    (a)theforeignnational,unlessinadmissibleunderthisAct,shallbegrantedpermanentresidentstatusiftheforeignnationalmeetstheprovincesselectioncriteria

    (b)theforeignnationalshallnotbegrantedpermanentresidentstatusiftheforeignnationaldoesnotmeettheprovincesselectioncriteria

    (c)theforeignnationalshallnotbegrantedpermanentresidentstatuscontrarytotheprovisionsofthelawoftheprovincegoverningthenumberofforeignnationalswhomaysettleintheprovinceaspermanentresidents,whetherthatnumberisanestimateoramaximum,orgoverningthedistributionofthatnumberamongclassesofforeignnationalsand

    10.(1)TheMinistermayconsultwiththegovernmentsoftheprovincesonimmigrationandrefugeeprotectionpoliciesandprograms,inordertofacilitatecooperationandtotakeintoconsiderationtheeffectsthattheimplementationofthisActmayhaveontheprovinces.

    (b)theyareunlikelytoappearforexamination,anadmissibilityhearing,removalfromCanada,orataproceedingthatcouldleadtothemakingofaremovalorderbytheMinisterundersubsection44(2)

    (c)theMinisteristakingnecessarystepstoinquireintoareasonablesuspicionthattheyareinadmissibleongroundsofsecurity,violatinghumanorinternationalrights,seriouscriminality,criminalityororganizedcriminality

    (d)theMinisterisoftheopinionthattheidentityoftheforeignnationalotherthanadesignatedforeignnationalwhowas16yearsofageorolderonthedayofthearrivalthatisthesubjectofthedesignationinquestionhasnotbeen,butmaybe,establishedandtheyhavenotreasonablycooperatedwiththeMinisterbyprovidingrelevantinformationforthepurposeofestablishingtheiridentityortheMinisterismakingreasonableeffortstoestablishtheiridentityor

    (e)theMinisterisoftheopinionthattheidentityoftheforeignnationalwhoisadesignatedforeignnationalandwhowas16yearsofageorolderonthedayofthearrivalthatisthesubjectofthedesignationinquestionhasnotbeenestablished.

    (2)TheMinistermay,ontheMinistersowninitiative,orderthereleaseofadesignatedforeignnationalwhowas16yearsofageorolderonthedayofthearrivalthatisthesubjectofthedesignationinquestionif,intheMinistersopinion,thereasonsforthedetentionnolongerexist.

    59.IfawarrantforarrestanddetentionunderthisActisissuedwithrespecttoapermanentresidentoraforeignnationalwhoisdetainedunderanotherActofParliamentinaninstitution,thepersoninchargeoftheinstitutionshalldelivertheinmatetoanofficerattheendoftheinmatesperiodofdetentionintheinstitution.

    60.ForthepurposesofthisDivision,itisaffirmedasaprinciplethataminorchildshallbedetainedonlyasameasureoflastresort,takingintoaccounttheotherapplicablegroundsandcriteriaincludingthebestinterestsofthechild.
