Instructions for filling out the Employment Agreement
The Employment Agreement contains 5 (five) blanks. Fill in every blank, following the instructions for
each number, below.
1. Blank 1 in both Languages- Signing date of the Employemtn Agreement
Should be indicated the date when the Employment Agreement was singed by the Employee in
his/her home country or place of departure. For example: if the contract is signed in USA on
June 15th, 2012 then the date of the Employment Agreement will be June 15
th, 2012.
2. Preamble, Blank 2 in both Languages - Full name of the Employee
Official names should be indicated including the middle names. For example: John Thomas
Smith and not John Smith only.
3. Preamble, Blank 3 in both Languages - Address
Should be indicated wither legal (home) address or correspondence address. Definition: The
Legal address is where the Employee is officially lregistered, however if he/she does not live in a
registered address, the address where Employee actually lives (correspondence address) in his
home country/place of residence should be indicated.
4. Article 6, Paragraph 6.2, Page 12 in both Languages - Effective Date for Salary Transfer
Should be indicated the date when the Orientation Training starts after the Employee arrives in
Georgia.
5. Article 7, Paragraph 7.1, Page 13 in both Languages – Validity Period of the Agreement
The end date of the Employment Agreement varies depending on how many semesters the
Employee wishes to be participating in the Program.
For one semester contracts the end date of the Agreement will be - December 23rd
, 2012;
For two semester contracts the end date of the Agreement will be - June 20th, 2013;

Article 1. General Provisions
1.1 Employment Agreement (the Agreement) regulates
employment and employment-associated relations
between Employer and Employee.
1.2 Agreement is consistent with the Labor Code of Georgia
and the Civil Code of Georgia.

Article 2. Subject of the Agreement
2.1 In terms of the Program, “Teach and Learn with
Georgia”, Employee shall perform the work in good
faith in compliance with Article 4 of the Agreement, and
Employer shall pay to the employee the salary as agreed.

2.2 Over the period of this Agreement, the Parties shall
respect basic human rights and freedoms guaranteed by
the legislation of Georgia.
2.3 Employment relations are established on the basis of the
agreement reached between the parties as a result of free
expression of will and equitability.

Article 3. Performance of the Work
3.1 The Employee shall perform the work personally.
3.2 During the entire term of employment, the Employee
shall perform his/her obligations defined in this
Agreement duly and with due diligence.

Article 4. Responsibilities of the Parties
4.1 The Employee shall:
4.1.1. Arrive in Georgia after successful completion of the
application process;
4.1.2. Participate in orientation training organized by the
Employer;
4.1.3. Attend Introduction meeting before starting teaching
and before entering new public school;
4.1.4. Plan and conduct English language lessons in
cooperation with the English language teacher(s) of
Georgian public schools;
4.1.5 Prepare English teaching materials, as well as, plan
other teaching activities;
4.1.6 Conduct English language lessons during
summer/winter schools of English language teaching
upon the Employer’s request;
4.1.7 Assist public schools in organizing various English
language teaching activities;
4.1.8 Work with local English language teachers

4.1.9 Submit monthly report according to the procedure
established by the Program on the last Friday of each
month. The Employee is obliged to notify the
Employer in case of delay in the performance of the
obligation indicated in this Paragraph as soon as
possible, which might be deemed as excused in case
the Employee provides with objective reasons for the
delay;
4.1.10 Abide by volunteer teacher's ethics rules;
4.1.11 Confirm his/her obligation to pay the full airfare cost
in writing in case he/she unilaterally terminates the
Employment Agreement;
4.1.12 Give a written notice to the Employer, in case of
unilateral termination of the Agreement, stating the
date of and reasons for termination 60 calendar days
in advance;
4.1.13 Refund full airfare costs to Employer within 45
calendar days after the termination of the Agreement
and pay for his/her own airfare home, should the
Employee leave the host country, by terminating the
Agreement or if the agreement is terminated by the
Employer based on Article 12, paragraph 12.3
subparagraphs 12.3.1-12.3.7, if the Employer does
not define otherwise;
4.1.14 Refund the Employer for cost of airfare to Georgia
within 45 calendar days and pay for his/her own
airfare home, if he/she tests positive for TB, HIV,
any STD’s, marijuana, narcotics, toxic substances,
other drugs or Hepatitis A, B or C, is the carrier of
the psych-neurologic and cancer or of any (chronic)
disease, which may prevent from fulfillment of
his/her activities as a teacher or otherwise fails
his/her medical exam as stipulated by Employer;

4.1.15 Refund the full airfare costs and pay for his/her own
airfare home if the Employee terminates the
Agreement on the grounds of emergency leave;
4.1.16 Cover the price difference on his/her own if the
Employee wishes to upgrade the ticket or changes
the place of destination. This rule applies both to the
vacation ticket and arrival/departure ticket to and
from Georgia;
4.1.17 Not leave the host country without the written
consent of the Employer during the entire term of
Employment;
4.1.18 Not engage in any additional monetary employment
without prior written permission from the Employer.
Additional job must not prevent the Employee from
fulfilling his/her primary obligation of conducting
lessons at public school.
4.1.19 Refund property of the Program “Teach and Learn
with Georgia” if damaging them as well as cost of
repair if the devices get damaged due to the
negligence of the Employee.
4.1.20 Return property of the Program “Teach and Learn
with Georgia” (cell phone with SIM card, phone box
and charger, textbooks etc. ) given to him/her upon
the expiration of the Agreement term;
4.1.21 Have a valid passport that will not expire for at least
one year after the Employees’ arrival to Georgia;
4.1.22 Take a medical exam, either in his/her home country
prior to departure or in Georgia after arrival, in
accordance with the requirements of “Teach and
Learn with Georgia” and pay for medical
examination in either place;
4.1.23 Go through additional medical tests if needed in case
of reasonable doubt of the Employer. If the medical
insurance package does not cover the expenses of the
additional medical tests, the Employee shall cover
additional expenses by himself/herself;
4.1.24 Inform the Employer about any change regarding
his/her health condition which differs from the

4.1.26 Not damage the reputation of the program with
his/her behavior in case of alcohol consumption
during his/her social time.
4.1.27 Respect and comply with Georgian legislation
including the law on general education as well as
public school policy;
4.1.28 Not damage school reputation;
4.1.29 Avoid publishing such information of a private
nature which can cause harm or be of detriment to
the reputation of the Employer, the program, the
school and the host family, as well as may affect
his/her own reputation as a teacher and make
negative influence on the students’ mindset;
4.1.30 Not offend the cultural environment, local traditions
and viewpoints of the host country with his/her
behavior and everyday life aspects;
4.1.31 Get acquainted with necessary security and traffic
regulations. Furthermore, comply with the rules
regarding crossing the borders of Georgia and
driving within Georgia, determined by the program
which are introduced to the Employee during
orientation training;
4.1.32 Notify the Employer immediately about any kind of
violent act, carried out against him/her or being
carried out against another Employee, student, host
family member or any other third party related to
him/her under the scope of the program that the
Employee eye-witnessed or found out about the
violent fact in any other manner;

4.1.33 Notify the Employer immediately about any act
committed by him/her or against him/her which
requires police involvement;
4.1.34 Give English lessons to the host family members and
dedicate not less than three days a week, minimum
one hour a day;
4.1.35 Not interfere with the privacy of the host family;
4.1.36 Not express any offensive attitude towards the host
family during the entire term of Employment;
Refrain from offensive attitude and epithets while
communicating with the host family, in case of
misunderstanding based on the language barrier;
4.1.37 Pay 100 GEL to the host family on the last day of
each month during the entire term of his/her
Employment Agreement;
4.1.38 Not violate the accepted level of noise during day
and night while staying with the host family;
4.1.39 Keep minimum standards of household hygiene;
4.1.40 Maintain the living area and property allocated and
entrusted to him/her by the host family. In case of
property damage, he/she will repair the property, or
in a timely fashion, compensate the expenses for its
repairing;
4.1.41 Vacate the room in its original condition or in the
same habitable condition upon the termination of
his/her Employment Agreement;
4.1.42 Perform factual actions towards living area only
upon agreement with the host family;
4.1.43 Give a written notification to the Employer at least
60 calendar days prior in case the volunteer takes
paid leave for 24 working days;
4.1.44 Allow Employer to request information from the
insurance company about his/her use of insurance
services with all related medical documentation;

4.1.45 Follow Program’s medical team’s instructions and
recommendations in case of health problem;
4.1.46 Follow the rules of conduct during orientation
training introduced by Program representatives;
4.1.47 Give the Employer precise and accurate information
(personal, professional, medical, criminal, etc) which
is requested by the Employer during application
process in order to determine his/her compliance
with program requirements;
4.1.48 Specify certain type of information from his/her
application upon request of the Employer;
4.1.49 Participate in any event organized within the scope
of the program upon the Employer’s request.
4.2 The Employee shall not disclose the information during
or after the term of his/her Employment, despite of the
reasons for termination of the Agreement, which:
4.2.1 May harm the program and reputation of the
Employer;
4.2.2 May negatively affect the school reputation;
4.2.3 May interfere with the privacy of the host family and
disrespect their traditions and everyday lifestyle;
4.2.4 May interfere with the rights of other volunteers;
4.3 The Employee shall not interact with the media without
obtaining a prior consent from the Employer.
4.4 Within its scope of competence, during the entire
term of this Employment Agreement, the Employer
shall:
4.4.1 Provide a secure work place for life and health of the
Employee. Give fair, explicit information within a
reasonable time regarding all facts, which may affect
life and health of the Employee;
4.4.2 Provide the Employee with living conditions in a
host family;

due to the language barrier;
4.4.9 Provide the Employee with the bank account and the
debit card;
4.4.10 Provide the Employee with the work statement upon
the Employee’s request;
4.4.11 Provide the Employee with the training during the
orientation meeting in Georgian Language,
Intercultural differences, teaching methodologies and
co teaching. Also, provide the Employee with the
information about transportation, traffic regulations,
safety and security. Furthermore, provide the
Employee with the information necessary for the
better communication with the host family and for
the integration in the society.
4.4.12 Provide the Employee with the hotel during the
orientation training and cover the hotel stay costs;
4.4.13 Provide the Employee with the health insurance,
medical assistance and emergency medical
transportation within Georgia if needed within the
scope of the insurance.
4.4.14 Provide the Employee with the necessary
information regarding the various legal procedures;
4.4.15 Provide the Employee with the information regarding

the Postal and Customs service;
4.4.16 Provide the Employee with the documents necessary
to obtain the visa and temporary residence permit;
4.4.17 Pay Employee the salary defined in the Agreement;
The Employer is entitled to suspend this obligation
until the Employee fulfils his/her obligation
determined by subparagraphs 4.1.13, 4.1.14, 4.1.15,
if the Employer does not define otherwise.
4.4.18 Provide Employee with one round trip economy
class flight ticket to and from Georgia. In case the
Employee chooses destination other than the original
departure place while departing from Georgia (after
expiration of the Employment Agreement), he/she is
obliged to cover all additional costs. The Employer is
entitled not to provide the Employee with the
returning ticket in case the Employee unilaterally
terminates this Employment Agreement or if this
Employment Agreement is terminated on the basis
of the Article 12, Paragraph 12.3, provided that the
Employee breaches this Employment Agreement;
4.4.19 Provide Employee with one round-trip economy
class ticket during the vacation time. The cost of
vacation ticket shall not exceed the price which
would cost the round trip ticket from the Employee’s
home country to Georgia. All additional costs shall
be covered by the Employee;
4.4.20 Award the certificate of completion and letter of
recommendation in case the Employee fulfills his/her
contractual obligations successfully;
4.4.21 Any unforeseen circumstances connected to the
flights (e.g. lost luggage; delayed or canceled flights;
extra charges for excess luggage/number of bags;
airplane class upgrades; etc.) should be
communicated either directly to the airline(s) or to
the travel agency that purchased the flight ticket from
the particular airline(s). Additionally, Employer is
not responsible to reimburse any extra fees and/or

unforeseen circumstances. Employer’s obligation is
limited up to providing the translation support
(English-Georgian and vice versa), if needed.
4.5 Sub Paragraphs 4.1.43 and 4.4.19 of this Article only
apply if the volunteer signs the Employment
Agreement through June 20, 2013.
4.6 The Employer is entitled to set reasonable deadlines and
give instructions in terms of fulfilling some of his/her
obligations in a due manner and the Employee is
obliged to follow these deadlines and instructions.
4.7 The Employee’s requested date of departure has to fall
within one month period after his/her contract expires.
4.8 The Employee is entitled to get the flight ticket at least
a week before his/her departure, unless the delay is
caused by the Employee.
4.9 The Employee is not entitled to give any instructions to
the Employer in terms of flight itinerary, rather than
specify the date and the destination. It is the
Employee’s responsibility to provide correct airport
name and code in the flight request form. Date of the
flight can fall 2-3 days around the requested date and
the Employee should be prepared for this change.
4.10 The Employer is entitled to define and specify the flight
itinerary with reasonable layovers. If the flight schedule
and/or itinerary is changed because of the reasons
falling beyond the control of the Employer, the
employee is obliged to cover all costs derived from
such changes.
4.11 Special arrangements such as seat preferences, meals on
the plane etc. do not fall under the responsibility of the
Employer.
4.12 The Employer and the Employee are obliged to
maintain correspondence with each other via email,
phone or other means of communication and share all
necessary information which might help both parties to
perform their contractual obligations effectively.

Article 5. Living Conditions
5.1 The Employer shall provide the Employee with living
conditions in a host family.
5.2 The Employee shall not change the host family
arbitrarily. The Employer is authorized to decide on the
Employee's re-housing. Moreover, the Employer chooses
the region and the host family.
5.3 The Employee shall pay the housing rent if he/she
chooses an apartment on his/her own will.
5.4 If the Employee justifiably complains about living
conditions, the Employer is obliged to offer alternative
host family as well as remind of his/her right of renting
the apartment.

Article 6. Amount of Salary and Payment Procedure

the last day of each month.
6.6 Leaving Georgia and/or non-participation in
winter/summer schools is considered as suspension
from work caused by the Employee’s fault and shall not
be reimbursed.
6.7 Paragraph 6.6 does not apply if the Employee leaves
Georgia within the scope of permitted paid vacation.
6.8 If the Employee spends paid vacation in Georgia,
his/her vacation pay shall be paid according to the rule
determined by Article 6 of the agreement.

vacation pay shall be deposited after his/her arrival in

Article 8. Work Time, Breaks and Holidays
8.1 Work time for the Employee is 5 (five) hours a day.
Duration of daily working hours shall not exceed 6 (six)

Article 9. Leave and its Application
9.1 Employee is entitled to a paid leave for 24 consecutive
working days per year, which should be taken only
during the summer or winter school vacation.
9.2 The Employee is entitled to an unpaid leave only upon
the prior consent of the Employer and the School
Director of that public school, where the Employee
teaches. The Employer’s post factum consent is also
possible only in exceptional situations.
9.3 The period of an unpaid leave shall not exceed 15
calendar days during the entire term of the employment
agreement.
9.4 The Employee is obliged to notify the Employer about
the unpaid leave and the reasons for taking such leave
two weeks in advance. In case the Employee fails to
notify the Employer in advance due to the objective
reasons, he/she is obliged to notify the Employer one
day before the vacation starts or on the second days
after he/she takes the leave.
9.5 For the purposes of this Article, the Employer’s post

Article 10. Sick Leave
10.1 The Employee shall be entitled to a paid sick leave if an
illness or injury prevents him/her from performing the
duties under this Agreement, provided, however, that
he/she obtains Employer's prior consent.
10.2 When the Employee takes a sick leave for two (2)
consecutive working days or during the teaching
session, the Employee shall notify the Employer and the
school before taking the leave and submit a doctor's
medical report to the Employer.
10.3 Employee's paid sick leave during the entire term of
Employment shall not exceed fifteen (15) working days.
If Employee requires a sick leave for more than fifteen
(15) working days during his/her entire term of
employment, Employee may take a further sick leave
without pay.
10.4 If the duration of the illness period exceeds 15
consecutive calendar days, the Employee shall be
considered as ineffective for work.

Article 11. Emergency Leave
11.1 In emergency situations, the Employee is entitled to

emergency leave for 14 calendar days during the entire

11.4 The period which Employee spends abroad is
considered as unpaid leave and shall not be reimbursed.
In case of emergency leave the Employee is exempted
from the obligation to inform the Employer about the
unpaid leave two weeks in advance. However, the
Employee shall inform the Employer as soon as it will
be possible about his/her intention to leave Georgia.
11.5 If the parties do not define otherwise and the
Employee’s stay abroad during the emergency leave
exceeds 14 calendar days, the Employment Agreement
with the Employee shall be terminated and he /she is
obliged to refund the full airfare costs.

Article 12. Termination of the Agreement
12.1 The Employment Agreement shall be terminated on
the grounds and according to the rules set out in the
Labor Code of Georgia.
12.2 The grounds for termination of the Agreement are:
12.2.1 Performance of the work envisaged by the
Agreement;
12.2.2 Expiration of the Agreement term;
12.2.3 Violation of the terms of the Agreement by one
of the Parties or undue performance;
12.2.4 Cancellation of the Agreement;
12.2.5 Mutual consent of the Parties;
12.2.6 Other grounds set out in the Labor Code of
Georgia.
12.3 The Employer may also terminate the Agreement if:
12.3.1 Employee tests positive for TB, HIV, any
STD’s, marijuana, narcotics, toxic substances,
other drugs or Hepatitis A, B or C, is the carrier

and cancer or of any (chronic) disease, needs
surgical operation (excluding the emergency
situations) which may prevent from fulfillment
of his/her activities or otherwise fails his/her
medical exam as stipulated by Employer and
when the medical test can not define the type of
disease in Georgia;
12.3.2 Employee is ineffective for work, due to the
diseases other than those defined in Article 12,
Paragraph 12.3.1;
12.3.3 Employee continuously fails to perform his/her
duties for seven or more working days without
any excuse or Employer’s prior notification;
12.3.4 Information provided by the Employee in
his/her application is not true or the Employer
has reasonable doubt about the accuracy of the
information;
12.3.5 Employee and Employer fail to reach an
agreement on Employee’s living conditions and
host family, provided that the Employer offered
the Employee alternative host family and the
Employee did not accept the offer;
12.3.6 Employee’s behavior is inappropriate for the
program “Teach and Learn with Georgia”;
12.3.7 Employee fails to reveal professional skills and
knowledge relevant to the present Agreement
during the entire term of the Employment
Agreement.
12.3.8 Employee fails to fulfill his/her obligation
determined by Article 4, paragraph 4.1,
subparagraph 4.1.24.
12.4 In case of breaching the terms of Agreement or undue
performance, the Employee shall be given a written or
verbal notification and in case of repetition the same or

terminated and the Employee shall be obliged to
refund airfare costs and other expenses, if any;
12.5 The Employer is entitled to apply to suspension from
work without pay for 5 working days in case the
Employee fails to perform the obligation indicated in
Article 4, Paragraph 4.1, Sub Paragraph 4.1.9.
Application of these measures will not discharge the
Employee from performance of his/her unperformed
obligations which must be fulfilled within a short
period after the expiration of the disciplinary measures.
12.6 Cancellation of separate terms of the Agreement shall
not release the Parties from fulfilling the remaining
obligations, such as refunding the expenses and
submitting monthly report.

Article 13. Rules of Introducing Amendments and
Additions to the Agreement
13.1 No amendment or modification of this Agreement
shall be valid or binding on any party unless the same
is made in writing, refers expressly to this Agreement
and is mutually agreed by both parties.
13.2 If amendments to the Agreement are required due to
some unforeseen circumstances, the initiator of such a
change shall inform the other Party in writing.
13.3 Employer is entitled to give instruction to the
Employee to specify particular conditions of the
performance of labor under the Employment
Agreement, which do not have substantial effect on the
Agreement terms.
13.4 Non substantial amendments of the Agreement terms
shall not lead to the Agreement amendment on merits.

13.5 In addition to the provision of Para. 13.3 of the
Agreement, the following is considered as non
substantial amendments of the Agreement terms:
13.5.1 Amendment, which is conditioned by
amendments to the legislation and makes exact
performance of the Agreement impossible,
without changing its essence;
13.5.2 Placement of an Employee in several work
locations, including a job location on part-time
basis in another school.

Article 15. Force-Major
15.1 The Parties shall not incur liability for non-fulfillment
or improper fulfillment of obligations provided for by
this Agreement, or for exceeding the term, if the non-
fulfillment of this Agreement is caused by force
majeure.
15.2 For the purposes of this Article, force majeure shall
mean such circumstances, owing to existence of which
the Party objectively failed to fulfill the contractual
obligations (natural disasters, hostilities, epidemic,
quarantine, sharp reduction of budgetary
appropriations, putting an embargo on the service
provision, coup d'etat, etc.).
15.3 In case of force majeure circumstances, either Party to
this Agreement, which failed to fulfill the obligations
imposed, shall, at its earliest convenience, notify the
other Party in the written form on these circumstances
and reasons causing these circumstances. In case the
notifying Party fails to receive an answer from the
other Party, the former Party, at its own discretion,
shall, according the expediency and opportunities,
proceed with the fulfillment of the obligations imposed

means of fulfillment of the obligations, which shall be
independent from the force majeure circumstances.

Article 16. Written Notification
16.1. Any notification indicated in this Agreement shall have
a written form.
16.2. The notice shall be sent to the official address of the
parties. Sending a written notice by a regular email is

Article 17. Settlement of Disputes
17.1 Any dispute arising in connection to non-fulfillment of
the Agreement shall be, to the extent possible, settled
through negotiations. If the Parties fail to reach
agreement, the dispute shall be adjudicated by the
Court according to the legislation of Georgia.

Article 18. Final Provisions
18.1 The parties confirm by signing that this Agreement
does not contain ambiguous clauses and that they are
accepting and fully aware of these terms and
conditions.
18.2 Issues which are not covered by this Agreement shall
be subject to the Georgian Legislation.
18.3 In case of nullity any of the clauses of this Agreement
due to the legal amendment, Court Injunction or some
other circumstances which occurs after the signing of
this Agreement, shall not affect the validity of any
clauses of this Agreement. If the aforementioned
circumstances occur the parties shall take the
responsibilities to negotiate changes in this Agreement

18.4 This Agreement is made billingually in Georgian and
English in three copies (text in both languages placed
in the same page next to each other), all texts being
equally authentic (One copy shall be deposited with
Employee and two with Employer).
18.5 In case of divergence in interpretation, Georgian
language text shall prevail.
