Please be advised that we act on behalf of Mr Richard Bonato, with regard to the above mentioned
Development Application.
This application has been prepared to seek approval of the proposed Reconfiguring a Lot (1 Lot into 3
Lots) at 137 - 139 Beach Road, Ayr, being properly described as Lot 3 on RP910223, Parish of Antill,
County of Gladstone. The subject site is identified as being within the Village Zone under the Burdekin
Shire Planning Scheme.
The development application recuests a Development Permit for Reconfiguring a Lot to create three
(3) residential allotments and Access Easements. Under the provisions of the Burdekin Shire Planning
Scheme the application is Code Assessable.
To enable Council’s con~deration, please find enclosed the following documents:

THE SITE
The subject site is described as Lot 3 on RP91 0223 and comprises a total area of 6.672 hectares. The
site has approximately 98 metres frontage to Beach Road and 475 metres frontage to Patricia Road.
The site contains an existing house, associated sheds and a relatives apartment.
It is also noted that the subject site is burdened by existing easements, Easement R on SP 1 361 30
which benefits Burdekin Shire Council and Lower Burdekin Water and Easement A on RP734076
benefits Burdekin Shire Council.

Approval of the Development Application will authorise a Development Permit for Reconfiguring a Lot
(1 Lot into 3 Lots). Plans detailing the proposed reconfiguration are enclosed with this application. A
brief assessment of the proposal is as follows:

It is the applicants intent to create proposed Lots 4 and 6 to contain the existing dwellings while
proposed Lot 5 will be created for the purposes of future low densi1y residential use.
Proposed Easements C and D are to oe created as Access Easements. The proposed Access
Easement D will burden proposed Lot 6 and benefit proposed Lots 4 and 5 for access purposes from
Beach Road. The proposed Access Easement C will burden proposed Lot 5 and benefit proposed Lot
4 for access purposes from Beach Road. Proposed access Easements C and D are aligned with an
existing concrete driveway.
Proposed Easement B is to be created for future services such as power, water and communications
to service proposed lots 4 and 5. Proposed Easement B will burden proposed lot 5 and benefit
proposed Lot 4.
It is considered that the proposed allotments are of an adequate area, dimension and orientation to
ensure that the current and intended land uses will be compatible with the desired character and
ameni1y of the 10cali1y. Each of the proposed allotments are provided with safe and convenient
vehicular access. It is also noted that each lot will be provided with an appropriate level of essenftal
services and infrastructure.
Overall, it is considered that the proposed development reflects the existing scale and is compatible
with the lower densi1y and semi-rural ameni1y of the 10cali1y. Furthermore, it is considered that the
proposed development achieves general consistency with the applicable acceptable solutions and
specific outcomes of the applicable planning scheme codes.
REFERRAL AGENCIES
The Integrated Development Assessment Process incorporates a referral process, established through the SustaInable PlannIng RegulatIon 2009 (IP Reg), enabling relevant state agencies to have input in
the assessment process. A review of Schedule 7 of the SustaInable PlannIng RegulatIon 2009 against the proposed development indicates that there are no referral agencies applicable to this
applicafton.
CONCLUSION
With the provision of reasonable and relevant conditions, we consider that Council are able to
approve the proposed reconfigurafton on the following grounds:
. The proposed development contributes to the available residential land in Ayr.
. The proposed subdivision is permissible development within the Village Zone and the proposed allotments exceed the minimum lot size of 800m2 which applies to the land.

The proposal will not have a detrimental impact on the function of fhe existing and future street
and traffic network.
The proposal is of a scale and nature that contributes to fhe proper and orderly development
of the locality. The area and dimensions of the lots are sufficient to accommodate the existing structures,
vehicle access and open space areas.
The proposed development does not intend to modity existing land contours, therefore
ensuring fhat fhe overland fiow paths do not directly or indirectly cause nuisance to a
downstream or adjoining property. All proposed allotments are able to be appropriately serviced by connecting to the existing
infrastructure.
