Vlhereas i t is expedient to provide for the taking of a census in these Islands from time to time as circumstances may require;

Be i t , therefore, enacted by the Governor, Legislative Council and Assembly of the Bermudas or Somers Islands as follows:

1. In this Act-

"census order" has the meaning assigned to i t in section 3; "the census", in relation to a census order, means the census to which the census order relates;

"census employee" has the meaning assigned to I t In section 4; "census officer" has the meaning assigned to i t In section 5; "compilation", in relation to a census, means the making of a report or reports on the census including the arrangement and tabulation of particulars and statistics relating to the census, the making of abstracts from the census and similar work relating to the census, as may be required by virtue of the provisions of section 11;

"the Member" means the Member of Executive Council for the time being responsible for registration matters and related matters; "premises" Includes any house or part of a house, any land and any vessel; and "prescribed" means prescribed by regulations made under this Act.

2. In the exercise of his functions under this Act the Governor shall act on the advice of the Member,

3. (1) The Governor may by order published in the Gazette direct that a census be taken in these Islands, or in any such part thereof as may be specified In the order, at such time or times as may be specified In the order.

(2) Any such order as aforesaid is hereafter in this Act referred to as a "census orcter".

(3) A census order-

(a) shall be published at least two months before the time or times at which the census is to be taken; (b) may by order published in the Gazette be revoked by the Governor but without prejudice to the publication

of another census order; (c) may by order published in the Gazette be varied by the Governor, so, however, that a census order shall not be

varied so that the time or times at which the census is to be t^en Is earlier than two months after the date of the publication"of the census order.

A. (1) Oh the publication of a census order there shall be appointed a public officer to be Superintendent of Census who shall have the general control and management of the taking and compilation of the census.

(2) There may be appointed such nurber of other public officers (hereinafter in this Act referred to as "census employees") to assist the Superintendent of Census in the taking and compilation of the census, as may from time to time be authorised by the Legislature.

5. In this Act, and In any regulations made thereunder, the expression "census officer", in relation to any census the taking of *i#iich has been ordered in pursuance of the provisions of this Act, means-

(a) the Superintendent of Census; and (b) any public officer duly appointed to be a census employee.

6. (1) Where a census order has been published, the Member, subject to the provisions of this section, may make regulations-

Ca) prescribing the particulars as to which information Is to be obtained In connection with the taking of the census;

(b) prescribing the persons from whom information is to be obtained in connection with the taking of the census; (c) prescribing the method in which information is to be obtained in connection with the taking of the census; (d) prescribing forms of schedules to be filled in with Information which is to be obtained in connection with the

taking of the census, and other forms to be used for the purposes of the census; (e) prescribing the duties of persons In relation to the giving of information for the purposes of the census; (f) prescribing the powers of census officers; (g) prescribing declarations to be made by census employees in relation to the performance of their duties; (h) generally, for ensuring that the taking and compilation of the census is conducted and completed In an effectual,

accurate and expeditious manner;

and such regulations may provide for obtaining different particulars, and for the use of different methods of obtaining Information, in respect of different persons or classes of persons or in respect of different places of abotte or in respect of different clrcintstances.

(2) No regulations shall be made under the provisions of this section unless a draft of the regulations has been laid before both Houses of the Legislature and a resolution approving the draft has been passed by each House of the Legislature and communicated to the Govemor by message.

(3) Regulations made under the provisions of this section may be varied, amended or revoked by subsequent regulations made in like manner and subject to the like conditions as the original regulations. •

(4) Regulations made under the provisions of this section shall be published in Wie Gazette and shall come Into operation on the date of such publication or on such later date may be provided In ttie regulations.

7. Where a census order has been published, the occupier or person in (diarge of any premises-

(a) shall allow any census officer such access to the premises as is reasonably necessary for the discharge of his duties in connection with the taking of the census; and

(b) shall allow any census officer to mark or affix on the premises such letters, marks or numbers as the Superintendent of Census may deem necessary for the purposes of the census.

8. Any person v^o, in connection with any census the taking of which has been ordered in pursuance of the provisions of this Act-

(a) refuses to give information as prescribed; or (b) gives infonnation which he knows to be false or does not believe to be true; or (c) refuses, in contravention of the provisions of section 7 -

(i) to allow any census officer to have access to premises; or ( l i ) to allow any census officer to mark or affix on premises, any letters, marks or numbers; or

(d) wilfully restricts, obstructs or hampers any census officer acting In the discharge of his duties as such; or (e) removes, obliterates, injures or alters any letter,'mark or number which has been lawfully marked or affixed on

any premises or place for the purposes of the census; or (f) refuses or neglects to comply with the provisions of any regulation made Lffider this Act,

shall be guilty of an offence against this Act, and shall for each such offence be liable on conviction before a court of surrmary jurisdiction to a fine not exceeding one hundred and twenty dollars.

9. Any census employee who, in connection with any census ordered to be taken in pursuance of the provisions of this Act -

(a) without reasonable excuse, the proof of which shall be upon him, refuses or neglects or fails to comply with any instructions given to him by the Superintendent of Census or any Assistant Superintendent of Census; or

(b) wilfully asks of any person any offensive or Improper question; or (c) knowingly makes any false return; or

(d) without due author i ty destroys, does away w i th , secretes, defaces, in jures or a l te rs any re tums or other docunent re la t ing to the census; or

12. (1) For the avoidance of doubt i t is hereby declared that the Secretary to Executive Council may d i rec t the Siper in-tendent of Census or any other census o f f i ce r of any census to abstract from the forms or other docLinents used in any census the names, addresses and ages (but no other par t icu lars) of persons therein mentioned, for the purposes of subsection (2 ) .

(2) An abstract prepared pursuant to subsection (1) may be used i n the course of duty by any public o f f i ce r authorised by the Secretary to Executive Council i n that behalf for such purposes in the interests of the peace, order and good government of these Islands as the Secretary to Executive Council may authorise.

(3) MD abstract prepared pursuant to subsection (1) may be copied by any such authorised o f f i ce r or be made avai lable to ttie pub l ic .

(4) The Secretary to Executive Council sha l l re ta in custody of any abstract prepared pursuant to subsection (1) at a l l times when i t i s not in use by an authorised o f f i c e r .

1. These Regulations may be cited as the Census Regulations 1977.

2. In these Regulations -

"the Census" means the census directed, by the Census Order published on the 23rd Septenter, 1977, to be taken on the 27th November, 1977;

"census nic^t" means the night between the 26th and 27th November, 1977;

"hotel" includes any hotel, boarding house, guest house or lodging house;

"household" and "premises" includes ship or boat ordinarily moored or anchored in Bermudian waters on which any person stays or intends to stay on census n l ^ t ;

"Institution" includes a hospital, nursing home, home for aged, sick or destitute, hostel or residential club, boarding school or prison or other place of detention.

3. The following particulars shall be given by any person so required by these Regulations to a census officer i f requested by him and he may require the particulars to be given orally or in writing -

(i) his surname and given names; ( i i ) his permanent address;

( i i i ) his usual place of residence i f different from his permanent address; (iv) Inhere he spent or proposes to spend census nic^it; (v) his sex;

(vi) the date of his birth; (vii) the country of his birth;

( v l i i ) whether he is a British subject; (lx) whether he has Bermudian status; (x) the length of time he will have been resident in Bermuda on census n i ^ t ;

(xl) whether he is a registered elector.

4. (1) Every person of the age of sixteen years or over in or proposing to be Bermuda on census night, other than guests in hotels who have not Bermudian status or are not ordinarily resident In Bermuda, shall give the particulars set out in regulation 3 i f so requested.

(2) The heads of households d persons in charge of hotels and institutions shall give a census officer on request a l i s t of persons ordinarily resident in their households, hotels or institutions, as the case may be, and a l i s t of persons expected to be present in the household, hotels, or institutions on census night.

(3) Notwithstanding paragraph (1) a census officer may require any person to give all or any of the particulars mentioned in regulation 3 i f he is of the opinion that the giving of sudi particulars will aid the compilation of the census.

5. A census officer, uhlle acting In the discharge of his duties, may at any reasonable time enter any premises.

6. Every census officer prior to taking any action under these Regulations ^ a l l make the following declaration before a justice of the peace -

" I solemnly and sincerely declare that I will faithfully and honestly f u l f i l my duties as a census officer and that I will not without lawful authority disclose or make known any information which comes to my knowledge while acting as a census officer."

(3) Notwithstanding paragraph (1) a census o f f i ce r may require any person to give a l l or any of the par t icu lars mentioned In regulations 3 i f he is of the opinion that the giv ing of such par t icu lars w i l l a id the canpi lat ion of the census.

5. A census o f f i ce r may require the head of a household as defined in regulations 3(2) to give the fol lowing addi t ional par t icu lars of any member of h is household l i v i n g outside Bermuda -

6. (1) A census officer may require any person in charge of any premises occupied as a dwelling to give the following additional particulars -

(2) For the purpose of paragraph (1) the person in diarge of premises sha l l have the meaning of the head of household i n regulat ion 3(2) .

7, The Superintendent of Census sha l l make such arrangements as are apprt^r late with ttie commanding o f f i ce rs or other persons in charge of -

(a) persons resident In the Lhited States bases;

(b) persons on board vessels of Her Majesty or of the United States of America; and

(c) members of the armed forces of Her Majesty or of the United States of Anerica or any c i v i l i a n employed i n such forces on duty i n Bermuda and the i r fami l ies ,

to obtain such par t icu lars o f such persons as he may consider necessary for the purpose of the census.

CENSUS DEFINITION OF BERMUDA STATUS AND BRITISH NATIONALITY

(TVie following notes were written for the guidance of Census Officers and are not a detailed exposition of the law.)

BERMUDA STATUS

No person can have Bermuda Status unless he or she is a British subject.

If a person was alive on the 1st July, 1956, then he or she can claim Bermuda Status i f he or she had been -

1. (a) bom in Bermuda or i f born outside of Bermuda his or her parents were ordinarily resident at the date of birth In Bennuda (1937 - (1) (a)); or

(b) had been continuously resident In the Island on tiie date for nine years (1937 - 5(1) (b) as anended); or

(c) had been naturalised as a British subject by the Governor (1937 - 5(1) (c); or

(d) the child, stepchild or adopted child of one of the above under sixteen years of age (1937 -5(1) (e)).

NOTE: These provisions did not apply to expatriate civil servants or to diplomats. (As read with 1956 - 17)

2. After the 1st July, 1956, i f a person had not already acquired Bermudian Status under 1 above, i t becomes necessary to have one of the following qualifications:

A. A woman i f -

(a) she is married to a man with Bermudian Status and is not living apart from him by reason of a court decree; or (1956 - 16(2))

(b) she is the widow of a man with Bermudian Status and at his death was not living apart from him as a result of a court decree (1956 - 16(3)).

B. Any person who has a certificate granting him or her Bermudian Status.

C. Any person other than A or B a f ter the 1st July, 1956 i f one of his parents has Bermudian Status and both of his parents at the time of his b i r t h were permanently l i v i n g i n Bermuda. I f the ch i ld i s i l l eg i t ima te the mother must have Bermudian Status and permanently l i v i n g in Bermuda.

D. A legi t imate c h i l d , stepchi ld or adopted ch i ld under twenty-one years of age of a person who has Bermudian Status.

The above conditions apply even i f tiie ch i ld Is born outside Bermuda. (1956 - 16(4))

B r i t i sh Subjects are:

Cit izens of the Lhited Kingdom and colonies, or of Canada, AcstraUa, New Zealand, Ind ia, Pakistan, Southem Rhodesia, Ceylon, Ghana, Malaysia, the Republic of C^ rus , Niger ia, Sierra Leone, Tanzania, Jamaica, Trinidad and Tobago, Uganda, Kenya, Malawi, Zambia, Malta, the Gambia, Guyana, Botswana, Lesotho, Singapore, Barbados, Maur i t ius, Swaziland, Tongo, F i j i and the Sahanas.

A c i t i zen of the United Kingdom and colonies:

1. A person bom wi th in the United Kingdom and Colonies (other than a foreign diplomat) or 2. His father was a c i t i zen of the United Kingdom and Colonies or 3. A natural ised c i t i zen of the United Kingdom and Colonies.

NOTE: I t i s possible that a person can claim to be a Br i t i sh subject i f he has no c i t izenship , i s a c i t i zen of the Republic of Ireland or i s a Br i t i sh protected person. In suc*i cases, o f f i ce rs must use the i r d iscret ion whether to accept them for the purpose of the census as B r i t i sh subjects.
