ObjectiveAct that provide for minimum legal wages for scheduled

employment, maximum daily working hours, weekly rest day and overtime

ScopeIt extends to whole India and applied to all estabishment employing

one and more person

Definations Scheduled Employment: An employment specified on the

schedule

Wages: it means all remunaration in terms of money.

Employee: A person who hired to do any work, skilled or

unskilled, manual or clerical.

Provision

1. Fixation of minimum wages: • Government fixes the minimum rates of wages for

different classes of employees- Skilled, Unskilled, Clerical,

Supervisory etc.

• Govt. should also fixes the peroad of these wages i.e. by

hour, by day, by month or other longer period

• The minimum interwal of revision of rates should not

exceed 5 years

Provision

2. Payment of minimum wagesI. Minimum wages shall be payable in cash

II. The government may

- fix no. of working hours

- provide a day for rest in a week

- provide payment for overtime

III. Wages for two or more classes of work based on time

spend on a particular class

3. ClaimsAn official registerd trade union on behalf of

employee can comclaim to govt. if

- Payment is less than minimum wage rate

- No payment for overtime

- payment of remunerartion for day of rest

4. Penalties

- Imprisonment upto 6 months or fine upto Rs. 500

or both

- this act was passed in 1948

- This act further amenden in

1950, 1951, 1954, 1956 and

lately in 1987

- Provisions under this act:1. Employee health & safety

Provision

Adolscent: 15< age < 18

Factory: A place wherein 10 or more persons are working

Worker: A person, employed directely or through any agency

Occupier of factory: A person who has ultimte control over

the affairs of the factoty

Factory Act Provisions

1. Health Provision

i. Cleanliness: washing, cleaning, painting (repainting once

in 5 year)

ii. Sutable arrangement for Disposal of wastes

iii. Adaquate Ventilation

iv. Keep workrooms free from Dust and fumes

v. Overcrowding:

min. space for a worker should be 4.2 Cu.m

vi. Sufficient and Suitable light in workroom

(Artificial/natutal/both)

vii. Drinking Water point should not located within 6 mtr of

any latrine.

viii. Latrines and urinals

2. Safety Provision

i. Encasing and fencing of machinary

ii. Work on or near machninery in motion:

- specially trainned adult workers should be

prefferred over women & young worker

iii. Hoist and lifts:

- adaquetly maintained and at least once in 6

month should be examined

iv. Safety equipments should be provided (safety goggles,

helmets)

v. Explosives/Inflammables/hazardous gas etc.:

- enclosed in saperate closed room

vi. Fire precautions:

- warning signals, free passageway, doors opening

towards outside the workroom

3. Welfare

i. Facility for sitting

ii. Washing Facility

iii. First aid facility:

- for every 150 workers one fully equipped first aid box

- factory employing more than 500 workers should have

ambulance room

iv. Canteen:

- factory employing more than 250 workers should have

canteen facility

v. Shelters, rest rooms and lunch-rooms:

- factory employing more than 150 workers should have

clean, ventilated, adaquate rest and lunch rooms.

vi. Welfare officer

- factory employing more than 500 workes shall employ

welfare officer

4. Working Hours

i. Weekly hrs: 48 working hrs/week

ii. Weekly holidays: Sunday

iii. Daily hrs: not more than 9hrs/day

iv. Interval for rest:

- after every 5 hrs of work, rest of atlest 30 min.

v. Extra wages for overtime

vi. Restriction on double employment

vii. Restriction on employment of women

- No women shall emplyed in factory except 6 a.m.

to 7 p.m.

5. Annual leaves with wages

A worker who has worked 240 day or more in a calender year is

permitted to take leave with wages in subsequent calender year

with the rate of:

1. One day for every 15 days of work for child worker

2. One day for every 20 days of work for Adult worker

Penalty

- Imprisonment upto 2 years or fine upto Rs.1,00,000 or both

- If voilation continues after conviction then fine of Rs.1000/day

- Voilation of same conviction then imprisonment upto 3 years or

fine upto Rs.10,000 to 3,00,000 or both

Root cause: “The fundamental reason for the

occurrence of a problem”

Root cause analysis: A process, method or procedure

that helps discover and understand the initiating

fundamental reason for the occurrence of a problem

Goal: Reduce the chance of recurrence of incidents to

improve the safety of all employees over time.
