INTRODUCTION:-

The district Sundargarh is an undivided district and functioning since 01.01.1948.The district has covered an area of 9712 sq.kms with a total population 20,93,437 nos having 10,61,147 male & 10,32,290 female as per census 2011. The district consist of 03 sub-division namely Sundargarh (sadar),Panposh & Bonai. There are 18 no of Tahasils, 112 no. Of R.I. circles, 17 no of Blocks, 01 Municipality Corporation, 03 Municipality, 47 Police stations, 262 GPs & 1744 no of Revenue villages. The district has 8.62% S.C, 50.21% S.T & rest others population. The district has 07 Assembly Constitution.

The office of the Collectorate is functioning in its own building. All the district level

offices have been accommodated in the Collectorate premises.

Sri Surendra Kumar Meena, IAS is now working as Collector & D.M, Sundargarh w.e.f 25.04.2018 prior to him Sri Vineet Bharadwaj, IAS was in charge of Collector & D.M. Sundargarh. Sri Bhaskar Chandra Turuk, OAS (SAG) is now working as ADM, Sundargarh w.e.f 01.06.2017. Smt Manisha Banerjee IAS is now working as ADM, Rourkela w.e.f. 29.05.2016.

Review of Case Records

Revenue Appeal No 24/2017

Ghanashyam Naik Vrs Subash Munda

The brief history of the case is that the appellant i.e. Ghanashyam Naik and

Others of Village-Tilengapali,PS- Sadar, are in possesion of Plot No 892, 893 & 905

with an area of 2.40 Acre under Khata No. 167 under Sadar Police Station Sundargarh.

The case was instituted on the petition filed by Subash Munda S/o- Late Durga Munda &

others U/S 3 (A) of Reg-2 of 1956 in respect of above scheduled land against the

appellant. The OSD(LR) Sundargarh persued the documents and heard both the parties

on 22.09.2017. Exchange deed is done without prior permission of the Competent

Authority. Further as per U/S-3(2) Reg-2 of 1956 the transfer of immovable property by

Scheduled Tribe to Non- Scheduled Tribe without prior consent of competent authority

is illegal. Also the Transfer is Benami. Since the case land belongs to ST Community the

OSD (LR) Sundargarh passed order to restore the case land in favour of the petitioner.

The appellate Court issued notice to both the parties for hearing. After hearing the

learned Addl. District Magistrate, Sundargarh (Appellate Authority) upheld the order of

lower court on the ground that there was provision for permission for selling of land U/S

Reg-2 of 1956 and there is no permission for transfer claimed by the appellant is fully

un-authorised. There is also no adverse possession on tribal land as per Supreme Court

decision. Hence upheld the order of lower Court and directed to restore the case land in

favour of Subash Munda, S/o Late Durga Muda of Telenga pali, Dist. Sundargarh.

OLR APPEAL No. 02/2013

Maheswar Patel Vrs. Bhika Besan @ Ganda

The Revenue Appeal bearing case No. 02/2013 U/S- 23 of OLR Act instituted on

02.02.2013 on the appeal petition filed by Maheswar Patel, S/o Late Ugresan Patel and

others of village Deuli, P/S Bhasma, Dist. Sundargarh preferred this appeal against the

order dated 15.01.2013 passed by the Sub-Collector, Sadar, Sundargarh in OLR Misc.

Case No. 31/2011 (U/S- 23 (A) of OLR Act).

The fact of the case is that Bhika Besan, S/o Late Bhagirathi Besan of village

Deuli, P/S Bhasma, Dist. Sundargarh filed a Misc. Case 31/2011 under section 23 (A) of

OLR Act against the appellant that Hal Khata No. 122 of village Deuli, Dist. Sundargarh

measuring an area of Ac. 1.96 recorded in the name of Bhagirathi Ganda. The appellants

have forcibly occupied land measuring Ac. 0.21 bearing plot No. 1077 under Hal Khata

No. 122 of village Deuli. The appellants who were opposite party in the Court below

filed show cause stating that they have purchased the case land on 15.02.1951 from Jatia

Ganda for consideration of Rs. 100/- and also contended that they have filed Civil Suit

No. 129/2011 in the Court of Civil Judge Sr. Division, Sundargarh for right, title and

confirmation of their possession over the case land.

The lower Court has given sufficient opportunity to prove their contention. Neither

any evidence was adduced nor the unregistered sale deed was produced. Hence the

appeal was dismissed by the Appeal Court.

REVENUE APPEAL NO. 22/2013

Sashi Bhusan Sahoo Vrs Alekh Nag

The Revenue Appeal No. 22/2013 U/S- 23 (A) of OLR Act was instituted on

13.11.2013 on the appeal petition filed by Sashi Bhusan Sahoo, S/o Late Sahadeb Sahoo

of FE/52, Basanti Colony, P/S Uditnagar, Rourkela, Dist. Sundargarh against the order of

Sub-Collector, Panposh U/S- 23 (A) of OLR Act. The learned lower Court passed order

in Misc. Case No. 01/2012 on dated 01.10.2013 on observation that appellant is in un-

authorized occupation of land of Alekh Nag, S/o Late Debraj Nag, Caste ‘GANDA’ (SC)

of Sector-1, Rourkela.

After hearing both the parties the learned lower Court passed eviction order for

restoration of the case land in favour of the petitioner (Respondent). Being aggrieved, the

appellant preferred appeal against the order of lower Court that the Respondent was

allotted with house under EWS category under the Orissa State Housing Board at Basanti

Colony HUDCO scheme and belongs to S.C. category. The Respondent had temporarily

permitted the appellant to occupy the house. The appellant forcibly occupied the house of

Respondent. There is no prior permission U/S 22 of OLR Act has been obtained from the

competent authority for transfer of the property. Hence the order of lower Court is upheld

and appeal is dismissed.

It reveals that the collection on arrear revenue against the demand is only 21.85 % and current revenue is 115.77 % during the year 2016-17. Similarly during the year 2017-18, the arrear revenue collection is 25.75% and current revenue collection is 105.83% against the respective demands.

During the year 2018-19 (up to 30.09.2018), the collection of arrear revenue against demand is only 11.35% and that of current revenue collection is 22.17%.

The collection position in respect of current revenue during the last two year is very good, but the collection position in respect of arrear revenue during last two years is not satisfactory. Similarly during the present financial year 2018-19 (up to 30.09.2018) the arrear revenue collection is 11.35% which is not at all desirable. The above position reveals that the field functionaries are not being bothered about collection of arrear revenue specially Sairat, Misc Revenue, CBWR & FWR and also an collection of current revenue towards Rent, Cess & FWR.

The Collector should make all out efforts and gear up the field functionaries meticulously for collection of Govt. revenue especially collection of arrear revenue and cent percent collection of current revenue against the target fixed by Govt.

It is seen from the above statement that, during the year 2016-17, 729 cases were instituted making a

total 7701 cases for correction of ROR and 7302 cases were corrected leaving a balance of 399 cases for

correction of ROR.

During the year 2017-18, 7458 cases were instituted making a total 7857 cases for correction of ROR

and 7541 cases were corrected leaving a balance of 316 cases for correction of ROR.

During the year 2018-19 (up to 30.09.2018), 2851 cases were instituted making a total 3167 cases for

correction of ROR and 2604 cases were corrected leaving a balance of 563 cases for correction of ROR.

The Tahasildars should be instructed to dispose of the pending cases early for correction of ROR. The

Collector may during his normal tour to Tahasil / RI Offices should verify same cases to ascertain the actual

position of correction of ROR and correction in the corresponding map.

The Collector should impress upon the Tahasildars for disposal of the pending mutation cases at an

early date.

It is seen that, during the year 2016-17 5638 no of cases involving an amount of Rs

46,01,08,335.00 were pending for disposal i.e. Different courts leaving a balance of 5191

Cases covering an amount of Rs. 40,73,09,541.11 . It appears that the cases with heavy

amount are pending with different courts of the district.

During the year 2017-18, 5683 no of Cases involving Rs. 42,69,64,376.95 were pending

for disposal in different courts leaving a balance of 5047 cases covering an amount of Rs.

41,66,43,932.35 and during the year 2018-19( Up to 30.09.2018) 5253 No of cases

involving Rs. 41,86,31,692.49 were pending for disposal in different courts leaving a

balance of 4969 cases covering an amount of Rs. 41,24,17,422.40 were pending for

disposal in different courts.

The Collector is advised to issue necessary instruction to the certificate officers for

disposal of cases as early as possible.

During the year 2016-17 the performance for disposal of encrochment cases in respect of urban area of the district, the tahasil Sundargarh and rourkela are very poor. During the year 2017-18 the performance inrespect of rural area the tahasil Bisra is very poor and during the year 2018-19 (Up to 30.09.2018 ) the performance in respect of Urban area the tahasil Sundargarh and rural area the tahasil Bisra are very poor.

The Collector should be instructed to take steps for early finalization of encrochment cases and keep watch for disposal of pending cases.

It is revealed that 225 no of cases involving area of 20276.495 Acres is pending with the Tahasildars.

It is seen that 75 no of cases involving area of 15940.940 Acres is pending with the Tahasildar Rourkela. The Tahasildars Should be directed to take steps for early disposal of pending cases.

During the year 2016-17, 1113 cases have been disposed of leaving abalance 996 in different Tahasils of the district. During the year 2016-17,2945 cases have been disposed of leaving a balance 728 in different Tahasils and during the year 2018-19 (up to 30.09.2014) 1089 cases have been diposed of leaving a balance 652 cases are pending in different Tahasils. The Collector is advised to take steps for dispoal of more number of cases.

GENERAL

(1) Survey as per Survey & Settlement Act 2012: It is seen that

Hi-Tech survey was notified for 1463 villages of Sundargarh

District. The technical agency has submitted preliminary maps in

respect of 355 villages. Verification has been done by the

Tahasildar as per section 9(4) in 108 villages. Land Parcel maps and

preliminary ROR distributed in 38 villages. Draft ROR and Maps

published in 8 villages. Final ROR and map has been published in

not even a single village. Collector, Sundargarh is instructed to

review the progress, identify the bottlenecks and report them to

Director, Land Records and Surveys by 31st December 2018.

(2) The Collector, Sundargarh has sought for clarification from

govt. in Revenue & D.M. Deptt. for Rent settlement of land

pertaining to Steel Authority Of India Ltd., Rourkela Steel Plant,

Rourkela recorded in bebandobasta status in the Record of Right

vide his Letter No. 2659 dt. 05/09/2018.

It is recommended that an early clarification may be made by

the Government in Revenue & D.M. Department in this regard.

(3) It is ascertained from the Letter No. 991 dt. 20.03.2018 of

Tahasildar Rourkela & No. 454 dt. 28.04.2018 of Settlement

Officer, Sambalpur that in six identified cases, the names of same

tenant appears in bebandobasta status and also in Record of Right.

The Tahasildar, Rourkela may be directed to lodge F.I.R.

against these fraudulent persons (Tenants) in respective Police

stations for appropriate action.
