WHEN THE C LOCK STRIKES '12"

NEW YORK - The 12 PM amusements curfew placed into effect by War Mobilization Direc-

tor James F. Byrnes created much comment among coinmen’' this past week#

Originally this was supposed to have been an 8 PM curfew, as reported by The

Cash Box in its Feb, 6 issue. This industry, therefore, has much to be thankful for

that the 8 PM closing hour did not go into effect*

A rapid trip thru some of the Eastern cities right after the announcement,

as well as phone calls to the Midwest and West by The Cash Box, resulted in the

concensus that this midnight curfew would, in general, not effect the take of the

average coinman in too great a degree*

The average tavern locations cater, to a great extent, to naborhood trade*

This being the case, the play drops almost completely after midnight. In war work

centers where some spots have been getting play after midnight there may be a

noticeable drop. But not enough locations will be affected, the general concensus

is, to really hurt the take too greatly on an average.

The general belief seems to be that if this midnight curfew will help to

step up civilian morale to a high pitch then it will be more than worthwhile.Opinions vary as to the saving in electricity, coal, manpower, etc. Most believe

this to be of very little moment.

In the belief that this may be an opening move by the prohibitionists, cafe,

cabaret and tavern associations have wired Byrnes asking that they be allowed to

remain open to their regular hour and instead close for a full day ( in fact for

29 consecutive hours) which would effect a greater savings in fuel and manpower.

Mayor LaGuardia of this city, on returning from a visit to Byrnes (ihurs,Feb.22) asked that the cabaret and tavern men remain calm because New York, beingthe entertainment center of the nation, special conditions would have to prevail.At the same time he suggested waiting until ,%&C director, Paul V. McNutt issued hisreport.

As is well known to the trade some territories already have a midnight curfewon phonos. At first it was believed that-this would tremendously hurt the take.Instead, it seeras, the public came in earlier and got their drinking and entertain-ment in before the curfew hour.

New Jersey coinmen report that some of their communities have had a midnightcurfew for sometime and that the public have become accustomed to it. Caldwell, N.J.has had a 12 FM curfew since the repeal of prohibition in 1933. Coin machines in thiscommunity are doing well. Little Ferry, N.J. has also had a 12 FM curfew and justthis past year voted to remain open later. Midnight closing will have little effecthere •

Coinmen who have Broadway locations in this city report that they expect a deepdrop in their take. This is to be expected. Yet it is believed that the drop willnot too seriously effect their averages. Not many coinnen have too large a number oflocations in the "roaring forties" area exclusively.

Ihe same condition is expected to prevail in other metropolitan centers suchas Chicago, Detroit, Cleveland, etc, California has been closing earlier and there-fore is not expected to feel this curfew too seriously.

In London, England, there is an 11 PM curfew for pubs. What's more, most ofthese do not open until 2 PM. It is we 11 known in the trade that British coinnenwould like to buy as many machines of all types as they could possibly get, regard-less of this curfew.

Possibly one of the best answers in regard to the effect this 12 PM closingwill have on the trade is what The Cash Box heard in Baltimore this past week whilediscussing this closing hour with a group of coinnen. One distrib, after listeningto an operator complain about this closing hour said, "If you feel that this willseriously effect your collections, why not sell me your route,"

NEW COMMISSION BASIS IMPERATIVEOf all the necessities in this coin operated machines industry, in preparation for

the forthcoming post-war era, a new commission basis is absolutely necessary so that

operators will be assured of financial soundness when new equipment is again produced

in volume.

Every operator who was connected with this industry prior to the war, rememberswhat the term ’’machine poor” meant. Only the war saved a great many of the coinmenin this industry from being included i-n this category.

Therefore, prior to running into such a period once more, this industry is being

urged by The Cash Box, just as it has been for a great many, many months, that to in-sure itself sound financial continuance during the post-war period, to change its

present inequitable commission basis to an entirely new set-up in favor of itself.

To begin with, the average location in this industry that is now on a 50%~50%commission basis, does not deserve so high a percentage of the gross intake. The av-erage coinman will admit that his overhead has increased better than 30% during thiswar period. With taxes what they are at present, and sure to continue on the samelevel for many years after the war, and also with the fact that labor, materials andsupplies costs have tremendously increased, it is extremely foolish to continue on a5f%-50% commission basis with the average storekeeper*

The average location, furthermore, never did deserve such a commission basis.This was only brought about by the extreme competition that existed in this industryduring the first flush of the pin game era. It is simply a carry over from the oldslot and pin game conmissions . (As far as slots, consoles, pin games and practicallyall amusement machines are concerned, this sort of commission basis can more or lessendure the rigors of present operating, tho even in the case of this equipment suchcommissions are not considered good business by a great many.)

While money is being spent freely, as it is today, and with the anticipation thatit will continue to be spent freely by the public for a year or so after the war isover, this 50%-50% commission basis will probably endure. But, when conditions re-turn to normal, and with general overhead away beyond what it ever was before, withthe new equipment sure to be much higher priced, then certainly such a commissionbasis should be changed to a more profitable one for the operator.

The Cash Box has constantly recommended that a 70%-3 f% commission basis be arrang-ed for by the men in this industry now, and carried over into the post-war period.This means that the additional 20% which the operator will be obtaining from the aver-age location will go toward the payment of notes that will surely come into being, to-ward the increased overhead that is already here and that will make itself even morefelt after the war if an"' expansion moves are made, and especially to cover the in-creased cost of labor, supplies and parts.

Music operators admit that they are today purchasing over 75% of the records theyneed from general retail outlets and that they are paying top consumers 1 prices forthese records. This alone is a tremendously increased overhead cost - just on theirrecords alone. They must arrange to assimilate all these additional costs or take abad beating in the long run. And such a beating will once again place them in thecategory of being "machine poor”.

It is admitted that there are some unusually good locations where the 5#%-50% com-mission basis can still apply. These average about 1% of the locations in any commun-ity. This means that after this 1% the rest are just average to good locations. Whena quantity of machines are placed the average income sometimes falls to an alarminglyow point. This is due to the fact that so many small producing locations must be in-

It is certainly puzzling to hear from so many outstanding coinmen in the nation

that The Cash Box suggestion of 70% to the operator and 30% to the location is one of

the best ideas ever advanced to this industry* Yet, with the exception of only a few

territories which have already accepted this suggestion, no Others seem to have follow-

ed, even tho they handsomely praise this plan,

Ihe majority also realize that at this time, with the average location owner more

or less dependent on "outside income" because of lack of his own merchandise, this

change to a new commission basis is more easy to place into effect than it will be

when the war finishes. When the new blood enters into the picture it will create keen,

and perhaps even hurtful, competition. Now is the time, not after the war,

This is the time to get a 70% to the operator and 30% to the location commissionbasis under way* Only in that fashion will the average coin machine* man be able to

survive competition, higher taxation and overhead, higher cost of equipment, and yet

remain in a financially liquid and sound condition.

This is the time to call together all others in your territory and ask them to

consider this proposition. They, too, want to save all that they possibly can, Ihey,

too, want to be prepared for this coming post-war period.

Any good accountant can step up to a blackboard and show reluctant men that at

70%-30% they are not demanding too much from the average location. Surely the men in

this industry are out to earn profit. Surely they want to protect their financial in-vestment after the war. Surely they will then admit that this is the commission basisthey should, and actually must, adopt before the war finishes and competition gets un-der way against them.

If ever this industry had the opportunity to institute a new eomnission basis,this is the time. Those men who have vision, and who intend to remain in this busin-ess after the war is over, should make it their greatest effort at the present timeto get a 70^30% commission basis under way in their territory. Not only will thismean their own future and better welfare but it will mean the future better welfare ofall the industry.

THE RECORD MFRS HAVE NOT ANSWEREDThe record manufacturers have not come forward to answer this industry* They havepaid no attention to the fact that the pien in this coin operated music machines indus-try have actually brought their case into the open before them and presented theiroomplaints frankly, honestly and aboveboard.

Not one word from the record manufacturers as to why the average music machinesoperator must purchase over 75% of the records he needs from local retail stores andp8y top consumers 1 prices for these records.

No answer to the fact that some of the coin machines men who are purchasing thoserecords from retail stores are men with whom these same manufacturers have dealt fromnine to eighteen years and during that time sold them at "dealer’s" prices.

No answer to the fact -why the average retailer, who is at this time 30 excitedabout records and has been in business for from only one to five years, and yet i* be-ing tremendously favored above these older and larger volume users. Some of these re-tailers are favored to such an extent that many operators are told to go to them topurchase their records by the distributor, the agent and even the branch offices ofthe record manufacturer.

This was openly brought out in the letters of a great many men in this business.A few of these letters appeared in the February 27th issue of The Cash Box. A greatmany others are on file in The Cash Box offices.

Why hasn’t the record manufacturer come forth and answered the questions abouthis present method of inequitable distribution? Why hasn't he stated just what is inhis mind regarding his future method of sales to this industry?

He knows that the men in this business must purchase the records of Bing Crosbyand certain other stars that he features, whether they like to or not. Knowing this,is he now so inflated with his importance and ego that he feels it nnnece ssary to evenanswer the men of this trade? Or does he think so little of the men in this businessthat he does not believe it necessary to answer them?

A great many in this coin operated music machines industry have proposed that aboycott he placed into effect. Others have recommended that a record company solely

for the members of this industry be created. This latter course seems to be the major-ity opinion* The average music coinman is of the belief that such a record companycan be made successful by the 400,000 jukes now in operation in the nation*

The belief of The Cash Box is that these record manufacturers are chasing a will-’ o-the-wisp in their exaggerated belief in the future home market. They seem to haveforgotten that the real instigator and actual creator of their present home market wasthe juke box.

They seem to have forgotten, too, that the juke box, playing each record for 5/was heard by a great many people in the location and thereby acted as a tremendouspromotional advertisement for them. This started the general publics urge to buyrecords. This helped to create their present market. This actually gave them a newlease on life. But, it is a short-term lease, as they once before learned.

The Cash Box still feels that the higher-ups in the record manufacturing industryknow very little of what is going on in their branch offices, among their distributorsand agents today. Just because these people are constantly demanding larger and larger

quantities of records (and this is because the present record won’t stand up longenough to get slow action) may have lulled them into the belief that these outlets oftheirs are doing the right thing by this trade.

This is the time for all the music machines men in this industry to come forthand openly and strongly protest the present viciously inequitable distribution system*These complaints must go to the top men in each of the "big three" firms to start with.If this doesn’t get the desired results from these firms then this industry will cer-tainly have to choose a new method for itself to better assure itself the records it

needs

FREE DEPOSIT INSURANCEMany months ago The Cash Box advised its subscribers that they could obtain free

deposit insurance from this publication for any deposits which they sent to advertis-ers in this medium for machines or merchandise advertised therein.

This is the one and only publication in all history which is willing to insure de-posits up to $100. for monies sent to its advertisers.

To obtain this free deposit insurance the sender simply first asks The Cash Box

whether it is okay to send the deposit to any certain advertiser. On receipt of a let-ter from The Cash Box that it is okay, the sender can go ahead with the full under-

of news that may be forthcoming regarding any announcements from Washington as to what

may happen should the war in Europe come to a sudden close this Spring*

There is no doubt that should the European conflict suddenly end that WPB and a

great many other governmental agencies will have to suddenly make decisions of greatmoment for the benefit of all industry.

There may be a return to former products production even sooner than many expectat this time. Whatever happens, there is no doubt that the forthcoming Spring Specialissue of The Cash Box will prove a very important one for this trade. It will proba-bly contain the first news flashes of what changes can be expected* It may even give

this trade its first glimpse into its future prospects for post-war. Therefore, it

will be an issue that everyone in this industry can look forward to with keen interest.

And, in such an issue, this is one time the trade can liberally identify itselffor post-war consideration.

under way once again, would be of tremendous benefit

National Forum To Iron Out ProblemsIt is well known that distributors and jobbers believe that a national

forum for the members of their division of the industry should long ago

have heroine an annual event. Some months back leaders urged that

publicity be given to this idea. Such an item appeared in The Cash Boxand the response was unusually good.

to the industry.

COLUMBUS ARCADES HURT BY TAXBILLCOLUMBUS, O.— Arcade owners here are tremendously upset by thelicense bill which has just gone into effect. They will pay SI 75 per yearfor an occupational tax in addition to extra license fees on each andevery machine in the place. But what has upset them most is the 17

years age limit which was written into this new license.

The distributors and jobbers are of the belief that a great many ills,

which beset their division of this trade during the pre-war era, could beironed out prior to the post-war era getting under way. They also believe

that such an annual national forum would benefit all the industry. Theyclaim that as the sales factors in the trade they have much to do withgeneral conditions.

Ops W ant National MeetThe ops, too, believe that a national meet would be of very great

importance to them. They feel that this is the time for operators to better

understand each other’s problems. Only by getting together into a businessmeeting, they claim, especially before the post-war production era gets

under way, will they be able to iron out a great many problems whichhave come into being during this war period.

They also want to have a better understanding of governmental agencyrulings.

They also seek to more solidly establish the thought of just who andwhat an operator is so that sales to storekeepers will halt.

To Help Post-War ManufactureAll believe that a national meet would be of great interest to the

manufacturer. They feel that not only will he have a better understandingof the temperament of the trade, prior to starting production again, butthat he will also be able to gauge his post-war possibilities. This, they feel,

is of very great importance to the average manufacturer for most of themhave tremendously increased their manufacturing facilities.

ODT RulingAs is well known the present ruling of ODT (Office of Defense Trans-

portation) Feburary 1, 1945, was to eliminate any meets of any kind.As ODT suggests to those who decide to call a meeting to ask themselvesfirst, “Will this help win the war?”.

The trade believes that such a statement is of good moment at this

time, but with all the nation looking to the future of industry, especiallyto help assimilate the millions who will return from the armed services,

such should not be the case. ODT, they feel, should announce at theearliest possible moment revision of this ruling when transportation suffi-

ciently eases so that industries can get together to plan for the future.

Announce Sales OutletsAmong distributors, jobbers and operators is also the belief that with

very few sales outlets as yet officially made known by the manufacturers,such a meet might help settle this problem, too. They believe that this

will allow many of the manufacturers to decide on territorial arrangements.This, they claim, is of great importance, especially right after the war

V is over, so that all the industry will know just whom its distributors arefor post-war purchasing.

“Extremely Important”One noted distributor writes, “A national meeting devoted to the best

interests of this industry’s future will not only help the men in this businessbut will help the plans for all business. We can only proceed to hire newpeople and arrange for expansion when we know just what our futureprospects are. A national meeting is extremely important.”

Rritish Will MeetThere are some who are of the belief that such meets will be held in

England even before they are held here. They claim that the British

}government is encouraging all industries there to get together as soon aspossible to arrange for future employment and expansion, and especiallyfor future expenditures for new enterprises so that the national economywill benefit.

This move on the part of the British market can be incorporated into! \ such a move in this industry. The general belief in the trade is that much

of the present used equipment now operating will be sold off to Englandand other European and South American countries. Many also believethat a great deal more machines will go into Canada once prices begin tocome down to normal levels. This same price situation holds true for theEuropean and other markets.

* What are your ideas in regards to a national

meeting of this industry prior to the start of

post-war production?

This “under 17 years” stipulation

would not only work a great hard-

ship on the arcade owners here to

police their arcades but clashes

with the tempo of the license bill.

The bill claims that only personsof “high moral character” will re-

ceive licenses. Therefore, it shouldbe accepted that men of “highmoral character” would not in anyfashion lower the morals of the

youthful players who patronize

their spots.

Columbus arcade men claim that

after meetings with the City Coun-cil on the writing of this first

licensing bill here they found the

completed bill to be anything butwhat they believed would be forth-

coming. This, too, has upset them.

There are also some clauses in

this new license that endanger the

entire operation of an arcade as

well as general route operating.

These should be removed from this

bill.

Columbus coinmen are already at

work and have hired attorneys to

bring this matter to court for ad-

justments.

BOSTON MUSIC OPS ENCOUR-AGED BY NEW CAPITOL MGR.

BOSTON, MASS.—Phono ops hereare encouraged by the statement of

policy issued by the new managerat Capitol Records. Capitol lias

just opened a branch offiec in the

heart of Coinrow in this city.

Bill Hill, formerly of the Eastern

Co., local distribs for RCA-Victor,is the new manager. He stated his

policy as, “Our policy will be to

cater to operators as well as retail

stores, both alike.”

GLEN ELLYN, ILL.—E. G. Batesof Bates Laboratories, this city,

writes, “It will be of interest to

you to know that hardly a weekgoes by without bringing me 1 or 2

and sometimes 3 and 4 new cus-

tomers who acknowledge that they

GLOYERSVILLE, N. Y.—Fred R.

Beman of Benian Sales & Service,

this city, writes, “Just a line to let

you know that we sold everymachine in our February 20th ad.

I guess The Cash Box is the sure

fire way to sell equipment. And I

am sure that this will be the coin

machine guide for all of us in the

post-war period as well as right

now.”

MONTGOMERY, ALA. — DaveFranco, Franco Novelty Co., this

city, write, “I do not find adequatewords in which to express the goodwork that is being accomplished byyour editorials. I don’t see howthe industry got along without TheCash Box. I believe everyone in

the industry should make the

manufacturers conscious of the

good work that is being carried on

by The Cash Box.”

ARKANSAS WANTS PRIVI-LEGE TAX PLUS 33'/3% OF

THE GROSS TAKE

LITTLE ROCK, ARK.— Probablythe most confiscatory license bill

ever yet introduced in any state

senate is Senate Bill No. 192, intro-

duced by Senator Byrd of this state

at the General Assembly.

Section 6 of this proposed bill

reads, “There is hereby imposedupon the owners, operators, lessors

and upon their agents and re-

ceivers, a privilege tax for the

operation of coin operated ma-chines and vending machines, in-

cluding automatic music vendingand automatic phonogragh ma-chines, which tax shall be paidannually, etc.”

There is then a list containingscales, gum venders, stamp venders,

cigarette venders and peanutvenders. With the exception of the

cigarette machines which must payS2.50 per year “privilege” tax, the

rest pay only SI each.

But, immediately following this,

“On all amusement and entertain-

ment devices, and phonograph or

other music producing devices, as

defined herein, the license tax shall

be one-third O/s) of the gross

‘take’ or receipts of said devices.”

In this past week’s issue of TheCash Box the trade was informedthat a National Tax Council wasimperative. If this proposed license

bill by the State of Arkansas isn’t

good enough reason, there neverwill be reason for such a council.

NAVY THANKS MILLS SALES

OAKLAND, CAL.— A letter from

A. G. Caslett, RM-l/C, somewhere

from the Southwest Pacific, re-

ceived at the offices of Mills Sales

Company, Ltd., this city, made the

firm feel that all their donations to

the armed services of games and

phonos were more than worthwhile.

The letter reads, “We want to ex-

press our sincere thanks and appre-

ciation for the juke box. It is

thoroly enjoyed by all hands and

we are having a pleasant evening

with it. We couldn’t wait to get to

our destination and are playing it

right now aboard .-hip. The Chap-

lain furnishes the records. All we

need now are a few drinks and a

nice dance floor.”

Coinmen who visited New York City this past week, combining business and

pleasure were J. R. "PETE" PIETERS and his wife. King Pin Games Co., Kalamazoo,

Mich.; TOM SMALLWOOD, Collette & Smallwood, Idaho Falls, la. who finished up a six

weeks trip thru the entire south; and AL SEBRING, Bell Products Co., Chicago, 111.

ED HARTMAN and JOE HENCKLE, Allied Electronics Co., New York City introduces

a new instrument, called a Diode Meter, of special interest to Seeburg music

operators. It is used to line up Seeburg Wall Boxes, Bar Boxes, sdection receivers,

speak organs and wireless sound transmitters. This meter is the first of a series

of test instruments to be developed for the music operators.

BILL BYE, Emby Distributing Co., Philadelphia, Pa. comes along with the

following story. A colored location called up late in the evening and asked that

someone be sent down to fix "the piccolo". Bye answered, "This is Lent, We can't

fix piccolos during Lent". The location owner insisted "Lent or no Lent, mistah

Bah, this joint's gotta keep jumpin'".

FOREWORDMany times, wide differences appear in the high and low prices of certain equipment. Like any true reporter TheConfidential Price Lists can only feature the market prices as they are quoted. The Confidential Price Lists act exactly

the same as the market quotation board at the Stock Exchange—posting the prices exactly as they are quoted for

the past week, regardless of how much they may seem to be out of line. Some machine prices do not changefor months. The Confidential Price Lists, rather than show no price, retain the last known quotations for suchequipment so that the subscriber at least has the last known quoted prices as a basis to work with. Prices

continue to be very widely divergent these days. Someone on the West Coast may feel a certain machine worth$150.00 whereas someone on the East Coast may think it worth but $75.00. Of course, condition, serial, appearance,demand, territory, quantity, etc., must all be taken into consideration. The Confidential Price Lists report eachquotation exactly as it is made and depend on the subscriber to make average price adjustment to fit the peculiarities

of his own territory.

listed is highest price for the past week. Where only one price appears this should be considered lowest price.
