in the taking of a large amount of evidence, which is not yet completed. Except as above stated, no new suits have been instituted, or are now pending, by or against our Board. Our legal affairs therefore are in an extremely satisfactory condition.
GRAIN SAMPLING DEPARTMENT Robert P. Kettles, Chief Grain Sampler
The amount received for sampling cars by the Grain SampHng Depart- ment of the Board, amounted to $55,428.62, and disbursements, $49,754.85, showing a surplus of $5,673.77.
During the year the department sampled 141,898 cars of grain, and the total number of bushels sampled for lake shipment aggregated 26,052,569 bushels.
These figures have been audited by the Everett Audit Co. and found correct.
BY THE PRESIDENT.
As indicating somewhat the volimie of business transacted under the rules of this Board during the past year, we would state that the receipts of grain and floiur in its grain equivalent for 1912, aggregated 322,068,041 bushels, as against 291,367,982 bushels during 1911. The shipments aggregated 244,423,142 bushels, as against 221,429,014 bushels during 1911.
The shipments of cured meats, in 1912, aggregated 566,627,100 pounds, as against 550,849,300 pounds, in 1911; of fresh meats, 822,915,700 pounds, as against 870,704,600 pounds in 1911; of lard, 252,176,100 pounds, as against 302,699,100 pounds, in 1911; of barreled pork, 138,752 barrels, as against 105,913 barrels, in 1911.
Receipts of all kinds of live stock at Chicago during 1912, aggregated 16,487,233 head, valued at $375,694,939, brought in 255,088 cars; as against 16,397,233 head, valued at $339,484,690, brought in 271,660 cars, in 1911.
Dtiring the year 1912 matters of importance to this Association have arisen and have received the attention of your Directors. Early in the year rulings of the Bureau of Chemistry of the United States Department of Agriculture, injurious in their effect on the grain commerce of the country, were promulgated. Your Directors originated a movement

calculated to overcome these rulings, which was taken up by the Council of Grain Exchanges and by the National Grain Dealers Association, a body of delegates meeting at Washington the Board of Administrative Control of the Bureau of Chemistry, composed of the three Secretaries of Agriculture, of the Treasury and of Commerce and Labor, and made a representation setting forth in detail the injury to the producers and handlers of farm products, and pleading that the Pure Food and Drugs Act could not have been intended by Congress to be applied to agricultural products in their natural form. The Secretaries after hearing the argu- ments and testimony of several chosen speakers, announced as their conclusion that the law was not so intended and the following day a formal ruling to this effect was made and published.
The same Board also promulgated a ruling on the practice of sulphur bleaching of grain, to the effect that such treatment of soimd grains is permissible if the packages are plainly labeled to show that they have been so treated for the purpose of removing weather stain only. All that was expected or desired at the beginning was accomplished with great financial benefit to producers and freedom from unreasonable restraint in the interstate movement of fermenting or hot grain. The decision of the United States Circuit Court of Appeals, reversing the findings of the lower court, has materially further removed the restraint on interstate shipments of grain growing out of the technical claims relative to misbranding, made by the U. S. Department of Justice at the instigation of the Bureau of Chemistry of the U. S. Department of Agriculture under the Pure Food and Drugs Act in the Hall-Baker Case.
Officers of this Association also participated with other Grain Exchanges under the leadership of the Coimcil of Grain Exchanges in making a repre- sentation to the Committee on Agriculture of the United States House of Representatives, against the so-called "Anti-Future Trading" bills before Congress, with the result that no legislation has been enacted, notwithstanding it is easily apparent that the sentiment is growing in the minds of the members of both branches of the National Legislative body that the Exchanges of the country should exercise care to avoid in any way giving offense to public opinion in the nature of interfering in any way with the normal and untrammeled flow of commerce in the articles dealt in on the Exchanges, especially those commodities freely bought and sold for future delivery.
As outlined in my address to the members one year ago, a committee was appointed to consider the advisability of erecting a new building in the place of the present one. Much time and careful attention has been

given to this subject, and a report is substantially ready for submission through the directorate to the members, which is being withheld for a time pending some improvement in the securities market, the successful operation of the proposed building most naturally depending somewhat on the amount of fixed charges including interest on the bonds to be issued.
During the year we have come into closer relations with the Chicago Association of Commerce. This body is of great influence, embracing in its membership prominent citizens, leaders in every branch of com- mercial and financial activity found in this great center of population and business. Its membership is large comprising more than four thousand of the active men of Chicago, who contribute more than any other agency to its growth and importance, placing it among the great cities of the world, holding the unique position of having grown to a commanding position in the shortest space of time of aU the large cities of the world.
The advantages of being closely allied with so powerful and influential a body as this is are too easily recognizable to make it needful to enumerate them here. I desire only to emphasize the desirability of coming into closer and more active relations with it, not only for the high purpose of participating in a large ser\dce to the great object of a better and a larger Chicago, but as well with the object of gaining in a materially increased meastu-e that added strength which proceeds from combining forces in defence against attacks from without, as well as in advancing our common interests from within. To this end, I am firmly of the opinion that good will tmquestionably come to the members of this Association and to the Association itself as a imit if they will in numbers more generally identify themselves with the larger body by becoming members of it.
I make no reference herein to other important matters relating to the Association because the same are fully covered in the Departmental reports.
IN MEMORIAM
The hand of death has been heavily laid upon the Association during the year. Twenty of our members, as against fifteen last year, have passed away. Among them were some of many years membership and prominence in long service to this Association. Our late Secretary, George F. Stone, who served us in that capacity for a period of twenty- eight years, earned for himself a high place by his devotion to duty, by his unfailing courtesy and his pronounced qualifications and ability. He was known throughout this, and in many foreign coimtries, as a Prince of Secretaries, and was well entitled by his superior qualities to that name. He will be long remembered by the members of this Association

as an officer who reflected great honor on it by his culture and his high character. He died Jtine 21, 1912.

Rules Governinglthe Inspection of Grain in the State of Illinois.
In Force On and After November 19, 1909.
The following are the rules adopted by the Board of Railroad and Warehouse Commissioners, establishing a proper number and standard of grades for the Inspection of Grain, as revised by them; the same to take effect on and after the 19th day of November, 1909, in lieu of all rules on the same subject heretofore existing: Orville F. RULE I WINTER WHEAT.
No. 1 White Winter Wheat shall include all varieties of pure soft white winter wheat, sound, plump, dry, sweet and clean, and weigh not less than 58 pounds to the measured bushel.
No. 2 White Winter Wheat shall include all varieties of soft white winter wheat, dry, sound and clean, and shall not contain more than 8 per cent of soft red winter wheat, and weigh not less than 57 pounds to the measured bushel.
No. 3 White Winter Wheat shall include all varieties of soft white winter wheat. It may contain 5 per cent of damaged grains other than skin-burnt wheat, and may contain 10 per cent of soft red winter wheat, and weigh not less than 53 pounds to the measured bushel.
No. 4 White Winter Wheat shall include all varieties of soft white winter wheat not fit for a higher grade in consequence of being poor quality, damp, musty or dirty, and shall not contain more than 10 per cent of soft red winter wheat, and weigh not less than 50 pounds to the measured bushel.
No. 1 Red Winter Wheat shall be pure soft red winter wheat of either or both light and dark colors, sound, sweet, plump and well cleaned, and weigh not less than 60 pounds to the measured bushel.
No. 2 Red Winter Wheat shall be soft red winter wheat of either or both light and dark colors, sound, sweet and clean, shall not contain more than 5 per cent of white winter wheat, and weigh not less than 58 pounds to the measured bushel.
No. 3 Red Winter Wheat shall be sound, soft red winter wheat of either or both light and dark colors, not clean or plump enough fpr No. 2, shall not contain more than 8 per cent of white winter wheat, and weigh not less than 55 pounds to the measured bushel.
No. 4 Red Winter Wheat shall be soft red winter wheat of either or both light and dark colors, shall contain not more than 8 per cent of white winter wheat. It may be damp, musty or dirty, but must be cool, and weigh not less than 50 pounds to the measured bushel.
No. 1 Hard Winter Wheat shall include all varieties of pure, hard winter wheat, sound, plump, dry, sweet and well cleaned, and weigh not less than 61 pounds to the measured bushel.
No. 2 Hard Winter Wheat shaU include aU varieties of hard winter wheat of either or both light and dark colors, dry, sound, sweet and clean, and may contain not more than 25 per cent of soft red winter wheat, and weigh not less than 59 pounds to the measured bushel.
No. 3 Hard Winter Wheat shall include all varieties of hard winter wheat of either or both light and dark colors, not clean or plump enough for No. 2, and may contain not more than 25 per cent of soft red winter wheat, and weigh not less than 56 pounds to the measured bushel.
