Legal instruments for cross-border cooperation

Two forms of cooperation: EGTCs vs. EuroregionsEGTC
• Regulated by EU law: Regulation 1082/2006/EC
• Objective: to facilitate and promote cross-border, transnational and/or interregional cooperation between its members, with the exclusive aim of strengthening economic and social cohesion
• Legal personality, with full legal capacity• Members: MSs, local/regional
authorities, bodies governed by public law• Has its own resources – collected from its
members• Mandatory organs: Assembly + Director
(not mandatory: technical and administrative team, committees)
• More stable cooperation• More options: can be MA of a ETC
Programme, can apply for funds from ETC Programmes
EUROREGIONS
• Based on intergovernmental treaties or agreements between the partners– international law applies
• Objective: Arrangements for co-operation between units of local or regional government across the border in order to promote common interests and enhance the living standards of the border populations
• More of a „transfrontier association” – no legal personality
• Members: local/regional authorities• No mandatory organs, sometimes
parliamentary assembly; permanent secretariat and a technical and administrative team
• Loose form of cooperation

Revision of the EGTC Regulation Revision process started in 2011
Amendments include:• Public undertakings can also participate in an EGTC• The option of establishing EGTCs between 1 MS and 1 third country
or overseas territory• The fact that the Madrid Convention can serve as a legal basis for
cooperation• Introduction of the tacit approval – after 6 months• Clarification regarding the content of Convention and of the Statutes• Simplification of the joining procedure

The future: new period, new possibilities
EGTC in Structural Funds programmes & projects :
• Managing authority• sole beneficiary of EU projects or run part of ETC
programme• can be involved in interregional cooperation in
mainstream programmes
EGTC can be involved in new cooperation instruments – ITI, CLLD, JAP
