Las Vegas continues to capture the imagination of more than 39 million visitors from around the world every year. General InformationWelcome to IMLA’s 73rd Annual Conference. If you have any questions or need assistance at any time during the Conference, an IMLA staff member will be happy to assist you. IMLA staff members are wearing blue name badges. The IMLA registration desk will open at 8:00 a.m. Sunday, Monday, and Tuesday, September 14–16 and close at 5:00 p.m. The registration desk hours will be from 7:30 a.m. to 12:00 noon on Wednesday, September 17. IMLA registration is located at the Tiberius Registration Desk. For your convenience, a message board has been placed near the IMLA registration desk. Messages for attendees will be posted on the message board throughout the Conference. For speaker paper access, go to www.imla.org for instructions.

CLeTo receive CLE credits for attending this Conference, it is imperative that you return the CLE Questionnaire and the Certification of Attendance form (available at the IMLA registration area) to the IMLA CLE table located at the Tiberius Registration Desk by 12:00 noon on Wednesday, September 17, 2008. Goodman, no one can doubt the love he has for this community and his overwhelming desire to make it even better. When he decided to run for Mayor in 1999, most said he could never win. The local newspaper headline read “Anybody but Oscar” the day after he filed for office. But the residents embraced Goodman’s no-nonsense, tell it like it is style, and elected him in a landslide. He says to anyone who will listen that he’s the “Happiest Mayor in the Universe.” In April of 2007, Mayor Oscar Goodman captured 84 percent of the vote in his re-election effort to a third 4-year term. The final vote tally is one of the largest margins of victory ever for a large city mayor in a major election. Mayor Good- man often jokes that he’s “still looking for the other 16 percent!” Mayor Goodman now serves as the Chairman of the Las Vegas Convention and Visitors Authority and feverishly works to promote the enticing destination of Las Vegas. Mayor Goodman has also started OPAC, Oscar’s Political Action Committee, to promote and protect the interests of Las Vegas. His first action was to donate $50,000 to the Keep Memory Alive Foundation, the “Think Tank” foundation for the Lou Ruvo Brain Institute. Mayor Goodman has been responsible for many great accomplishments in the heart of downtown. As Mayor, he was successful in acquiring a large piece of urban real estate in the city without resorting to eminent domain. Union Park, a phenomenal 61-acre planned development, will include the Lou Ruvo Brain Institute, designed by renowned architect Frank Gehry, a 350,000 square- foot Performing Arts Center, boutique hotels, multiple high residential units, business, medical, and retail opportunities. Downtown is undergoing a dramatic change, a renaissance. It is evolving into a vibrant place for living, working, and being able to enjoy entertain- ment and art venues. Bounding Union Park are the World Market Center, the Chelsea Properties mall, and an office complex which is LEED certified. The World Market Center is a state-of-the-art home furnishings trade show facility. When completed, the complex will exceed 12 million square feet with 8 buildings. The Chelsea Properties discount mall is the most successful of its kind for dollar per square foot income. A jewelry mart, 50 plus stories in height, is also in the developmental state. In addition, there are almost 18,000 living spaces being planned for construction in the downtown. Also, for the first time in many years, multi-million dollar casino and hotel renovations and expansions are currently underway. The Mayor’s mother, Laura, was a renowned sculptor and had a great influence on the Mayor. Her appreciation for art is reflec-tive of the Mayor’s efforts to enhance culture and the arts in Las Vegas. You can currently visit an emerging eclectic mix of live- work artist residences and galleries known as the 18b Arts District. You can always catch the Mayor at an event called First Friday, which the Mayor describes as “a sense of place in an artistic environment.” Thousands of people now flock downtown to this once a month event. It’s known as a huge block party for art perusal and appreciation. Mayor Goodman also managed to acquire a beauti-fully historic downtown post office from the General Service Administration, which he plans to refurbish as a museum of Las Vegas, showcasing his city’s colorful history. Fremont East Entertainment District continues the synergy of downtown featuring trendy new gathering places for dining, dancing, cocktails and enjoyment. An intellectual marketplace is being designed in a historical Spanish-styled elementary school and will be home to the University of Nevada Las Vegas’ School of Architecture, UNLV Modern Letters Program and the Nevada School of the Arts. Goodman has always been a downtown kind of guy. Born and raised in Philadelphia, he graduated from Haverford College and received his law degree from the University of Pennsylvania Law School. He and his wife of 45 years, Carolyn, who was a Manhattanite and alumna of Bryn Mawr College, moved to Las Vegas in 1964 “with $87 in our pockets,” he’s fond of saying. They grew up with the town, utilizing their great educations and establishing an extremely successful law practice. He made a name for himself by tak-ing on some of the toughest cases and winning them, as told in the recent publication of John L. Smith’s biography, Of Rats and Men. Goodman is now representing the City with the same fervor he brought to every case he tried as a criminal defense attorney. For his legal work, the National Law Journal has recognized him as one of the “15 Best Trial Lawyers in America.” Because of his unique client list, his exploits were the subject of a British documentary titled, Mob Law. He also played himself in the movie, Casino. Carolyn is the founder and President of the first non-profit, non-sectarian private school in Nevada, The Meadows. The Mayor also has a few personal reasons for wanting to keep Las Vegas strong. Carolyn and he have four grown children, all of whom have acquired college degrees and graduate degrees in law, medicine and human resources, with all now calling Las Vegas their home. He wants for them the same thing he wants for every resident—the ability to make your dreams come true. “When Carolyn and I came here, Las Vegas was truly the land of milk and honey,” he says. “You could establish a career, make something for yourself, and enjoy a great quality of life. I want to make sure that never changes.”

Marta Adams is Senior Deputy Attorney General Marta Adams has practiced law for thirty years with a focus on environmental, land use and water law issues. She is primarily responsible for representing Nevada’s Agency for Nuclear Projects, the agency charged with blocking development of the proposed high-level nuclear waste repository at Yucca Mountain. She oversees other high-profile litigation involving water and environmental issues.

John “Kelly” Addy has been a Deputy City Attorney handling civil matters for the City of Billings, Montana (pop., 100,000) for the past eight years. A 1974 Georgetown Law graduate and a member of the District Columbia Bar, he served in the Army JAG Corps in Huntsville, Alabama and Pyongtaek, Korea before returning home and being admitted to the State Bar of Montana in 1979. He was in private practice for 20 years before coming to work for the City of Billings and has served four terms in the Montana House of Representatives, the last as Speaker Pro Tempore, and two terms as the Chair of the Montana Democratic Party. His daughter, Amanda, is a freshman at the University of Montana and his son, Caleb, is a freshman at Skyview High School in Billings. This spring he married his Army sweetheart and the love of his life, Mary Alice Brinkley, of Huntsville, Alabama. He also a licensed local pastor appointed as pastor to Huntley United Methodist Church in Huntley, Montana. His municipal law practice focuses on Public Works, Aviation and Transit, Human Resources, and Public Records Requests, with other duties as assigned.

Ken Albright is the Director of the Groundwater Resources department for the Southern Nevada Water Authority. As Director, he is responsible for the acquisition, development and environmental compliance of new and existing groundwater resources for the Authority. Prior to joining the Authority in November of 2002, Ken worked for the city of North Las Vegas, where his most recent assignments were as the Assistant Director of the Public Works Department and Director of the Parks and Recreation Department. Ken attended the University of Minnesota where he received his Bachelor of Science Degree in Civil Engineering. His professional asso-ciations include the National Society of Professional Engineers, American Public Works Association, American Water Works Association, National Water Resources Association and Nevada Water Resources Association. He holds professional engineering licenses in Illinois and Nevada. Ken is married, has three sons, and has been a resident of Las Vegas since 1989.

Adell L. Amos is an Assistant Professor of Law and the Director of the Environmental and Natural Resources Law Program at the University of Oregon School of Law in Eugene, Oregon. Amos joined the law school faculty after practicing environmental and natural resources law for six years with the Solicitor’s Office at the United States Department of the Interior. Amos represented and advised the U.S. Fish and Wildlife Service and the National Park Service on state and federal water rights issues including work involving the Klamath, Snake, Columbia, Middle Rio Grande, and Gunnison River Basins. Additionally, she provided legal advice on the interaction of water law with other environmental statutes including the ESA, CWA, and NEPA. Amos teaches Water Resources Law, Wildlife Law, Oregon Water Law and Policy, Environment and Energy, Environmental Conflict Resolution, and Civil Procedure. Her scholarship addresses citizen participation in water rights adjudications, the relationship between federal and state governments on water resource management, and the role of administrative agencies in setting national and local water policy. Amos recently published an article entitled, “The Use of State Instream Flow Laws for Federal Lands: Respecting State Control While Meeting Federal Purposes” in Environmental Law. She has a forthcoming article in the Journal of Environmental Law and Litigation on hydropower reform and the Energy Policy Act of 2005. Amos earned

her B.A. in 1995 from Drury College, her J.D. in 1998 from the Uni-versity of Oregon (Coif ). After law school, Amos clerked on the Ninth Circuit Court of Appeals for Judge Proctor Hug Jr. She is a member of the Missouri bar, admitted 1999.

A. Fleming Bell, II is a professor of public law and government in the School of Government, The University of North Carolina at Chapel Hill. Some of his specialties are local government law; ethics and conflicts of interest in government; parliamentary and other procedural issues; and office-holding questions. Bell earned an AB magna cum laude and a JD with High Honors from Duke University, where he was elected to Phi Beta Kappa and was first in his law school class. He also holds a master’s degree in regional planning from UNC at Chapel Hill.

Mary ellen Bench joined the City of Mississauga in May, 2001 as City Solicitor. She was called to the Bar in Ontario in 1986. In 2003 the Inter-national Municipal Lawyers Association (“IMLA”) conferred upon her the designation of Local Government Fellows in recognition of demonstrat- ed excellence in the field of local government law. In 2006 she achieved the designation of certified Specialist (Municipal Law—Local Government / Land Use Planning and Development Law) from the Law Society of Upper Canada. Mary Ellen is a member of the IMLA Board of Direc-tors since 2006, and is a frequent speaker on municipal topics, speaking before a wide range of audiences.

Brad D. Bailey is a graduate of Gonzaga University School of Law where he was the Technical Editor of the Gonzaga Law Review. Mr. Bailey has practiced local government law since 1987 starting in the City Attorney’s Office in Longmont, Colorado as the City Prosecutor. Mr. Bailey was co-counsel in City of Littleton v. Z.J. Gifts, 541 U.S. 774 (2004). He was counsel of record for IMLA, NLC et al. as amicus curie in Town of Castle Rock v. Gonzales, 545 U.S. 748 (2005). Mr. Bailey has been a previous speaker for the Colorado County Attorney’s Association, the National Association of County Civil Attorneys, the City Attorneys Association of Kansas, the Colorado Municipal League and IMLA. Mr. Bailey is currently the Assistant City Attorney for Littleton, Colorado.

Michael Brave is the President of LAAW International, Inc., and the former President of the International Force Institute, Inc. He has been involved in a wide-range of comprehensive law enforcement and private security risk/liability management services including: training programs, policy development and review, liability/risk assessments, training appraisals, department audits, post-incident analysis, etc. He has been a litigation consultant and an expert witness in federal civil rights issues; sudden unexpected death; positional asphyxia; restraint; handcuffing; pepper spray, impact tools, neck restraints, law enforcement policy, training, supervi-sion, discipline, and retention; use of force (including deadly force); vehicle operations (including pursuits, roadblocks, and emergency operation); canines; correctional/jail issues (including suicides); and other cases.

Naomi Brown has been employed as a solicitor with the City of Toronto’s Legal Services Division, Litigation Section, since July of 1997. Prior to that, Ms. Brown practiced criminal law. Ms. Brown was called to the bar in 1996, having received her LL.B. from the University of Toronto in 1994. At the City, Ms. Brown’s practice includes an emphasis on building-related matters, and she has spoken at seminars in respect of building negligence claims. Ms. Brown’s practice has also included sign litigation, personal injury and property damage claims, appeals from the Ontario Municipal Board respecting planning matters, police defence, public health issues, property and business tax issues, property standards matters, by-law enforcement, and applications for judicial review. Kenneth A. Brunetti is a principal with the San Francisco office of Miller & Van Eaton. Mr. Brunetti represents municipalities in tele- communications, right-of-way management and cable television matters, specializing in complex litigation and bankruptcy. He has represented municipalities in forums through out the nation, including state and fed-eral courts as well as state regulatory commissions. He was lead counsel for the City of St. Louis in its successful defense of its right-of-way licensing requirements. Level 3 Communications, LLC v. City of St. Louis, 477 F. 3d 528 (8th Cir. 2007). Mr. Brunetti has also represented communities in several major bankruptcy proceedings involving telecommunications and cable television companies, including Aldelphia Communications. Mr. Brunetti received his law degree magna cum laude, from the University of California, Hastings College of Law in 1991 and his Bachelor of Arts in Psychology from the University of Pennsylvania in 1986.

Jeffrey J. Burrow, Director, Business Affairs, BMI General Licensing negotiates, drafts and analyzes new license agreements; educates customers regarding music licenses; and provides expertise on music and copyright matters. Christine G. Carter is a partner with Paterson, MacDougal LLP where she practices extensively in the area of municipal defence litigation. She is the author of a chapter on environmental liability in the text “The Law of Municipal Liability in Canada” and a number of articles touching on municipal issues in Butterworths’ Municipal Liability Risk Management Newsletter. She is a frequent speaker at conferences such as the Canadian Institute’s Provincial /Municipal Liability Conference, the Ontario Municipal Insurance Exchange’s Annual Conference and the Society of Public Insurance Administrators of Ontario.

Basile Chiasson, Q.C., practices law in Bathurst, New Brunswick, with the law firm of Chiasson & Roy. He was called to the Bar in 1983 and practices mostly in general civil litigation, municipal law, and planning law. He was appointed Queen’s Counsel in 2004 and has been awarded the Distinguished Service Award of the New Brunswick Branch of the Canadian Bar Association. He publishes regularly and speaks at events and seminars, including at the Canadian Department meeting of the IMLA Annual Conference. He is the author of the Rules of Court of New Brunswick Annotated, first published in 1989 and updated six times, with the last update released in 2005. Mr. Chiasson is currently pursuing a LL.M. in municipal law from Osgoode Hall Law School.

Andrew Ching started his legal career with the Tempe, Arizona City Attorney’s Office first as a volunteer, then served as a law clerk and later an attorney. He left briefly to work in the Mesa, Arizona City Prosecutor’s Office, where he was named Prosecutor of the Year in 1997. Returning to Tempe, Mr. Ching worked as Assistant City Attorney from 1998 to 2005, and was named Senior Assistant City Attorney in 2004. He left the city in 2005 to join the Phoenix firm Moyes Storey, practicing in the areas of civil and land use litigation, zoning law and local govern- ment law. He was subsequently appointed Tempe City Attorney in August, 2006. Mr. Ching received a BA in Political Science from the University of Arizona in 1991 and his law degree from Arizona State University in 1994.

James P. Cooney, III has represented individuals and businesses in some of the most difficult and high-profile cases in North Carolina, in-cluding successfully defending Reade Seligmann, one of the wrongfully charged lacrosse players in the “Duke Lacrosse Rape Case,” by securing a dismissal of the charges and a declaration by the Attorney General of North Carolina that Reade Seligmann was innocent. Mr. Cooney is a Fellow in the American College of Trial Lawyers and a Permanent Member of the Fourth Circuit Judicial Conference. He has been selected as one of the “Best Lawyers in America” since 2000 in both civil and criminal litigation. Abigail elias is Chief Assistant City Attorney for the City of Ann Arbor, Michigan. Since getting her J.D. from Harvard Law School, her law career has included work in the Civil Rights Division of the U.S. Justice Department, the City of Detroit Law Department, including six years as Deputy Corporation Counsel, and a private firm in Detroit doing commercial litigation.

Deborah H. Fox is one of California’s foremost experts on First Amend- ment issues affecting the public sector. Her practice includes trial and ap-pellate work in both state and federal courts and involves First Amendment and civil rights issues relating to sings, billboards and banners. She was named one of California’s 2007 Top Women Litigators by the Daily Journal for her career achievements and overall contributions to the profession.

eunice Gibson served the City of Madison as Assistant City Attorney for 17 years and as City Attorney for 11 years before retiring in 2002. In 2001 she was designated an IMLA Fellow in local government law and in 2003 as the most outstanding individual IMLA member. She now teaches law courses at Madison Area Technical College and at the William Kellett School of Business Administration, Lakeland Col-lege, Madison. Mrs. Gibson received her B.S. University of Wisconsin Madison, 1956 and J.D. University of Wisconsin Law School, 1973.

Benjamin e. Brian t. Grogan is a shareholder with the Minneapolis law firm of Moss & Barnett practicing in the firm’s communications law department. Since 1988 Brian has worked with governmental entities throughout the country on a variety of cable, telecom, wireless and broadband com-munications issues. Brian appears before state utility commissions and the FCC and recently assisted Minneapolis draft its Wireless Broadband Agreement.

Douglas C. Haney has been City Attorney for the City of Carmel, Indi-ana, since 1997. Mr. Haney’s educational credits include a Bachelor of Arts (B.A.) degree (with distinction) from the University of Wisconsin-Madison, a Master of Arts (M.A.) degree from Butler University, a Doctor of Law (J. D.) degree (cum laude) from the University of Wisconsin and a Master of Laws (L. LM.) degree from Georgetown Law Center. Prior to his employment with the City of Carmel, Mr. Haney served in the U.S. Army, as a Special Assistant U. S. Attorney and as a private practitioner. He has appeared before many federal and state courts and administrative agencies, including the U. S. Court of Appeals for the Seventh Circuit. He has authored numerous legal articles and is a frequent speaker at legal seminars. Mr. Haney is also an adjunct professor at Indiana University (Indianapolis), where he has received a “Best Instructor” award. He serves as Chair of the Governmental Practice Section of the Indiana State Bar Association, as a member of the ISBA House of Delegates, and as a member of the Legislative Committee of the Indiana Association of Cities and Towns. He is also the International Municipal Lawyer’s Association State Chair for Indiana and former Chair of IMLA’s Litiga-tion and Risk Management Section. In 2006, IMLA designated Mr. Haney a “Local Government Fellow” in recognition of his demonstrated excellence in the field of local government law. He is believed to be the first Indiana attorney to be so distinguished. Mr. Haney resides in Carmel with his wife, Tammy, and their three daughters, Elizabeth, Carolyn and Katherine. Adrian e. Herbst is a principal with the Washington, D.C. based firm The Baller Herbst Law Group, P.C., in charge of its Minneapolis, Min-nesota office. He has over 30 years of experience in municipal and govern- mental work. Adrian has been extensively involved in representing lo-cal governments throughout the country on cable television matters, including franchise renewals, transfers of ownership, governmental own-ership alternatives, local I-Nets and PEG access, franchise compliance audits, rate regulation issues, and federal and state legislative and FCC regulatory proceedings. He has also been extensively involved in rights-of- way management, telecommunications regulations, development of fiber optic networks, municipal websites, wireless zoning, and public radio system 800 MHz rebanding. Ralph G. Hildebrand is the Corporate Counsel for the Greater Vancou-ver Regional District, Vancouver, British Columbia. Prior to becoming GVRD Corporate Counsel he was the Deputy City Solicitor for the City of Surrey, British Columbia. Scott Howard has been practicing municipal law for over 31 years, the past 18 years as the in-house City Attorney for Glendale providing advice on a full range of issues. Scott is a 1976 graduate of Southwestern University School of Law and received his Bachelor’s of Science degree from the University of Southern California in 1972; Graduate of the FBI National Law Institute (1989); Past President of the City Attorney’s Association of Los Angeles County (1995); Past President of the Glendale Bar Association (1994). Mr. Howard has served as past state chair for the International Municipal Lawyer’s Association (IMLA) and is the current regional vice president 9th Circuit for IMLA. Darrel J. Huenergardt is principal in Huenergardt Law Office in Kimball, Nebraska and Pine Bluffs, Wyoming. Mr. Huenergardt is a graduate of Union College, Lincoln, Nebraska and University of Nebraska College of Law. He was appointed City Attorney of Kimball, Nebraska in December 1972; and he also serves as Village Attorney for Dix and Bushnell, Nebraska. John Joye is a former state prosecutor that has been with the City of Charlotte for over eight years. He is a class of ’97 graduate of UNC-Law.” Rebecca “Becky” Kanis joined Common Ground to launch the Street to Home Initiative that reduced street homelessness by 87% in Times Square. Essential to her work is reframing homelessness as an urgent public health issue—helping communities across the country identify and then prioritize homeless individuals who are at the greatest risk of dying for housing and health care.

William J. Kearns, Jr. is a partner in the firm of Kearns, Vassallo & Kearns in Willingboro, NJ. He is admitted to practice before the trial, appellate and Supreme Courts of New Jersey, the United States District Court for the District of New Jersey, the United States Court of Appeals for the 3rd Circuit and the United States Supreme Court. He focuses his practice on local government, municipal land use, and business clients. He is a graduate of St. Peter’s College and the Rutgers University School of Law [Newark]. He is General Counsel for the New Jersey State League of Municipalities, a Senior Trustee of the New Jersey Institute of Municipal Attorneys and a Past President of the International Municipal Lawyers Association. He is a former Chair of both the Local Government Law Section and the Women’s Rights Section of the New Jersey State Bar Association. He has earned the Diplomate in Local Government Law designation from the New Jersey Institute of Local Government Attorneys and was one of the original attorneys to earn the designation as a Fellow in Local Government Law from the International Municipal Lawyers Association. He is an Instructor in the Diplomate in Local Gov-ernment Law program and is a frequent author of articles in legal and local government publications. He regularly lectures nationally on local

government and land use issues. Mr. Kearns is a Past President of the Burlington County Bar Association. He is a Past President and Director Emeritus for Life of the Burlington County Chamber of Commerce. Mr. Kearns serves as attorney for and supervises the defense of claims on behalf of two municipal joint insurance funds. He is the Municipal Attorney for Beverly City, Delanco Township and Edgewater Park Township and Florence Township and served for 22 years as the Municipal Attorney for Willing-boro Township. He has served as counsel to various other municipalities, Planning Boards and Zoning Boards of Adjustment. He has held public office as a member of the Willingboro Township Council and as Mayor of Willingboro.

Robert J. Kerwin is the immediate past President of the Massachu-setts City Solicitors and Town Counsel Association and an IMLA Local Government Fellow. Together with his partner, Kerry Ryan, Mr. Kerwin has been litigation counsel in two matters that have resulted in multi- million dollar awards to municipalities in connection with landfill and host community agreements.

Anna Kinastowski received a B.A. in geography from McMaster Univer-sity and graduated from the Faculty of Law at the University of Toronto. She has over 20 years of experience in municipal government with the former Cities of Toronto and Scarborough and since 1998, the amalgamated City of Toronto. In the former City of Scarborough, she held the positions of Director of Land Development and Director of General Legal Ser-vices and Administration. At amalgamation, Anna was appointed Director, Planning and Administrative Tribunal Law where she oversaw the successful amalgamation of five planning law units from the former municipalities. On March 18, 2002, Anna was appointed City Solicitor of the City of Toronto and is responsible for the provision of legal services to City Council, staff and City agencies, boards and commissions. Anna oversees the largest municipal legal division in Canada consisting of over 250 staff, of which over 100 are lawyers. Anna is a frequent speaker on matters relating to municipal law and was recently certified by the Law Society of Upper Canada as a Specialist in Municipal Law: Local Gov-ernment / Land Use Planning and Development. She is the Canadian Regional Vice President of the International Municipal Lawyers Association (IMLA). She has a special interest in encouraging young lawyers to choose the public service as a rewarding and fulfilling career.

Kris W. Kobah teaches Constitutional Law and Immigration Law at the University of Missouri (Kansas City) School of Law. He received his BA from Harvard, 1988; D.Phil. from Oxford, 1992, and his JD from Yale Law School, 1995. He served as Counsel to US Attorney Gen-eral John Ashcroft, 2001-03. He represents Hazleton, Pennsylvania, Valley Park, Missouri, the state of Arizona, and other cites and counties in pending preemption cases. He is a regular guest on The O’Reilly Factor and Lou Dobbs Tonight.”

Joel A. Kramer is an Associate Counsel with the Washington Subur-ban Sanitary Commission, one of the country’s largest water/wastewater utilities. Joel graduated from University of Maryland with a degree in zoology (1975), withdrew from University of Maryland School of Dentistry with a degree of relief, and graduated from University of Maryland School of Law with a degree of uncertainty (1982).

Dan Kuzmyk joined the Region in August 2004 following several years specializing in municipal litigation. As Senior Counsel, Dan represents the Region and its local boards in all aspects of civil litigation. Dan advises Regional departments and York Regional Police on a variety of operational, strategic and risk management issues, as well as issues and

todd A. LaSala is a partner in the firm’s Real Estate Division and concentrates his practice on representing commercial real estate owners, brokers and developers. He has represented both municipalities and developers in the development and redevelopment of recent major projects in the Kansas City area. Todd also has significant experience in representing landlords and tenants in commercial leasing matters involving office, retail and industrial property. He has represented sellers and purchasers in the conveyance of commercial property, as well as lenders and borrowers on loans secured by real estate. He has expertise in drafting and negotiating leases, contracts, easements, mortgages and deeds of trust, options, license agreements, and other transactional real estate documents. James B. Lampke, esq. is engaged in the general practice of law with the Hingham/Hull firm of Lampke & Lampke, Mr. Lampke con-centrates in the area of municipal law, real estate and civil litigation. He is the Town Counsel for the Town of Hull and serves as special counsel for a number of municipalities and as agency counsel. He also serves as an Independent Hearing Officer. Mr. Lampke is a graduate of the School of Public and International Affairs of The George Washington University and received his Juris Doctorate, cum laude, from New England School of Law. A frequent speaker on municipal legal issues, he is the Executive Director of the City Solicitors and Town Counsel Association and a past Chairman of the Public Law Council of the Massachusetts Bar Association. David M. Lawrence is William Rand Kenan, Jr., Professor of Public Law and Government in the School of Government, The University of North Carolina at Chapel Hill. At the School he focuses on local govern-ment law and particularly has written and consulted on open meetings and public records, issues involving local government property, governing board procedures, annexation and incorporation, economic development, utility services and organization, and local government reorganization. Lawrence is a native of Portland, Oregon. He is a graduate of Princeton Univer-sity and Harvard Law School and has been at the School of Government since 1968.

edwin M. Levy is a Senior Counsel, specializing in construction litigation among other areas, in the Commercial & Real Estate Litigation Division of the New York City Law Department, Office of the Corporation Counsel, where he has practiced for 20 years. He attended the University of Chicago as an undergraduate and Brooklyn Law School.

Craig MacFarlane is the City Solicitor of Surrey, British Columbia; BA (HONS.) and LL.B. Queen’s University. He has previously served as York Regional solicitor and with the City of Toronto’s Legal Department. He is the author of Land Use Planning, Practice Procedure and Policy,

DeWitt F. “Mac” McCarley is the City Attorney of Charlotte, NC. He received a BA in Religion and his law degree from the University of North Carolina at Chapel Hill. Prior to serving in Charlotte he was City Attorney in Greenville, NC after starting his career at the NC League of Municipalities. Julia “Rita” McNeil recently joined the Cincinnati USA Regional Cham-ber and serves as Vice President for Government Affairs. Prior to joining the Chamber, Ms. McNeil served as the City Solicitor for the City of Cincinnati. Juanita Maginley, RN, BSN, MA, is the Outreach Program Manager for the British Columbia Centre for Disease Control. The Outreach Program is an innovative public health nursing program focused on vulnerable populations. Street Nursing is one of the outreach programs that work with people who are homeless, and live with mental health and addictions issues. Juanita has worked in urban health, women’s health, and international health projects. She is one of the co-producers of the DVD, Bevel Up:

John P. Markovs is an Associate County Attorney for Montgomery County, Maryland and he serves as agency counsel to Department of Gen-eral Services, Division of Building Design and Construction. Dwight H. Merriam of Robinson & Cole LLP is a Fellow and Past President and of the American Institute of Certified Planners, a Fellow of the American Bar Foundation, a Counselor of Real Estate and a member of the American College of Real Estate Lawyers. Dwight has published four books and over 200 articles. He received his J.D. from Yale.

Nicholas P. Miller is an expert in the law and policy governing cable television and telephone regulation, and in the legislative aspects of communications law. He is a well-known advocate for the interests of local governments, airports, and national local government associations in cable television and telecommunications matters. He served as the U. S. Senate Communications Counsel and as a special consultant to the White House on telephone deregulation issues. He has worked extensively with international multilateral agencies engaged in telecommunications policy advice to developing countries. Mr. Miller is widely recognized for his lobbying experience with the Cable Act of 1984 and 1992, the AT&T divestiture, and the Telecommunications Act of 1996. He currently repre-sents the coalition of local governments which is challenging the FCC’s preemption of local cable franchise authority in the United States Court of Appeals for the Sixth Circuit. Mr. Miller is admitted to practice in Washington State and the District of Columbia Bar Associations. He received his law degree in 1973, and his undergraduate degree in 1966, both from the University of Washington where he was a member of the Washington Law Review. He is a member of the American and Federal Communications Bar Associations and an honorary life-time member of the National Association of Telecommunications Officers and Advisors, where he was their 1995 Member of the Year. He is also a member of the International Municipal Lawyers Association. Mr. Miller was a founding partner of the Washington, D.C. law firm Miller & Holbrooke. Prior to law school, Mr. Miller served in the U.S. Navy in Vietnam where he saw extensive combat. Mr. Miller holds the Silver Star, the Purple Heart and other combat commendations.

Robert J. Miller is a professor at Lewis & Clark Law School in Portland, Oregon, the Chief Justice of the Grand Ronde Tribe, and a citizen of the Eastern Shawnee Tribe of Oklahoma. He received his J.D. in 1991 from Lewis & Clark Law School and he clerked for the Ninth Circuit in 1991-92.

G. Foster Mills is the Managing Attorney of New York City Law Department and a member of the Law Department’s Executive Staff. Mr. Mills oversees the Administration, Information Technology, Operations, Worker’s Compensation and Legal Recruitment Divisions. His responsibilities include administration of the Law Department’s $125 million annual budget and management of the Department’s more than 1,300 employees. Mr. Mills has been with the Law Department since 1985, and he has held the position of Managing Attorney for the past ten years. In 2003, he was awarded the “Corporation Counsel Award for Distinguished Legal Service”—the office’s most prestigious award. Before being appointed to his current position, Mr. Mills served as a Deputy Davison Chief for the Contracts and Real Estate Division. Under former Mayor David Dinkins, Mr. Mills was appointed as the Direc-tor of New York City’s Office of Contracts and simultaneously held the position of New York City’s Chief Procurement Officer. In these positions, Mr. Mills oversaw the City’s $7 billion annual procurement budget. He is currently Vice President of the Country Attorneys Association of the State of New York and a Director of IMLA. Kory A. Nelson has been an Assistant City Attorney for Denver, Colorado since 1989, where he is counsel for Denver’s photo traffic enforcement program. He was born and raised in Fremont, Nebraska. Barry S. tulin ozdeger directs the Civil Rights Project at the National Law Center on Homelessness & Poverty. Howard Paperner has been the City Attorney of Winchester, Missouri since 1980. He is the City Attorney of Maryland Heights, Missouri, since its incorporation in 1985. From 1979 until 1981 he was the City Attor-ney of Times Beach, and represented the City in the Superfund “buyout.” Since 1989 he has been a Hearing Examiner for the Missouri Depart-ment of Natural Resources. He is also, the City Attorney of Breckenridge Hills and Crystal Lake Park, Missouri. He graduated from the University of Missouri-St. Louis (BA 1970) and the University of Missouri-Kansas City (JD 1973). Previously he served as an Assistant Public Defender in the City of St. Louis, an Assistant Prosecuting Attorney for St. Louis County, and, as an Adjunct Assistant Professor, Administration of Justice Department of the University of Missouri-St. Louis. He is a past President of the Missouri Municipal Attorneys Association.

Nina Perales is the Southwest Regional Counsel for MALDEF in San Antonio, Texas. In that role, she directs MALDEF’s litigation, advocacy and public education in Texas, New Mexico, Colorado, and six additional southern and western states. Ms. Perales specializes in voting rights litiga-tion, including redistricting and vote dilution challenges. She served as lead counsel for Latino plaintiffs in the redistricting cases in Texas in 2001 which secured a Texas House of Representatives redistricting plan containing an increase of four Latino-majority districts. Ms. Perales was lead counsel for Latino interveners in Arizona in 2003 and successfully defended the Latino-majority Congressional District 4 against an attempt to dismantle it. On March 1, 2006, Ms. Perales successfully argued before the U.S. Supreme Court in LULAC v Perry, a Latino vote-dilution challenge to the 2003 Texas congressional redistricting plan. In June, 2006 the Court struck down the redistricting plan as a violation of the Voting Rights Act of 1965. In addition to her own cases, Ms. Perales supervises the work of six staff attorneys who conduct impact litigation and advo-cacy on behalf of Latinos throughout the Southwest in the areas of educa-tion, immigrant rights, employment discrimination and political access. Ms. Perales received a Bachelor’s degree from Brown University and earned her J.D. from Columbia University School of Law in 1990.

edward G. Rheinheimer is the County Attorney for Cochise County, Arizona. He began his legal career in 1980 as a Captain in the U.S. Army Jude Advocate General’s Corps. In 1987, he left active duty with the Army and entered private practice where he remained until 1992. In 1992, Mr. Rheinheimer joined the Cochise County Attorney’s Office as a prosecutor with the Southwest Border Alliance Group Anti-Narcotics Task Force. In 2002, he was promoted to the role of lead prosecutor with the task force and in 2004 he as elected to the position of Cochise County Attorney.

Luis Robles has defended numerous police misconduct and prisoner rights cases in both federal and state courts, Mr. Robles is a trial lawyer with considerable expertise in Section 1983 and New Mexico Tort Claims Act litigation. Both as an Assistant City Attorney with the City of Albuquerque and in private practice, he has litigated claims involving high speed vehicle pursuits, warrantless arrests, search warrant procure- ment and execution, use of less-lethal force, police K-9 apprehension (bite), and police shooting cases.

Leon Rodriguez has been the County Attorney in Montgomery County, Maryland, since May 2007. From May 2001 until his appointment, he was a shareholder in the Washington, D.C. office of Ober, Kaler, Grimes & Shriver, where he was a litigator specializing in white collar criminal defense and health care law. For thirteen years prior to entering private practice, Mr. Rodriguez was a federal and state prosecutor in various jurisdictions. From 1997 to 2001, he was an Assistant U.S. Attorney in Pittsburgh, Pennsylvania, serving as the First Assistant U.S. Attorney from 1999-2001, and as the Chief of the White Collar Crimes Section from 1998-1999. Throughout his service as an Assistant United States Attorney, Mr. Rodriguez handled white collar matters with particular emphasis on health care, securities and tax fraud matters. From 1994–1997, Mr. Rodriguez served as a trial attorney in the Criminal Section of the U.S. Department of Justice, Civil Rights Division, where he handled a variety of criminal civil rights matters involving human trafficking, hate violence and law enforcement misconduct. Mr. Rodriguez was the lead prosecutor in the case of United States v. Miguel Flores, et al., which resulted in convictions of three individuals for involuntary servitude and smuggling of migrant agricultural workers from Mexico and Guate-mala. Prior to joining the Justice Department, Mr. Rodriguez was an Assistant District Attorney in Brooklyn, NY. Mr. Rodriguez received a B.A. in History from Brown University in 1984 and his law degree from Boston College Law School in 1988.

Kerry t. Ryan has handled complex legal matters as special municipal counsel on landfills, contracts and environmental issues. Kerry is a member of the Solid Waste Association of North America, Massachusetts Chapter and the Environmental Business Council New England, Inc. He has practiced law in both California and Massachusetts.

orlando Sanchez was named to fill a newly-created third deputy city manager position within the City Manager’s Office in May 2006. He oversees the departments of the City Clerk, Human Resources, Neighbor-hood Services, Information Technologies, Leisure Services and Finance and Business Services. Prior to being named deputy city manager, Or-lando served as the Neighborhood Services Department director, where he spearheaded many key, innovative plans and programs such as the 10- year Plan to end Homelessness; the Homeownership For Educators Program to assist teachers with housing costs; the Abandoned and Vacant Buildings Program to eliminate visible blight in neighborhoods; the EVOLVE Program to reintegrate ex-felons into productive lives; and a pilot program to help chronic inebriates. Orlando has significant knowl-edge and experience with the city dating back to 1988, when he served as a management analyst with the then Department of Economic and Urban Development. As a Development Officer in Economic and Urban Development, he worked to promote and develop the Las Vegas Technology Center, the Spectrum of Las Vegas and the Las Vegas Enter-prise Park that brought jobs to where people lived, to reinvigorate eco- nomically lagging areas and cut commute times. Since then, he has demon-strated his versatility and progressive leadership style with several departments in the city. As a facilities manager, he saved the city substantial money by standardizing and streamlining operations. His experience also includes work on the city’s long-term, comprehensive facility master plan. Orlando chairs the 2008 Southern Nevada Regional Planning Coalition’s Committee on Homelessness. He is a Leadership Las Vegas 2007 graduate from the Las Vegas Chamber of Commerce. In 2005, he was recognized as the “Emerg-ing Public Administrator of the Year” by the American Society for Public Administration. Prior to joining the city of Las Vegas, Orlando served in the private sector as a branch manager for a financial institution. A native of Belen, New Mexico, Orlando graduated from New Mexico State University with a bachelor’s degree in economics.

Suzanne Sangree has been a Chief Solicitor in the Baltimore City Department of Law since March 2007. Her non-litigation work includes low income energy assistance, foreclosure prevention and relief, and homelessness. She is counsel on Baltimore v. Wells Fargo, O8-CV- 062 (D. Md.), a novel Fair Housing Act claim alleging racially discriminatory predatory lending. Previously, Ms. Sangree was Appellate Director at the Public Justice Center and taught at the University of Maryland School of Law and West Virginia University College of Law.

Jennifer A. Smout is a solicitor with the Corporation of the City of London practising in the areas of municipal law, licensing, privacy law and corporate governance. She has recently returned to the City of London after serving as an adjudicator with the Ontario Municipal Board for four and a half years. Prior to her appointment to the OMB, she was a solicitor for the City of London where her areas of practice included land develop- ment, land use planning and zoning, expropriation law, real estate law, municipal law and corporate and commercial law. In addition to her public roles, Jennifer has private experience gained from her association with three prominent London law firms. Jennifer is an active participant in many professional associations and community organizations. She has

been a guest speaker for many continuing education programs for the Ontario Bar Association, the Law Society of Upper Canada, the Canadian Institute, the UWO Faculty of Law and the Ivey Business School. Jennifer is the co-author of a book on land use planning and development law. She is a gradu- ate of McMaster University and the University of Western Ontario.

Larry Stevens, BMI Assistant Vice President, General Licensing-based at BMI’s office in Nashville, Tennessee, oversees the management of BMI General Licensing sales and marketing activities. BMI’s general licensing department is responsible for developing and executing sales and marketing plans as well as developing and enhancing long-term relationships with customers who use music. Stevens first joined BMI in June of 1981 as licensing executive and advanced through the organization.

Laura Swisher is Associate Counsel for the Washington Suburban Sani-tary Commission, one of the ten largest water and wastewater utilities in the country. Laura graduated from University of Baltimore Law School in 1987, and is active in many organizations, including the Maryland- District of Columbia Utilities Association and the State and Local Government Law Section of the Maryland State Bar Association.

Herbert W.A. thiele has served as County Attorney for Leon County, Florida, since 1990. Prior to becoming County Attorney, Mr. Thiele was the City Attorney for the City of Delray Beach, Florida, for over eight years, and an Assistant City Attorney in Delray Beach, as well as in pri-vate practice, for the three years preceding. Mr. Thiele graduated from the University of Notre Dame with a B.A. in government and interna-tional studies and received his Juris Doctor degree from the University of Florida. He is admitted before the Florida Supreme Court, the United States Supreme Court, the United States District Court for the Northern District of Florida and the Southern District of Florida (both in the General Bar and in the Trial Bar), the United States Court of Ap-peals for the Fifth and Eleventh Circuits, and the United States Tax Court. He currently serves as Chairman of the Counties and Special Municipal Districts Department of IMLA; was a member of the Board of Directors and Secretary/Treasurer of the Florida Municipal Attorney’s Association; is a former Chairman of the Local Government Law Section of the Florida Bar, has served on the Board of Directors of the Florida Asso-ciation of County Attorneys, and held the Offices of Secretary, Treasurer, Vice-President, and on three occasions, as President of FACA. He is a past-Chairman of the Board of Directors of FACA. He is a member of the American Bar Association (Urban, State, and Local Government; Labor and Employment Law; and Litigation Sections; Government & Public Sector Lawyers Division); and the City, County, and Local Govern-ment Law (serving as an ex-officio member of the Executive Council), Envi-ronmental and Land Use Law, Labor and Employment Law, Administrative Law, and Trial Practice Sections of the Florida Bar. He was a member of the Florida Bar Long Range Planning Committee, and is also a past member of the Individual Rights and Responsibilities Committee and the Continuing Legal Education Committee of the Florida Bar. Mr. Thiele also holds mem-bership in the Association of Trial Lawyers of America; the ASPA Section on Environmental and Natural Resources Administration; and, the Inter-national Municipal Lawyers Association. He was chosen Florida Municipal Attorney of the Year for 1987-1988, and was awarded the Ralph A. Mar-sicano Award in 1991 by the Florida Bar Local Government Law Section for significant contributions to the development of local government law in Florida. In addition, he was honored to receive the Ethics in Gov-ernment Award in 1998 and in 2001, as well as The President’s Award in 2004 from the Florida Association of County Attorneys. In 2000, he received the prestigious Paul S. Buchman Award for outstanding contribu-

He has served as Vice Chair of the Second Judicial Circuit Bench/Bar Committee since 2003. He is also listed in the Who’s Who in American Law and named one of the Outstanding Young Men in America. Mr. Thiele has lectured and writ-ten numerous articles on Florida and national local government matters, including public records and sunshine laws; personnel matters, including public employee drug testing programs; public finance; and zoning, land use, and comprehensive planning matters.

Henry W. underhill, Jr. received his BA degree in History and English, Belmont Abbey College; LLB, University of North Carolina School of Law. He was the Assistant City Attorney for Charlotte, NC from 1965-1968, and Charlotte City Attorney, 1968–1995. Mr. Underhill was IMLA (NIMLO) Executive Director/General Counsel from 1995–2006. In 1981, he received the Outstanding Boss of the Year–Charlotte Legal Secretaries Association award; President, North Carolina Association of Municipal Attorneys; 1994 recipient of the Ernest L. Ball Awardfor Outstanding Public Service, North Carolina Association of Municipal Attorneys; National Institute of Municipal Law Officers Treasurer and member of the Board of Directors; NIMLO President—1982–1983; 1983 recipient of the NIMLO Distinguished Public Service Award; 2006 recipient of the IMLA Charles S. Rhyne Lifetime Achievement in Municipal Law Award; and recipient of the North Carolina Order of the Long Leaf Pine in 2006 conferred by NC Governor Michael Easley. Now retired, he and his wife, Mary, live in Seattle, Washington.

Helen Valkavich is Assistant City Attorney advisor on Ethics and Open Records issues, served as primary staff support to the Mayor’s Committee on Integrity and Trust in Local Government, and provides ethics training to city staff and officials. From September 1996 through October 2000 she served as Special Prosecutor, State of Alaska Attorney General’s Office. Investigated and prosecuted white-collar offenses, election code violations and official misconduct offenses. From September 1990 through July 1995, she was Assistant District Attorney, Anchorage, Alaska. Ms. Valkavich prosecuted felony offenses, including homicides, narcotics offenses, and sexual assaults. She is a member of the Texas and New York Bar Asso- ciations and Federal District of Alaska. Helen is also member of the Bexar County Women’s Bar Association. She received a Bachelor of Science in Geology from Trinity University in San Antonio, Texas (1984), J.D. from the University of Texas in Austin (1987).

Joseph Van eaton is a Partner with the Washington, D.C. and California-based firm of Miller and Van Eaton, P.L.L.C. and received his law degree, cum laude, from the University of Pennsylvania in 1979, and his under- graduate degree, magna cum laude, in 1975 from Syracuse Univer-sity. For 25 years, he has specialized in assisting local governments on cable, telephone, Internet and wireless issues in courts and at the nego- tiating table. He is representing municipalities in a pending appeal chal- lenging recent FCC cable franchising orders.

Patricia P. Via is the Chief of the Division of Litigation, Office of the County Attorney for Montgomery County, Maryland. She attended the University of Maryland School Law (JD 1985) and the University of Maryland (BA 1982-cum laude). She currently manages and super- vises attorneys who litigate tort and civil rights claims in defense of Mont-gomery County, other local governments, and their employees.

Frank Waite is Of Counsel in the Labor and Employment and Govern- ment Litigation Practice Groups in the Dallas office of Thompson & Knight LLP. He has more than 20 years of experience defending local govern-ments on matters involving constitutional, employment, and tort claims. His practice is focused on representation of local government entities and public officials in litigation. Mr. Waite received his J.D. in 1984 from Texas Tech University School of Law and his B.A. in Sociology and Psy-chology in 1979 from the University of Wisconsin. He was an Assistant City Attorney for the City of Dallas and for the City of Arlington, Texas. He has been an IMLA Local Government Fellow since 2000.

Michael J. Watza is a commercial litigation/governmental affairs group co-chair at the Kitch Firm in Detroit Michigan concentrating on litigated, legislative and regulatory solutions on behalf of municipal, non profit and private sector clients. He represents clients in State and Fed-eral trial and appeals courts, regulatory agencies and legislatures regarding commercial, telecommunications, local government and mass torts. Mr. Watza is also a Michigan Gaming Control Board Member.

Judith Welch Wegner is Burton Craige Professor of Law at the University of North Carolina-Chapel Hill. She received her BA from the University of Wisconsin-Madison and her J.D. from UCLA. After joining the UNC law faculty in 1981, she served as dean from 1989-99. She served as an elected member of the Carrboro, NC Board of Aldermen from 1985-89. Wegner teaches property law, state and local government law, and land use law, and assists with UNC’s Community Development Clinic. She is co-author of State and Local Government Law in a Fed-eral System (6th ed., Lexis-Nexis 2006) and Educating Lawyers (Carnegie Foundation for the Advancement of Teaching) (Jossey-Bass, 2007) among other publications.

Holly Whatley is Senior Counsel at Colantuono & Levin, P.C., where she provides advice to, and litigates on behalf of, public agencies on a broad range of issues, including intellectual property, election law, CEQA and land use. Holly received her B.A. cum laude (1988) and her J.D. (1992) both from the University of Texas.

George A. Wilkki, City Solicitor for Windsor, Ontario is a Windsor Law graduate, a Sessional Lecturer for 5 years, called to the Bar in 1979. Canadian Scholarship FundIMLA is very pleased to announce the continuation of the Canadian Scholarship Fund based on a proposal by Sylvia Watson, who many will remember as the dy-namo behind the very successful IMLA Conference in Toronto, Canada. The fund, financed from the excess proceeds raised by the City for IMLA’s 1999 Conference in Toronto, will be used annual to underwrite the expenses of young (under 40) Cana-dian lawyer’s trip to an IMLA Annual Conference. In turn, the successful applicant will be required to present a paper on a municipal law topic at the Conference.

This year’s recipient is the sixth to be chosen. The 2008 Canadian Scholarship recipient is Naomi Brown with the City of Toronto Legal Services Litigation Division, Toronto, Ontario Canada. Naomi will present a paper at the 2008 Annual Conference on Sign By-Law Litigation and its Impact on Municipalities.
