Meeting Notice Report: Director reported that the meeting notice had been duly posted at the Humboldt County Courthouse, Humboldt County Library, County Annex, Winnemucca City Hall, and Humboldt County Website.

1. Call to order: The meeting was called to order at 5:02 pm

2. Public Comment and Discussion: There was no public comment at this time.

3. Consent Agenda: Any items appearing on the consent agenda can be pulled down and discussed in detail (for possible action): Trustee McComb motioned to bring the consent items A, C, & D down for discussion and approve item B with minor fix. Motion carried.

4. Consideration, Discussion and Possible Action on the Director’s Report for the month

of July: Discussion of the upcoming NLA conference, recently submitted grants for the

2020FY, improving advertising and marketing on library programs, Future of the Denio

Library/Annex and staffing, and the Reading Coalition’s work on the Little Libraries.

Trustee Haas motioned to approve the Director’s Report as presented, and the motion

carried.

5. Consideration, Discussion and Possible Action on the applications received for the

position of Library Director and the decision to interview and/or appoint a Library

Director from the applicants submitted according to the powers and duties of trustees

in NRS 379.025(b): Trustee Olsen read a letter of recommendation for Jessica Anderson

received from Betty Lawrence of the Humboldt County Planning Department.

Discussion on the two applicants. Trustee Olsen made a motion to conclude the

recruitment with these applicants and go forward with interviews for both candidates,

and the motion carried. Trustee Boni made a motion to nominate Trustees Putnam and

Trustee Olsen to work with H.R. Director Abel del Real-Nava on interview questions, and

the motion carried.

6. Discussion and Possible Action to adopt the Library Board of Trustees Policy manual

and possible action to recommend presentation of manual to the Board of County

Commissioners for adoption: Discussion on the need for Trustee Policies 1-7, and the

changes needed for the Policy on the Library Director Investigation. Trustee Olsen

motioned to table the policy on the Library Director Investigation until the next meeting

and directed Interim Library Director Anderson to e-mail the Board the updated version

of the policy with the changes discussed to review. The motion carried. Trustee

McComb then made a motion to table the Trustee Policy Manual from items #1 - #7,

indefinitely. The motion carried.

Directors Report

Tuesday, August 20th, 2019

New and Ongoing events:

We’ve started a bi-monthly Conversation Spanish class for adults, with 14 attendees in our

first meeting and our first Calligraphy class will be Saturday, August 17, but interest is

already high from the feedback we are receiving on Facebook. These are great additions to

our roster of adult programming that already include Quarterly live music, Book Talks, and

Dramatic Read Alouds, and monthly Book Clubs and Computer Classes. New adult

programs for Art, Theater and other educational and recreational pursuits will be included

throughout the year.

The library is being cleaned up and reorganized in preparation of making everything more

streamlined when things have to be moved around for the placement of carpet, which

included maximizing the storage space in the garage and back office, which are the two

biggest areas in this project. The end goal of this project is two-fold, make the placement

of carpet smoother and to better utilize the space we have, rearranging all the staff desks to

oversee the main floor for the best coverage instead of facing away or towards walls.

Pop-up storytimes have proven to be a hit, and several more are planned throughout the

year including a visit to the courthouse with Judge Montero on August 20th. Places visited

so far include the Farmer’s Market, Vesco Park, the Fire Department, and by partnering

with the Chamber of Commerce; Winnemucca’s Ford Dealership.

With school starting back up again we are making the rounds to the schools for registration

to talk to the students and parents about our available resources and schedule visits with the

teachers for library tours and class visits.

We’ve rolled over into the 2nd

phase of the State Libraries Emergent Technologies pilot

program featuring Virtual Reality and the Lifelique museum and catalog. The McDermitt

Branch library is being equipped with a VR helmet and computer capable of running the

software so they will be able to start offering Virtual Reality programming, and we

received an Oculus Go to expand our own services over the next year.

Little Libraries goes before the City Council on August 20th for permission to place a little

library at each city park. We’ve already got our first little library and will be looking to

commission others after we get the go-ahead.

Red tabbed items and Bills for long overdue items have been cleaned up, mailed out and

caught up. Long overdue notices will now be going out each week, with three notices

before a final bill is sent out, at which point the account will be blocked until cleared. This

was a project long in the works, we kept finding new red-tabbed files and completing

inventory helped clear several accounts.

Summer Learning has mostly wrapped-up, with the Bookmobile in its last week.

Policy Proposal

SUBJECT: INVESTIGATIONS OF ALLEGED MISCONDUCT BY THE LIBRARY

DIRECTOR

POLICY: To perform and manage investigations of complaints of harassment,

discrimination, retaliation, safety and ethical allegations of misconduct by the Library Director

in a timely manner in order to ensure that prohibited actions and behaviors cease immediately

and in order to protect the parties involved in the investigation process.

1.1 Purpose

When an employee makes an informal or formal complaint against the Library Director,

Humboldt County will take prompt steps to stop the alleged conflict, protect involved parties,

and begin investigations. Under many laws [e.g., Title VII, the Americans with Disabilities Act

(ADA), the Age Discrimination in Employment Act (ADEA), the Occupational Safety and

Health Act (OSHA), the Sarbanes-Oxley Act, state and local nondiscrimination laws], Counties

are legally obligated to investigate complaints (harassment, discrimination, retaliation, safety and

ethical) in a timely manner. In addition, reasonable action is required to be taken by the County

to ensure illegal actions and behaviors cease immediately.

Responsiveness to a complaint and an investigation will not only yield the best information and

evidence, but it will also enhance both the investigator’s and the County’s credibility.

Investigations can help the organization identify and resolve internal problems before they

become widespread. Humboldt County takes all complaints seriously, and will conduct

appropriate, reasonable, and prompt investigations.

1.2 Investigation Process

No investigation should be undertaken without the written notification of the County Manager or

Human Resources Director. The following steps will be taken as soon as the County receives a

verbal or written complaint that warrants an investigation.

a. Maintain Confidentiality

The County will protect the confidentiality of employee claims to the best of its ability

and in accordance with law. At the same time, the County must conduct a prompt and an

effective investigation. It may not be possible to keep all information completely

confidential. The County should explain to the complaining party and all individuals

involved in the investigation that all information gathered will remain confidential to the

extent possible for a thorough investigation. It should also be explained to the parties that

to conduct a prompt and effective investigation, some information may be revealed to the

accused and potential witnesses, but that information will be shared only on a need-to-

b. Provide Interim Protection

The County may take immediate measures for the protection of the accuser or the

complainant. Separating the complainant from the accused may be done to guard against

continued harassment or retaliation. Actions such as a schedule changes, transfers, or

leave of absence may be necessary, and are not done for retaliatory purposes. The

County Manager and Human Resources Director are authorized to take immediate

action.

The status of protective action may be changed at any time by the Human Resources

Director in consultation with the County Manager during the investigation.

c. Select an Investigator

An investigator will be chosen by the Human Resources Director in conjunction with the

County Manager and in consultation with the District Attorney and the Library Board of

Trustees.

The County may use the resources of experienced Human Resources professionals,

internal security, legal counsel (inside or outside), a third-party investigator, or the

County may use a team approach.

d. Discussion of an Active Investigation

Library Board of Trustees members and all other parties involved in the investigation

process are prohibited from discussing or answering questions pertaining to an active

investigation that can compromise the integrity of an investigation. Trustees will

forward any inquiries about the investigation from the public or Library Director to the

Human Resources Director.

1.3 Determination

Upon receipt of the completed investigation report, the Human Resources Director, or County

Manager, or both, will review the entire investigative file, the employee’s personnel file, and any

other relevant materials. The Human Resources Director, or County Manager, or both, may

return the entire investigation to the assigned investigator for further investigation of action.

Once the investigation report is completed to the satisfaction of the Human Resources Director,

or County Manager, or both, s/he will review the report and its findings, and will provide to the

Library Board of Trustees, County Manager, or other appropriate person potentially taking

recommending disciplinary action against the employee to the Library Board of Trustees.

1.4 Closure of Investigation

Once a decision recommendation is made, the Human Resources Director will notify both the

complainant, the accused and the Library Board of Trustees that the investigation is complete,

that the County took the complaint seriously, and that the County took appropriate action to

investigate the complaint. At the meeting of the Library Board of Trustees, the Board will

select two Trustees to serve on an Investigative Report Committee alongside the Human

Resources Director and County Manager. The County is not obligated to disclose to the 21

complainant what actions were taken against the accused.

The Human Resources Director should set a time frame to follow up with the complainant to

ensure there are no other issues and that no retaliation has been endured. The County should

encourage communication and follow-up until the complainant is comfortable again. Finally,

the Human Resources Director should remind all parties to preserve confidentiality as

appropriate.

When necessary, the County must take reasonable action that is appropriate to the situation.

1.5 Forwarding of Investigative Report

Upon closure of the investigation, the Human Resources Director will forward a copy of the

investigative report to members of the the Library Board of TrusteesInvestigative Report

Committee and District Attorney’s Office for review. To protect the privacy of those that

contributed to the investigation, the Human Resources in consultation with the District Attorney’s

Office may redact information from the copy of the investigative report provided to the Library

Board of Trustees. The Human Resources Director will make available as much of the

investigative report as possible to the Library Board of Trustees.

1.6 Special Meeting to Consider Findings of the Investigation

A special meeting of the Library Board of Trustees will be scheduled to consider the Library

Director’s alleged misconduct, professional competence, and character no later than one week

after the Library Board of TrusteesInvestigative Report Committee and District Attorney haves

received a copy of the investigative report. Notice of the special meeting will be forwarded to the

Library Director in accordance with NRS 241.033(1) (a) and (b) as outlined in section 1.7 of this

policy. To protect the privacy of those that contributed to the investigation, the Human Resources

in consultation with the District Attorney’s Office may redact information from the copy of the

investigative report provided to the Library Board of Trusteesdiscussed during the special

meeting. Once discussion on the topics of the special meeting have concluded, the Library Board

of Trustees will vote on the recommendations of the investigative report. The Library Board of

Trustees may vote impose disciplinary action, up to and including termination of the Library

Director’s employment.

1.7 Notice to Library Director

Before the Library Board of Trustees intends to consider the Library Director’s character, alleged

misconduct, professional competence, or physical or mental health at one its meetings, the Library

Director is entitled to receive personal notice of the time and place of the meeting pursuant to NRS

241.033 (1) (a) and (b). Such notice must be delivered in person at least five working days before

the meeting or sent to the Library Director by certified mail at least 21 working days before the

meeting. The Library Director may waive their right to receive personal notice per the provisions of

NRS 241.033 (1) (a) and (b). If s/he wishes to waive their right to such personal notice, they must

sign the Waiver of Right to Receive Personal Notice Under NRS.241.033 form prescribed by Human

Resources in council with the District Attorney’s Office.

1.8 Archiving

The Human Resources Director will maintain confidentiality of all materials related to the

investigation and will store the materials separately from the employee’s personnel file.

The Library Board of Trustees in conjunction with the Human Resources Director and District

Attorney’s Office will review this policy every 4 years or sooner as necessary.
