RERA Settlement - 79%- Sharmila Ranade

Real Estate (Regulation and Development) Act has provided a platform for the aggrieved home buyers to seek relief from the faulting Developers. MGP has been actively involved in Conciliation with Developers Associations since March 2018 to facilitate the settlement of such disputes.

Presently 25 Conciliation Benches are operating in Mumbai, Thane, Pune, Nasik where MGP Volunteers are nominated as Conciliators. Disputes pertaining to claiming interest for delay in handing over the

paid to the Developer, Non formation of Cooperative Housing Society, Non Issuance

before the Conciliation Benches.As of September 2019, 465 cases were

referred for Conciliation out which 318 were referred to Benches in Mumbai and Thane and 147 were referred to Benches in Pune. 210 cases in Mumbai and 98 cases in Pune were successfully settled. Settlements could not be arrived at in 67 cases in Mumbai and 16 cases in Pune. Hearings are in process for

18 cases in Mumbai and 17cases in Pune. It may be noted that the success ratio for Settlement is 78.77%.

MahaRERA has been referring certain cases to Designated Conciliation Benches when the disputing parties agree to resolve their dispute by way of Conciliation. As of now 6 Designated Conciliation Benches are operating in Mumbai and Pune. As of now 13 cases have been referred by MahaRERA out of which 7 have been settled successfully and hearing is in process for 5 cases. Settlement could not be reached in one case.

To MahaRERA,On 12th Oct. 2019, Conciliation case

hearing took place in Andheri.The branch was

addressed by Mr. Paras Gundecha and Adv. Sharmila Ranade. From the time. I entered the premise, there was warmth and positive attitude in every person involved,

Dr. Harsh Vardhan, Union Minister of Health and Family Welfare launched the 'Trans Fat- Free' logo of the Food Safety & Standards Authority of India (FSSAI), at the 8th International Chefs’ Conference (ICC VII) in New Delhi, on 4th October 2019. An important milestone in the movement against Trans-Fats, it also provided momentum to the ‘Eat Right India’ movement of FSSAI.

Food establishments, which use trans-fat-free oil and do not have industrial trans-fat more than 0.2g/100g of food, can display the 'Trans-fat-free' logo at their outlets, and on their food products. The use of the said logo is voluntary. Industrial trans-fats are made by adding hydrogen to liquid vegetable oils to make them more solid, and to increase the shelf life of foods. Trans-fats are largely present in partially hydrogenated vegetable fats/oils, vanaspati, margarine, and bakery shortenings, and can be found in baked and fried foods.

The Union Health Minister said, “Trans-fats are the worst type of fats with known health risks. FSSAI is committed to reducing the industrially-produced trans-fatty acids to less than 2% by 2022 in a phased manner”.

At the same event, Dr. Harsh Vardhan released a slogan ‘Chefs 4 Trans Fat Free’, under which more than 1,000 chefs from different parts of the country took a pledge to use trans-fat-free oils in their recipes. He also launched the Green Purple initiative logo. This initiative aims to qualify chefs on food safety legal requirements and sustainable cooking methods, for promoting

program that includes key areas of trans-fat-free cooking, using less sodium, and hygienic, seasonal, eco-friendly, less-energy consuming cooking methods. The chefs shall thereafter ensure global standards of food safety and sustainable environment practices.

The Mobile App is an alternate way to register consumer-related grievances on the portal https://consumerhelpline.gov.in. The website was launched by the department of consumer affairs, government of India to create awareness, advise and redress consumer grievances and act as a central registry for lodging consumer grievances.

Though all efforts will be made to address grievances registered on the portal, if the grievance is not redressed to full satisfaction, a consumer has the choice to approach the appropriate consumer forum. As per the

Mobile App for Consumer ComplaintsConsumer Protection Act, consumers can approach consumer forums at the district, state and national level for dispute resolution.

An aggrieved consumer can register grievance by either calling the

toll-free number 1800-11-4000 or 14404 to talk to an agent to register it or register online on the portal or through the mobile app, in which case, the consumer gets an user ID and password to lodge a grievance.1

The app also has consumer awareness material, addresses of various consumer forums and other related useful sites.

UNFAIR CONTRACT TERMSOne of the new provisions added in the

CPA, 2019 is that of Unfair Contract (UC). This is different from Unfair Trade Practice (UTP)

"Unfair Contract" means a contract between a manufacturer or trader or service provider (like Builder/Developer, Finance Companies etc.) and Consumer, which contains certain terms which are unfair to

in rights of such consumer.

2) Imposing heavy penalty on the consumer for breach of contract wholly disproportionate to the loss suffered due to such breach. eg Builder imposing term of forfeiture of the entire amount paid by the homebuyer in the event of cancellation of booking by the

homebuyer.3) Refusing to accept early repayment of

debts4) Entitling a party to contract to terminate

the contract unilaterally without reasonable cause. Eg. Builder reserving right to terminate Agreement for Sale without notice in case of default in payments by consumer.

5) Permitting one party to assign contract to the other without consent of the consumer.

6) Imposing on consumer any unreasonable charge, obligation or condition which puts such consumer to disadvantage.Such Unfair Terms in contract can now

be challenged under CPA, 2019.However, the powers to strike down

such unfair contract terms are given only to State Commission and National Commission. District Commission is not given this power. Hence Complaints challenging Unfair

National Commission. This provision of striking down Unfair

consumers from lot of market transactions where consumers have to reluctantly agree to sign such unfair terms.

In a long-awaited judgement, MahaRERA Bench has declared that Property Web Portals which go beyond mere advertising and actually facilitate and negotiate sale/purchase of properties for Developers & Home-buyers must register themselves as Real Estate Agent with MahaRERA
