COVER AND LIMITS

SECTIONS OF COVER You can choose to have either Buildings and/or Contents sections (Legal Expenses section is automatically included). Personal Possessions section can be added if you have Contents cover. Sums insured under the Contents section are not index linked.

NO CLAIMS DISCOUNT If you do not make any claims we will allow a discount from the renewal premium. Separate discounts apply to the Buildings and Contents sections (Personal Possessions claims affect the Contents discount). Legal Expenses claims will not affect the discount.

EXCESS You will generally be responsible for the first amount of any claim and this is known as an excess. The amounts of excess are specified either in the schedule, policy wording or in any endorsements. The amount of any voluntary excess will be in addition to any policy excess that applies but does not apply to any extensions to the sections.

YOUR RIGHT TO CANCEL If after receiving the full written documentation (either in paper or electronic format), you change your mind and no longer require the cover then you have 14 days (cooling-off period) from the date you received the full documentation (or the date the cover commenced if later) to tell us writing inthat you wish to cancel the policy. In such circumstances we will make a full refund of premium. If you cancel your cover outside this period, there will be a premium charge but no return of premium will be made if there has been a claim.

SECURITY You have given us certain informat n about security at the home. You must always put this security into effect whenever the home is left iounattended by a responsible adult. If you improve security with an alarm system acceptable to us it may be possible to allow a premium discount. If you do not use the security devices and a theft claim occurs there may be no cover or an increased excess may apply.

MOTORISED WHEELCHAIRS / INVALID CARRIAGES We include cover for Class 1 and 2 wheelchairs / invalid carriages while they are in the home and temporari away from the home, provided lythey are unable to travel at more than 4 miles per hour and are not required to be registered with the DVLA. We do not cover Class 3 wheelchairs / invalid car s, i.e. those which are able to travel at more than 4 miles per hour and are required to be riageregistered with the DVLA for use on public roads.

GENERAL INFORMATION CHILDMINDING ACTIVITIES We do not cover any childminding activity that you undertake as a business within the homes of third parties nor at premises other than your home.

CONDITION AND PROTECTION OF THE BUILDINGS • the buildings no longer being in a good state of repair • the home is protected by a lower level of security than originall d y declare• a change to the alarm system if you receive an alarm discount.

CHANGE OF ADDRESS / INFORMATION You must tell us abo t any change to information you previously declared to us. BUILDING IMPROVEMENTS OR EXTENSIONS It is possible that you may have building improvements or additions made after you take out this insurance. Generally speaking the contracto rwill have suitable insurance in place for this work but there may be occasions when work is carried out under certain JCT contract wordings. There is no cover under this policy for such work but we may, for additional premium, be able to extend our policy by endorsement to provide cover in joint names and, if required, for the building work itself but only where it is carried out under a JCT contract and provided the contract price does not exceed £100,000. You will need to provide additional information to us for such cover but we cannot guarantee that we will accept the risk.

You must tell us immediately you become aware of any f the following situations occurring, or that you know will occur, during the current operiod of insurance or after the policy’s renewal with us. If you fail to do this your cover may be invalid or adversely affected and claims may not be paid or not be paid in full.

UNSPECIFIED PERSONAL POSSESSIONS Articles designed to be personally worn, used or carried about the person may include such items as driving licences or passports, sports equipment, media players and recorders (e.g. ipods, MP3 players), cameras, mobile phones or laptop computers.

TENANTS FIXTURES AND FITTINGS Permanently fitted furniture and equipment is normally covered as part of the fixtures and fittings of the buildings. However, if you are a tenant and you have added some fixtures and fittings and you remain responsible for them then cover is provided under the TENANTS PROPERTY AND LIABILITY extension of section 2 (Contents).

STORM A storm is extremely windy conditions, generally accompanied by heavy rain, snow or hail. The decision as to if weather conditions at the time of any damage represented a storm would take into account the prevailing wind strength as measured on the Beaufort scale. Rainfall, snow or hail without the extreme wind conditions may not be considered to be a storm.

PROOF OF VALUE AND OWNERSHIP It is strongly recommended that, whenever possible, you retain all receipts, valuations instruction booklets and guarantee cards for the family’s property and take photographs of any valuable items. This will help in proving, assessing and settlement of any claim that might arise.

FLOOR COVERINGS / CARPETS We deem floor coverings, including carpets, to be part of the fixtures and fittings of the buildings when they are actually stuck / glued to the floor. If they are not stuck / glued then they are deemed to be part of the contents.

EXTENT OF COVER Please be aware that we do not provide the same level of cover for all your property. Restrictions do apply in certain areas, e.g. garages and outbuildings, and we would ask you to read carefully through the Summary of Cover (Key Facts) and the policy wording in order to get a full picture of the cover given and where it is restricted.

• The insured person must inform DAS as soon as possible and within the time limits stipulated under the terms of the policy, giving full details in writing of the insured incident and providing such proofs, supporting evidence and other information as DAS may require.

• DAS will ask you about your legal dispute and if necessary call you back at an agreed time to give you legal advice. • If your dispute needs to be dealt with as a claim under this policy, DAS will give you a claim reference number. At this point DAS will not be able to confirm that

you are covered but will pass the information you have given to the relevant DAS claims handling team and explain what to do next. • Claims are usually handled by a representative appointed by DAS, but sometimes DAS deal with them themselves. Claims outside the United Kingdom may

be dealt with by other DAS offices elsewhere in Europe • Please do not ask for help from a solicitor or accountant before DAS have agreed. If you do, we will not pay the costs involved.

BUILDINGS, CONTENTS AND PERSONAL POSSESSIONS

• For any claims that require urgent attention such as severe storm, fire or flood, you must take all reasonable steps to prevent any further damage. • If the damage is serious, we may decide to appoint an independent loss adjuster or investigator to deal with your claim, therefore you must contact our claims

department immediately for further assistance. • For claims that do not require urgent attention such as minor property damage, you must take all reasonable steps to prevent any further damage. • If possible, obtain competitive estimates for the repair and, if requested by us, submit with a completed claim form for our approval.

Please send any requested claim form to us immediately should there be any delay in obtaining estimates.

• Once we have agreed an estimate, you can get the work done and send the final account to us for reimbursement (subject to any policy terms). • A full specification of the damaged property is required together with substantiation, e.g. original purchase receipt, photographs of the article or payment

receipts etc. Forward the requested information, with a completed claim form where requested, for our approval. • Whenever appropriate we aim to provide replacements and we may use our preferred supplier. • When necessary, you should arrange for emergency repairs to be carried our to prevent further damage.

LIABILITY (CLAIM BEING MADE AGAINST YOU)

MONEY AND CREDIT CARDS

SALVAGE

• All savage must be protected and retained for our inspection, unless we or the loss adjuster have instructed you to the contrary. THEFT, LOSS AND MALICIOUS DAMAGE

KEYS LOST OR STOLEN We will pay the reasonable cost of replacing and installing external door locks of the home where the keys of such locks have been lost or stolen. You can claim under either section 1(Buildings) or 2(Contents), whichever is operative, but not both for the same loss.

5 WHAT IS NOT COVERED

Keys and locks of any outbuildings.

The most we will pay is £500 for any claim 6 SALE OF THE HOME

When you have contracted to sell the home the buyer will have the benefit of cover under section 1 (Buildings) until completion of the sale.

7 PROPERTY OWNERS LIABILITY a) We will pay all amounts which you become legally liable to pay as owner (not as occupier) of the buildings and s land it for damages and costs and expenses if accidental: i) bodily injury to any person, r o ii) damage to material property occurs during the period of insurance.

1. Liability arising from:a) bodily injury of a member of the family or any person employed by a member of the family b) damage to property belonging to or under the control of a member o the family or any person employed by a member of f the family c) an agreement unless liability would have existed without the agreement d) any business, profession or occupation other than where you re a responsible as owner of the buildings for business activities e) a claim under the Defective Premises Act which is insured by a more recent or current policy f) costs of remedying any fault or alleged fault i any private n residence you previously owned or occupied g) the ownership or use of any lift or motor vehicle. 2. Liability for: a) fines, pen lties or punitive, exemplary, aggravated or multiplied a damages b) liquidated damages. 3. Liability covered by any other insurance.

b) Cover under a) above also extends to the: i) buildings of any home you used to live in ii) buildings for 7 years after the date of cancellation f o section 1 of this policy due to sale of the buildings but only in respect of your legal liability under Section 3 of the Defective Premises Act 1972 or Section 5 of the Defective Premises Act (Northern Ireland) Order 1975.

INDEMNITY LIMIT The most we will pay for any claim (or series of claims arising from any one event, source or cause), including all costs nd aexpenses, is the Property Owners Liability indemnity limit shown in the schedule.

SPECIAL NOTES (not forming part of the policy): 1. If you own and occupy the buildings:

liability for bodily injury or damage generally attaches to the occupier rather than the owner.

2. If you are the owner and occupier: insurance against your liability as occupier is not covered under this extension. You should ensure that you have contents insurance which provides the occupiers liability cover you need. We can provide this under Section 2 of the policy.

20 Claims settlement for Section 1 Buildings DAMAGE We can choose to settle any claim for damage by either: • paying for the full cost of repairing, replacing or reinstating the buildings, or • by making a cash payment.

COSTS AND FEES Subject to the LIMITS below, claims settlement for damage will include payment for the following costs and fees: • the cost of clearing the site and making it safe • architects', surveyors' and other professional fees necessary to reinstate the buildings • the additional costs of rebuilding or repairing the damaged parts of the buildings solely to comply with any governm nt or local authority e requirements, but not for costs relating to requirements that have been advised to you before the damage occurred. We will not pay for any fees or costs incurred by you to prepare your claim.

EXCESS The amount of any applicable excess will be deducted from any claim payment.

LIMITS 1) The most we will pay in respect of any claim for damage ncluding COSTS AND FEES above) is the: (i • specific limit shown in any definition, event, extension, or • sum insured shown in the schedule plus an amount for index linking where the sum insured is exceeded solely because of index linking. 2) The most we will pay in respect of any claim for liability is the indemnity limit shown in the schedule for PROPERTY OWNERS LIABILITY.

INDEX LINKING We will continue to apply our automatic inflation provision (to reflect general changes in rebuilding costs and inflation trends) during rebuilding or repair work providing there is no unnecessary delay.

WEAR AND TEAR In any settlement for damage, a deduction for wear and tear and betterment will be made if: • the sum insured on the buildings (including an amount for clearance costs and architects’ and surveyors’ fees) at the time of the damage is less than the full cost of rebuilding to the same specif cation i• the buildings are in a poor state of repair or decoration.

REDUCTION IN MARKET VALUE • If the repair or reinstatement of damage is not carried out we will pay the resultant reduc on in the market value of the home but not ti exceeding what it would have cost to repair or reinstate had such work been carried out. • We will not pay for any reduction in market value of the home after damage has been repaired, replaced or reinstated.

MATCHING PROPERTY We will not pay for the cost of replacing any undamaged property which forms part of a set (other than a pair) or suite or any other property of a uniform nature, colour or design, in ding carpets, when damage happens to a specific part or within a clearly identifiable area and clureplacements cannot be matched.

AUTOMATIC REINSTATEMENT OF THE SUM INSURED The sum insured shown in the schedule will not be reduced by a claim payment.

Keys and locks of any outbuildings.

KEYS LOST OR STOLEN We will pay the reasonable cost of replacing and installing external door locks of the home where the keys of such locks have been lost or stolen. You can claim under either section 1(Buildings) or 2(Contents), whichever is operative, but not both for the same loss.

GLASS, MIRRORS AND CERAMIC HOBS We will pay for accidental breakage of fixed glass in furniture, glass tops to furniture, mirrors and ceramic hobs or tops in free- standing cookers while in the home.

FATAL INJURY If you or your spouse, or partner, living with you dies within 3 months of, and as a direct result of, injury caused in the h me oby fire or thieves we will pay £5,000 to the legal ersonal prepresentatives of you, your spouse or partner.

TENANT’S PROPERTY AND LIABILITY If you are the tenant of the home, we will pay for damage caused by any operative event 1 to 10 of section 1 (Buildings) to any: a) fixtures and fittings, decorations, greenhouses or heds you s have installed at the home and for which you are responsible b) part of the buildings that you are gally responsible for as le tenant under a tenancy agreement provided section 1 Buildings is inoperative.

SPECIAL OCCASION INCREASE The sum insured on contents is aut matically increased by o£5,000 for 30 s before and after: daya) Christmas b) the wedding day of a member of the family.

If we allege that by reason of this limitation any liability for damages and costs an dexpenses is covered only up to a specified limit of liability, the burden of proving to the contrary shall be upon you.

AUTOMATIC REINSTATEMENT OF THE SUM INSURED The sum insured shown in the schedule will not be reduced by a claim payment.

COLLECTIONS • where there is a nationally recognised catalogue available for any collectable, we shall not pay more than 50% of the current list value within that catalogue for any item within a collection • where there is no nationally recognised catalogue we will not pay more than 50% of a valuation from a full time professional dealer in such collectables within the United Kingdom (or any other valuation acceptable to us) for any item within a collection. All subject otherwise to the limits stated for collections.

MATCHING SETS We will not pay for the cost of replacing any undamaged items which form part of a set (other than a pair) or suite or any other item of a uniform nature, colour or design, in ding carpets, when damage happens to a specific part or within a clearly identifiable area and clureplacements cannot be matched.

WEAR AND TEAR A deduction for wear and tear and betterment will be made: • in respect of clothing and household linen • if the sum insured shown in the schedule at the time of the damage is less than the full cost of replacement as new (after allowing for wear and tear on clothing and household linen).

INDEX LINKING The sums insured under this section are not index linked.

LIMITS 1. The most we will pay in respect of any claim for damage: • to valuables is £3,000 for any item and in total the limit shown in the schedule • to contents in garages and outbuildings of the home is 10% of the sum in ured shown in the schedule s • by theft of contents from gara es and outbuildings of the home is £2,500 g • to garden contents is £1,000 • is the specific limit shown in any definition, event r extension, o • overall is the sum insured shown in the schedule. 2. The most we will pay in respect of any claim for liability is the indemnity limit shown in the: • schedule for OCCUPIERS, PERSONAL AND BUSINESS LIABILITY and LIABILITY TO DOMESTIC EMPLOYEES • specific extensions for TENANT’S LIABILITY and UNRECOVERED COURT AWARDS.

EXCESS The amount of any applicable excess will be deducted from any claim payment.

CLEARANCE COSTS Subject to t e LIMITS below, settlement will include payment for the cost of clearing any debris of the damaged property insured following a hvalid claim.

Claims settlement for Section 2 Contents DAMAGE We can choose to settle any claim for damage by either: • paying for the full cost of repairing or by replacing the property insured as new, or • by making a cash payment. Where we elect to replace damaged property we may use one of our preferred suppliers.

You are required to: keep any item of jewellery with a sum insured or value of £3,000 or more in a locked safe while within the home when it is not being worn or handled by you, except while such item is in the custody or control of a professional jeweller.

Damage caused by or resulting from: a) fraud, deception (unless used solely to gain entry to the home) or alse payment b) domestic pets c) faulty wo manship, defective design or the use of defective rk materials d) theft: i) from any unattended motor vehicle unless the property is concealed in a glove compartment, locked luggage compartment or boot and all window and sunroofs are s securely closed and all doors cked lo ii) from any unlocked hotel room iii) of pedal cycle tyres and accessories unless the pedal cycle is stolen at the same time e) racing, pacemaking or trials f) any deliberate, malicious or wilful act by a member of the family or by any person lawfully in the home. 5. Damage if you fail to comply with Special Requirement 1 or 3 for this section and such failure caused or worsened the damage.

WHAT IS NOT COVEREDWHAT IS COVERED We will pay for damage to: a) unspecified personal possessions b) any other specified property that belongs to, or is the legal responsibility of, a member of the family and is listed in the P rsonal Possessions Specification on the eschedule, when anywhere: i) within the territorial limits, or ii) temporarily outside the territorial limits for a period not exceeding 60 days while in the custody or control of a member of the family.

LIMITS The most we will pay for any claim: • in respect of any item specified in the PERSONAL POSSESSIONS SPECIFICATION, is the sum insured against that item, and the tota l sum insured for all items, shown in the schedule plus index linking increases from the renewal date immediately prior to the date of the damage • that arises as a result of theft from any unattended motor vehicle is £1,000 • for unspecified property with a family member who is attending university or college is £1,000.

EXCESS The amount of any applicable excess will be deducted from any claim payment.

29 Section 4 Legal Expenses

SPECIAL NOTES The cover under this section has been arranged by us in conjunction with DAS Legal Expenses Insurance Company Limited (DAS). DAS is authorised and regulated by the Financial Services Authority (Register number 202106) and is a member of the Association of British Insurers. We are responsible for paying any claims under this policy but DAS manage all claims matters and correspondence on our behalf.

MAKING A CLAIM

Separate guidance notes are included in this document. Please see the index for the page number.

WHAT IS COVERED WHAT IS NOT COVERED

We agree to provide the insurance described in this section, in return for payment of the premium and subject to the terms, conditions, exclusions and limitations set out in this policy, provided that: a) reasonable prospects exist for the duration of the claim b) the date of occurrence of the insured incident is during the period of

insurance c) any legal proceedings are dealt with by a court, or other body which DAS agree

to, in the territorial limits and d) the insured incident happens within the territorial limits We will pay an appointed representative, on your behalf, cost and expenses incurred following an insured incident, provided that: a) the most we will pay for all claims resulting from one or more event arising at the

same time or from the same originating cause is £50,000 b) the most we will pay in costs and expenses is no more than the amount we

would have paid to a preferred law firm c) in respect of an appeal or the defence of an appeal, you must tell DAS within

the time limits allowed that you want to appeal. Before we pay the cost and expenses for appeals, DAS must agree that reasonable prospects exist

d) for an enforcement of judgement to recover money and interest due to you after a successful claim under this section, DAS must agree that reasonable prospects exist, and

e) where an award of damages is the only legal remedy to a dispute and the cost of pursuing legal action is likely to be more than any award of damages, the most we will pay in cost and expenses is the value of the likely award.

1. The first £250 of any claim for legal nuisance or trespass. You must pay this as soon as DAS accept the claim.

2. A claim where you have failed to notify DAS of the insured incident within a reasonable time of it happening and where this failure adversely affects the reasonable prospects of a claim or DAS consider their position has been prejudiced.

3. Costs and expenses incurred before DAS provide written acceptance of a claim.

4. Fines, penalties, compensation or damages that a court or other authority orders you to pay.

5. Any legal action you take that DAS or the appointed representative have not agreed to, or where you do anything that hinders DAS or the appointed representative.

6. Any claim where you may be one of a number of people involved in a legal action resulting from one or more events arising at the same time or from the same cause which could result in the court making a Group Litigation Order.

7. Any claim relating to written or verbal remarks that damage your reputation. 8. A dispute with DAS not otherwise dealt with under policy condition 7. 9. Cost and expenses arising from or relating to judicial review, coroner’s inquest

or fatal accident inquiry. 10. In the event of a claim, if you decide not to use the services of a preferred law

firm, you will be responsible for any costs that fall outside the DAS Standard Terms of Appointment and these will not be paid by us.

INSURED INCIDENTS: The following are not covered in respect of the insured incident against which they appear:

1 EMPLOYMENT DISPUTES A dispute relating to your contract of employment or future employment

1. A claim relating to the following: a) disciplinary hearings or internal grievance procedures b) any claim relating solely to personal injury c) a compromise agreement while you are still employed.

2 CONTRACT DISPUTES A dispute arising from an agreement which you have entered into in a personal capacity for: a) buying or hiring goods or services b) selling goods SPECIAL NOTE: 1. you must have entered into the agreement or alleged agreement during

the period of insurance, and 2. the amount in dispute must be more than £100.

1. A claim relating to the following: a) construction work on any land, or designing, converting or extending any

building where the contract value exceeds £5,000 (including VAT) b) the settlement payable under an insurance policy (DAS will cover a dispute if

your insurer refuses your claim, but not for a dispute over the amount of the claim)

c) a dispute arising from any loan, mortgage pension, investment or borrowing. d) a dispute over the sale, purchase terms of lease, license, or tenancy of land or

buildings. However, DAS will cover a dispute with a professional advisor in connection with these matters.

PERSONAL INJURY A specific or sudden accident that causes your death or bodily injury to you. CLINICAL NEGLIGENCE An identified negligent act of surgery or identified negligent clinical or medical procedure, which causes death or bodily injury to you.

29 Section 4 Legal Expenses

WHAT IS COVERED WHAT IS NOT COVERED

We agree to provide the insurance described in this section, in return for payment of the premium and subject to the terms, conditions, exclusions and limitations set out in this policy, provided that: a) reasonable prospects exist for the duration of the claim b) the date of occurrence of the insured incident is during the period of

insurance c) any legal proceedings are dealt with by a court, or other body which DAS agree

to, in the territorial limits and d) the insured incident happens within the territorial limits We will pay an appointed representative, on your behalf, cost and expenses incurred following an insured incident, provided that: a) the most we will pay for all claims resulting from one or more event arising at the

same time or from the same originating cause is £50,000 b) the most we will pay in costs and expenses is no more than the amount we

would have paid to a preferred law firm c) in respect of an appeal or the defence of an appeal, you must tell DAS within

the time limits allowed that you want to appeal. Before we pay the cost and expenses for appeals, DAS must agree that reasonable prospects exist

d) for an enforcement of judgement to recover money and interest due to you after a successful claim under this section, DAS must agree that reasonable prospects exist, and

e) where an award of damages is the only legal remedy to a dispute and the cost of pursuing legal action is likely to be more than any award of damages, the most we will pay in cost and expenses is the value of the likely award.

1. The first £250 of any claim for legal nuisance or trespass. You must pay this as soon as DAS accept the claim.

2. A claim where you have failed to notify DAS of the insured incident within a reasonable time of it happening and where this failure adversely affects the reasonable prospects of a claim or DAS consider their position has been prejudiced.

3. Costs and expenses incurred before DAS provide written acceptance of a claim.

4. Fines, penalties, compensation or damages that a court or other authority orders you to pay.

5. Any legal action you take that DAS or the appointed representative have not agreed to, or where you do anything that hinders DAS or the appointed representative.

6. Any claim where you may be one of a number of people involved in a legal action resulting from one or more events arising at the same time or from the same cause which could result in the court making a Group Litigation Order.

7. Any claim relating to written or verbal remarks that damage your reputation. 8. A dispute with DAS not otherwise dealt with under policy condition 7. 9. Cost and expenses arising from or relating to judicial review, coroner’s inquest

or fatal accident inquiry. 10. In the event of a claim, if you decide not to use the services of a preferred law

firm, you will be responsible for any costs that fall outside the DAS Standard Terms of Appointment and these will not be paid by us.

INSURED INCIDENTS: The following are not covered in respect of the insured incident against which they appear:

1 EMPLOYMENT DISPUTES A dispute relating to your contract of employment or future employment

1. A claim relating to the following: a) disciplinary hearings or internal grievance procedures b) any claim relating solely to personal injury c) a compromise agreement while you are still employed.

2 CONTRACT DISPUTES A dispute arising from an agreement which you have entered into in a personal capacity for: a) buying or hiring goods or services b) selling goods SPECIAL NOTE: 1. you must have entered into the agreement or alleged agreement during

the period of insurance, and 2. the amount in dispute must be more than £100.

1. A claim relating to the following: a) construction work on any land, or designing, converting or extending any

building where the contract value exceeds £5,000 (including VAT) b) the settlement payable under an insurance policy (DAS will cover a dispute if

your insurer refuses your claim, but not for a dispute over the amount of the claim)

c) a dispute arising from any loan, mortgage pension, investment or borrowing. d) a dispute over the sale, purchase terms of lease, license, or tenancy of land or

buildings. However, DAS will cover a dispute with a professional advisor in connection with these matters.

1. Any claim if you are self employed, or a sole trader, or in a business partnership 2. An investigation or enquiries by HM Revenue & Customs Special Investigations

Section or Special Civil Investigations or the HM Revenue & Customs Prosecution Office.

7 JURY SERVICE AND COURT ATTENDANCE

Your absence from work: a) to attend any court or tribunal at the request of the appointed

representative b) to perform jury service The maximum we will pay is your net salary or wages for the times that you are absent from work less any amount the court give you.

1. Any claim if you are unable to prove your loss.

8 LEGAL DEFENCE Cost and expenses to defend your legal rights: a) If an event arising from your work as an employee leads to

i) you being prosecuted in a court of criminal jurisdiction ii) civil action being taken against you under:

• discrimination legislation • section 13 of the Data Protection Act 1998

b) if an event leads to you being prosecuted for an offence connected with

the use or driving of a motor vehicle.

1. A claim relating to the following: a) parking or obstruction offences. b) you driving a motor vehicle that you do not have valid motor insurance for.

LIMITS Unless otherwise stated, the most we will pay for any claims under this section, including costs and expenses, resulting from one or more events arising at the same time or from the same originating cause is the indemnity limit shown in the policy schedule. EXCESS

31 Special Conditions for Section 4 Legal Expenses 1 a) On receiving a claim, if legal representation is necessary, DAS will appoint a preferred law firm or in-house lawyer as your appointed representative to deal

with your claim. They will try to settle your claim by negotiation without having to go to court. b) If the appointed preferred law firm or DAS in-house lawyer cannot negotiate settlement of your claim and it is necessary to go to court and legal proceedings

are issued or there is a conflict of interest, then you may choose a law firm to act as the appointed representative. c) If you choose a law firm as your appointed representative who is not a preferred law firm, DAS will give your choice of law firm the opportunity to act on the

same terms as a preferred law firm. However if they refuse to act on this basis, the most we will pay is the amount we would have paid if they had agreed to the DAS Standard Terms of Appointment.

d) The appointed representative must co-operate with DAS at all times and must keep DAS up to date with the progress of the claim.

2 a) You must co-operate fully with DAS and the appointed representative. b) You must give the appointed representative any instruction that DAS ask you to.

3 a) You must tell DAS if anyone offers to settle a claim. You must not negotiate or agree to a settlement without DAS’s written consent. b) If you do not accept a reasonable offer to settle a claim, DAS may refuse to pay further legal costs. c) We may decide to pay you the reasonable value of your claim, instead of starting or continuing legal action. In these circumstances you must allow DAS to take

over and pursue or settle any claim in your name. You must also allow DAS to pursue at our own expense and for our own benefit, any claim for compensation against any other person and you must give DAS all the information and help they need to do so.

d) Where a settlement is made on a without-costs basis DAS will decide what proportion of that settlement will be regarded as cost and expenses and payable to DAS.

4 a) You must instruct the appointed representative to have legal costs taxed, assessed or audited if DAS ask for this. b) You must take every step to recover cost and expenses and court attendance and jury service expenses that we have to pay and must pay us any amounts that

are recovered.

5 If the appointed representative refuses to continue acting for you with good reason, or if you dismiss the appointed representative without good reason, the cover we provide will end immediately, unless DAS agree to appoint another appointed representative.

6 If you settle or withdraw a claim without the agreement of DAS, or do not give suitable instructions to the appointed representative, DAS can withdraw cover and will be entitled to reclaim from you any costs and expenses we have paid.

7 If there is a disagreement between you and DAS about the handling of a claim and it is not resolved through our internal complaints procedure, you can contact the Financial Ombudsman Service for help. For all other types of disputes there is a separate arbitration process. The arbitrator will be a barrister chosen jointly by DAS and you. If there is a disagreement over the choice of arbitrator, DAS will ask the Chartered Institute of Arbitrators to decide. DAS may require you to get, at your expense, an opinion from a barrister or accountant, on the merits of the claim or proceedings, or on a legal principle. If the chosen person's opinion indicates that it is more likely than not that you will recover damages (or obtain any other legal remedy that we have agreed to) or make a successful defence, then we will pay the cost of getting the opinion.

8 You must:

a) keep to the terms and conditions of this policy b) take reasonable steps to avoid and prevent claims c) take reasonable steps to avoid incurring unnecessary costs d) send everything DAS ask for, in writing, and e) report to DAS full and factual details of any claim as soon as possible and give DAS any information DAS need.

We will, at our discretion, void the policy (make it invalid) from its start date or from the date of claim, or alleged claim, or we will not pay the claim if:

a) a claim you have made to obtain benefit under this policy is fraudulent or intentionally exaggerated, or b) a false declaration or statement is made in support of a claim.

Apart from us and DAS, you are the only person who may enforce all or any part of this policy and the rights and interests arising from or connected with it. This means that the Contracts (Rights of Third Parties) Act 1999 does not apply to the policy in relation to any third-party rights or interest.

If any claim covered under this policy is also covered by another policy, or would have been covered if this policy did not exist, we will only pay our share of the claim even if the other insurer refuses the claim.

This policy is governed by the law that applies in the part of the United Kingdom, Channel Islands or Isle of Man where you normally live. Otherwise, the law of England and Wales applies. All Acts of Parliament mentioned in this policy include equivalent laws in Scotland, Northern Ireland, the Isle of Man and the Channel Islands as appropriate.

accidental bodily injury directly or indirectly caused by or contributed to by terrorism involving the use or release or the threat thereo fof any nuclear weapon, device or chemical or biological agent regardless of any contributory cause. If we allege that by reason of this exclusion any accidental bodily injury is not covered by this policy the burden of proving the contrary shall be upon you.

c) In respect of any cover, extension or endorsement under this policy for Personal Accident

liability to third parties or any liability incurred by you for damages, costs and expenses directly or indirectly caused by, resulting from or in any connection with any act of terrorism or any action taken in controlling, preventing, suppressing or in any way relating to any act of terrorism. If we allege that by reason of t s exclusion any liability for damages and costs and expenses is not covered, the burden of hiproving to the contrary shall be upon you.

b) In respect f any cover, extension or endorsement under this policy for liability to third parties (other than to any domestic o employee)

(notwithstanding any provision to the contrary within this insurance and regardless of any con utory cause)tribany damage or expense, directly or indirectly caused by, resulting from or in connection with: i.contamination or threat of contamination ii.any action taken in control ng, preventing or in any way relating to contamination or the threat of contamination lidue to any act of terrorism. For the purposes of this exclusion “contamination” means the contamination, poisoning or prevention and/or limitation of the use of objects due to the effects of any substance or process. If we allege that by eason of this exclusion any damage or expense is not covered by this policy, the burden of proving to the contrary rshall be upon you.

TERRORISM a) In respect of any cover, extension or endorsement under this policy other than as specifically referred to in b) or c) below

INDIRECT LOSS any indirect loss which results from the incident that caused you to claim except as specifically provided for under this policy.

UNINSURABLE RISKS a) any costs of propert maintenance or normal decoration yb) damage caused by: i.wear and tear or gradually operating cause ii.vermin, insects, parasites, woodworm, fungus, rot or frost iii.the action of light or any atmospheric or climatic conditions (other than storm or flood, if cover is operative under the policy) iv.any process of cleaning, dyeing, altering, repairing, renovating or restoring c) mechanical or electrical fault, breakdown or failure d) property being confiscated or detained by order of any government or any public or police authority.

POLLUTION OR CONTAMINATIONany damage or liability arising from pollution or contamination unless caused by: a) a sudden and unforeseen and identifiable accident b) escape of oil from a domestic oil installation at the home. All pollution which arises out of one incident shall be deemed to have occurred at the time such incident takes place.

REDUCTION IN MARKET VALUE any reduction in value of the property insured following a claim payment.

EXISTING DAMAGE any damage occurring before the cover under this policy started.

COMMUNICABLE DISEASES the transmission of: a) Human Immunodeficiency Virus (HIV) and/or any HIV r lated illness, Acquired Immune Deficiency Syndrome (AIDS) and/or any e mutant derivative or variatio s thereof however caused nb) any communicable disea e sby a member of the family.

SONIC BANGS damage arising directly from pressure waves caused by aircraft and other aerial devices travelling at sonic or supersonic speeds.

WAR RISKS any loss, damage or liability which is the direct or indirect result of any of the following, whether or not contributed to by any other cause or event: war, invasion, activities of a foreign enemy, hostilities or warlike operations (whether war has been declared or not) civil war, mu ny, ti revolution, or insurrection (meaning people rising up and rebelling against the government by force), civil commotion which is so severe or widespread that it resembles a popular uprising, military power (even if properly authorised by the duly elected government), usurped power (meaning power taken by force by any person or group, including the armed forces, which is not the duly elected government) or property being confiscated by any government or public or local authority.

This policy does not cover: RADIOACTIVE CONTAMINATION any claim or expense of any kind caused directly or indirectly by: a. ionising radiation or radioactive contamination from any nuclear fuel or nuclear waste arising from burning nuclear fuel; b. the radioactive, poisonous, explosive or other dangerous properties of any nuclear equipment or part of that equipment.

liability arising directly or indirectly from: a) mining, processing, manufacturing, removing, handling, disposing of, treatment of, distributing or storing of asbestos. However, this shall not apply where removing, handling or disposing of asbestos does not form part of your usual business activities or any contract work undertaken and i.you have complied with any legal obligations to manage asbestos an d ii.any discovery of asbestos by you is unintentional and accidental and iii.where, upon discovery of asbestos, all work immediately stops and iv.a HSE licensed asbestos removal contractor is employed - to make safe the area in which the discovery is made as soon as is practicable and - who has Employers’ and Public Liability insurance in force which provides limits of indemnity no less than those provided by your policies and which do not exclude the work to be carried out b) fears of the consequences of exposure to, or inhalation of asbestos.

damage to any computer or other equipment or component or system or item which processes, stores, transmits, retrieves or receives data or any part thereof whether tangible or intangible (including but without limitation any information or programs or software) and whether your property or not where such damage is directly or indirectly caused by or arising from virus or similar mechanism or hacking or denial of service attack.

Meaning of words specifi to this exclusion: cdenial of service attack any actions or instructions construed or generated with the ability to damage or interfere with or otherwise affect the availability of networks, network services, network connectivity or information systems. Denial of service attack includes but is not limited to the generation of excess traffic into network addresses, th tion of system or network weaknesses and the generation of excess e exploitaor non-g nuine traffic between and amongst networks. ehacking unauthorised access to any computer or other equipme t or component or system or item which processes, stores, transmits, nretrieves or receives data whether your property or not. virus or similar mechanism program code, programming instruction or any set of instructions intentionally constructed with the ability to damage, interfere with or otherwise adversely affect computer programs, data files or operations whether involving self replication or not. Virus or similar mechanism includes but is not limited to Trojan horses, worms and logic bombs.

ELECTRONIC RISKS (applicable only to business activities)12 This exclusion does not apply to any operative cover for Liability to Domestic Employees, Personal Accident or Legal Expenses.

This policy does not cover: DATE RELATED COMPUTER FAILURE any claim, loss, liability or expense caused by or arising from, directly or indirectly or in any way relating to, the failure of any computer, data pr cessing equipment or media, microchip, integrated circuit or similar device or any computer software, whether your property or onot, to: a) correctly recognise any date as its true calendar date b) capture, save or retain, and/or correctly to manipulate, interpret or rocess any data or information or command or instruction as a p result of treating any date otherwise than as its true calendar date c) capture, save, retain or correctly to process any data as a result of the operation of any command which has been programmed into any computer software, being a command which causes the loss of data or the inability to capture, save, retain or correctly to process such data on or after any date but this shall not exclude bsequent damage to your property specifically insured by the policy or any loss not otherwise excluded suwhich itself results from: fire, explosion, lightning, smoke, aircraft or other aerial devices dropped from them, theft or attempted theft, impact by any road vehicle, train or animal, riot, civil commotion, strikers, locked-out workers or persons taking part in labour disturbances, malicious people or v ndals, storm or flood, escape of water from any tank, apparatus or pipe, escape of fuel oil from any fixed oil-fired heating a installation if covered by this policy.

CLAIMS PROCEDURE (OUR RIGHTS) a) If you make a claim under this policy we have the right to the salvage of any insured property. b) We are entitled to take-over: • your rights against another person before or after we have paid a claim • the defence or settlement of a claim against you by another person. c) We have the right to settle any liability claim by payment of the Indemnity Limit (less any sum or sums already paid or incurred) or any lesser amount for which, at our discretion, the claim can be settled. We will then relinquish control of the claim and be under no further liability.

CLAIMS PROCEDURE (YOUR DUTIES) - Contact details can be found under MAKING A CLAIM. For legal expenses claim, refer to the special conditions under the Legal Expenses section. When you become aware of a possible claim under this policy you shall (at your expense):

• notify us as soon as is reasonably possible • give all assistance and information we may require • advise us in writing giving full details, as soon as possible, and complete our appropriate claim form if required • immediately tell the police if damage is caused by theft, attempted theft, malicious acts, riot or civil commotion and obtain a crime reference number where

appropriate. • send to us, unanswered every claim, writ, summons or other communication immediately it is received • do all you reasonably can to recover any lost or stolen property or prevent further damage. When you become aware of a possible claim under this policy you shall not:

• admit, deny, negotiate or settle any claim without our written consent • without our written consent, throw away or destroy any damaged property or abandon any property to us.

DUTY OF CARE You must: a) do all that is reasonably pos ble to: si • protect the property insured • prevent, or reduce the extent of, d mage a • prevent accidents or bodily injury b) keep any property insured under this policy in good condition.

PREMIUM PAYMENT BY INSTALMENTS If the premium for this policy is payable by instalments and an instalment is not received by the due date then, subject to the Consumer Credit Act 1974 (if it applies), the redit agreement and the policy will be cancelled from the date the instalment was due unless cotherwise agreed by us in writing.

COOLING-OFF AND CANCELLATION a) Your right to cancel in the cooling-off period: If at inception or renewal of this policy and after receiving the full written documentation (either in paper or electronic format), including the schedule, you change your mind and no longer require the cover then you have 14 days (cooling-off period) from either the date you received the full documentation or the date the cover commenced, whichever is the later, to tell us, or you insurance r intermediary, in writing that you wish to cancel the policy. In such circumstances we will make a full refund of premium. However, if you make a claim during this cooling-off period sults in the sum insured or indemnity limit under one or all of the that re policy sections being paid in full then no refund will be due. b) Your right to cancel after the cooling-off period: If the policy is not cancelled within the cooling-off period, then the insurance is in force and you are committed to pay the premium. However, you can still cancel the policy providing that you give us notice in writing (including electronic format). As long as you have not made a claim we will refund the premium for the remainder of the period of in urance, suitably adjusted if the premium is s paid by instalments and provided that the amount of refund due is not less than £10.00. If you have made a claim in the current period of insurance then the full annual premium is due and no refund will be allowed. If the premium is paid by instalments then ny premium owing for the remainder of the period of insurance must be paid by you or will be a deducted from any claim settlement. c) Our right to cancel: We have the right to cancel the policy by giving you 7 days notice in writing sent by recorded delivery to your last known address. If we cancel the policy we will refund the premium for the remainder of the period of insurance, suitably adjusted if the premium is paid by instalments.

GOVERNING LAW AND LANGUAGEThis policy will be governed by English law unless you live in Scotland in which case the law of Scotland will apply. If there is any dispute as to which law applies it shall e English law. bWe will communicate with you in English at all times.

If you fail to comply we have the right to either cancel the policy, refuse a claim or reduce the amount of any claim payment.

JOINT POLICYHOLDERS (Not applicable to the Legal Expenses section of this policy)If there is more than one policyholder named in the schedule then either policyholder can amend the policy or make a c aim. lRemoval of a policyholder from the policy can only be made with that policyholder’s written authority or their executors.

RIGHTS OF THIRD PARTIES A person or company who is not party to this policy has no right under the Contracts (Rights of Third Parties) Act 1999 to en ce any forterm of this policy but this does not affect any right or remedy of a third party which exists or is available apart from that Act.

CHANGE OF INFORMATION OR CIRCUMSTANCES You must tell us about any change to the information upon which t is policy is based as soon as possible. Failure to do so could hinvalidate the policy. These changes include, but are not limited to: • change of address • structural alteration to the home • business use not covered by the po licy• unoccupancy for more than 60 days • bankruptcy of any member of the family • a family member being convicted with any criminal offence other than motoring offences.

FRAUD If you or anyone acting for you: • make(s) a false or fraudulent claim • suppor s) a claim by any fraudulent document, device or statement t(then we: • will not pay the claim • at our discretion, may declare the p licy void and you will forfeit all rights under the policy o• retain the right to keep the premium • shall be entitled to recover from you the amount of any claim we have already paid under the policy

General Conditions continued OTHER INSURANCE If at the time of a claim there is any other insurance covering anything insured by this policy we will only pay our proportionate share.

Endorsements 36 The follow sements and any supplementary endorsements are operative only if the number shown against them appears in the ing endorschedule.

INTRUDER ALARM DISCOUNT In consideration of us allowing a premium discount you are required to: a) protect the main building of the home with the intruder alarm system that you have stated as being installed at the home b) keep in force an annual intruder alarm maintenance contract with an NSI (i cluding NACOSS) or SSAIB recognised alarm company nc) set the intruder alarm system in full whenever the home is left unattended. If yo fail to comply with any of the above the amount of excess will increase to £250 for any claim resulting from theft or attempted u theft.

INTRUDER ALARM REQUIREMENT (LEVELS B, C AND D)Under sections 2 (Contents) and 3 (Personal Possessions), we will not pay any claim for damage caused by theft or any attempted theft from the home unless: a) the main building of the home (and any other building have specified) is protected by the intruder alarm system that either: we i. you have declared to us and we ha e accepted, or v ii. we have stated in writing is required in order for us to provide theft cover under this policy at the home b) you keep n force an annual intruder alarm maintenance contract with an NSI (including NACOSS) or SSAIB recognised alarm i company c) you, or a responsible family member, sets the intruder alarm system in full whenever the home is left unattended.

PHYSICAL SECURITY REQUIREMENT (LEVEL 4) Under sections 2 (Contents) and 3 (Personal Possessions), we will not pay any claim for damage caused b theft or any attempted theft yfrom the home unless the home is self-conta ith a lockable front door under your sole control and all: ined wa) external doors are fitted with the following: i.MAIN EXIT / ENTRY DOOR: • 5 lever mortise deadlock, or • a lock approved to BS3621, or • multi-point locking system with at least 3 locking points in additio to a horizontal deadbolt or hook-bolt, or n • rim automatic dead-latch ith a key locking handle on the inside w ii.PATIO / FRENCH DOORS: • multi-point locking system with at least 3 locking points with mushroom headed, hook or shoot bolts, or • existing lock with key operated patio door locks top and bottom, or • key operated security bolts top and bottom on e ch leaf in addition to the existing lock (flush bolts or internal bolts top and a bottom are accept ble for the first closing leaf) a iii.ALL OTHER DOORS: • locks as specified for the main entry / exit door or • key operated security bolts top and bottom in addition to the existing lock. b) opening windows (mea ng more than 23cm x 23cm - i.e. 9” x9” ) that are easily accessible from the outside are fitted with key suri operated window locks c) window louvres are glued into their brackets d) other basement or ground floor openings must be secured with key operated locks.

All your security devices are to be put into full operation whenever the home is left unattended or (apart from open windows in occupied rooms) each night after the occupants have retired to bed. If you fail to put any of the security devices into full operation as required an da claim for theft or attempted theft arises due to such failure then an increased excess of £250 will apply. However, we will not pay any claim if at the same time you also fail to comply with any INTRUDER ALARM REQUIREMENT that is effective under this policy.

4 PHYSICAL SECURITY REQUIREMENT (LEVELS 2 AND 3)Under sections 2 (Contents) and 3 (Personal Possessions), we will not pay any claim for damage caused by theft or any attempted eft thfrom the home unless you keep in place and in good working condition all the physical protections that you have stated to us were installed at the home when you applied for this insurance.

All your security devices are to be put into full operation whenever the home is left unattended or (apart from open windows in occupied rooms) each night after the occupants have retired to bed. If you fail to put any of the security devices into full operation as required an da claim for theft or attempted theft arises due to such failure then an increased excess of £250 will apply. However, we will not pay any claim if at the same time you also fail to comply with any INTRUDER ALARM REQUIREMENT that is effective under this policy.

INTRUDER ALARM REQUIREMENT (LEVEL A) Under sections 2 (Contents 3 (Personal Possessions), we will not pay any claim for damage caused by theft or any attempted theft ) andfrom the home unless you: a) keep in place and in good working condition the intruder alarm system that you have stated to us was installed at the home w en h you applied for this insurance. This alarm system must, as a minimum, protect the main entry / exit door with an alarm contact device or passive infra-red (PIR) detector connected to an external bell or siren b) or a responsible family member, sets the intruder alarm system in full whenever the home is left unattended.
