Petition By Joint Civil Society Groups And Concerned Citizens 1 THE PEOPLE/S PETITION TO THE PRIME MINISTER GORDON DARCY LILO WE, the people of Solomon Islands hereby Petition: a) The Prime Minister of Solomon Islands, Hon Gordon Darcy Lilo to resign as Prime Minister of Solomon Islands within the next seven (7) days failing which the people of Solomon Islands will take very strong and appropriate non-violent civil actions. TO: The Prime Minister Gordon Darcy Lilo and members of the Cabinet of Solomon Islands, let us remind ourselves of the intention and spirit of our nation, Solomon Islands, when we gained independence on the 7 th July 1978 and gave ourselves the National Constitution by which we have been governed to this day. We make reference to the PREAMBLE TO THE CONSTITUTION and we quote; “We the people of Solomon Islands, proud of the wisdom and the worthy customs of our ancestors, mindful of our common and diverse heritage and conscious of our common destiny, do now, under the guiding hand of God, establish the sovereign democratic State of Solomon Islands; AS a basis of our unite nation DECLARE that; a) All power in Solomon Islands belongs to its people and is exercised on their behalf by the legislature, the executive and the judiciary established by the Constitution; b) The natural resources of our country are vested in the people and the government of Solomon Islands; AGREE AND PLEDGE that a) our government shall be based on democratic principles of universal suffrage and the responsibility of executive authorities to elected assemblies; b) We shall uphold the principles of equality, social justice and equitable distribution of income; c) We shall respect and enhance human dignity and strengthen and build on our communal solidarity; d) We shall cherish and promote the different cultural traditions within Solomon Islands; e) We shall ensure the participation of our people in the governance of their affairs and provide within the framework of our national unity for the decentralization of power; AND for these purpose we now give ourselves this Constitution.     THE PEOPLE/S PETITION

    TO THE PRIME MINISTER GORDON DARCY LILO

    WE, the people of Solomon Islands hereby Petition:

    a) The Prime Minister of Solomon Islands, Hon Gordon Darcy Lilo to resign as Prime Minister of

    Solomon Islands within the next seven (7) days failing which the people of Solomon Islands will

    take very strong and appropriate non-violent civil actions.

    TO:

    The Prime Minister Gordon Darcy Lilo and members of the Cabinet of Solomon Islands, let us remind

    ourselves of the intention and spirit of our nation, Solomon Islands, when we gained independence on

    the 7th July 1978 and gave ourselves the National Constitution by which we have been governed to this

    day.

    We make reference to the PREAMBLE TO THE CONSTITUTION and we quote;

    We the people of Solomon Islands, proud of the wisdom and the worthy customs of our ancestors,

    mindful of our common and diverse heritage and conscious of our common destiny, do now, under the

    guiding hand of God, establish the sovereign democratic State of Solomon Islands;

    AS a basis of our unite nation DECLARE that;

    a) All power in Solomon Islands belongs to its people and is exercised on their behalf by the legislature,

    the executive and the judiciary established by the Constitution;

    b) The natural resources of our country are vested in the people and the government of Solomon Islands;

    AGREE AND PLEDGE that

    a) our government shall be based on democratic principles of universal suffrage and the responsibility of

    executive authorities to elected assemblies;

    d) We shall cherish and promote the different cultural traditions within Solomon Islands;

    e) We shall ensure the participation of our people in the governance of their affairs and provide within

    the framework of our national unity for the decentralization of power;

    AND for these purpose we now give ourselves this Constitution.

    LET IT BE KNOWN THAT WE, the undersigned people. founded our Petition on the:

    a) Fundamental right of freedom of Expression enshrined under Section 12 of the National

    b) Declaration that all power in Solomon Islands belongs to its people and is exercised on their

    behalf by the legislature, the executive and the judiciary established by the Constitution;

    c) Pledge that the democratic principle of governance shall ensure the participation of our

    people in the governance of their affairs and provide within the framework of our national

    unity for the decentralization of power;

    d) Believe that the Doctrine of Separation of Powers pursuant to Section 35 of the National

    Constitution has not been effected properly on our behalf by the Executive Arm of the

    Government due largely to negligent and recklessness acts under the leadership of the Prime

    Minister Gordon Darcy Lilo.

    LET IT BE KNOWN OUR CALL IS MADE PURSUANT to Section 34 (3) (d) of the National Constitution [S34

    (3) The office of Prime Minister shall also become vacant -(d) if he resigns such office by writing under

    his hand addressed to the Governor-General] which provides for resignation by the Prime Minister

    grounded on the following:

    A. LEADERSHIP FAILURE AND SCANDALS IN THE EDUCATION SECTOR

    1. THE GOVERNMENTS POOR MANAGEMENT AND FAILURE TO PAY STUDENT FEES AND

    ALLOWANCES [SINU, USP, FSM, FIT, UPNG, CUBA, PAU ETC]

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    the Ministry of Education & Human Resources Development has miserably failed in

    administrating the National Scholarship Scheme fairly and transparently;

    the Ministry of Education & Human Resources Development has miserably failed in managing

    and controlling, monitoring and evaluation of the budget for scholarships-

    i) by over running the budget by $10.4 million

    ii) late payment of scholarships allowances for our student overseas

    iii) late payment of tuition fees to overseas universities

    iv) approval of scholarships for unsuitable students who are taking up placements

    of capable students.

    The Ministry of Education & Human Resources Development has miserably failed to implement

    the Auditor Generals Report and Recommendation in the 2006 OAG Report.

    The Prime Minister misled and lied to the nation about securing 800 scholarships (K20m) for

    Solomon Islanders to study in PNG Institutions.

    The Government owes Solomon Islands National University (SINU) $22.7 million and has no

    money available immediately to resolve the issue

    Government-sponsored students at SINU have been locked out of campus and are going without

    accommodation, food, and transport allowances

    SINU faces closure in a months time due to the irresponsibility of Prime Minister Gordon Darcy

    Lilo and his Government

    The Curriculum Development Centre has been inoperable due to non-payment of power bill and

    other utilities

    The TVET department has been evicted from their office due to non-payment of rental bills

    KGVI School has been forced to close down for one week due to disconnection of power for non-

    payment of bills.

    Creating unnecessary negative impact on the right to education for our children.

    PETITION:

    The Prime Minister as leader of the Executive Head of the Solomon Islands Government has miserably

    failed and/or refused and/or neglected to exercise proper management and leadership resulting in dire

    consequences suffered by our students, therefore denying the nation of its future human resources

    development.

    So we strongly petition Hon Gordon Darcy Lilo to step aside from being the Prime Minister of Solomon

    Islands.

    2. SECONDARY SCHOOLS COMPUTER PROJECT SCAM

    ISSUES OF CONCERN:

    The misappropriation of $4.9 million has denied children of Solomon Islands their rights to

    quality education.

    The current Prime Minister was Minister of Finance and Acting Prime Minister when the

    secondary school computer project was undertaken and subsequently abused.

    The Ministry of Finance and Treasury did not process a normal general payment voucher and

    consequently the payment to Antech Pty Ltd for $4.9m was in breach of the Financial

    Instructions and the Public Finance and Audit Act.

    The actions of the Prime Minister Gordon Darcy Lilo when as Minister of Finance and Acting

    Prime Minister, in collusion with Antech Pty Ltd may amount to serious breach of the Penal Code

    of Solomon Islands.

    PETITION:

    The Prime Minister Gordon Darcy Lilo has been implicated in this scandal involving $4.9 million dollars

    and therefore we petition him to step aside to allow for investigations to be conducted.

    3. SOLOMON ISLANDS NATIONAL TEACHERS ASSOCIATION- TEACHERS SALARY RE-LEVELING AND

    INCREMENT

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    The Governments continuous breach of the following:

    A. Trades Dispute Panel Consent Order

    B. Two Memorandum of Agreement

    C. A High Court Consent Order.

    The delaying tactics employed by the Solomon Islands Government to frustrate the teachers of

    Solomon Islands and deny their lawful entitlements.

    Soliciting of bribes and corruption by public servants seeking payment from teachers before

    processing re-leveling and incremental payments.

    The actions of the Solomon Islands Government caused the unnecessary denial of the children of

    Solomon Islands right to quality education

    It is more appalling to note that Solomon Islands Government says it is not giving priority to

    Education as pronounced in the Prime Ministers Independence Speech.

    PETITION:

    The Prime Minister Gordon Darcy Lilo has failed the nation through gross negligence to resolve these

    very important national concerns in the education sector therefore we strongly petition the Prime

    Minister to step aside.

    B. FREQUENT COSTLY OVERSEAS TRIPS WITH UNNECCESARY DELEGATES

    4. TOO MANY OVERSEAS TRIP WITH TOO MANY UNNECESSARY DELEGATES

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    Too many overseas trips by the Government that are not properly planned and budgeted for

    thereby considered unproductive.

    Exceeding budget allocations for overseas travels.

    Lack of accountability by not producing appropriate reports for each of the travelling

    delegations.

    The nation has not observed any benefits whether real or tangible as a result of these expensive

    trips except for lies and deception (kalulu deals) e.g. Georgia computer deal & K20m PNG

    scholarship assistance deal, Indonesian investment deals.

    It would appear from the frequency of overseas trips taken by the government that the Prime

    Minister spends an average of 20 days overseas and only about 10 days in-country per month. In

    essence if the Prime Minister travels overseas for at least 20 days in a month that would cost the

    tax payers approximately $60,000.00 [his usual per diem of more than $3000.00 per day] over

    and above his usual entitlements and so in a year the cost would be approximately $720,000.00.

    Inclusion of political appointees for the purposes of political expediency and treating of political

    supporters and political fixers

    The inclusion of Ms. Bronwyn Noda in almost the all trips as spouse of the Prime Minister when

    the Prime Minister has yet to dissolve his marriage to his legal wife and allowing Ms. Bronwyn

    Noda to receive per diems and enjoying tax payers money as legal spouse of PM tantamount to

    fraud and misappropriation of peoples money under the laws of Solomon Islands.

    Lack of terms of references to provide clear descriptions of the roles and responsibilities of each

    travelling delegate therefore accommodating tourists at the expense of poor taxpayers of

    Solomon Islands who make up the silent majority

    Huge travelling delegations becoming a national liability because it deprives the nation of much

    needed financial resources.

    THESE EXORBITANT EXPENSES ARE EXEMPLIFIED IN THE RECENT INDONESIAN TRIP WHERE THE

    FOLLOWING EXPENSES WERE INCURRED:

    resulting in useless and unlawful spending on extravagant, lavish and expensive government overseas

    trips therefore we strongly petition the Prime Minister to step aside.

    5. GOVERNMENT TRIP TO INDONESIA

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    Unjustified and irresponsible suspension of a parliamentary sitting to undertake the trip despite

    the availability of the Deputy Prime Minister in-country to continue proceedings;

    The haste in taking the trip and the ad hoc manner of planning for the trip

    - Illegal financial arrangements

    - No TORs for each travelling delegate

    - Payment of dubious allowances

    - Irrelevant delegates

    Deliberately lying to the nation

    - Trip being fully funded by Indonesia when the delegation is understood to have visited other

    nations as well Australia, Malaysia, Jayapura, Singapore

    - Noncompliance with normal standards of international diplomatic and bilateral protocols

    when Indonesia purportedly reimbursed Solomon Islands government for the full cost of the

    trip when it was announced to be a Solomon Islands State Visit to Indonesia

    - Compromising the sovereignty of Solomon Islands and insulting the people of this nation in

    soliciting and accepting the reimbursement from Indonesia

    - Failure to disclose the real source of the reimbursement from Indonesia

    - Abusing bilateral relations to mask personal interests in the logging industry discussing

    Maybank with Malaysian representatives

    - Concealing the true nature of the Indonesian and another associated trip

    6. PROMOTING HUMAN RIGHTS VIOLATIONS AND ATROCITIES PERPETRATED BY INDONESIA ON

    WEST PAPUANS

    Under the leadership, management and control of Prime Minister Gordon Darcy Lilo:

    - Paying lip service and ignoring the plight of the oppressed people of West Papua at international

    forums including the United Nations General Assembly

    - Misrepresenting the peoples of Solomon Islands and the Melanesian Spearhead Group concerns

    on human rights abuses in West Papua

    - Pre-empting the views of other MSG nations on West Papua

    - Subverting the proposed delegation planned visit to West Papua. NOTE!!!! FIJIS CONCERN.

    PETITIION

    The Prime Minister Gordon Darcy Lilo has failed the nation through continuous gross deceits and

    dubious diplomatic dealings for self-interest and political expediency therefore we petition the Prime

    Minister to step aside.

    The proposed unjustified, un-procedural and inconsistent award of pension to one-term

    9. FUNDING OF FIJI DELEGATION FOR INDEPENDENCE CELEBRATIONS

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    Unnecessary and unjustified spending on an controversial government leader and his disciplinary

    forces as tourists in Solomon Islands

    Alleged undermining the Royal Solomon Islands Police full participation in the Independence Day

    guard of honor.

    The extravagant spending of $8.6 million of government funds for the Fiji delegation and the

    RAMSI 10th Anniversary celebrations.

    The Members of Parliament are yet to account for the distribution of $15milion by providing a

    report to NDC or NDMO to detail how these funds were used.

    Failure by Prime Minister Gordon Darcy Lilo to provide a report accounting for the use of $2.7

    million of tsunami funds allocated to Gizo/Kolombangara constituency paid into his personal

    account.

    In contravention of the National Disaster Act, the Prime Minister Gordon Darcy Lilo when as

    Minister of Finance devised this accounting concept as an opportunity to have access to the $15

    million approved by Cabinet for disaster relief and rehabilitation of victims of the earthquake

    and tsunami disaster.

    Also in contravention of the National Disaster Act, Gordon Darcy Lilo initiated this illegal

    Disaster Relief Account and placed it under his direct personal control.

    Conflict of interest as the Member of Parliament for West Honiara had a High Court case

    pending against him at that time (Citizenship Case)

    This assistance is considered as TREATING of voters in his constituency

    Compromising the integrity thus increasing the publics perception of corruption in the RSIP

    Failure by the Prime Minister to discipline the Chairman of Government Caucus for putting the

    integrity of the RSIP into disrepute

    PETITION:

    The Prime Minister Gordon Darcy Lilo has lost total control over the management, disbursement, and

    accountability of public funds belonging to the people of Solomon Islands or at best manipulated the

    use of the public funds for political expediency and ambition, therefore we the people of Solomon

    Islands strongly petition the Prime Minister to resign with immediate effect.

    The Prime Minister and his government turned a blind eye to illegal harvesting of beche-de-mer.

    The lifting of the ban was politically motivated.

    The tendering process for temporary licenses was biased and not transparent.

    Licenses issued were mostly to political supporters.

    The Prime Minister and his Governments lack of transparency and accountability to deal fairly

    and justly with the people of Ontong Java following voluntary surrender of their beche-der-mer

    consignment to the Attorney General of Solomon Islands.

    The $51 million beche-de-mer scandal involving the government and dubious foreign (Chinese)

    businessmen which is currently before the High Court of Solomon Islands. This business deal has

    attracted and instigated both civil and criminal investigations.

    The theft of 44 bags of beche-de-mer on Monday 14 October under the directive of a

    government backbencher undermining Cabinet and legal processes

    Non-payment of outstanding contractor payments in the sum of approximately $17 million

    despite repeated demands for payment.

    representation of all landowning tribes of the Munda airport land

    The Prime Minister and political cronies are promoting division between the tribal owners of

    Munda airport land.

    The indifferent attitude of the Prime Minister and his political cronies in addressing genuine

    landowner issues repeatedly raised to his office by concerned landowners may result in social

    disorder.

    Under the above scenario, the safety of passengers and aircrafts using the Munda airport is

    being compromised by the actions of the Prime Minister Gordon Darcy Lilo and his advisors.

    24 TRUTH AND RECONCILIATION COMMISSION (TRC) REPORT FAILURE TO RELEASE

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    Failure by the Prime Minister to table the Report before Parliament thereby undermining

    requirements of the TRC Act.

    Failure to table the Report despite its undue release via the social media

    The failure to table the Report will potentially result in unnecessary delays in implementing its

    recommendations

    The indifferent attitude of the Prime Minister Gordon Darcy Lilo has and will compromise the on-

    going peace processes

    Islands by the Prime Minister Gordon Darcy Lilo and his Government.

    Outright rejection of the peoples ownership of the National Parliament of Solomon Islands

    through Prime Minister Gordon Darcy Lilos sheer arrogance and insistence to expedite the

    passage of the Bill.

    Lack of morals, ethics, and accountability in the intent of the Bill

    27. GRANTING OF DUTY AND TAX EXEMPTIONS

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    Granting of 100% Tax and Duty exemptions on Cigarettes to Solomon Sun Cigarette Factory

    Company Limited for a 40 feet container

    Elite Idea Ltd (a Cayman Island registered company and owned by Tian Family of Taiwan) Tax

    and Duty Exemption granted to it to invest in SI [This is contained in a written MOU];

    i) during the period of 5 years from 2011 to 2015, be 100% exempt from

    - Company income tax upon its profits and income earned

    - Withholding tax on dividends paid out of profits, regardless of whether the dividends

    were paid during or after the tax holiday period

    - Withholding tax on interest on shareholder loans notwithstanding that the investor was

    not a duly registered financial institution;

    - Goods tax and import duty on capital equipment to the value of SBD$25.7 million

    - Export duty of any kind or amount on plantation logs and/or sawn plantation logs

    (currently assessed at nil%) even if the rate is moved above zero.

    ii) Be exempt from tax on the income of expatriate workers

    iii) Be exempt from penalties on arrears of tax

    v) Elite Idea Limited 100 % tax and duty exemption for the further period from 2016 to

    2030.

    vi) Prime Minister Gordon Darcy Lilo and his government are promoting and entertaining

    5. Assent of the Governor General as Head of State to make the National Budget an Act of

    However, under the leadership of Prime Minister Lilo, Cabinet without going back to the Parliament to

    amend the Appropriation Act, unilaterally agreed to transfer funds allocated for rural community

    development usually managed and administered by the appropriate Ministries, to the control and

    management of the individual Members of Parliament.

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    Breach of National Constitution.

    Breach of Appropriation Act, Public Finance & Audit Act, and Financial Instructions

    Misuse or abuse of Cabinet due processes

    Misuse and abuse of the democratic principle of separation of powers.

    PETITION:

    The Prime Minister Gordon Darcy Lilo has willfully, wittingly and deliberately solicited political support

    from Cabinet and Caucus members through the abuse of laws and procedures governing Parliamentary

    and Cabinet processes in order to gain access and control over public funds.

    By doing that the Prime Minister has lost total and proper control over the management, disbursement,

    and accountability of public funds belonging to the people of Solomon Islands.

    Obviously the Prime Minister Gordon Darcy Lilo has invented this scheme to manipulate the use of

    Public Funds in order to continue to keep him in power as the Prime Minister; therefore we relentlessly

    condemn his actions and unconditionally petition the Prime Minister Gordon Darcy Lilo to resign with

    immediate effect.

    F. BRINGING THE HIGH OFFICE OF THE PRIME MINISTER OF SOLOMON ISLANDS INTO DISREPUTE

    30. PMS EXTRAMARITAL SCANDAL

    ISSUES OF CONCERN:

    The Prime Minister Gordon Darcy Lilo has brought the High Office of the Prime Minister of

    Solomon Islands into disrepute:

    - When he allegedly had an affair with a private citizen.

    - Subsequently frivolously used the court process to derail and dodge any productive

    investigations (LCC complaint by FSII and complaint to the police by Solomon Star for

    threats and demanding with menace) into the circumstances surrounding the affair

    - The delay in pursuing his civil claim in the High Court concerning his denial of the alleged

    affair has impeded the progress of RSIP and Leadership Code Commission investigations

    and possible laying of charges.

    The Prime Minister Gordon Darcy Lilo has further brought the High Office of the Prime Minister

    of Solomon Islands into disrepute, when:

    - In response to our concerns on the payment of per diems and other travel entitlements

    of travelling government delegates, the Office of the Prime Minister stated that

    delegates were paid under contractual arrangements.

    - We understand that Ms. Bronwyn Noda does not have any legal contractual

    arrangements with the SIG therefore not legally entitled to receive any travel

    entitlements.

    - Gordon Darcy Lilo presented Ms. Bronwyn Noda as his legal wife in custom locally, and

    internationally as Madame Lilo, and we contest the validity of such a presentation.

    31 EXPENSIVE GOVERNMENT RENTAL AND UTILITIES BILLS

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    Misuse of Government vehicle assets, costing the people of Solomon Islands approximately $17

    Bringing the Commission into disrepute for non-performance of its functions and duties.

    33. TACTICAL DELAY IN THE APPOINTMENT OF COMMISSIONER OF POLICE

    ISSUES OF CONCERN:

    Under the Leadership, Management and Control of Prime Minister Gordon Darcy Lilo:

    Political interference into an independent constitutional office.

    Delaying tactics by the Prime Minister and his office to prevent RSIP investigations into

    allegations against him and his cronies Members of Parliament and high government officials.

    Loss of faith and trust in the RSIP by the people of Solomon Islands.

    Bringing the RSIP into disrepute for non-performance of its functions and duties.

    PETITION:

    The people of Solomon Islands hereby unconditionally demand the resignation of the Prime Minister
