PROCEDURE: Tracts 1 through 16 will be offered “Buyer’s Choice” whereas the high bidder can purchase (in any order) any or all of Tracts 1 through 16 for their high bid (price per acre basis). “Buyer’s Choice” auctioning will continue until all of Tracts 1 through 16 have been purchased.
BUYERS PREMIUM: A 2% buyer premium will be added to the high bid to equal the final contract price for a tract(s).
DOWN PAYMENT: A 10% down payment of the total contract purchase price will be due immediately after being declared the buyer. The down payment may be paid in the form of personal check, business check, or cashier’s check. The balance of the contract purchase price is due at closing. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING.
POSSESSION: Possession will be given at closing, subject to the remaining rights of the current tenant, if any.
ACCEPTANCE OF BID PRICES: All successful bidders will sign an Agreement to Purchase at the auction site immediately following the close of bidding. All final bid prices are subject to approval or rejection by Seller.
CLOSING: Closing shall occur within 30 days or as soon thereafter as applicable closing documents are completed.
TITLE: Seller shall furnish the buyer(s) at Seller’s expense an Owner’s Policy of Title Insurance in the amount of the purchase price, and agrees to provide and execute a proper deed conveying merchantable title to the real estate to the buyer(s).
REAL ESTATE TAXES: Seller shall pay 2014 and all prior year real estate and drainage taxes.
ACREAGE: All tract acreages, dimensions, and proposed boundaries are approximate and have been estimated based on aerial maps.
SURVEY: Where there is no existing legal description to determine acreage amounts and sufficiently convey title, seller shall provide a boundary survey by a licensed land surveyor. Final purchase price will be based upon legally described acres or gross surveyed acres.
MINERAL RIGHTS: The buyer will receive and seller will convey all mineral rights that the seller owns relating to the property.
