Footnote 2a:AUSA Bradley Murphy made an in limine motion to preclude me from introducing evidence of termination ofthe 6141 Plan in 1991 resulting from the Pension Benefit Guarantee Corporation motion granted by Decree ofthe United States District Court for the Western District of North Carolina pursuant to title IV ofERISA. Judge Mihm granted Murphy's motion and also precluded me from introducing any evidence or reference at trial whatsoever regarding the prior termination of the 6141 Plan, including the PBGC and District Court action, the termination of employment of a116141 Plan participants, the closing ofthe plant and business, and the opinion of Albert Grasso, a nationally recognized ERISA expert who was prepared to testify in my behalf that there was no plan subject to any provision oftitle I ofERISA at any time relevant to the Superseding Indictment. In consequence ofJudge Mihm's gag order I could not presentessential elements of my defense at trial.
