    Permit Descriptions CAFRA - A Coastal Area Facility Act permit is required to construct residential, commercial, public, transportation, utility and energy-related facilities in the coastal area as defined by the Act. Federal Consistency Activity: Certain federal permits, not limited to the U.S. Army Corps of Engineers Dredge and Fill Permits, require certification by the DEP prior to the issuance of the permit by the federal agency. Flood Hazard Area: A Flood Hazard permit or verification is required for disturbances within the floodway or floodplain in areas regulated under the Flood Hazard Area Control Act. Freshwater Wetlands: A Permit (Letters of Exemption, Letters of Interpretation, Statewide General Permit, Open Water Fill, Individual, Transition Area Waiver, Water Quality Certificate) is needed prior to engaging in a regulated activity in or around freshwater wetlands and associated transition areas. A Flood Hazard Area Permit, an U.S. Army Corps of Engineers Dredge and Fill Permit, and a Water Quality Certification may also be required. General Groundwater Petroleum Products Cleanup: This general permit authorizes the surface water discharge of treated groundwater previously contaminated with petroleum products. NJPDES permits: A permit is required for the discharge of pollutants to surface and groundwater, a discharge from an indirect user or the land application of municipal and/or industrial residuals. (A more comprehensive definition of activities, which require a permit, may be found at N.J.A.C. 7:14A-2.4) Solid Waste Facility: A permit is required to conduct or operate any solid waste facility as defined under the Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq., and N.J.A.C. 7:26-1 et seq. Special Highlands Resource: A Highland Preservation Area Approval is required for regulated activities within the Highland Preservation Area as defined in the Highlands Water Protection & Planning Act Preservation Area Rules. Tidal Wetlands: A Coastal Wetlands Permit is needed to excavate, dredge, fill or erect structures on coastal wetlands. Treatment Works Approval: A TWA permit is required for the construction, modification or operation of a treatment works, including sanitary/industrial sewage pretreatment or treatment systems, sewage conveyance systems, sewer extensions and subsurface sewage disposal systems. Waterfront Development: A permit is required for any project involving the development of waterfront near or upon any tidal or navigable waterway in the State. Coastal Wetlands: A permit authorizing disturbances to Mapped Tidal Wetlands under the Wetlands Act of 1970, N.J.S.A. 13:9A”

    General Information The DEP Bulletin is an information service provided by the New Jersey Department of Environmental Protection. In compliance with the Rules and Regulations Governing 90 Day Construction Permits (NJAC 7:1C-1.1 et seq.) this semi-monthly publication contains a list of construction permit applications recently filed or acted upon by the DEP. Using the Application Milestone Codes located on the inside front cover, interested persons can determine the status of Coastal Area Facility Review Act (CAFRA) permits, Federal Consistency Activity permits, Freshwater Wetlands Individual and Statewide General permits, General Groundwater Petroleum Products Cleanup permits, Open Water Fill permits, Solid Waste Facility permits (SWF), Flood Hazard Area (FHA) permits, Tidal Wetlands permits, Waterfront Development permits and Treatment Works Approvals (TWA). In addition, a calendar of Events of Interest and a Schedule of Public Hearings is provided. The public hearings listed do not, however, constitute an official notice. Environmental Impact Statements acted upon during the period are also shown. Additional information concerning the permit applications can be obtained by calling the project manager at the appropriate office listed on the inside back cover. Public Hearings are held for the purpose of obtaining input and reaction to a proposed rule, regulation, or new program. Some hearings may be mandated by law. Generally their scope of impact is statewide or of broad general interest and open to the public. Contested Case Hearings are held between the State and a particular party involving an application, enforcement violation or an appeal. Interest in these hearings is generally limited to those directly involved. DEP Events of Public Interest include public hearings, council meetings, workshops, public information meetings, and exams.

    CAFRA Hardship Exception (SWRPA)

    TAKE NOTICE THAT THE DEPARTMENT OF ENVIRONMENTAL PROTECTION inadvertently published a Notice on page 6 of the December 21, 2011 DEP Bulletin, which was identical to the notice published in August 18, 2010 DEP Bulletin regarding this application. That notice in the December 21, 2011 DEP Bulletin was published in error and should be disregarded. TAKE FURTHER NOTICE THAT THE DEPARTMENT OF ENVIRONMENTAL PROTECTION, subject to notice and comments, intends to issue a CAFRA permit with a hardship exception for a Special Water Resources Protection Area (“SWRPA”) for the Railroad Avenue Connector Road between Lacey Road and U.S. Route 9 in Lacey Township, Ocean County, New Jersey. This notice is provided in addition to prior notice provided on August 18, 2010 regarding a Stipulation of Settlement for the proposed issuance of the required permits from the Division of Land Use Regulation to authorize the project, which are still under consideration by the Department. IN THE MATTER OF: Township of Lacey CAFRA File No. 1512-08-0020.1 CAF080001 Freshwater Wetlands File No. 1512-08-0020.1 FWW 080001 Flood Hazard Area Hardship Exception File No. 1512-08-0020.1 FHA 080001 OAL Docket No. ELUCA 10995-2009S The proposed project involves development of a new public road through the Special Water Resource Protection Area (“SWRPA”) of a Category 1 Water, specifically the Cedar Creek and an upstream tributary/ditch in the same HUC-14 watershed of Cedar Creek. A SWRPA exists because Cedar Creek and the tributary ditch appear on the USGS map as lined features and because the proposed project is classified as a major development pursuant to N.J.A.C. 7:8-1.2. N.J.A.C. 7:8-5.1(a). N.J.A.C. 7:8-5.5(h)(1)(i) establishes a 300 foot SWRPA buffer around the Cedar Creek and the tributary ditch. Encroachment in the outer 150 feet requires that the applicant demonstrate that the functional value and overall condition of the SWRPA will be maintained to the maximum extent practicable. Further, encroachment in the outer 150 feet is not permitted where it is previously undisturbed/undeveloped; encroachment in the inner 150 feet of the SWRPA is generally prohibited. N.J.A.C. 7:8-5.5(h)(1)(ii). The Technical Manual for Stormwater Resource Protection Area (revised January 24, 2008) issued with Commissioner Lisa Jackson’s Administrative Order No. 2008-02 provides that the Department may (1) make an allowance for encroachment into undisturbed portions of the outer 150 feet where there is no feasible and prudent alternative to the proposed project, including not pursuing the project, which would avoid or substantially reduce the anticipated adverse effects of the project, and if it meets the criteria for a hardship exception under the Flood Hazard Area Control Act Rules (See N.J.A.C. 7:13-9.8) and (2) make an allowance for encroachment in inner 150 feet for a linear development that has no feasible alternative route for which the Department makes the findings required to grant a hardship waiver under the Flood Hazard Area Control Act Rules (N.J.A.C. 7:13-9.8). The Department proposes to grant a hardship waiver for encroachment in the undisturbed outer 150 feet of the SWRPA (Cedar Creek and tributary/ditch) and the inner 150 feet of the SWRPA (tributary/ditch only) under N.J.A.C. 7:13-9.8 for this project based on upon information and materials previously submitted to the Department pursuant to N.J.A.C. 7:13-9.8(c). The Department reviewed materials describing the project’s potential impacts upon the environment and materials describing the existing development in the area and any potential impacts of the proposed project on that development. This hardship waiver does not pertain to: access requirements, potential impacts from or to flooding, and is not based on economic grounds. N.J.A.C. 7:13-9.8(c)(2), (3), (4). The project will disturb 14,777 square feet within the SWRPA (9766 square feet in the inner 150 feet surrounding the tributary/ditch, 3876 square feet in the outer 150 feet surrounding the tributary/ ditch, and 1135 square feet of overlapping area of the outer 150 feet of the Cedar Creek and the inner 150 feet of the tributary/ditch). Much of the SWRPA area surrounding the tributary/ditch and Cedar Creek in this area is previously disturbed. The area surrounding the tributary/ditch contains paved parking lots associated with commercial buildings and single-family homes. The project is proposed to increase public safety by diverting congested traffic in a densely developed area away from Route 9.

    There is no feasible and prudent alternative to the proposed project and there is no feasible and prudent alternative route to the proposed project. Further, granting of the hardship waiver would not compromise the reasonable requirements of public health, safety and welfare, or the environment. N.J.A.C. 7:13-9.8(a)(1). The New Jersey Department of Transportation (NJDOT) has advised the Department that the project will improve traffic on the local roadway network. NJDOT concludes that there is a need for a “more robust system” of local roadways within this region to allow for the local trips to exist on roadways designed with that specific traveler in mind. The Department has determined that the project promotes public health, safety and welfare by providing a safe alternative for local travel trips and that there is no feasible and prudent alternative to the proposed project, which was designed to further the public purpose of reducing congestion. The project is within an existing cleared right-of-way surrounded by residential and commercial development. The existing developments and vegetation, which parallel the proposed roadway, preclude alternative alignments. Therefore, the Department has determined that there is no practicable alternative alignment for the proposed project. See discussion in “Wetlands and Wetlands Buffers” (N.J.A.C. 7:7E 3.27 and 7:7E-3.28) and “Rule on Location of Linear Development” (N.J.A.C. 7:7E-6.1) in the Summary Report. Prohibiting development in the inner 150 feet of the SWRPA for this project would result in an exceptional and undue hardship on the applicant. N.J.A.C. 7:13-9.8 (b)(1). Given the previously disturbed nature of much of the SWRPA area, the existing development around the SWRPA, the public purpose of the project, the satisfaction of water quality requirements under the Stormwater Rules, prohibiting such development would be an exceptional and undue hardship on the applicant. This hardship would not adversely affect the use of any contiguous or nearby properties. N.J.A.C. 7:13-9.8(b)(2). Existing development will not be impacted because the project will meet the water quality standards of the Stormwater Rules and will not cause flooding. The proposed project will not pose a threat to the environment, or public health, safety and welfare. N.J.A.C. 7:13-9.8 (b)(3). Due to the existing conditions and project design, the project will not have an adverse impact of the functions provided by the SWRPA associated with the tributary/ditch to Cedar Creek and to the Cedar Creek; the functional value and overall condition of the SWRPA will be maintained to the maximum extent practicable. The tributary flows through an area that is significantly altered by human disturbance in the form of single family homes, lawns and human activities. Therefore the existing functional value of the riparian buffer, including temperature moderation, and pollution reduction, is significantly diminished. The project does not include any stormwater outfalls or point discharges within the SWRPA to the tributary. Instead all stormwater will sheet flow off of the road and will infiltrate or otherwise will be filtered prior to reaching the tributary to Cedar Creek or Cedar Creek. Therefore, the project will not have an impact on the pollution reduction functional value of the SWRPA. In addition, because stormwater will sheet flow off of the proposed road instead of being directly discharged, temperature and channel integrity will be moderated by the infiltration and interception of the stormwater as it sheet flows overland. Therefore, allowing the stormwater to sheet flow overland will mitigate any adverse impacts to the tributary to Cedar Creek associated with stormwater runoff. The Department has not identified the presence of suitable habitat for any threatened, endangered or unique species within any portion of the project limits. In addition, the Department has already reviewed the impacts associated with flood storage displacement and stormwater quality, quantity and recharge. Stormwater quality standards will be met. The hydraulics analysis associated with the construction of the culvert shows that there would be no additional flooding impact on adjacent properties. Further, the project is proposed for a public purpose to support public health, safety, and welfare. The hardship was not created by any action or inaction of the applicant or its agents. N.J.A.C. 7:13-9.8(b)(4). The applicant seeks to resolve a local traffic problem. The proposed project is the only prudent and feasible alignment to resolve the problem. Thus, the hardship was not created by the applicant. Thus, the applicant has satisfied the criteria under N.J.A.C. 7:13-9.8(a)(1) and (b) and the Department proposes to issue a hardship exception for encroachment into the SWRPA for this project.
