Newsletter President’s Message The Idaho Funeral Service Association Annual Convention held in McCall, Idaho, June 29 to July 1, 2008, was a smashing success for sev- eral reasons. To be back at Whitetail (Shore Lodge) was very exciting because of the memories that it brought back to those of us that were there. The convention was extremely successful because of the hard work that Myrna and Steve Gordon gave for this event. We had some great presenters – Bill Hoy, Donna Anderson and Shaun Myers. Bill addressed how we care for ourselves while caring for others, Donna spoke on health and safety aspects for owners and em- ployees, and Shaun gave us a great picture of NFDA and how they can be of assistance to each funeral home through special programs, adver- tising, GPL assistance, legal support, and many innovative ways to grow our profession. It was wonderful to be treated like royalty at Whitetail. The staff, coor- dinators (and even the doormen) took care of our every need. The food prepared was excellent (I might mention the blackberry cobbler with ice cream was unbelievable!) Myrna had attended to details that made you remember the good ole days. Bingo for the adults and kids was great and the ladies had a very nice luncheon. Also, a special thanks to Perri Anne and Ken for all their behind the scenes work to make our convention such a success. Did I mention golf at a world-class golf resort? We had great spon- sors and suppliers in attendance at our convention and we so appreci- ated their support. We want to encourage even more involvement of our generous suppliers with us at future conventions. There was only ONE thing that would have made it better. We needed MORE members and employees represented at the convention! President’s Message The Idaho Funeral Service Association Annual Convention held in McCall, Idaho, June 29 to July 1, 2008, was a smashing success for sev-eral reasons. To be back at Whitetail (Shore Lodge) was very exciting because of the memories that it brought back to those of us that were there. The convention was extremely successful because of the hard work that Myrna and Steve Gordon gave for this event.

We had some great presenters – Bill Hoy, Donna Anderson and Shaun Myers. Bill addressed how we care for ourselves while caring for others, Donna spoke on health and safety aspects for owners and em-ployees, and Shaun gave us a great picture of NFDA and how they can be of assistance to each funeral home through special programs, adver-tising, GPL assistance, legal support, and many innovative ways to grow our profession.

It was wonderful to be treated like royalty at Whitetail. The staff, coor-dinators (and even the doormen) took care of our every need. The food prepared was excellent (I might mention the blackberry cobbler with ice cream was unbelievable!)

NEW BOARD OF TRUSTEES MEMBER

At the recent annual meeting of the IFSA Board of Trus-tees, the Board voted to recommend to the membership that a new position be created on the Board: to be desig-nated as the Trustee at Large Position. This person would be appointed by the Board to serve a three year term, and would be appointed based upon expressed interest in serv-ing the Association and without regard to location throughout the State.

Currently, the Board is made up both officers (President, First Vice-President, Second Vice-President, Past President), and 5 Trustees representing the 5 geographical districts of the Association.

The Board believes this new position will allow inter-ested members to serve on the board regardless of where their funeral home is located, and that it will increase inter-est and participation in the Association’s management.

This new position will require an amendment to current by-laws. A ballot was emailed to each member firm, setting forth the proposed by- law amendments and asking for a reply vote from each firm. As of the date of publication ISFA received 100% affirmative on all returned votes (approx. 30 % of membership).

CONTINUING PROFESSIONAL EDUCATION

At the annual meeting of the Board of Trustees, the Board unanimously voted to approve and sponsor a con-tinuing education requirement for morticians and funeral directors licensed in the State of Idaho. Morticians and Fu-neral Directors are among the only professionals licensed in the State who do not have a continuing education require-ment as a condition of licensure. The Board believes such a continuing education requirement is long overdue and will be a benefit to licensees and the public at large.

The proposal is to amend Idaho Law to give to the State Board of Morticians the power and duty to adopt the con-tinuing education requirement by Rule. This is a formal process which allows input from all interested parties and then must be approved by the Idaho Legislature. Discus-sions with the Board of Morticians indicate that the Board will welcome the law change and will work with the Asso-ciation and Idaho funeral directors to come up with a meaningful and workable continuing education program. Credits will be available both from national, state and dis-trict meetings and from a variety of educational sources, including in house programs and self study. The program will assist funeral directors in keeping current with all the many laws affecting funeral service and will assist funeral homes and staff to operate as safely as possible for the benefit of the public and the funeral home.

The NFDA Policy Board met in early August in San Francisco in conjunction with the NFDA Leadership Conference. In discussion was a resolution by the Florida Funeral Directors Association not to allow a second association from the same state to be recognized by NFDA and thus having voting rights. The Inde-pendent Funeral Directors of Florida are wanting NFDA to formally recognize them so they can be part of NFDA’s governance. The policy board voted with the Florida Funeral Directors Association to recommend to the House of Dele-

gate that they do not allow secondary associations have any governance in NFDA.

The policy board asked the executive board to move forward on the establishment of associ-ate memberships in NFDA. These memberships would be non-voting.

Two new members to the executive committee were elected, Robby Bates from Texas and Mike Krill from Ohio; they will replace Randy Earl from Illinois and Shaun Meyers from Utah.

Thank you, thank you, thank you to everyone who attended the 2008 IFSA convention in McCall. Without you it wouldn't have been a success. I can't express

enough thanks to each supplier that attended and gave sponsorships towards the convention costs. You were very generous and I am grateful for your contributions.

Thanks to Mark and Melissa Stehn, OFDA, and Jewell Steffensen, WFDA for attending, participating, and being great supporters. Our speakers, Bill Hoy and

Donna Anderson, were wonderful and I want to thank them for sharing with us. We were pleased to have Shaun and Christina Myers and their family join us as represen-tatives of NFDA. To each funeral home that attended, thanks for making the effort to get away. I hope that you were able to relax, learn and connect with others. To the funeral homes that did not attend, we missed you and I hope that you will seriously

consider joining us next year.

I am thankful for the year that I spent as the President of IFSA. I learned many things and did things I never thought I could, but together we made it. Thanks to all

House Passes NFDA’s QFT Bill On July 29, 2008, the House unanimously passed NFDA’s qualified funeral trust (QFT) bill. QFT was included in a veterans’ benefit bill called The Hubbard Act (H.R. 6580, also know as the Saving Private Ryan bill), which gives military benefits to active members of the military de-clared as sole survivors of their families and honorably dis-charged. The bill now goes to the Senate, where it has been hotlined by Senator Feinstein, D-Calif., and Sen. Saxby Chambliss, R-Ga., to go directly to the Senate floor. The Sen-ate vote should occur by the end of the week. Once passed, it will go to the president for his signature. Passage of this bill into law will help you, state associa-tions with master trusts and the families you serve. QFT eliminates the dollar limit on qualified funeral trusts. Cur-rently, if a preneed trust is valued at less than $9,000, a fu-neral director trustee can pay the tax on the trust’s income directly to the IRS. Taxes on trusts valued at more than $9,000 must be paid by the trust holder. Eliminating the QFT dollar limit will simplify the tax-reporting burden for consumers, especially senior citizens, and eliminate the costs you incur when sending 1099 or K-1 form to trust holders. By some estimates, the administra-tive costs for processing and mailing a single 1099 or K-1 form is approximately $7.50. Successful passage of the QFT bill could save you hundreds or thousands of dollars annu-ally. NFDA’s full-time advocacy staff in Washington, D.C., has worked diligently on this issue for more than five years and, while the battle won’t be over until QFT is signed into law, we are closer than ever before! Rep. Ron Kind, D-Wis., has championed this bill and his tenacity, along with that of NFDA-member Rep. Charlie Wilson, D-Ohio, brought us to this point in our nation’s capital. Most important, however, has been the effort of every NFDA member who lobbied their congressional represen-tatives over the years, urging them to pass this important piece of legislation. Thank you for your grassroots advocacy on behalf of your business and the families you serve. To-gether, we can make a difference!

CDC Elevates Funeral Personnel Vaccination Priority In its most recent guidelines for pandemic flu vaccina-tion priorities, the Centers for Disease Control and Preven-tion (CDC) placed “mortuary service personnel” in a sepa-rate category and elevated them to the Tier II level (there are six tiers, and the most critical workers and response per-sonnel are in the first three tiers). This is a major victory for those working in funeral ser-vice; they were initially classified in Tier III with “other im-portant health care workers.” NFDA worked diligently to educate CDC officials on what funeral service professionals do and why they would be at a greater risk for infection than other professions, due to the nature of their work. CDC agreed with NFDA’s position and reclassified funeral service personnel on the pandemic flu vaccination priority list. Funeral directors should note that vaccines for a pan-demic flu are developed when a strain is identified, be-comes active and begins infecting people. Only then will the vaccine become available and administered according to the CDC priority list. Follow-up: Do I Need A License? The June 6 issue of the NFDA Bulletin informed readers about Church Copyright Licensing International (CCLI), which sells licenses to churches, religious schools, funeral homes and other ministries that regularly reprint song lyrics in programs used during services. A reader subsequently emailed with a follow-up ques-tion concerning how their firm occasionally encounters families that bring a stack of copied music to distribute to those attending the funeral. The NFDA-member firm wanted to know if it is in violation of the law by permitting a family to distribute such music, and if they can assist in passing out such copied music. According to NFDA General Counsel Scott Gilligan, if you or your staff distributes programs created by a family that contain copyrighted music lyrics, you have committed a technical violation of copyright laws. While your chances of being sued are probably minimal, you can avoid liability if the funeral home's staff does not take part in the distribu-tion of the programs. The family may place the programs at the entrance of the chapel for attendees to pick up or the family may distribute the programs themselves. Gilligan says the alternative is to purchase an annual license to re-print the musical lyrics in programs from an organization such as CCLI. However, before you do, you should check their library to ensure it has songs frequently requested by your families. If you have any questions about copyright licensing, please contact your attorney. Spotlight Spotlight Spotlight Minimum Wage Increases Legislation passed by Congress last year mandated three incremental increases to the federal minimum wage. The current minimum wage is $5.85 per hour. Ef-fective July 24, 2008, the federal minimum wage will be $6.55 per hour. On the same date in 2009, the federal minimum wage will increase to $7.25 per hour. This increase in the federal minimum wage will affect businesses that compensate workers at or near the cur-rent minimum wage and could impact the internal equity of pay structures offered by some organizations. Prior to making any across-the-board adjustments to you current pay scale, contact SESCO Management Consultants, NFDA’s endorsed human resources consultants, at 800-764-4127 for advice. Please note that your state’s minimum wage might vary from the federal minimum wage. Some states tie their minimum wage to the federal standard, while others mandate a minimum wage higher than the federal hourly rate. Identity Thieves Target Recently Deceased Reports of an identity-theft scam related to death cer-tificates have surfaced in Indiana. Scam artists are scan-ning obituaries and contacting the families of the de-ceased. Posing as employees of the state department of health, the scam artists request detailed information, such as the deceased's birth date, home address and Social Se-curity number, in order to complete a death certificate. While this scam appears localized to Indiana, schemes like this surface nationally time and again. Because of that, NFDA was contacted by an AARP reporter to help frame a national article which outlines how a death certificate is filed, and identifies the funeral director as the person who typically performs the administrative procedures as a ser-vice to families. Be on the alert for similar scams in your community. Remind the families you serve that they shouldn't give out sensitive information over the phone. If they are con-tacted in such a manner, they should gather as much in-formation about the caller as they can, and contact the state attorney general's office.

Feds Drafting Mass-Fatality Management Plan In a recent meeting with officials from FEMA, Depart-ment of Homeland Security (DHS) and the Department of Health and Human Services (HHS), NFDA was informed that FEMA has begun drafting a mass-fatality manage-ment plan. The plan will coordinate a federal response to mass disaster, delineate the duties and responsibilities of offi-cials on the ground and incorporate all governmental and private-sector resources. The plan calls for a senior federal official to coordinate the mass-fatality response from a central command center in Washington, D.C. It also will provide guidance to state and local officials, medical ex-aminers/coroners and funeral homes so they may inte-grate their resources with the federal efforts. NFDA Advocacy staff is pleased to see that their persis-tence in urging the federal government to create a mass-fatality management plan is beginning to pay off. NFDA will continue to serve as a resource to FEMA as they de-lineate the role of funeral service in the federal response to a mass-fatality event. IRS Sets New Mileage Reimbursement Rate In light of rising gas prices, the Internal Revenue Ser-vice announced in June, an increase in the standard mile-age reimbursement rate for the final six months of 2008. Beginning July 1, the rate will increase to 58.5 cents a mile for all business miles driven, effective until December 31, 2008. This is an eight-cent increase over the rate for the first six months of 2008.

NFDA Key Federal Issues Update July 2008

Following is a status report on the issues involving funeral service. It is critical that all NFDA members go to the members side of the NFDA website under professional resources, Advocacy and Compliance and click on Con-gress-at-a-click and send your Representative and Senators a predrafted e-mail on the Qualified Funeral Trust bills and the SSI Codification bills. 1. LEGISLATIVE ISSUES Estate Tax (no bill yet). NFDA and 150 other associations continue to strongly advocate for permanent relief from the federal estate tax. FDA will continue to actively advocate for permanent estate tax relief for funeral homes but this is clearly a next year issue. Small Business Health Plans (S. 2795/H.R. 6210). To date several bills have been introduced or will be intro-duced that would benefit funeral homes including a bill that NFDA is assisting the Chairman of the House Small Business Committee in drafting. NFDA does not expect action to provide any health care relief for small business in 2008 unless some significant problem arises to force them to move. Codification of SSI Irrevocable Funeral/Burial Trust Exemption. (S. 989/H.R. 1629). At the request of NFDA, Senator Blanche Lincoln (D-AR) and Representatives Pomeroy (D-ND) and Wilson (D-OH) have again intro-duced bills to codify the current regulatory exclusion specifying that irrevocable funeral and burial trust funds are not assets for purposes of determining eligibility for the supplemental security income (SSI) and Medicaid programs. Passage of these bills continues to be a high NFDA priority for 2008. Eliminate the Dollar Limitation on Qualified Funeral Trusts (H.R. 1264/S.1743). At the request of NFDA, Repre-sentatives Kind (D-WI), Wilson (D-OH), Matheson (D-UT), Camp (R-MI) and Tiberi (R-OH) have introduced H.R. 1264, a bill to eliminate the current dollar limitation on qualified funeral trusts under Section 685 of the Internal Revenue Code. This bill will reduce administrative costs for funeral homes and assist those consumers who want to preplan and prepay their funeral expenses. They also will benefit state master trusts. Congressional Resolution Declaring March 11, 2008 as National Funeral Director and Mortician Recognition Day (S. Res. 390/H. Res. 892). Both the House and Senate passed this Resolution honoring funeral directors and morticians! At least we had one victory! Energy/Fuel Prices. NFDA has been invited to participate in a coalition of small business associations which will advocate with Congress and the White House the importance of developing reasonable energy policies to alle-viate the upward pressure on costs associated with operating and managing a small business caused by esca-lating fuel and energy prices. 2. REGULATORY ISSUES Mass Fatality Management. Prompted by the threat of a pandemic flu epidemic, NFDA continues to work the federal government regarding disaster management to ensure that the role and responsibilities of funeral homes, cemeteries and crematories and all funeral service personnel, are included in the National Response Framework or any mass fatality and family assistance plans that may be adopted. This includes: a. A Mass Fatality Management Component MUST be developed and made part of the National Response framework (NRF) and any federal Agency Response Plan or Policy. Such a Plan should include: i. Policies and procedures dealing with the dignified recovery, storage, identification and processing of re-mains as well as the timely issuance of death certificates and the orderly conduct of the funeral and final dispo-sition. ii. The establishment of a SINGLE Agency and Agency official responsible for implementing and managing the mass fatality component of any disaster response plan. b. Establishment of a national missing person's database and locater for displaced family members which would include a universal identification code for victims. c. Funeral homes, cemeteries, crematories and morgues and their suppliers should be included as a priority for logistical and workforce support and protection, including vaccinations and personal protective equipment, during emergency situations that may involve quarantines, restrictions on transportation, travel and public gatherings as well as the actual conduct of the funeral and final disposition.

d. Temporary suspension of certain federal, state & local laws, rules and regulations governing the conduct or practice of funeral directing, cemetery or crematory operations and which may otherwise hinder the proper conduct of fatality services in an emergency situation. These would include but not be limited to the FTC Funeral Rule, various workplace, wage and hour and environmental policies. e. Emergency licensing reciprocity for Medical Examiners, Coroners, funeral directors, cremationists, and other licensed fatality service personnel to allow them to support the needs of fatality services in other jurisdic-tions. f. Limited legal liability protection for funeral homes, cemeteries, and crematories to fully comply with a pre-need contract or failure to adequately comply with the federal, state and local laws, rules and regulations mentioned in item 4 above. Progress is slow on the importance of these issues. NFDA has been successful in its efforts to put funeral service personnel in one of the top Tiers set forth by CDC for priority vaccinations against the avian flu during a sever national pandemic. NFDA was initially able to have funeral service personnel classified in Tier 3 (out of 5 Tiers) along with other "essential health care workers". Recently, NFDA advocated that funeral service per-sonnel should be at least in Tier 2, the second highest level due to their increased risk of exposure. CDC has indicated that it would reconsider their original placement and could move funeral service personnel into Tier 2. Formaldehyde. This will be a critical year for funeral service as the Government's National Cancer Institute (NCI) is conducting a study on formaldehyde exposure by funeral directors/embalmers and increased risk of cancer; the European Union is proposing a total ban on the use of formaldehyde even in embalming; the US EPA is conducting a risk assessment on formaldehyde exposure and many state regulators are analyzing for-maldehyde and risk to workers who are exposed to it. The consequences of all these efforts could have signifi-cant ramifications for funeral directors and could lead to bans on formaldehyde use/exposure or significant reductions in exposure to include expensive prep room air filtration systems. Moreover, it could lead to dra-matic changes in embalming procedures including using non-formaldehyde embalming chemicals.

Consumers Speak: Landmark Survey Unveils Attitudes about Funeral Service WALL, N.J. - Kates-Boylston Publications, the publisher of American Funeral Director and American Cemetery maga-zines, recently conducted a survey of almost 400 people to discover their attitudes about the funeral industry. All re-spondents were 50 years old and older, residents of the United States and spread equally throughout the country. The survey shows that while some think the funeral in-dustry is too profit driven, most people have a favorable opinion of funeral directors. Among the survey's findings:

• 51% described funeral directors as "helpful." • 36% described them as "caring." • 34% described them as "consoling" • 25% described them as "honest." • 19% described them as "flexible."

Other results that were generally favorable to funeral directors included the following responses:

• 39% said their last funeral experience was "comforting." • 26% described their last funeral experience as "personalized."

However, there were some negative opinions people had of funeral directors. Among the results:

• 36% of respondents said the industry was "too profit-driven." • 23% said funeral directors "prey on the bereaved." • 8% said funeral directors could "do more to help the bereaved."

Most people, however, fail to realize that profits in the funeral industry has been steadily declining for the past 25 years. While the average selling price of a regular adult funeral went from up, the profit to average sale for funeral directors actually went down from 11.25% to 6.12%. A 6% profit margin doesn't really support the idea that funeral directors are trying to take advantage of the public. Kates-Boylston Publications publishes American Funeral Director and American Cemetery magazines as well as Fu-neral Service Insider and the American Blue Book of Fu-neral Service.

Funeral Service Foundation Scholarships and New “Women in Funeral Service” Fund Brookfield, Wis.—The Funeral Service Foundation (FSF) awarded five scholarships to select attendees of the 2008 NFDA Professional Women’s Conference in April. At the conference, FSF also announced its new Women in Funeral Service Fund, dedicated exclusively to supporting the ad-vancement of female funeral service professionals. Recipi-ents were recognized by FSF Executive Director Melinda Mueller at an awards luncheon on April 12. Bios of scholar-ship winners are posted on FSF’s Web site, www.funeralservicefoundation.org. In addition to awarding scholarships, the Funeral Service Foundation announced a new fund, the Women in Funeral Service Fund. The new fund will support scholarships, grants, programs and research to advance females in fu-neral service. Applications for scholarships to attend the 2009 NFDA Professional Women’s Conference in Austin, Texas will be available from FSF in January, 2009.
