Thelaw1 Whatisthelawonnewmachinery?Therearetwogroupsof law: Onedealswithwhatmanufacturersandsuppliersofnewmachineryhaveto
do.Thiscanbecalledthesupplylaw.The lawthatyouwillcomeacrossmostoftenistheSupplyofMachinery(Safety)Regulations1998(asamended)-amendedin2002bytheHealthandSafety(MiscellaneousAmendments)Regulations2002- whichrequiremanufacturersandsupplierstoensurethatmachineryissafewhensuppliedandtohaveCEmarking.Seequestion11forotherrelevantsupplyregulationsandleafletsonsupplyingnewmachinery.(Note:wheretheword'safe' isused,itshouldberegardedasincludingriskstobothsafetyandhealth.)
Theotherdealswithwhattheusersofmachineryandotherequipmenthavetodo.Thiscanbecalledtheuserlaw.TheonewhichappliesmostwidelyisknownastheProvisionandUseofWorkEquipmentRegulations1998.Theserequireemployersto:- providetherightkindofsafeequipmentforuseatwork;- ensurethatitcanbeusedcorrectly;and- keep itmaintained inasafecondition.
Ifyoubuynewequipment(includingmachinery)thislawalsorequiresyou,asauser,tocheckthattheequipmentcomplieswithallthesupplylawthatisrelevant.Theuserlawhasotherrequirements,butthisleafletdoesnotdealwiththem.

2 Whydowehavetheselaws?Tomakesurethatworkequipment issafewhenfirstsupplied,andthatitisthenusedcorrectlyandsafely,sothattheriskofaccidentsorillhealthoccurringasaresult
of
using
the
work
equipment
is
reduced.
Theselawsreplacedandupdatedolderlawsthathadsimilarrequirements.However,theydidnotreallychangewhatyouhavetodo.3 Whatismeantby'machinery'?Amachineisnormallyregardedasbeingapieceofequipmentwhichhasmovingpartsand,usually,somekindofdriveunit.Examplesinclude: fork-lifttruck; metalworkingdrill; papermakingmachine; circularsaw; combineharvester; liftingequipment(andevenliftingtackle); escalator; meatmincingmachine; balingmachine.Sometypesofmachineryarenotcoveredbythesupplylaw- thereisalistunderExclusionstowardstheendofthisleaflet.
PracticalmattersYoumayalreadyknowthatmostnewmachineryshouldhaveCEmarkingwhenyoubuyit.However,CEmarkingisonlyaclaimbythemanufacturerthatthemachineryissafeandthattheyhavemetrelevantsupply law.You,theuser,alsohavetocheckthatitis,infact,safe.Tounderstandwhatthismeanswhenyouarebuyingnewmachinery,ithelpsifyouunderstandwhatthemanufacturer(orsupplier)hastodo.4 Whatdoesthemanufacturerhavetodo?Manufacturersmustmakesurethatthemachinestheymakearesafe.Theywilldothisby: findingoutaboutthehealthandsafetyhazards(trapping,noise,crushing,
electricalshock,dust,vibrationetc)thatare likelytobepresentwhenthemachineisused;
assessingthelikelyrisks; designingoutthehazardsthatresultinrisks;or,ifthatisnotpossible, providingsafeguards(egguardingdangerouspartsofthemachine,providing
noiseenclosuresfornoisyparts);or,ifthatisnotpossible, usingwarningsignsonthemachinetowarnofhazardsthatcannotbe
designedoutorsafeguarded(eg'noisymachine'signs).Manufacturersmustalso: keepinformation,explainingwhattheyhavedoneandwhy, inatechnicalfile;

buyer,

instructions
to
explain
how
to
install,
use
and
maintainthemachinerysafely.
IsCEmarkingaguaranteeofsafety?No.themanufacturerisclaimingthatthemachinerycomplieswiththelaw.Youstillneedtocheckthemachineissafebeforeitisused.6 WhatdoIneedtodowhenbuyinganewmachine?Beforeyoubuyit,thinkabout: whereandhowitwillbeused; whatitwillbeusedfor; whowilluseit(skilledemployees,trainees); whatriskstohealthandsafetymightresult; comparinghowwellhealthandsafetyrisksarecontrolledbydifferent
manufacturers.Thiscanhelpyoutodecidewhichmachinemaybesuitable,particularly ifyouarebuyingastandardmachine'offtheshelf'.Ifyouarebuyingamorecomplexorcustom-builtmachineyoushoulddiscussyourrequirementswithpotentialsuppliers.Theycanoftenadviseyouontheoptionsavailable.Foracustom-builtmachine,youcanusetheopportunitytoworkwiththesuppliertodesignoutthecausesofinjuryandillhealth.SomeoftheitemsyoucancoverareinChecklistA,whichfollowsquestion10.Timespentnowonagreeingthenecessarysafeguards,tocontrolhealthandsafetyrisks,couldsaveyoutimeandmoneylater.Note:Sometimesmachineryissuppliedviaanotherorganisation,egan importer,ratherthandirectfromthemanufacturer,sothisorganisationisreferredtoasthesupplier.Whenyouplacetheorder,specifyinwritingthatthemachineshouldbesafe.Whenyouhaveboughtit,lookforCEmarking,checkthatyouhaveacopyoftheDeclarationofConformityandasetofinstructionsinEnglishonhowthemachineshouldbeused,andmost importantofall,checktoseeifyouthinkthatitissafe.7 HowcanIcheckthemachine?Firstmakesurethatthesupplier(orinstaller)hasgivenyouinformationonhowthemachineworksanditssafetyfeatures.Withsmalleroff-the-shelfmachinery,thisshouldbe includedwiththemachine.Withcomplexorcustom-builtmachinesthismaybedemonstratedbythesupplier.Thenhaveacloselookat it.Manythingsthataffectsafetyareobvious;otherscanbedetectedusingcommonsenseandtakingtimetohaveagoodlookatyournewmachine.Youcanalwayscompareitwithanyexistingsimilarmachinesyouhave,tosee ifitisatleastasgood,or(hopefully)better.Buyingnewmachinery 3of9pages

DeclarationofConformity ifyouhavenotbeengivenone. Checkthatthesupplierhasexplainedwhatthemachineryisdesignedtobe
usedforandwhatitcannotbeusedfor(unlessthisisoff-the-shelfmachinery). Makesureamanualhasbeensuppliedwhichincludesinstructionsforsafe
use,assembly,installation,commissioning,safehandling,adjustmentandmaintenance.
MakesuretheinstructionmanualiswritteninEnglish.(Themaintenanceinstructionsmay,however,bewritteninanotherlanguageifspecialisedstafffromthemanufacturerorsupplierwillcarryoutmaintenance.)
Makesureinformationhasbeenprovidedaboutanyremainingrisksfromthemachine,andtheprecautionsyouneedtotaketodealwiththem.Thesemayincludeelectrical,hydraulic,pneumatic,storedenergy,thermal,radiationorhealthhazards.
Checkthatdataaboutnoiseandvibrationlevelshavebeenprovidedand,wherenecessary,explainedtoyou.
Ensurethatanywarningsignsarevisibleandeasytounderstand. Foracomplexorcustom-builtmachinearrangeforatrialrunsoyoucanbe
shownthesafetyfeaturesandhowtheywork. Checktoseeifyouthinkthemachineissafe. Makesureanyearlyconcernsaboutthesafetyofthemachinearereportedto
thesupplier.RememberNeverassumethatmachineryissafejustbecauseithasCEmarking.

13 WhatisaDeclarationofIncorporation?Ifthemachineisintendedfor: incorporationintoanothermachine;or assemblywithothermachines;themanufacturercanissueaDeclarationofIncorporation.InthiscasethemachineshouldnothaveCEmarking.14 DoimportersandsuppliershavetofollowalltheserequirementsevenifthemachineryismadeoutsideEurope?AllsuppliershavetomakesurethemachinerytheysupplyintheEuropeanEconomicArea(EEA)issafenomatterwhereit ismade.TheEEAincludestheEuropeanUnionmembercountriesandalsoIceland,NorwayandLiechtenstein,butexcludesSwitzerlandeventhoughthatcountryisimplementingtheEuropeanDirective.Theyalsoneedtocheckthat: themanufacturerhascarriedoutallthestepsinvolvedinmakingsurethe

16 Whataboutbuyingsecond-handmachinery?Ithastobesafeforuse.InmostcasesitwillnothaveCEmarking,butitisstillthedutyofthesuppliertomakesurethatitissafeandhasinstructionsforsafeuse.There
is
also
the
duty
on
you
(the
user)
to
make
sure
that
second-hand
machinery
is: safe; suitablefortheworkitistodo; maintainedinasafecondition.Ifasecond-handmachinehasbeentotallyrefurbished(forexample,addingCNCcontroltoamachine,togetherwithotherwork)itmayhaveCEmarking.Thisisbecausethewayitoperatesisdifferentaftertherefurbishmentandasaresultithasbeentreatedasifitwasanewmachine.17 Whataboutmachinerywhichisgoingtobepartofanassemblyline?Ifamachine isdesignedtobeincorporatedintoothermachinery,itmightnothaveCEmarkingfixedtoit.ItshouldbemanufacturedtobeassafeaspossibleandbeprovidedwithaDeclarationofIncorporation.Instructionsonsafeinstallationanduseshouldalsobeprovided.Whenthemachineisfittedintotheassembly line,particularattentionmustbegiventoanyhazardswhichmayhavebeencausedbythemachinebeingfittedintotheline.Forinstance,additionalguardingorothercontrolsmayberequired.Oncethemachinehasbeenfittedandthewholelineissafe,thetechnicalfileshouldbecompletedandeitherthemachineorthewholelineshouldhaveCEmarking.Thiscanbedonebyaprojectmanager(egtheinstaller,assemblerorthemanufacturer)butinmanycasesyoucandoit,particularlyifyouoperateasmallcompany.
DoIalwayshavetobuythemanufacturer'ssafeguards?Normallyit isbettertobuythemachinewithallthemanufacturer'ssafeguardsincluded.However, insomespecialcircumstances,forexamplewhereparticulartoolsetcaregoingtobe incorporatedoranexistingnoiseenclosureisgoingtobere-used,therecanbeaspecificwrittenagreementrelatingtotheprovisionoftheseparticularitems,betweenyou,thebuyer,andthesupplier.Butyoumustsigntoacceptthisresponsibilityandineffectbecomeinvolved inthefinalpartofthemanufacturingprocess.TheCEmarkingshouldbeaddedtothemachinebythemanufacturerorbyyou,theuser,aftertheothersafeguards,etchavebeenfitted.
ExclusionsThesupplylawdoesnotapplytothefollowingmachinery: ThoseintendedforuseoutsidetheEEA. Second-hand(whennotrefurbished). Manually-poweredmachineryexceptmachineryusedforliftingorlowering
