GOLD BUYERS ACT, 1921.

Regulations.1. In these regulations, unless the context otherwise indicates,

the terms used have the meanings assigned to them by the GoldBuyers Act, 1921, and the following words and expressions have themeanings herein set against the same, respectively, viz.:

"the Act": the Gold Buyers Act, 1921; "the Department ofMines": the Head Office of the Department of Minesat Perth.

2. A "gold assayer," within the meaning of the Gold BuyersAct, 1921, shall be

(a) a person who for two years prior to the 1st day ofJanuary, 1922, continuously carried on business publiclyin Western Australia as a gold assayer; or

(b) a person who for three years prior to the 1st day ofJanuary, 1922, was actually continuously employed inWestern Australia as a gold assayer by a person,company, or corporation carrying on business publiclyas a gold assayer; or

(c) a person holding a certificate or diploma of competencyas a gold assayer, or of a kind that necessarily importscompetency as a gold assayer from a School of Minesor Technical School in Western Australia or any otherschool or institution approved by the Minister forMines.

The Warden must, before issuing a certificate for a licenseas a gold assayer under section 7 of the Act, be satisfied that theapplicant is a gold assayer within the meaning of this regulation.

3. The forms prescribed under these regulations in the schedulehereto, or to the effect thereof, shall be used in connection with anyapplication, certificate, declaration, license, record, registration,report or return to which any such form shall be applicable.

4. An applicant for a certificate for the renewal of his licenseas a gold assayer or as a dealer in gold matter, granted under theprovisions of sections 6, 7, and 8 of the Act, shall deliver or forwardto the Mining Registrar of the Warden's Court where the applicationis intended to be made seven clear days' notice in triplicate inForm No. 5, and shall post in a conspicuous place on the noticeboard of the Warden's Office a copy of such notice and also anotification of the day on which such application will be heard bythe Warden.

5. An applicant for transfer to other premises shall give sevenclear days' notice to the Mining Registrar in triplicate in Form No.6, and shall post in a conspicuous place on the board at the Warden'sOffice a copy of such notice and also a notification of the day onwhich such application will be heard by the Warden.

6. The Mining Registrar of the Warden's Court at which acertificate for the issue or renewal of any license is granted, or atwhich any license is revoked or transferred, shall enter the particu-pars of same in a register in the Form No. 7, and shall also keep aregister in the Form No. 8 of all licenses issued by him.

7. A duplicate of all licenses issued by him and notificationof all transfers, revocations, or dealing with such licenses, shall besent by the Mining Registrar to the Under Secretary for Mines.

8. Applications for the issue of a Gold Assayer's License, undersection 17, subsection (1), paragraph (a), shall be made by

(1) the Director of the School of Mines;

(2) the Superintendent of State Batteries; or

(3) the State Mining Engineer.

9. Applications to the Minister for Gold Assayer's Licenses,under section 17 of the Act, shall be lodged with the MiningRegistrar for the District within which the crushing battery ortreatment works of the applicant are situated and shall be for-warded by the Mining Registrar to the Under Secretary for Mineswith a description of the said battery works and its situation andlocality.

9A. (1) When any person forwards gold or gold matter to alicensee for sale or smelting and such firstmentioned person is un-able, on account of distance or some other disability, to tender inperson such gold or gold matter to the licensee for sale or smelting,he shall make and subscribe a declaration in Form No. 22A.

(2) Every such declaration shall specify the mining districtand the division thereof wherein is situated the mine, claim, orplace from which such gold or gold matter was obtained. Anyperson who knowingly and wilfully makes any false declarationbefore a justice of the peace as hereinafter provided shall be guiltyof a misdemeanour and section 170 of the Criminal Code shall apply.

(3) Declarations shall be made before a justice of the peace,who shall clearly explain to the declarant, before taking the declara-tion, the nature of the declaration and the liability incurred bymaking and subscribing a false declaration.

(4) The person making any such declaration shall forward sameto the licensed gold buyer to whom he is forwarding the gold orgold matter.

10. For any new license under section 25 of the Act, the sumof two shillings and sixpence shall be payable.

11. A duplicate of every certificate issued under section 26 ofthe Act shall be sent by the member of the Police Force issuingsame to the Under Secretary for Mines at the Department of Mines.

12. (a) The holder of a license as a buyer of wrought gold,under section 29 of the Act, may apply for renewal of his licenseduring the month of December in each year to the Under Secretaryfor Mines, and shall forward or produce to him in connection there-with the current license.

(b) Each page of the book of account (Form No. 27) beforebeing used shall be numbered consecutively, and after having beenbrought into use the leaves of the book shall not be interfered withand the numbering shall be maintained without alteration or oblit-eration.

(c) Every person for six months after ceasing to be a licenseeunder section 29 shall at all reasonable times permit any memberof the Police Force to inspect and take extracts from the bookrequired to be kept by him, and shall also forthwith, when so re-quired in writing by the Under Secretary for Mines, supply to hima correct copy of the entries in such book covering the date ordates referred to in any such requisition.

13. (a) Every person who has removed or treated tailings shall,within ten days after the end of each calendar year, furnish a returnin Form No. 30.

(b) A person registered under section 34 shall at any time per-mit an Inspector of Mines or a person authorised by the Ministerto take and remove samples of any tailings in the possession orunder the control of such person, for the purpose of having suchsamples assayed by some qualified person.

14. There shall be kept in the office of the Under Secretaryfor Mines, at Perth, a register of all licenses of every kind for thetime being in force containing particulars of

(1) The name of holder.

(2) His place of business.

(3) Character of license.

(4) Authority at whose instance or by whom issued.

(5) Date of issue.

(6) Date of expiry.

A record shall also be kept at such office showing the particu-lars of every registration effected by a member of the Police Forceunder section 26.

(2) Any person who knowingly, wilfully, and corruptly makesany false declaration before any licensee as provided in the nextpreceding subsection shall he deemed to be guilty of a misdemean-our, and section one hundred and seventy of the Criminal Codeshall apply.

(3) Before taking any such declaration as aforesaid, suchlicensee shall clearly explain to the person to whom such declarationis tendered the nature of such declaration and the liability incurredby taking and subscribing a false declaration.

(4) In addition to complying with the requirements of thepreceding subsections of this section, a licensee, before buying goldfrom any person shall assure himself that such person is entitledto sell the same; and, except in the case of a person who is person-ally known to him to be of good repute, he shall require such per-son to produce a certificate from some well-known reputable per-son that he believes the person offering or selling such gold or goldmatter obtained it honestly.
