• The purpose of the Trademarks Act 1999 is to protect not only the proprietor of the trademark, but also the general public, which is susceptible to deception and confusion. The board held that the trademark MAGGI had acquired an extensive reputation among the public by way of sales and advertisements. Hence, the public would assume that any product bearing the mark MAGGI was manufactured by the appellant. Thus, any unauthorized commercial use thereof in relation to any goods or business was likely to be associated with the business. It was also averred that since the company was a prior user of the trademark, its interest in the mark ought to be protected. On the basis of these factors, the maggi trademark is protected as a well known mark
