Begun and held in Metro Manila, on Monday, the tw enty-th ird day o f July, tw o thousand eighteen.

[ REPUBLIC ACT NO. 1 1 3 3 8 ]

AN ACT CREATING THE POSITION OF ASSISTANT CITY ADMINISTRATOR, EMPHASIZING THE PROHIBITION ON ILLEGAL GAMBLING, AND ESTABLISHING THE CITY REGISTRY OF DEEDS OFFICE, AMENDING FOR THE PURPOSE SECTIONS 7, 10, 36, 51 AND 52 OF REPUBLIC ACT NO. 8983, OTHERWISE KNOWN AS THE CHARTER OF THE CITY OF BAYAWAN

Be it enacted by the Senate and House of Representatives o f the Philippines in Congress assembled:

Section 1. Section 7 of Republic Act No. 8983, otherwise known as the “C harter of the City of Bayaw an”, is hereby amended to read as follows:

“Sec . 7. The O ffic ia ls o f the C ity o f Bayawan. — (a) There shall be in the City: a city mayor, a city vice mayor, sangguniang p an lu n g so d m em bers, a s e c re ta ry to th e

sangguniang panlungsod, a city treasurer and an assistan t city treasurer, a city assessor and an assistan t city assessor, a city accountant, a c ity b u d g e t o fficer, a c ity p la n n in g an d development coordinator, a city engineer, a city h ea lth officer, a city civil reg is tra r , a city a d m in is t ra to r a n d an a s s i s ta n t c ity adm inistrator, a city legal officer, a city social w e lfa re an d d e v e lo p m en t o fficer, a c ity veterinarian, a city general services officer, a city agriculturist, a city cooperatives officer, a city register of deeds, and an environm ent and natural resources officer;

“(b) XXX

“(d) XXX.”

Sec . 2. Section 10(D)(1)(e) of the C harter of the City of Bayawan is hereby amended to read as follows:

“Sec . 10. The Sangguniang Panlungsod.- X X X

“(e) Enact ordinances intended to prevent, suppress and impose appropriate penalties for habitual drunkenness in public places, vagrancy, mendicancy, prostitution, establishm ent and m ain tenance of houses of ill-repute, illegal gambling and other prohibited games of chance, fraudulent devices and ways to obtain money or property, drug addiction, m aintenance of drug dens, drug pushing, juvenile delinquency, the printing, distribution or exhibition of obscene or pornographic m aterials or publications, and such other activities inimical to the welfare and morals of the inhabitan ts of the City;”

Sec . 3. There shall be inserted a new section in the same C harter to be known as Section 36-A to be read as follows;

“Sec . 36-A. Assistant City Administrator.- (a) The assistant city adm inistrator m ust be a citizen of the Phihppines, a resident of the City of Bayawan, of good moral character, a holder of a college d eg ree p re fe ra b ly in p u b lic administration, law, or any other related course from a recognized college or university, and a first grade civil service eligible or its equivalent. The person appointed m ust have acquired experience in m anagem ent or adm inistrative work for a t least three (3) years immediately preceding the date of the appointment.

“(b) The assistant city adm inistrator shall be entitled to such compensation pu rsuan t to Republic Act No. 6758, as amended, otherwise know n as the ‘C om pensation and P osition Classification Act of 1989’.

“(c) The assistant city adm inistrator shall assist the city adm inistrator and perform such duties as the la tte r may assign.”

Sec . 4. Article VIII in the Charter of the City of Bayawan is hereby amended and two (2) new sections shall be inserted to be known as Sections 51 and 52, which shadl read as follows:

“Article VIII

City Registry of Deeds Office

“Sec . 51. The City R eg istry of D eeds Office. — (a) There shall be established in the

City a city registry of deeds office, which shall be under the supervision and control of the A d m in is tra to r of th e L and R e g is tra tio n Authority, pursuan t to the provision of Section 7 of Presidential Decree No. 1529, otherwise known as the Property Registration Decree.

“(b) The City of Bayawan shall provide a suitable space or building for the office of the city register of deeds until such time as the same could be provided out of the national fund.

“(c) The D e p a r tm e n t of B udget and M anagem ent (DBM) is m andated to estabhsh a full staff complement to support the registry of deeds until such time th a t the same shall be provided out of the national fund.”

“Sec . 52. The City Register of Deeds. - (a) The d ty registry of deeds office shall be headed by a city register of deeds, who m ust be a citizen of the Phihppines, a resident of the City, of good moral character, a member of the Integrated Bar of the Phihppines and m ust have practiced law for a t least three (3) years immediately preceding the date of the appointment.

“(b) The city register of deeds shall be en titled to such com pensation p u rsu a n t to Repubhc Act No. 6758, as amended, otherwise known as the ‘C om pensation and Position Classification Act of 1989’.

“(c) The d ty register of deeds shall perform aU the duties and functions as m andated under the provisions of the Property Registration Decree within the territorial jurisdiction of the City.”

Sec . 5. The subsequent sections in the Charter of the City of Bayawan are hereby renumbered accordingly.

Sec . 6. This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a new spaper of general circulation.
