• For an individual not eligible for regular, extended benefits.

• Includes: self-employed, independent contractors, gig economy workers, or those with limited work history.

o Does NOT include individuals able to telework with pay or individuals receiving paid sick or other leave.

Pandemic Unemployment Assistance


• Timing: Effective for weeks of unemployment beginning on or after 1/27/20 and ending 12/31/20.

• Duration: 39 weeks of benefits total INCLUDING regular UI and “extended benefits under any Federal or State law” unless additional EB weeks are added later.

• Those eligible under PUA will also be eligible for $600 weekly benefit.

• No waiting week. • 100% federally funded for benefits and admin expenses.

Pandemic Unemployment Assistance


• Anyone eligible to receive regular UI benefits under state law or eligible for PUA will receive an additional $600 in weekly benefits.

• DWD entered into an agreement with USDOL effective 3/29.

• Benefits will be paid retroactively.• For regular UI, DWD started making FPUC payments

• 100% federally funded for benefits and administrative expenses. • Improper Payments o Fraud = ineligible for future FPUC, and prosecution. oOverpayments without fraud need to be repaid except can be waived

if no claimant fault AND “such repayment would be contrary to equity and good conscience.”

o 3 year recovery window. oDue process. States must provide opportunity for hearing for any

deductions or required repayment. • FPUC is disregarded for purposes of Medicaid and the Children’s

Health Insurance Program (CHIP).

Indiana’s Traditional Unemployment System


Benefit AmountsFormula established by state statute to determine an individual’s weekly payment:• Divide total wages earned in the four quarters (12 months)

prior to the last quarter the individual worked by 52. • Multiply the sum by 0.47. o For example, if the individual earned a total of $30,000 in the four

quarters prior to the last quarter worked: $30,000 ÷ 52 = $576.92 x 0.47 = $271 (weekly benefit amount).

• The weekly benefit amount should be rounded down to the next whole dollar amount and will not exceed $390.

• Federal stimulus package adds $600/week to UI amount.

• File a voucher and comply with the terms. Submit your weekly voucher during the week following your initial application and then every week after. File weekly vouchers even if you haven’t received an eligibility determination.

• Best days to file: Tuesday through Saturday.

• The one-week waiting period has been waived for COVID-19.

• You should receive your first payment within three weeks if there are no issues with your initial claim.

If I did not qualify for regular unemployment benefits through the Indiana program, can I qualify for the additional federal money?

The federal PUA program provides relief to individuals who do not normally qualify for regular UI, but would be working if not for COVID-19. This includes the self-employed, most REALTORS®, independent contractors, gig economy workers, and those who have a limited work history.

If I am self-employed, will I get regular unemployment insurance benefits?

Independent contractors and self-employed individuals are not engaged in traditionally-covered employment for the purposes of UI, so regular UI benefits wouldn’t be available. You will be eligible for Pandemic Unemployment Assistance(PUA) under the new federal CARES Act. For now, an individual can file a regular claim for benefits, as it is necessary to file a state claim, even if you know you will be denied, before you can be considered eligible for PUA.

What if I don’t work for a company and am part of the “gig” economy?

Self-employed individuals and gig economy workers – such as licensed brokers, contractors and delivery drivers, whose income has been cut or eliminated by the pandemic – may be eligible under the federal PUA program. For now, an individual can file a regular claim for benefits, as it is necessary to file a state claim, even if you know you will be denied, before you can be considered eligible for PUA. Beginning April 24, the new system will be in place and ready for new applications.

What is the amount of wages I must earn to meet the minimum eligibility for benefits?

If you haven’t earned enough wages, you won’t be eligible. This is determined by how much you earned during your base period. Your base period includes the first four of the last five quarters before the week you file an initial claim. If you file your initial claim between 1/5, and 4/4, your base period will be Q4 2018, Q1 2019, Q2 2019, and Q3 2019. If you file your initial claim between 4/5, and 7/4, your base period will be Q1 2019, Q2 2019, Q3 2019, and Q4 2019.

Is the one week waiting period for unemployment insurance benefits being waived?

Yes. The one-week waiting period for payment of unemployment insurance (UI) was waived by the Governor’s Executive Order. The waiver is retroactive to the week of 3/8. This means that benefits will be paid for the first week you are eligible. In most cases, payments are retroactive to the week of March 29.

If I live in one state but work in another or work in multiple states, which state do I file in?

Generally, you should file your claim with the state where you worked. If you work in more than one state, you should file where your employer filed your wages. If you worked for more than one employer in different states, file where you primarily worked. If you file in the other state, it could take longer to obtain your wages to fully review the claim. If you did not work in Indiana at all, you should not file in Indiana.

I received my federal stimulus payment from the Internal Revenue Service (IRS). Will this impact my unemployment insurance benefits?

No. The federal stimulus payment from the IRS is not considered deductible income for unemployment insurance benefit purposes so it will not impact your weekly benefits.

Could unemployment be offered indefinitely through this crisis?Unemployment benefits are typically available for up to 26 weeks. With the federal CARES Act, unemployment benefits have been extended to up to 39 weeks.Am I still required to search for work or conduct reemployment activities during the pandemic?No, during this emergency, the requirement that claimants actively search for work each week that they receive benefits has been waived. However, claimants still must be “able and available for work.”
