Page 1 of 7 EXECUTIVE ORDER ON SAMALENO BAYAHANIHAN CODE WHEREAS, the World Health Organization declared Covid-19 virus as a pandemic; the first pandemic caused by a coronavirus; WHEREAS, Article II, Section 15 of the Philippine Constitution states that the State shall protect and promote the right to health of the people and instill health consciousness among them; < WHEREAS, on March 8,2020, President Rodrigo Roa Duterte issued Proclamation No. 922 declaring a State of Public Heal^h Emergency throughout the Philippines due to the outbreak of Covid-19; WHEREAS, on March 16, 2020, President Rodrigo Roa Duterte issued Proclamation No. 929 declaring a State of Calamity throughout the Philippines due to Corona Virus Disease 2019; WHEREAS^ th^ continuing rise of confirmed eases of GQVJ.Q-19 is a serious threat to the health, safety, security, and lives of the Filipino people and poses a long-term adverse effects on the mean of livelihood and severe disruption of the economic activities; WHEREAS, on March 23, 2020, Republic Act 11469 known as the "Bayanihan to Heal as One Act" was enacted to mitigate transmission of Covid -19; undertake measures that will prevent the overburdening of the health system; undertake a program for recovery and rehabilitation; partner with the private sector and other stakeholders, promote and protect the collective interests of the Filipinos, among others; WHEREAS, the Local Government Code mandates all local government units (LGU) to exercise the powers for the efficient and effective governance essential to uphold the general welfare, especially the health and safety of its people; WHEREAS, Section 4 (g) of Republic Act 11469 mandated all LGU to act within the rules, regulations and directives issued by the National Government; WHEREAS, on May 1, 2020, Bceaotive order 37 Series of 2Q20 of the Provincial Government of Davao del Norte recommended to its component cities the adoption of measures and guidelines deemed fit and necessary to its area of jurisdiction; WHEREAS, there is a need to set the guidelines to ensure the continued compliance to rules, and regulations sat ta mitigate the. spread of Gavid-19 even after the lifting at Local Safety Measures in the Island Garden City of Samal; NOW, THEREFORE, I, AL DAVID T. WHEREAS, the World Health Organization declared Covid-19 virus as a pandemic; thefirst pandemic caused by a coronavirus;

3. Entry to Samal Island. All individuals who will enter the island shall be required topresent their Home Quarantine Pass/ Worker's Pass/ Fisherfolk's Pass /Government QR Sticker together with a valid government issued ID / CompanytD.

Businessmen shall be required to present their business permits together with theirHome Quarantine Pass / Worker's Pass / Food Lane Pass and valid IDs in going to/ from their business located in Samal.

Government personnel who are on official travel shall be required to present

approved travel order by the Head of Agency.

a.Only the person named in the Pass with his/her valid Identification Cardshall be allowed to use it. This shall be issued only once;

b.All households / families shall be given one (1) Home Quarantine Pass.Only Qa% (t I m^mb^r of the household / family shall go out for purposes ofbuying of food and other basic necessities; buying of medicine; disposalof garbage; going to the hospital and other emergencies; and going towork;

c.All residents who work outside Samal and non-residents who work inSamal, shall be given one (1) Worker's Pass. It shall be issued to residentswho work outside Island Garden City of Samal and all non-residents who

work in Island Garden City of Samal.

d.All registered Fisherfolks shall be given one (1) Fisherfolks Pass. It shall beissued to att registered Fishertolfcs. This can be used as passes during thecurfew hours, provided that they are going to / from their fishing activities;

e.All Government Employees, both national, local and barangay, shallreceive only one (1) Government QR Sticker. It shall be issued to allgovernment employees in the national, local and barangay level and isattached to the agency tD. This can be used on days where employeedischarges duties and functions;

2. Policies ^n^ guidelines. To mitigate transmission of Cov4d - \9 and protectthe collective interests of the Samalehos and to undertake a program for recovery and

rehabilitation, the following General Austerity Measures are directed:

1.People shall only come out from their home / dwelling place to buy food /modicino>. go to tho hospital transact at any oxamptad. esiabfehment asidentified provided that they cany with them the necessary pass, valid ID andany proof of identity.

2.Use of. Home Quarantine Pass, Workers Pass, Fisher folks Pass and GovernmentQR Sticker. The City shall continue to implement the electronic system fortracking of resident's movement through the use of Home Quarantine Pass,Workers Pass, Fisher folks Pass, Student Pass and Government QR Code. ThesePasses, together with a valid ID shall be used as entry pass to the barangays,ports, markets and other public areas or establishments;

Section 1. The Samaleho Bayanihan Code shall be implemented in the Island GardenCity of Samal through the guidelines provided, from May 5,2020 to December 31,2020;

9.Checkpoints. There shall be strict implementation of checkpoints island-wide bythe national, local and barangay security forces.

10.Regular disinfection. Government offices and private sectors should conductcleaning and disinfection regularly especially to those areas that are frequentlyused by the public.

11.Disinfection Stations. Government offices and private sectors shall install handwashing facility with soap and flowing water that is easily accessible to clients.Hand sanitizers and alcohol shall also be made available to the public and shallbe used upon entering to their respective premises.

12.Liquor Ban. Total liquor ban is still implemented until the declaration of publichealth emergency is lifted.

4.Sea Transport. A separate Executive Order shall be issued to govern theoperations of the ferry boat services and launch services.

5.Land Transportation. Passengers for motor vehicles shall be limited. The following

guidelines musf strictly be observed.5.1Wealing of face mask is required.5.2Drivers are prohibited to carry passengers who are not wearing face

masks.5.3Motorcycles - three (3) passengers, including the driver.5.4Tricycles and 4-wheeled vehicles - four (4) passengers, including the driver.5.5Buses - 50% of its seating capacity5.6Government-owned vehicles - 50% of its seating capacity;

5.7Operators of public transport shall have their units installed withcellophane barriers / partitions to separate the driver and the passengers.

6.Mandatory Face Mask. Pursuant to DILG MC 2020 - 071, all citizens are requiredto wear face masks in public as a precautionary measure to combat the spread

ofCOVID-19.

7.Mandatory Social Distancing. All citizens are required to observe socialdistancing (also called physical distancing) which means keeping spacebetween oneself and other people outside of one's home to avoid transmission

and spread of a highly confagious disease.

8.Conduct ot Activities. Conduct of big gatherings is strictly prohibited. There shallbe no extravagant celebrations and commemoration of legal holidays, fiestas,birthdays and other important dates and events whether public or private affair.

a.All celebrations, get-togethers, parties, anniversaries and festivities toinclude araw ng barangay / purok to be conducted by the barangay,city and national government agencies shall not be allowed.

b.Private, personal and / or family activities where a group of peoplegathered together in one place for a common purpose, such as but notlimited to masses, worship services, vigil, burial/ interment, and wedding,to mark milestones shall be allowed only for a maximum of 25 attendees,all of which are required to wear face masks at all times.

c.Gatherings shall be allowed only for a maximum of 25 attendees.Attendees should observe all quarantine protocols, such as socialdistancing, wearing of mask, hand sanitation, etc.

13.No Smoking. The No Smoking Ordinance shall be strictly implemented. Personsfound violating this provision shall be litigated in the proper courts for violation ofexisting City Ordinance and other pertinent laws.

14.No Gambling. All forms of gambling shall be strictly prohibited. Transport of derbycocks to and fro and within the city is prohibited.

15.Curfew Hours. No person is allowed to go out, roam around, loiter and wanderalong streets, parks and any public places whether individually or in group duringthe Curfew hours:

For adults: 08:00 PM to 05:00 AM.For minors: 06:00 PM - 06:00 AM.

Exception from Curfew Hours are emergency cases or when going to workrelated to security, health, social services, sanitation, emergency services andpublic officials who by reason of their office and/or nature of their job arerequired to be outside of their homes. Provided, however, that they couldpresent valid identification card and/or certification from their employer.

Business establishment exempted from Curfew Hours shall only include foodestablishments, 24-hours grocery stores; pharmaceutical stores; health servicefacilities like hospitals and health clinic both public and private; and transportfacilities carrying health, security and emergency personnel.

16.Suspension of classes. Suspension of classes and academic activities from preschool to post-graduate shall continue. Opening of classes shall be subject tothe guidelines as may be issued by the Department of Education and theCommission of Higher Education.

17.People who are at High Risk of Infection. No minor, senior citizen, pregnantwomen, sick and immune-compromised individuals can go out of their residenceor dwelling except for educational, employment, medical and other essentialnecessities where no other person can perform such duty, upon presentation ofappropriate valid ID as the case maybe and QR pass and certification from theiremployer and / or business permit.

18.Compassion Campaign. As a means to show compassion and empathy to thecommunity, all citizens are encouraged to:

18.1Check on elderly neighbors through text and phone call especially whenthey live alone;

18.2Combat misinformation by reporting to the City Government through itshotline numbers;

18.3Whenever possible, provide relief goods and raise fund for people

financially impacted by quarantine measures;

18.4Express gratitude to frontline workers for their hard work by giving theminspiring words and other forms of encouragement.

19.Unrestricted Movement of Vital Frontline Workers and Cargo / DeliveryBusinesses. Vital frontline workers and cargo/ delivery trucks carrying food,medicines and other essentials (dry goods, general merchandise, hardware,motor repair shops / accessories) shall be allowed to enter the city, provided,that they present QR Pass and valid ID; and/or certification from their employeror business permits.

20. Foreign Travels. Foreign and domestic travels for leisure and vacation are

restricted.

21.Gulayan sa Tugkaran. The "Gulayan sa Tugkaran" program shaft be intensified,hence, all citizens are required to grow and cultivate plants and vegetables intheir respective backyards. All puroks and barangays are highly encouraged toput up Communal Garden in idle lands within their areas of jurisdiction.

22.Commodities and Goods, To protect consumer's rights from unscrupulousbusinessmen illegally increasing the prices of basic necessities. Residents arestrongly advised to buy food supplies at their respective wet market / palengkeonly.

22.1Public Markets.a.The new schedule of the wet market / palengke shall be 06:00 AM

-07:00 PM.b.There shall be continued implementation of "one entry, one exit

point" policy.c.A pass and a valid ID shall be required upon entry to public

markets.

22.2Bagsakan sa Isla. The City Government has initiated the Bagsakan sa Islato cater to the vegetable supply needs of all vegetable vendors in publicmarkets, barangay public market, registered cooperatives (vegetableretailers), wholesalers, caterers and restaurants tor the consumption of the

general public.

d.Residents are discouraged to travel to other LGUs to buycommodities that are available locally.

e.Farmers and fishermen are encouraged to sell their products locallyfor local consumption. The City Fishlanding Center and the Taboanlocated adjacent to the Negosyo Center, at Barangay Pehaplatashall continue operations to ensure venue for display / sell theproducts of our farmers and fisherfolks.

22.3Hoarding, profiteering, injurious speculations, manipulation of process andother form of product deceptions, shall be strictly prohibited pursuant toSection 4 (i) of RA 11469. Business Permits of persons or entities foundviolating the provisions of this Order shall be revoked or suspended withoutneed of judicial process and shall be litigated in the proper courts forviolation of RA 7581, RA 11469 and other pertinent laws.

22.4Groceries, pharmacies and other stores selling alcohol, sanitizers anddisinfectant solutions are directed to limit the purchase of these productsto two (2) pieces per person only.

23.AH registered business establishment may open on a limited capacity or reducedmanpower except those sectors working in tourism, leisure, gambling / gaming,

fitness, and kid industry.

24.Food establishments may open for take-out / delivery services only.

25.Flexible work arrangement in the private establishments, such as work fromhome, compressed work week, skeleton force in the workplaces shall beimplemented to reduce manpower by 50% and to safeguard the welfare of theworkers.

26.Private Establishments and individuals. The private sectors are highly encouragedto consider food distribution, feeding program or financial assistance to theiremployees instead of lavish celebrations to mark their important events.

27.Spreading of False Information. There shall be strict prohibition on individuals orgroups creating, perpetrating, or spreading false information regarding theCOVID-19 crisis on social media and other platforms, such information having novalid or beneficial effect on the population, and are clearly geared to promotechaos^ panic* disord^r* fear* or confusion; and those participating in cyberincidents that make use or take advantage of the current crisis situation to preyon the public through scams, phishing, fraudulent emails, or other similar acts.

28.Government Services. Transactions and services in the government shall remainopen to the public. However, there shall be strict implementation of socialdistancing and mandatory wearing of face mask. Single-client transaction is

highly advised.

Section 3. Return of Stranded Overseas Filipino Workers (OFWs). All returning OFWsregardless of origin must undergo Rapid Testing and a 14-day quarantine in an isolationfacility to be provided by the City Government before entry to the city.

Section 4. Monitoring of Coastlines. The Philippine Coast Guard, Philippine NationalPolice, Philippine Navy and Task Force Samal and other security forces are enjoined torender full assistance and cooperation in the strict monitoring of coastlines to restrict allillegal activities such as illegal fishing and sea travels by boat as these can be means ofpossible virus spread^

Illegal Fishing shall be prohibited. All unregistered motorboats operating within themunicipal waters of the Island Garden City of Samal shall be impounded by theauthorities. All violators of impounded motorboats shall be arrested for violation ofexisting laws. Impounded motorboats shall be penalized with an administrative fine ofTwo Thousand Pesos (Php 2,000.00) per City Ordinance 2018-292 and other pertinentlaws.

Section 5. PUI Cases. Case of Persons Under Investigation (suspect) under the newclassification are those with Acute Respiratory Symptoms and who have a history oftravel or residence that has a reported local transmission of COVID 19 disease duringthe ) 4 days prior to symptom onset or with contact to a confirmed or probable case ofCOVID 19 case are mandated to report to the City Health Office for proper procedure.

Those who shall not follow the Department of Health (DOH) rules and regulations shallundergo a mandatory 14-day quarantine at a government facility.

Barangay Officials shali monitor PUls. in their respective, Barangays and coordinate withthe City Health Office.

Section 6. Management of Human Cadavers. All human cadaver, shall be buried withinseventy-two (72) hours from the time of death or from the time of arrival of the cadaverin the city. Necrological Services, Vigil or Interment shall be conducted with 72 hoursonly.

In all these necro/vigil/interment services, social distancing, wearing of mask, andproper protocols and quarantine /lockdown guidelines shall be strictly observed. Onlythe immediate family members are allowed and in no case shall the said gatherings willexceed 25 persons.

No human cadaver shall be transported into the City without the required travel permitand death certificate duly issued by the proper authorities. The said document shall bepresented to the concerned authorities at checkpoints upon entering the city.

Provided, that the cause of death as reflected in the Death Certificate is a non-infectious disease, otherwise, it shall not be allowed entry to the city.

The standard process on the management of the human cadavers for PUfs andconfirmed COVID-19 cases shall be strictly observed. Proper burial of Muslim Filipinosshall likewise be observed. COVID-19 confirmed case must be put in a sealed cadaverbag and must be buried within 12 hours in the nearest designated Muslim Cemetery.

In. case of d^aths du^ to infectious diseases^ the cadaver must tee tewed or crematedwithin twenty-four hours (24 hours) and it shall be immediately reported andcoordinated with the City Health Office or any proper government agencies.

Section 7. implementation. Security Personnel such as Task Force Samal, PhilippineNational Police, Philippine Coast Guard, Civilian Volunteer's Organization, etc includingBarangay Officials are mandated to strictly implement the provisions of this ExecutiveOrder.

Section 8. Repealing Clause. All prior issuances inconsistent herewith are hereby

modified, repealed and superseded by this Order.

SeeHon ^. Separability Clause, if any portion or provision of this Order will be declaredinconsistent or invalid, the other portions or provisions hereof, which are not affectedthereby, shall continue in full force and effect.

Section 10. Etfectivity. This order shall take effect immediately upon approval thereof
