A 35 Year Perspective

History of Storm Water Policy

• 1956 to 1972 – series of federal pollution control acts aimed to improve water quality

• 1972 – National Pollutant Discharge Elimination System enacted and beginning of Clean Water Act

• 1987 – Clean Water Act Amendments– Establishes schedule for industrial and municipal storm water

discharge permits. Municipalities required to have controls to reduce pollutant discharges

• 1990 – Phase I – municipalities greater than 100,000 in population

• 1999 – Phase II – all small municipalities in urbanized area– 2003 – court case prevented Texas from issuing a state storm water

program for urbanized municipalities

Phase II Storm Water Permit

• Permits the discharge of storm water to waters of the US from the MS4– provided the City:

• Prepare a Storm Water Management Plan• Submit Plan to TCEQ by February 11th, 2008• Reduce amount of pollutants entering waterways

via implementation of Plan• Five Years to implement

Public Education and Involvement

• Requirements: – outreach activities or materials that will inform the

public about storm water impacts– Allow all members of the public to participate in the

development of the SWMP

• Southlake’s Goals:– Provide brochures or other informative materials– Website information– Educational program at Carroll ISD– Post SWMP on website– Solicit comments at SPIN meeting on SWMP

Illicit Discharge Detection and Elimination

• Requirements:– Develop techniques for detecting illicit discharges– Develop actions and enforcement for elimination of

illicit discharges

• Southlake’s Goals:– Map the storm sewer system– Create an ordinance that would effectively eliminate

illicit discharges– Educate staff and public to be the “eyes and ears”

and who to notify about illicit discharges

Construction Site Storm Water Runoff Control

• Requirements:– Ordinance to require erosion and sediment controls– City to require that contractors to implement appropriate erosion

and sediment controls– Develop procedures to review site plans for erosion and

sediment controls

• Southlake’s Goals– Develop an ordinance and enforcement procedures– Develop site review procedures specific to erosion and sediment

controls– Provide education for staff on erosion and sediment control

inspections– Provide education for construction site operators

Pollution Prevention/Good Housekeeping for Municipal Activities

• Requirements:– Identify housekeeping measures and BMPs– Implement housekeeping measures where needed

and maintain current BMPs– Provide training for staff– Properly dispose of waste

• Southlake’s Goals:– Provide training to staff annually– Audit all municipal activities and facilities for potential

sources of pollution and identify needs– Remove and properly dispose of wastes found in

storm drain systems
