IBC Code, BC Code and MARPOL Annex II AMENDMENTS ENTERING INTO FORCE ON 1st JANUARY 2021
The amendments
Resolutions:
- MEPC.315(74) Amendments to MARPOL Annex II
- MEPC.318(74) Amendments to IBC Chapters 1, 15, 16, 17, 18, 19, 21
- MEPC.319(74) Amendments to BCH Chapters IV, V, VI
have been adopted by IMO on 17 May 2019, and will enter into force on 1-1-2021
Amendments to MARPOL Annex II
MEPC.315(74)
REGULATION 13.7.1.4:
When unloaded inside the North West European waters, the Baltic Sea area, the
Western European waters and the Norwegian Sea, persistent floaters category Y
substances identified by '16.2.7' in column 'o' of chapter 17 of the IBC Code, shall
be subject to a prewash procedure, and the washwater/residues shall be
discharged to a reception facility.
These are 44 substances, mostly oils, oleins and stearins of vegetable origin,
including palm, rapeseed and olive but also fish oil.
This Regulation is recalled in IBC Regulation 16.2.7 and BCH Regulation 5.2.7

APPENDIX IV - STANDARD FORMAT FOR THE PROCEDURES AND ARRANGEMENTS MANUAL
The resolution amends the standard P&A Manual format, to include instructions on
how to deal with the Persistent floaters required to undergo prewash per regulation
13.7.1.4, when inside the identified area.
Therefore, in order to be compliant with MARPOL A.II as of 1-1-2021, the P&A
Manuals are to be updated and re-approved.

IBC REGULATION 15.15 & BCH 4.24
The resolution introduces a new regulation
requiring to provide on board H2S detection
equipment when carrying bulk liquids prone to H2S
formation. This is applicable to:
- Sodium hydrosulphide/Ammonium sulphide
solution
- Sodium hydrosulphide solution (45% or less)
Toxic vapour detection instruments complying with
the requirements in para. 13.2.1 of the Code and
able to test for H2S may be may be used to satisfy
this requirement.

CHAPTER 17 & 18
The resolution completely replaces the content of chapter 17 and Chapter 18.
The criteria for assigning carriage requirements in IBC Chapter 21 have been
updated, and all products have been reassessed and assigned new carriage
requirements These amendments may result in change of required ship type (e.g.
IMO 2 instead of IMO 3) and other carriage requirements for some cargoes.

IMPACT ON SUPPLY VESSELSThe above amendments also impact on Supply vessels
certified as complying with:
- A.1122(30) (OSV Code), because it refers directly to the
IBC Code:
- definition of cargo area depends on Hazards (P, S,
S/P) assigned to substances
- damage assumptions and location of cargo tanks are
referring to Ship Type 1, 2, or 3
- cargo segregation criteria and arrangement of
entrances, air inlets and openings to accommodation,
service and machinery spaces and control stations
depends on the Hazards (P, S, S/P) assigned to
substances
- Special requirement are applicable to piping systems
intended to transfer TOXIC products

IMPACT ON SUPPLY VESSELS
Also Supply vessels certified as complying with:
A.673(16) as amended (LIMITED AMOUNT OF
HAZARDOUS AND NOXIOUS LIQUID SUBSTANCES), are
impacted, as far as the IBC Code is referred in:
- Paragraph 1.2.2: “Product which for safety reasons may
be assigned for carriage on a type 3 ship … which are
not required to meet the requirements for toxic product in
section 15.12 of that code”
- Appendix 1 as amended per Resolution MEPC.236(82):
“Oil …water based mud containing mixtures of products
listed in chapters 17 and 18 of the IBC Code
- Para 3.1.10, 3.2.4, 3.4.3 : the requirement concerning
segregation of tanks and piping, position of tank opening
and access to accomodations and other spaces and
personnel protection equipment may be waived for
pollution hazard only substances

Implementation of the amendments
On 1 January 2021 ships provided with the following certificates:
- ICOFCHE
- NLS/IPPC
- COFCHE
- LAHNLS Statement in accordance with A.673(16) as amended by MEPC.158(55)
- OSV Chemical code certificate in accordance with A.1122(30)
shall have on board a new list of products amended in accordance with resolution
MEPC 318(74), and pertinent certificate shall be re-issued.
SHIP STATUS: Forthcoming requirement
- - The list of products currently allowed for the carriage reassessed and confirmed due to the revised
criteria for assigning carriage requirements introduced by IBC Code Amendments (Chapt. 21)
- Prewash procedures developed for certain newly defined persistent floaters in certain trading areas, e.g.
North Western European waters, Baltic Sea area, Western European waters, Norwegian sea as
specified in new paragraph 13.7.1.4 and paragraph 9 of the amended Annex II of MARPOL 74/78
- The current P&A Manual amended and re approved in consideration of the new list of products and
prewash procedures
- Hydrogen Sulphide (H2S) detection equipment supplied on board if carrying in bulk liquids prone to H2S
formation
- The ICOFCHE COFCHE, or IPPC Certificates, as applicable, amended and reissued as
necessary
Hydrogen Sulphide (H2S) detection equipment
The Hydrogen sulphide (H2S) detection equipment is to be provided on board to
carry liquids prone to H2S formation (par 15.15 in column O).
RINA does not require attendance on board to verify presence on board of such
equipment. In case the ship has already the toxic vapour detection instrument on
board, also the products prone to H2S formation will be included in the list.
It is Owner responsibility to have on board the appropriate equipment when
carrying the products prone to H2S formation.
Check of the instrumentation necessary for the carriage of products in the list, is
part of the periodical survey when due.

ISSUANCE OF THE NEW CERTIFICATE

- P&A Manual amendment is requested
irrespectively of the product of list allowed for
carriage
- P&A Manual may be updated by means of an
attached sheet which summarize the
amendment to the P&A manual
- At this purpose RINA provided a template of
this amendment sheet to facilitate Owners in
the preparation of the P&A attachment
- Owners are to send the attachment sheet to
RINA for approval

RINA has developed a supporting tool capable
of identify, on the basis of the individual ship’s
arrangements:
- The list of new products allowed
- The list of products not anymore allowed
- The list of products deleted by the IBC Code
- The technical reason which excluded the
carriage of a specific product
- The list Products of the ship that changed
cargo tank group for their carriage

- When P&A Manual attachment is approved, the Office will issue the full term
certificate with the new list of products in accordance with IMO procedure set in
PPR 7-22 as shown in the following

expiry date and accepted by all the Administration are automatically inserted in
the new list of products of the new certificate

RINA apply the same guidance also for the NLS, OSV
certificates and LAHNLS statement.PPR 7-22
is a document of an IMO
subcommittee for Pollution
Prevention and Response that will
be approved at the next
committee session in and it
manage the issue of the
ICOFCHE/COFCHE certificates
prior to 1 Jan 2021.
Formally this document has been
adopted but due to COVID-19 not
approved yet.
The PPR 7-22 document adopts the following guide for
replacement of an existing certificate by a revised certificate that
is issued before the entry into force of amendments to the IBC
Code:
.1 the issuance of the revised certificate may be initiated from
the date of adoption (the later of the adoption dates by MSC
or MEPC, as the case may be) of the IBC Code amendments,
rather than the date of entry into force of the amendments
.2 the revised certificate should have the same expiry date as
the existing certificate; and
.3 the revised certificate should be provided with a stamp/text
on the front page stating that the revised certificate is
effective, and supersedes the existing certificate, on the date
of entry into force of the amendments to the IBC Code

RINA procedure for the issuance of certificate
- RINA ship status will show only the new
certificate: specific memo will be issued to inform
third parties
“the ICOFCHE/COFCHE/NLS/LAHNLS/OSV certificate showed in the
ship’s status and issued on dd/mm/yyyy is effective from 1 January
2021, and supersedes the existing certificate issued on dd/mm/yyyy,
which continues to be valid until that date. After 1 January 2021 the
Owner has to send back to RINA the existing certificate which ceases
to be valid”
- new certificate recalls last amendments to the
Code and the following text on the first page:
“NOTE: this certificate is effective, and supersedes the existing
certificate issued on gg/mm/yyyy, on the date of entry into force of the
amendments to the IBC Code i.e. 1 January 2021.”
Replacement of the existing certificate
- It is master responsibility to follow the provisions
of the appropriate certificate in use and show it to
third parties
- On 1 January 2021, the existing certificate cases
to be valid and products allowed are those listed
in the new certificate
- RINA request to send back the existing certificate
after 1 Jan 2021 when new one will be effective
- When RINA receive the superseded certificate the
memo on the status will be removed
Carriage of products before and after 1 January 2021
Ships carries their products in accordance with the existing provisions and list of
products in force until 31 December 2020.
When a cargo is loaded prior 1 January 2021 and unloaded after that date, the
relevant provisions of the IBC Code at the time of loading should be applicable
until the cargo has been unloaded.
Special cases on the application of the
amendments GAS Carrier
Pollutant requirements of chemical products commonly carried on Gas carrier and
listed in both IGC and IBC Code have not changed.
- NLS Certificate of Gas carrier is not
affected by this amendments
- P&A Manual is to be checked in
respect to the standard template
taking into account that prewash
procedures are not envisage for a gas
carrier
Products allowed on a gas carrier have their safety requirements covered by IGC
code and pollutant requirements covered by MARPOL ANNEX II (i.e. category X, Y
or Z).
