THE 2012 LEGISLATIVE VETO SESSION in lateNovember and early December produced limited action on most keyissues affecting the IEA and public education. The limited nature ofthe veto session, those bills that were vetoed by the Governor, meantthat only six bills should be up for consideration. But, as has becomethe tradition in Illinois, other issues are discussed and voted upon.

One surprise was SB 282, the proposal introduced by SenatePresident Cullerton, would require public corporations to make tax filings public. If the corporation does not pay any taxes, it would haveto disclose why. Additionally, publicly-traded corporations doing busi-ness in Illinois would have to disclose detailed information from theirIllinois income tax returns, including how much income and replace-ment tax they paid each year. The legislation narrowly passed theSenate and is awaiting a hearing in the House.

PENSIONSDuring the second week of the veto session, a number of rank-and-

file legislators introduced HB 6258 (Nekritz, D-Northbrook). Theoverview explains the proposal and how it would affect members ofthe Teachers’ Retirement System (TRS) and the State UniversitiesRetirement System (SURS). The bill includes teachers, state employees,higher education employees and members of the legislature. IMRF wasnot included in this piece of legislation. However, those that partici-pate in IMRF must know that any benefit reduction legislation thatpasses for the state pension systems will certainly be applied to IMRFsoon after it passes. The constitutionality of many parts of this bill is inquestion.1. Cost-of-Living Adjustment (COLA) changes:

a. Changes would apply to active and already retired members.b. The COLA would be payable only when a retiree has reached

age 67 or after five years of retirement, whichever comes first.This provision applies to current retirees. Currently, memberscan receive their 3 percent compounded COLA upon reachingage 61.

c. A new COLA equal to the lesser of $750 or 3 percent of the

annuity. The COLA for most members in TRS and SURS wouldbecome an annual $750.

d. Current retirees would have their annuities frozen to meet thecriteria of the second dot point and they would have theirCOLA reduced to the amount specified in dot point numberthree.

2. Changes for actives only:a. The age for retirement eligibility would change as follows:

i. Members older than 46 would see no change.ii. Members between 40-45 would have to work an additional

year.iii. Members 35-39 would have to work three additional years.iv. Members younger than 34 would have to work five more

years. 3. The age of a member on the day the legislation takes effect would

be used to determine how these new requirements would beapplied.

4. Pension contribution increase: Members would pay one percentmore of their salary toward their pension the first year and two percent the second year.

5. Pensionable salary cap: The legislation would cap pensionablesalary to the Social Security Wage Base ($113,700 for calendar year2013) or the member’s salary on the day the legislation takes effect.

6. Changes for members in Tier Two:a. There would be a Cash Balance Plan implemented for future

hires. Current Tier Two members would have the option to par-ticipate in the cash balance plan.

b. The cash balance plan applies interest to the retirement contri-butions by and for members. The balance of the contributionsgrows at a variable interest rate and a portion is annuitizedwhen the member retires. The retirement system is responsiblefor investing the contributions by and for the member.

L ast year, I listed New Year resolutions for IEA — fight for pensions, lobby legislators, write editorials, increase memberparticipation in recommendation meetings and political action.

Looking back, we were quite successful. Many of these resolutions willcontinue, from my perspective.

This year, I made a new list for each of you to consider adding toyour own resolutions:

• Invest in a 403b — Whether it’s a very small amount ($10 or $25)a month, or larger, all educators must be investing. In theseuncertain times, we must protect ourselves against pensionchanges, supplement our future income and prepare fordecreased income in retirement.  

• Take care of yourself — You give to your students, your schoolsand your communities. So, take time for yourself and slow downby resting, exercising and spending time with family and friends.

• Get to know your legislator — Building a relationship with yourstate representative and senator as well as your congresspersonhelps us all when issues such as education, pensions, subcontract-ing, etc. arise. Legislators listen to their constituents.

• Participate in your local and in IEA — Youhave so many talents and skills that would begreat additions to help in your local’s commit-tees, community outreach, political action andpublic relations.  Offer ideas to your local lead-ers. Attend an IEA conference (SummerLeadership in July).

• Make IEA your homepage — www.ieanea.orgis the quickest way to get the latest information, find out aboutresources and grants, read In the News articles about what’s hap-pening in education across the state, get any calls to actionregarding legislation, plus many more topics.

• Update your member profile and your home email — Is youraddress correct? Have you provided your home email so IEA canalert you at a moment’s notice of calls to action, pension propos-als, etc.?  Many districts block emails and crucial informationwon’t get to you if we can’t contact you on your home email. Wetry very hard to be discriminating and only send emails whenessential.

peting interests all revolving around the need for revenue and animmediate end to the pension controversy. There will be those whoclaim that the gaming bill is essential and must be dealt with immedi-ately to create much needed revenue. There will be those who claimthat the income tax needs to be made permanent right now because ofthe 35 legislators who are free to vote their conscience without fear oflosing their seats There will be those who believe that the state’s bondrating will be negatively impacted without the resolution of the pen-sion crisis.

Who will prevail? No one knows. But, we do know that each ofthese proposals is colossal and will require a great deal of conversationand arm twisting to get passed. The likelihood that all of them getpassed is remote. The challenge is to be ready for whichever proposalcomes before the General Assembly for a vote. Each of these proposalswill have a significant impact on public education. So, we will do ourdue diligence and be at the ready. We ask you to do the same.

7. Cost-shift: The proposal would shift the cost of downstate and sub-urban teachers and higher education staff pensions from the state tolocal schools, universities and community colleges. This proposal isphased in over a number of years. However, many schools alreadyface severe budget cuts which limit educational opportunities forstudents. This cost-shift would drain millions of dollars from thesedownstate and suburban educational institutions.

8. New pension funding plan:a. The proposal creates new revenue to fund the pension systems

by using money freed up from bond payments to pay down thepension debt.

b. Pension funding would be considered a constitutionally-pro-tected benefit under this proposal.

So, as we prepare for the lame duck session, which is scheduled tobegin on Jan. 2, what can we expect? There will be a number of com-

There’s no time like the present to seriously consider becoming a delegateto the National Education Association Representative Assembly (NEA RA).

The most important part of being a member of an association like the Illinois Educa-tion Association is the ability to have one’s voice heard on a variety of issues that af-fect the working conditions of school employees and learning environments of studentsacross this nation.

One of the most effective ways to accomplish this is to become a delegate to the NEARA. This assembly is one of the largest democratically elected deliberative bodies inthe world when it is seated, and the debates on educational issues are a true reflec-tion of what each member experiences in his or her community.

To become a part of such an important, exciting and influential assembly, follow thesesteps:

1. Note the deadlines below for submitting required paperwork.

2. Fill out the required forms on pages 5-7 of this issue and send it via certifiedmail to the IEA before the stated deadline.

3. Notify your local president, region council chairperson, and any other leaders inyour area that you are running to be a delegate. Solicit their support and tell themto spread the word.

4. If you are a minority, and we strongly encourage minorities to run, be sure to no-tify IEA minority caucus chairpersons so that they can assist you in gathering votesacross the state.

5. Make sure you are aware of the issues that are facing us nationally and talk about your desire to influence the debate with all IEA members you encounter.Check the IEA (www.ieanea.org) and NEA (www.nea.org) websites for issues ofimportance.

6. Make sure people in your local know you are running and that they VOTE whenthe time comes.

IEA SPRINGTIME ELECTION INFORMATIONNomination: Only student members who are enrolled for a minimum of twelve(12) semester hours may be nominated. All student delegate nominees mustuse the Student Delegate Nomination Form.

Council of Retirees:

Vacancies: Member (3 positions)

Eligibility: All IEA-NEA retired members are eligible to participate in the election ofthe above positions. Nomination: All retired nominees must use the RetiredNomination Form.

Educational Support Professional Council:

Vacancies: Member (2 positions, 3-year term) and Member (1 position, 1-yearterm)

Eligibility: All IEA-NEA members who are employed as Educational SupportProfessionals in a school district and/or combination of school districts are eligi-ble to participate in the election for the above positions.

Educational Support Professional Southern/Central Alternate/NEA RA SuccessorDelegate (2-year term):

Eligibility: All IEA-NEA members in Regions 1-14, 45, 47, 48 and 62 are eligible toparticipate in the election for the above position.

Vacancies: Chairperson/NEA RA State Delegate, Member (2 positions, 3-year term),Member (1 position, 2-year term) and Member (1 position, 1-year term) Eligibility: All IEA-NEA members who are employed in institutions of higher edu-cation are eligible to participate in the election for the above positions.

Higher Education Suburban Alternate/NEA RA Successor Delegate (1-year term):

Eligibility: All IEA-NEA members in Regions 23-43, 46, 49, 50, 52-60, and 63-67are eligible to participate in the election for the above position.

Central Ethnic-Minority Alternate/NEA RA Successor Delegate (2-year term):

Eligibility: All IEA-NEA members in Regions 8, 9, 12-18, 44, 51, 61 and 62 are eligible to participate in the election for the above position.

1. Nominations will be accepted if received in the IEA-NEA president’s officeby February 20, 2013. These nominations are to be filed by CERTIFIEDMAIL. Candidates may state on the form, in 100 characters or less, whattheir qualifications are for the position. (STUDENT DELEGATE NOMINEESMUST USE THE STUDENT DELEGATE NOMINATION FORM AND RETIREDNOMINEES MUST USE THE RETIRED NOMINATION FORM.) Note: The100 character limit on statements will be strictly followed. Candidate state-ments will be mailed with the ballots.

2. Sample ballots will be sent out to all candidates and IEA-NEA board mem-bers by February 27, 2013.

3. Names shall appear on the ballots in order as determined by lot.

4. Challenges regarding the ballots must be received by March 13, 2013 byCERTIFIED MAIL.

5. Ballots shall be sent by bulk mail no later than March 27, 2013. They mustbe returned to the IEA-NEA Headquarters, 100 East Edwards St.,Springfield, IL 62704 no later than 11:59 p.m. on April 24, 2013, in theofficial ballot envelope, one ballot per envelope. Ballots received other thanin the official ballot envelope shall be considered spoiled.

6. Results shall be tallied or certified by the State Elections Committee onApril 26, 2013 at the IEA-NEA Headquarters Building in Springfield.Candidates shall be notified of the results by May 3, 2013.
