; and

a. Approved the Special and Regular Meeting minutes of February 23, 2016.

10 STREETS/SIDEWALKS/

LANDSCAPING The City Council considered:

a. Approving an Agreement with United Pacific Services, Inc (UPS) for a three-year term for the maintenance of the City's urban forest to be performed under the Citywide Tree Maintenance Program, City Project No. 540-ST, in the amount of $1,519,500; and

b. To fully fund services in Fiscal Year 2015-2016, appropriate General Funds as follows: $403,417 to Account No. 251-714-25-6101, and $60,000 to Account No. 100-460-61-6101; and

c. Authorizing the Mayor to execute the Agreement in a form acceptable to the City Attorney.

Mayor Morales asked City Manager to summarize this item. City Manager stated that at this time staff is recommending a change in the agendized recommendation. Staff is asking Council to reject the bids and direct staff to re-bid. Staff received two different documents and provided Council with copies (letter dated March 18, 2016 from Lawrence Graze representing West Coast Arborists and an Administrative Report dated June 16, 2015 from Tim Shea).

City Manager asked City Attorney if he has anything else to add.

City Attorney Salinas stated that the City put out to bid a request for tree trimming contractors to submit a bid. The request included certain conditions that had to be met by each of the responding parties. The bid

LANDSCAPING CONT'D also allowed the City to waive defects in any of the responses and reject any bids or accept the lowest responsible bidder. City staff received and reviewed three bids.

City Attorney Salinas stated that the staff's recommendation was to approve an agreement with United Pacific Services, Inc. That recommendation was based on a misunderstanding of whether or not a certain requirement in the bid dealing with the safety record of a particular entity could be waived if it fell outside the threshold as set in the RFP. The safety requirement for United Pacific Services was above the standard set forth in RFP. The City could do one of two things it could reject that bid, go to another bid process or simply decline all bids and go out to bid again. The decision to waive the safety record was based upon a view that that requirement could in fact be waived. Staff discussed the matter with the City Attorney's Office and also received a protest bid, City staff and City Attorney's Office believes the most prudent course is to continue making this as a transparent process as possible and not prejudice any other contractors that was thinking about submitting a bid but decided not to because they might have felt they did not meet the same rating.

Carmen Avalos, City Clerk stated that the administrative report and letter from Mr. Lawrence Graze will be part of the record.

Angel Sotelo, 10513 Dolores Avenue stated that his company submitted a bid and on behalf of his company thanked the City of South Gate for allowing them the opportunity to work in the City for the past three years. His company is prepared to accept the direction the City gives today.

Having no one else come forward, Mayor Morales closed the audience portion.

Mayor Morales stated that this is the same issue from three years ago.

City Attorney Salinas stated that this exact situation did occur at the last time the City went out to bid. Staff improved the contract's amount and focused on making sure that certain standards that were not in the prior contract are standards and the work can be audited. The clause regarding the Experience Modification Rate (EMR) was left untouched.

LANDSCAPING CONT'D Mayor Morales motioned to reject all bids, modify the Request for Proposals so that the information regarding the safety record evidence by the EMR rating will continue to be provided in response to the Request for Proposals in the future, but the rating will not be a disqualifying factor preventing any contractor from bidding on the project and it may be a factor that may be waived in the process and seconded by Vice Mayor De Witt. The motion carried unanimously (5-0).

11 WARRANTS AND

CANCELLATIONS The City Council unanimously approved the Warrants for March 22, 2016, by motion of by motion of Council Member Auditor Bernal and seconded by Vice Mayor De Witt.

BUDGET ADMIN The City Council received a presentation from staff on the FY 2015-16 mid-year budget review of the City's General Fund, by motion of Vice Mayor De Witt and seconded by Council Member Hurtado; and

a. Received and filed the attached mid-year budget information.

Mayor Morales asked City Manager to summarize this item. City Manager stated that staff tries to provide a mid-year budget update to Council due to sales taxes, property taxes and changes introduced by the state.

CONT'D Ms. Acosta has provided Council with three different schedules: Attachment A is a detail of all the general fund revenue sources; Attachment B is expenditures by departments and Attachment C is a summary of our general fund balance.

Council Member Bernal questioned how the unassigned fund balance was going to be compromised with the PERS retirement. Ms. Acosta stated that when the budget is presented some projections will be presented for future years.

Vice Mayor De Witt stated that the City has been having a problem with Bank of America. He asked if this has been resolved or will it be agendized for discussion at the next meeting. City Manager stated that staff has been having a lot of discussion with Bank of America and with other cities. Bank of America has decided not to have the City of South Gate as a customer. A Request for Proposals for new banking services has gone out. The City has received proposals from other banks.

1. CONFERENCE WITH LEGAL COUNSEL — PENDING LITIGATION Pursuant to Government Code Section 54956.9(a), 54954.9(b)(3)(c)

a. Maria Gomez v. City of South Gate b. Ron Inman v. City of South Gate (WCAB) c. Rosalinda Garcia v. City of South Gate

On item 1(a), the City Council received an offer to settlement this matter. This is a trip and fall case. Due to the amount of the settlement, the City Council on a vote of 3-0 authorized the City Attorney's Office to refer this settlement over to ICRMA for further dealings with that settlement matter.

Item 1(b) is a Workers' Compensation matter involving a former employee of the City. The City received a settlement offer on this matter. The terms of the settlement has not yet been finalized and once finalized the amount will be available for public disclosure. The motion to approve the settlement was made by Council Member Hurtado and seconded by Council Member Davila and the vote was 3-0.

2. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION Pursuant to Government Code Section 54956.9(c)

One (1) - Potential Case

Item 2 is a matter where the City Council may initiate litigation and the purpose of this is to allow the Council to discuss the strategy associated with that litigation without having to disclose the nature of it publically.

Paramount. The word annexation in this case is intended to mean that both Cities boundaries would be adjusted if there was a transaction made.

THE AUDIENCE Virginia Johnson, 5751 McKinley Avenue thanked Council Member Hurtado for announcing at the last City Council meeting that she called in sick. She also thanked Code Enforcement for following-up on a complaint she had about a Boost Mobile store in Hollydale. She mentioned that the pergola shade that was next to the 7/11 store on Garfield and Main was removed by mistake by the City, and it has not yet been replaced.

Ms. Johnson stated that at the last Council meeting, Vice Mayor De Witt suggested inviting all candidates to our auditorium for the next election. This is good for our community to know who is running for all offices.

THE AUDIENCE CONT'D Ms. Johnson thanked Mayor Morales for announcing at the State of the City Address that we have an audio of the City Council meetings on the City's website.

Ms. Johnson mentioned that the mural on Garfield and Main Street is supposed to be depicting Hollydale's unique charms but instead is 90% South Gate. The mural has a picture of Cypress Hill the band formed in South Gate based on gang life on the westside. The band goes around showing the middle finger. Ms. Johnson does not agree that it should be representative of the City of South Gate. She thanked City Council for adjourning in honor of Richard Reed because his wife (Jean Reed) has dedicated herself to the City.

Linda Parsons, 5780 Main Street stated that in 2004 she attended her first meeting with the Arroyo Group about a plan for developing businesses in Hollydale. She attended another meeting in 2015. The company showed pictures of developments of nice looking places. She is jealous because in Paramount on Paramount Boulevard and Clearwater they are building similar kind of development. She is disappointed about the new businesses in Hollydale because the buildings are picking brighter colors. Her neighbors comment that this is Tijuana not Hollydale.

Nick Godoy, 8611 San Gabriel Avenue stated that South Gate is not Tijuana, but if Santa Ana had not given up the rights of the western states, this would have still been part of Mexico.

Mr. Godoy mentioned that drivers cannot see the "no turn" signs on Ardmore and San Gabriel. He is having parking issues on San Gabriel Avenue again and requested that the names on the Memorial be updated if possible.

Denise Diaz, 10365 Virginia Avenue on behalf of Tony Plana thanked Council Members Davila and Hurtado and Mr. Adams for being present at Liberty Elementary's combination last week. The students, parents and Principal Rios were very happy to see Mr. Adams and the Council.

Ms. Diaz informed Chief of Police that Officer Rafael Vega has interacted with the youth and asked the Chief to congratulate him.

Jose Cervantes, 2562 Santa Ana Street, Huntington Park stated that in October he filed a complaint against Casino Pachanga due to loud music and wants to know what can be done to control the noise.

FROM CITY OFFICIALS Mayor Morales asked if City staff have anything to report.

Joe Perez, Director of Community Development reported that CicLAvia will have an event on Sunday, May 15, 2016. CicLAvia will be having a meeting on April 21st at South Gate Park Girl's Club House at 6:30 p.m.

Council Member Hurtado asked Mr. Perez to speak about the meeting with the pastors.

Mr. Perez stated having a productive meeting with two churches. They are still in contact with two more churches that are in the area of Atlantic and Tweedy.

Randy Davis, Chief of Police thanked Council, City Manager and Parks staff and gave a brief report on the success of the Youth Leadership Summit which took place on Saturday at South Gate Park.

Raul F. Salinas, City Attorney stated that we are blessed to have the Boy Scouts from South Gate present tonight. They are the future leaders of this community. Mr. Salinas is involved with the Boy Scouts because he has four boys in the Boy Scouts and two have become Eagles. He stated that the Boy Scouts participation in tonight's meeting allows them to check off one of the elements for citizenship in the community.

Mr. Salinas also mentioned that he is an approved counselor for the law merit badge and does a great job of running a criminal trial involving one of the three little pigs who is accused of killing the bad wolf. He would be happy to sponsor it in the City.

Council Member Davila was in Sacramento on the Vector Control Legislative Day. The South Gate Multi-Cultural Women's Club hosted their annual conference. She was very impressed with the students from Liberty Elementary for performing their own skit. She congratulated Chief Davis and the Police Department for a job well done during the Youth Leadership Summit. She also attended the CEHAT and Lynwood's Women Conference on Saturday.

Council Member Hurtado mentioned that Councilwoman Davila will be the new president for the Multi-Cultural Women's Club in May. He attended the theater event and the children were phenomenal and the Teen Summit went well. He also attended the CEHAT which is a group of residents working together on environmental issues. He attended the COG meeting and they discussed a gas sales tax measure (Measure R) that does not benefit the community.

Mayor Morales had an opportunity to speak to a group of leaders at the 3rd Annual Leadership Summit at South Gate High School on Saturday. The Key Note Speaker was Edwin Saucedo. He also attended a round table discussion with Supervisor Hilda Solis.

CONSENT CALENDAR Agenda Items 9, 10, 11, 12, 13, 14 and 15 were approved during Consent Calendar by motion of Mayor Morales and seconded by Council Member Hurtado.

9 STREETS/SIDEWALKS/

LANDSCAPING The City Council adopted Resolution No. 7701 entitled — Resolution rescinding Resolution No. 6900; authorizing submittal of funding requests to the Department of Resources Recycling and Recovery (CalRecycle) for the Beverage Container Recycling City Payment Program; and authorizing the City Manager to execute all necessary documents, during consideration of the Consent Calendar.

GENERAL PLAN The City Council approved an Agreement (Contract No. 3201) with the County of Los Angeles and the Los Angeles County Sanitation District No. 2, which is a three-party agreement, necessary to hold the Household Hazardous Waste and Electronic Waste Collection scheduled for April 23, 2016, during consideration of the Consent Calendar; and

a. Authorized the Mayor to execute the Agreement in a form acceptable to the City Attorney.

11 ENERGY AND CONSERVATION

PROGRAMS The City Council approved Amendment No. 3 to Contract No. 2620 with Southern California Edison for the Gateway Cities Energy Leader Partnership Program which is necessary for the City to continue receiving monetary and other incentives for implementing energy savings projects, during consideration of the Consent Calendar; and

a. Authorized the Mayor to execute Amendment No. 3 in a form acceptable to the City Attorney.

12 TRANSPORTATION

PLANNING/ADMIN The City Council approved Amendment No. 5 to Contract No. 2429 with Atkins North America, Inc. to: (i) extend the contract period through December 31, 2018, (ii) revise the hourly rate schedule from the original Contract rates to the current Atkins, 2016 Standard Rate Schedule, and (ii) increase the current construction support services budget by $100,000 for the construction of the I-710/Firestone Boulevard Interchange, Phase IV, over the Los Angeles River, Federal Project No. HP21L-5257(016) and City Project No. 354-ST, (Firestone Boulevard Bridge Widening Project), during consideration of the Consent Calendar; and

a. Authorized the Mayor to execute Amendment No. 5 in a form acceptable to the City Attorney.

13 COMMERCIAL ASSESSMENT

DISTRICTS The City Council accepted the completion of construction work performed by South Coast Lighting & Design, Inc., of the Hollydale Business District Street Sign Panel Refurbishment (Phase II), City Project No. 523-TRF, effective February 1, 2016, replacing street name sign panels in the Hollydale Business District, during consideration of the Consent Calendar; and

a. Instructed the City Clerk to file the Notice of Completion with the Los Angeles County Recorder's Office.

POLITICAL SUPPORT The City Council authorized the Mayor to execute a letter of support for Senate Bill 2533 "California Long-term Provisions for Water Supply and Short-term Provisions for Emergency Drought Relief Act" introduced by the Honorable Dianne Feinstein, US Senator, during consideration of the Consent Calendar.

15 COMMUNITY

PROMOTION The City Council approved the following requests for the CicLAvia Southeast Cities Event to be held on Sunday, May 15, 2016, during consideration of the Consent Calendar:

a. Waived the Sidewalk Sale Permit Requirements and Fees for all business along the CicLAvia Southeast Cities route; and

b. Waived the Special Event Permit Requirements and Fee of $46 for the CicLAvia Southeast Cities event; and

c. Waived the Business License Requirement and Fee of $46 for CicLAvia, a nonprofit corporation.

LANDSCAPING The City Council considered:

a. Adopting a Resolution - preliminarily approving the Engineer's Report for proceedings for the Fiscal Year 2016-2017 Annual Levy of Assessments within the Street Lighting and Landscape Maintenance District No. 1; and

b. Adopting a Resolution - declaring the City's intention to levy and collect assessments in Fiscal Year 2016-2017 annual levy and collection of assessments within the Street Lighting and Landscape Maintenance District No. 1, and setting a Public Hearing for May 24, 2016; and

c. Authorizing the Director of Public Works/City Engineer to proceed with completing a thorough benefit and financial analysis report to identify alternatives to minimize the funding deficit, as recommended by the Engineer's Report, which will be needed if the City Council wishes to conduct Proposition 218 Ballot proceedings for new or increased assessments.

Mayor Morales asked City Manager if there's an urgency to approve this item tonight. He feels all Council Members should be present. City Manager stated that this item can be continued, but he would like to introduce this item.

Mayor Morales asked City Manager to summarize this item. City Manager stated that in order to levy any type of assessment it requires four steps. This is the second step and Council will not be setting the levy or fee tonight. City staff hires consultants and get an engineer's report that outlines exactly what type of fee it will take to generate revenue. This assessment has not gone up for over two decades and has left this fund with a negative balance.

THE AUDIENCE Virginia Johnson, 5751 McKinley Avenue mentioned that a new Postmaster, Mr. Juan Rivas visited the Hollydale Post Office last week. Mr. Rivas informed the longtime post mistress that the hours will be cut from 8 to 4 hours a day. This needs an action by our Council.

Ms. Johnson mentioned that the U-haul big rental bins are out on the street at 12024 Center Street.

Ms. Johnson thanked Art Cervantes, Director of Public Works for his quick response time whenever there is a problem or to answer a question.

Nick Godoy, 8611 San Gabriel Avenue provided a rough sketch of the Memorial Day Ceremony to Parks. Mr. Godoy had asked a question and was informed that the names on the memorial are the ones that lived in South Gate and passed away while in the service. Mr. Godoy and the Veteran Affairs Committee would like to know why the City doesn't buy any flower arrangements. Mr. Godoy was informed that the committee had decided not to buy any flower arrangements.

Mr. Godoy was under the impression that the hump on San Gabriel Avenue was going to get smoothed down so when the sweeper goes by the brushes would not leave glass and trash behind.

Maria Cruz, 2510 Indiana Avenue informed Council about a project on the other side of Alameda near Tweedy Boulevard. She is concerned about the dust from Alameda.

Council informed Ms. Cruz that that is the City of Los Angeles and the City Manager will inform the City of Los Angeles about the dust.

Ms. Cruz also stated that 14 months ago she reported to the City that while driving East on California Avenue to make a right turn onto Tweedy

months to fix the situation, but then came El Nino and there was no budget. The City was going to take care of the trees instead. She mentioned that Truba Avenue has a lot of potholes due to El Nino. Long Beach Boulevard towards Southern Avenue is unsafe and there's a lot of homeless on Alameda.

Maria Rendon, 8937 Cypress Avenue informed Council that the pass two years the residents on Cypress Avenue between Firestone Boulevard and Southern Avenue have celebrated El Dia del Nino. She has submitted petitions and paid the $50 fee and then is informed that she has to pay $400. The residents are not willing to pay the $400, but are asking if the City would close the street so the children can be safe.

Ms. Rendon asked if the City can synchronize the traffic lights crossing Firestone Boulevard. She also mentioned the City was supposed to fix the sidewalk at 8943 Cypress Avenue.

German Castilla, District Representative for Congresswoman Janice Hahn's Office is providing a Certificate of Commendation from the United States Congress to the Honorable Jorge Morales for his service as Mayor for the City of South Gate, Honorable W.H. (Bill) De Witt in honor of being appointed the new Mayor and Honorable Maria Davila in honor of being appointed the new Vice Mayor of the City of South Gate.

Paul Adams, Director of Parks & Recreation mentioned that on April 30th is the Second Hollydale Master Plan Workshop for the parks at 9:00 a.m. at Circle Park. May 7th is JAA's opening day, May 12th is the Health Fair in front of the Senior Center, and May 14th is the Spring Fit 5K run at the park and on May 15th is the CicLAvia event.

Joe Perez, Director of Community Development stated that a community workshop "Gateway District Special Plan" is scheduled for Wednesday, May 4th from 6:00 to 8:00 p.m. in the City Council Chambers.

Randy Davis, Chief of Police thanked Jorge Morales for his support during this past year.

Council Member Morales thanked Chief Davis.

Mike Had, City Manager informed Council that he and Mr. Richard Luna will be spending the day in Sacramento tomorrow meeting with the legislative staff, chief of staff for Speaker Rendon's Office, Lara's Office and getting a briefing from the League of California Cities.

Gregory Martinez, City Treasurer attended the California Treasurer's Convention in Squaw Valley last week. The key topic was the Changing of Banking regarding municipalities and water districts.

City Treasurer Martinez explained that Bank of America is no longer working with municipalities. He mentioned that the City had an RFP and spent the last two days interviewing new banks.

Council Member Hurtado mentioned that Saturday's Earth Day turn-out was amazing. He mentioned that the City of Vernon had an election recently and Mayor W. Michael McCormick did not get re-elected. He served his community for forty-years.

Council Member Morales — nothing to report.

Vice Mayor Davila commended various departments for their cooperation in connection with the Earth Day event. She attended various South Gate schools' events.

Mayor De Witt informed Mr. Godoy that William Warren's brother Bob is still living. He'll inform Bob Warren about the Memorial Service. Mayor De Witt mentioned that William Warren died in Vietnam.

Mayor De Witt was in D.C. two weeks about and met with the army corp. engineers on the LA River. He also met with several congressional representatives and members of the House of Representatives on several issues that face the City of South Gate.

Mayor De Witt is interested in a new program for the City of South Gate, for example the City of Hollywood has the walk of fame on Hollywood Boulevard; Los Angeles has a number of areas where they honored older business and residents. He suggested helping our veterans from the different arm forces.

CONSENT CALENDAR Mayor De Witt asked if any member of the City Council or the public wished to remove or pull an item from the Consent Calendar. There was no request from the public or staff to remove any items on the consent calendar. Council Member Hurtado requested to pull item 10.

13 LAW ENFORCEMENT The City Council accepted the completion of construction of the South

Gate Police Department Parking Lot Pavement Rehabilitation, City Project No. 533-GEN performed by Terra Pave, which was completed on February 12, 2016, during consideration of the Consent Calendar; and

a. Directed the City Clerk to file a Notice of Completion with the Los Angeles County Recorder's Office.

The City Council adopted Resolution No. 7702 entitled — A Resolution of the City Council of the City of South Gate preliminary approving the Engineer's Report for proceedings for the Fiscal Year 2016-2017 Annual Levy of Assessments within the Street Lighting and Landscape Maintenance District No. 1, by motion of Council Member Morales and seconded by Vice Mayor Davila; and

a. Adopted Resolution No. 7703 entitled - A Resolution of the City Council of the City of South Gate declaring the City's intention to levy and collect assessments in Fiscal Year 2016-2017 annual levy and collection of assessments within the Street Lighting and Landscape Maintenance District No. 1, and setting a Public Hearing for May 24, 2016; and

b. Authorized the Director of Public Works/City Engineer to proceed with completing a thorough benefit and financial analysis report to identify alternatives to minimize the funding deficit, as recommended by the Engineer's Report, which will be needed if the City Council wishes to conduct Proposition 218 Ballot proceedings for new or increased assessments.

He believes the City will continue to have an annual levy or assessment that funds this item. The assessment is currently based on adjusted frontage of $2.38 per adjusted frontage. It is a four step process to levy an assessment and in order to comply with Prop 218. Tonight's action is not setting a levy; it is accepting the Engineer's Report and then directing staff to come back with some recommendations on funding the special district.

ELECTION ADMIN The City Council considered discussing the implementation of Senate Bill No. 415 (Hueso) Voter Participation, relating to mandatory consolidation of General Municipal Elections with Statewide Elections and will select one of three (3) options below:

Option 1: Allow for the implementation of SB 415 which will take effect on January 1, 2018; OR

Option 2:

Introduce an Ordinance adopting plans pertaining to the future consolidation of elections with the Statewide Election no later than the November 8, 2022, Statewide General Election; OR

Option 3: Authorize Members of the City Council, City Manager, City Treasurer and/or City Clerk to sign the petition to support an alternate solution to increase voter participation and to allow the continuance of stand-alone elections.

Vice Mayor Davila requested that this item be continued due to Councilwoman Bernal not present.

HOUSING The City Council conducted a Public Hearing to consider adopting Resolution No. 7704 entitled — A Resolution of the City Council of the City of South Gate, California, receiving and approving the program year 2016-2017 Action Plan and authorizing the execution of all necessary documents for the submittal of said plan to the U.S. Department of Housing and Urban Development, by motion of Council Member Hurtado and seconded by Council Member Morales.

Mayor De Witt asked City Manager to summarize this item. City Manager stated that this is an annual action taken by the Council. Every five years Council adopts a plan and then every year within the five year Council adopts a plan that complies with the five year plan. The U.S. Department of Housing and Urban Development provides large block grants.

Mayor De Witt asked if the City is in compliance with the federal requirements and regulations. Joe Perez, Director of Community Development stated that we are.

Virginia Johnson, 5751 McKinley Avenue asked if the numbers on the five year plan are the same the CAC recommended.

Mike Flad, City Manager stated that this is specific to overreaching goal. The actual allocations from the CAC have to align with the annual goals and five year goals. There have been no changes in the funding.

Council Member Morales asked if this item addresses affordable housing funds. City Manager stated that it is correct. This is the overreaching strategic goal setting document and also compliance document for CDBG and housing funds.

Council Member Morales would like to have a Council meeting for Council to discuss the preference on how to utilize the funds. He would like to see the funds go into bigger developments.

Mike Flad, City Manager stated that Council has not had a study session explaining what our housing strategy is. HUD sets the minimum standards or compliance requirements, but within that umbrella Council has a lot of different options before them. He stated that after the budget is completed, staff will schedule a study session on housing.

THE AUDIENCE Virginia Johnson, 5751 McKinley Avenue commended the Parks & Recreation Department for the new electronic sign. She mentioned that a small white truck ran into her car last Saturday on Paramount Boulevard in Downey. She called 911 and the dispatcher was extremely rude. Ms. Johnson wants the South Gate 911 dispatchers to know that she appreciates their kind and thoughtful services to our community and to outsiders as well.

Adolfo Vara, 3375 Wisconsin Avenue informed Council about providing $40,000 funding to the Chamber of Commerce and their California State license has expired. Mr. Vara has informed Council via email and has not received any replies. He noted that Council Member Hurtado has spoken to other South Gate residents about these issues.

Nick Godoy, 8611 San Miguel Avenue stated that the Memorial program is being finalized. Mr. Godoy stated that there was a small confrontation at last City Council meeting due to many proclamations and certificates. The chambers were overcrowded with parents and kids and it needs to be kept down due to fire hazard. Mr. Godoy was instructed to move from where he was sitting so the kids may sit.

Guion Hughes, 9810 Pinehurst Avenue lives near Tweedy Elementary. Mr. Hughes stated that about 300 to 400 people walk on his lawn every week. He would like to extend the sidewalk so people don't trip on his lawn.

department is working on the budget.

Ms. Avalos stated that she is and that there will be a voting registration drive. She mentioned that as of January sixteen-year olds can register to vote, however they cannot vote until they are eighteen.

Council Member Hurtado wished every mom a Happy Mother's Day. He stated that today's Mother's Day event at the park was well attended. He mentioned the JAA's Opening Day was last Saturday. He thanked City staff for showing-up during the opening day. The organization has been around for 60-years and he has been the president of the JAA for 23-years.

Council Member Hurtado hopes to see everyone on Sunday's CicLAvia event. He also mentioned that the Thunderbird Villas is celebrating its 50th anniversary this Saturday.

Council Member Bernal had her son, Emmanuel Jimenez on April 1 She apologized to Mr. Varas for not responding to his email, but she did follow-up with City staff to see what is being addressed. She thanked everyone for their good wishes and whished all moms a Happy Mother's Day.

Council Member Morales announced that the City of South Gate was featured in a magazine called Western Cities. This is a monthly magazine by the League California Cities. Council Member Morales and City Manager were quoted in the article called "Sustainability Offers a Path to Prosperity."

Council Member Morales attended the SCAG meeting last week and the committee has had issues with lack of quorums in the past, so the committee has decided that any votes will be counted based on the members present. Council Member Morales was appointed by Secretary John Laird from the California Natural Resources to the Lower LA River Working Group and the committee has about 10 months to come up with a master plan for the lower LA River. He also attended the California Contract Cities executive board meeting. This was the last executive board meeting for the current Board of Directors. Gustavo Camacho who was the president is outgoing and the incoming president will be Lou La Monte, Council Member from the City of Malibu. Council Member

Council Member Hurtado is on the Executive Board of the Gateways Cities Council of Governments; is the Chairman of the 1-710 Project Committee and was just elected as the new president of the Independent Cities Finance Authority.

Council Member Morales was appointed to the State Board of the League of California Cities.

Mayor De Witt attended the Mother's Day event at the park, Public Works' MSA at the park. He mentioned that starting in June he will have an event called "Coffee with the Mayor" on a Saturday morning. The first one will be at the McDonalds restaurant on Tweedy Boulevard and then rotate to different locations. He mentioned that Council has always had an open door policy during working hours, but not on Fridays because City Hall is closed on Fridays.

Mayor De Witt stated that earlier a speaker spoke about his concerns in regards to the Chamber of Commerce. Mayor De Witt did follow on social media some of the events and he does not play in the area on social media. Mayor De Witt called the City Manager and directed the City Manager to investigate thoroughly. City Manager worked on this item and is working to get these issues resolved.

CONSENT CALENDAR Mayor De Witt asked if any member of the City Council or the public wished to remove or pull an item from the Consent Calendar. There was no request from the public or staff to remove any items on the consent calendar. Council Member Hurtado requested to pull item 6.

Agenda Items 5, 7, and 8 were approved during Consent Calendar by motion of Council Member Hurtado and seconded by Mayor De Witt.

ENGINEERING ADMIN The City Council approved Amendment No. 1 to Contract No. 3200 with CivilSource providing staff augmentation services for the Engineering Division necessary for the delivery of Capital Improvement Program Projects, in an amount not to exceed $230,020, during consideration of the Consent Calendar; and

At this time, Council Member Hurtado was excused from participating on item 6 and departed from the Council Chambers.

The City Council approved an Agreement (Contract No. 3205) with Reyes Construction, Inc., for the lease of a portion of City-owned property located near the intersection of the 1-710 Frontage Road West and Southern Avenue (Assessor ID No. of 8267-027-903) in the City for the purpose of staging construction trailers for the duration of the Firestone Boulevard Bridge Widening Construction Project, by motion of Council Member Morales and seconded by Council Member Bernal; and

a. Authorized the Mayor to execute the Agreement in a form acceptable to the City Attorney.

Mayor De Witt asked City Manager to summarize this item. City Manager stated that the City has City owned property that is next to Thunderbird Villas that the contractor for Firestone Boulevard would like to use as a storage area.

Mayor De Witt asked staff to make certain the construction company has adequate insurance. City Manager and Director of Public Works stated that the construction company does have adequate insurance.

Council Member Morales inquired on the size of the property being leased. Arturo Cervantes, Director Public Works stated that the size of the property is 7 acres. The company is using a small portion to lay down construction trailers or offices for staff and parking.

Mike Flad, City Manager stated that the construction company asked City staff to use a small portion of the property.

Mayor De Witt inquired about how much per square foot per month the City is renting the portion. He directed staff to notify Council when the information is available.

WATER The City Council considered authorizing the Mayor to execute a letter requesting that Metro designate 2% of gross annual revenues from the proposed Measure R2 sales tax initiative to provide a dedicated funding source for a Green Complete Streets Program necessary to comply with the MS4 Permit/Water Management Plan, during consideration of the Consent Calendar.

MINUTES The City Council approved the Joint Meeting minutes of December 8, 2015 and March 8, 2016, during consideration of the Consent Calendar; and

a. Approved the Special and Regular Meeting minutes of March 8, 2016.

REJOINED MEETING City Council Hurtado rejoined the Council prior to the discussion on this matter.

MUNICIPAL CODE ADMIN The City Council waived the reading in full and introduced Ordinance No. 2327 entitled — An Ordinance of the City Council of the City of South Gate adding new Section 2.10.585 (Fines Relating to Dangerous Fireworks) to Chapter 2.10 (Business Regulation) of Title 2 (License -Business Regulations) establishing the use of administrative citations and fines prohibiting dangerous fireworks, by motion of Council Member Hurtado and seconded by Council Member Morales.

Mayor De Witt asked City Manager and Chief of Police to summarize this item. City Manager stated that it has been Council's priority to look for different strategies to address illegal fireworks problem within the City of South Gate. Other cities have used this tool. City staff is recommending Council to approve this item tonight.

Randy Davis, Chief of Police stated that this issue has been dealt with for several years. He and City Manager met with the Sheriff. Mayor De Witt and Council Member Morales met with the Sheriff last year to form a global solution. They decided to create an ordinance, as other cities have, by placing a monetary fine on the use sales.

Chief Davis has spoken to other Chiefs in the LA County and they have seen a reduction. He mentioned that there is one typographical error on page 5 on the total amount of penalties plus late charges. For the second offense is should state $2,000 not $2,500: and for the third offense is should state $3,000 not $4,000.

CONT'D Virginia Johnson, 5751 McKinley Avenue is very happy with this ordinance.

Having no one else come forward, Mayor De Witt closed the audience portion.

Raul F. Salinas, City Attorney stated that this ordinance tracks the model fireworks ordinance that was adopted by State Fire Marshal. The State Fire Marshal's penalties are higher than what City staff is proposing.

Council Member Hurtado asked how the message will be sent out. The Chief stated that the message will be disseminated by several different venues. It will be in the water bills, social media, all message boards, local publications, and neighborhood watch meetings.

Council Member Bernal is glad to see something being done. She asked who would be in charge to make certain people pay the fines. The Chief stated that the fine structure falls under the administrative citation process within the city.

BUDGET The City Council considered:

a. Adopting goals for the Fiscal Year 2016-2017 Municipal Budget and Work Program; and

b. Receiving and filing an overview of the upcoming budget schedule.

Council Member Morales suggested for Council's goals to focus on building the City's reserve. City Manager stated two separate concepts, and it's a great addition to build-up the reserves.

Council Member Hurtado asked what the plan is and how to "improve communications and civic engagement" because he'll be asked questions during a neighborhood watch. The residents should know the answer too many of the questions by now.

City Manager stated that this past year an app was added, facebook, twitter, access to the website was increased and the vista was changed.

Mayor De Witt asked how we are going to have any information on channel 3 on a monthly basis.

BUDGET CONT'D City Manager stated that the goals will not need to be adopted tonight. The item will be brought back on May 24th.

The City Council continued item 11(a) to the City Council meeting of May 24, 2016; and Item 11(b) was approved by motion of Council Member Hurtado and seconded by Council Member Morales:

a. Adopting goals for the Fiscal Year 2016-2017 Municipal Budget and Work Program; and
