Prince William County was designated by the U.S. Department of Housing and Urban Development (HUD) as an “Urban Entitlement County” Beginning July 1, 1992. As such, Prince William became eligible to receive annual allocations of federal housing funds, to be used for activities which benefit low-and moderate-income persons and households. The Prince William County Office of Housing and Community Development (OHCD) is responsible for administering County housing programs and initiatives. This includes administration of the Area’s annual federal (HUD) allocations, a portion of which goes to the independent Cities of Manassas City and Manassas Park.

The Consolidated Plan is a federally-mandated, multi-year plan for meeting the housing and community development needs of low-and moderate-income households in the Prince William Area (PWC, Cities of Manassas and Manassas Park). The Consolidated Plan is a collaborative process wherein community housing and community development needs, resources and priorities are identified, and a vision is set for addressing these needs, using federal entitlement funds of CDBG and HOME.

Housing Choice Voucher Program

The Prince William County Office of Housing and Community Development (OHCD) is a public housing agency (PHA) that administers the federally funded Housing Choice Voucher Program through a cooperative agreement with the U.S. Department of Housing and Urban Development (HUD). The program is designed to provide affordable, safe, decent and sanitary rental housing for very low, low-and moderate-income families. As vouchers become available, eligible families are called from the waiting list which opens periodically. Vouchers may be used anywhere in the United States, including the U.S. Virgin Islands, Guam and Puerto Rico. The Housing Choice Voucher Program enables families to locate housing in the private rental market where landlords are willing to participate and where the rents are comparable to similar unassisted units and falls within the program’s guidelines. When families begin renting assisted units, they must pay a minimum of 30%, not to exceed 40%, of their monthly adjusted income towards rent and utilities. This calculation of assistance is done by a Housing Specialist.

OHCD screens families for participation in the program using income, assets and household size. Landlords are screened to prove ownership of the property, and suitability for the program. There are HUD restrictions on owners who are related to household participants. The owner is responsible to screen potential tenants using the same procedures used for unassisted tenants. Any screening of tenants is subject to Fair Housing Laws.

It is the responsibility of the tenant to pay the security deposit. The amount should be the same charged to non-program participants given the same circumstances (i.e. credit). Virginia State Law limits the security deposit amount to no more than two months contract rent. Contract rent in the Housing Choice voucher program is subject to PHA approval.

Any approved lease may be used as long as the HUD Tenancy Addendum is used in con-junction with the lease. Leases are submitted to the tenant’s assigned Housing Specialist for approval prior to Execution of the lease. The initial lease term for any assisted unit is one year. Upon renewal, owners and tenants can opt to renew for an additional year, alternate terms (i.e. 6 months) or month to month which is the legal default renewal lease tem where no other term is specified.

Rental payments to owners are the combination of both a tenant’s portion and/or the portion designated to be paid by the PHA. Payments are scheduled to reach owners by the first of each month. Payments for new leases may be delayed by approximately one month due to an initial processing time. Tenants must pay the amount of rent designated by their Housing Specialist, within the timeframe required by their lease. Active tenants cannot be held legally responsible for unpaid portions of rent due from the PHA to the owner. Tenants can never pay over and above approved contract rent that has been designated by the PHA.

The tenant is responsible to pay for any utilities designated by the terms of the lease. Utility deposits are also the responsibility of the tenant. It is both the tenant and landlord’s responsibility to ensure that the utilities are put in the tenant’s name. Failure to maintain working utilities for periods longer than 24 hours in an assisted units is considered a violation of the Housing Choice Voucher program, which may result in termination of Rental Assistance.

A family participating in the program may be evicted for the same reasons an unassisted tenant can be evicted through local courts. The Code of Federal Regulations requires that both tenant and owner notify the housing authority when a notice to vacate, or eviction has been is-sued. Housing assistance may be terminated in cases of eviction.

Federal regulations define basic Housing Quality Standards (HQS) that an assisted housing unit must meet before it can be rented under the Housing Choice voucher program and become eligible for Housing Assistance Payment (HAP). HQS requires a PHA to “inspect the unit leased to a family prior to the initial term of the lease, at least annually during assisted occupancy, and at other times as needed, to determine if the unit meets the HQS.” According to CFR 982.404, “The owner must maintain the unit in accord-ance with HQS. If the owner fails to maintain the dwelling unit in accordance with HQS, the PHA must take prompt and vigorous action to enforce the owner of obligations. PHA remedies for such breach of the HQS include termination, suspension or reduction of housing assistance payments and termination of the HAP contract[…..]. The owner is not responsible for a breach of the HQS that is not caused by the owner, and for which the family is responsible.” Family caused HQS breaches may lead to termination of assistance to the family.

Housing Choice Voucher Homeownership Program— The Housing Choice Voucher (HCV) Homeownership program is used to aide current rental assistance program participants to purchase a home of their own by using their voucher. Family Self-Sufficiency— The Family Self-Sufficiency (FSS) program is a United States Department of Housing and Ur-ban Development (HUD) designed program to provide participants receiving Housing choice voucher Program assistance in becoming self-sufficient and independent of public assistance. The program serves families who volunteer to participate by providing case management and referrals to community supportive services. Welfare-to-Work— Federal and State welfare reform efforts have created the Welfare-to-Work (WORK) pro-gram. This program offers participants a way to achieve self-sufficiency that often leads to homeownership. These participants are often accepted into our Family Self Sufficiency program which sets guidelines to help individuals meet these goals.

The Prince William County Office of Housing and Community Development (OHCD) is respon-sible for administering the Prince William Area’s (Prince William County, cities of Manassas and Manassas Park) Community Development Block Grant (CDBG) annual allocation. The Neighbor-hood Housing Rehabilitation Program is one of several CDBG supported initiatives administered by OHCD, and is available in these jurisdictions to eligible households as described below.

The program allows for all repairs to correct health and safety violations in order to make the property meet HUD’s Housing Quality Standards (HQS).

Gross household income must be at or below 80% of the area median income, adjusted for family size. OHCD can provide you with the income table. Households with incomes at or below 50% of area median income will receive priority in being assisted.

Recipients shall be the owner of record or have a 99 year leasehold interest in the property which is to be improved, and shall maintain that property as their primary residence. The property owner must provide a copy of the certified deed to the property to document ownership.

The amount of assistance provided for rehabilitation will be secured by a deferred deed of trust on the property. The trust will not be due and payable un-til the property ceases to be the principal residence, is sold, or the borrower fails or neglects to pay the taxes, assessments, premiums for hazard, flood (if re-quired), mortgage insurance, or terms of the deed of trust are violated.

The owner, contractor, and the Office of Housing and Community Development (OHCD) will enter into a contract for the work to be completed. The County, with funds provided by the CDBG program and with the owners written consent, shall pay the contractor for performance of work. OHCD will serve as funds disbursement agent on behalf of the owner, authorizing payments under the contract to the contractor.

Rental Rehabilitation Program

The purpose of the Rental Rehabilitation Loan Program is to provide owners of affordable rental housing in Prince William County with a financial tool to improve the safety, integrity, accessibility, and curbside appeal of their property. The intent of the subsidy is to reduce the rehabilitation cost of substandard rental units to a level that can support affordable rents. An additional goal of the program is to help improve the surrounding neighborhood and preserve the affordable housing stock for low and moderate-income (LMI) households. The program provides zero-interest, deferred loans to rental property owners to make improvements to their property. The property owner agrees to make units available to low and moderate income renters with restricted rents for a specified period of affordability, between 5-20 years based upon loan amounts and number of units. Repayment of the loan in full is required upon sale, refinancing, non-compliance with funding requirements or foreclosure before the end of the period of affordability along with penalties.

A Rental Rehabilitation Contract between the property owner and the County will be executed upon approval of the project. The Rental Rehabilitation Loan Program assistance will be secured by a Promissory Note, Deed of Trust and Deed of Easement and Declaration of Restrictive Covenants for the applicable period of affordability. If a no interest, deferred period loan is approved, the owner will not make periodic payments, nor will interest accrue. However, a lump sum payment equal to the amortized amount of the loan will be due upon the owner’s failure to comply with the terms of the Rental Rehabilitation Contract. In the event an owner re-finances the debt on a rental rehabilitation project after the completion of the project and after the Rental Rehabilitation Deed of Trust has been recorded, the County will not subordinate its interest in the property. However, County will consider entering into a subordination agreement to prevent foreclosure on the property and subsequent loss of the property to the affordable rental market. The owner may sell the property assisted under the Rental Rehabilitation Loan Program provided the subsequent owner agrees to the terms of the Rental Rehabilitation Contract, Deed of Trust, Promissory Note and Deed with Restrictive Covenants. The County shall approve the sale of the property and the assumption of the Promissory Note, provided the new owner is qualified to manage the rental property and agrees to the terms of the Rental Rehabilitation Contract. In the event the new owner does not agree to the terms the principal amount of the loan will become due at sale however the affordability provisions contained in the Deed with Restrictive Covenants running with the land will remain in force even if the property is sold and/or the loan is repaid to the expiration of the affordability period

To be eligible every Rental Rehabilitation assisted unit must need a minimum of $2,000 in rehabilitation to correct HQS deficiencies. The minimum threshold prevents assistance to properties that need only superficial improvements. A unit is defined as anything in which a household can reside, ranging from a single-room occupancy hotel unit, to a single family home, to a three-bedroom apartment. If multiple households share a single-family house, the house is counted as one unit. The maximum per unit subsidy is very generous. The per unit subsidy cannot exceed the FHA Section 221(d)(4) limits as established by HUD.

The terms of the amount of assistance are based upon the total dollar amount of assistance and the type of unit assisted.

In the event the Loan becomes due before the end of the deferred loan period of affordability the principal loan amount would become due but the Deed with Restrictive Covenants running with the land will remain in force until the period of affordability has expired. At the end of the loan term, the no interest deferred payment loan will be forgiven. No payment will be required as long as the loan terms of the contract are satisfied.

Affordable Rent Limits

Funds can only be used on Projects when there is a period of affordability. The affordability of the unit is based upon Home Investment Partnership (HOME) Rent Limits based upon unit size. The Affordable Rent Limits are established by HUD and adjusted annually. In projects where housing is occupied prior to application, the rents charged after rehab to existing tenants cannot exceed the greater of the prior rent or 30% of the tenant’s income. For new tenants the rent cannot exceed the Home Investment Partnership (HOME) Rent Limits based upon unit size. If the tenant pays utilities, the maximum allowable rent is reduced using the HUD Section 8 Existing Housing Allowance for Tenant-Furnished Utilities. Rents may be adjusted at the annual anniversary of a rehabilitated unit’s initial lease. OHCD must review and approve all increases in rent based on changes in the Home Investment Partnership (HOME) Rent Limits as published by HUD. The owner is responsible for requesting an annual increase in rent. If the unit is occupied no rent increase may take effect until the owner has given the tenant a thirty day notice of rent increase. In exchange for the low-interest financing from the County, the owner agrees to restrictions on rent and tenant incomes to ensure affordability for an extended time period. The minimum affordability period is 5 years with the maximum 20 years based upon dollars per unit and type of units. The affordability provision is secured by a Deed of Easement and Declaration of Restrictive Covenants running with the land that remains in force even if the property is sold and/or the loan is repaid to the expiration of the affordability period.

Prince William County, through the Office of Housing and Community Development, has funding available to make the dream of homeownership a reality for low-income first time homebuyers. The Homeownership Assistance Program provides financial counseling, Homeownership Education, and deferred loans for down payment, closing costs, energy efficiency improvements or rehabilitation of the property being purchased. First trust financing is available through local private lending institutions that have made a commitment to work cooperatively with the Office of Housing and Community Development in providing homeownership opportunities for first time homebuyers.

For purposes of determining eligibility for the Prince William County Homeownership Assistance Programs the income, assets and circumstances of all individuals, persons, families or households currently residing together (whether by blood, marriage, adoption, or unrelated), and others anticipated to occupy the housing unit will be considered, and must meet all program requirements. All individuals, persons, families and/or household members must be U.S. Citizens, U.S.

non-citizen nationals, or qualified alien legally admitted to the U.S. with valid USCIS documents. Currently live or work in Prince William County for at least prior 6 months. First time homebuyer status: Persons, individuals, families or households can not have

purchased or had ownership interest (own, purchase, co-sign on a loan, inherit, etc. regardless of whether they lived there) in a home or other residential property within the last three years anywhere in the United States, foreign land or country.

Gross household annual income is projected forward for one year from date of settle-ment and can not exceed 80% area median income (AMI), per the table below. Interest from

assets is added to income in determining eligibility. Interest on assets over $5,000 is imputed @ the HUD determined passbook rate. For assets over $5,000, the greater of

the actual interest earned, or interest imputed at the passbook rate is included as income. Households must meet these income guidelines up to, and projected forward for one year from the day of settlement. Actual or anticipated increases in income must be reported within 10 days of occurrence or notification.

Previous recipients of HAP or other first time homebuyer program funds are not eligible. Completion of the program’s financial counseling and homeownership education requirements.

Sufficient income and good credit to qualify for a first trust FHA, VHDA, VA or conventional loan from a private lending institution at interest rates within 1% of current market rate.

First trust financing must be fixed rate, step, or buy down. No Adjustable Rate Mortgag-es (ARM’s), balloons, or interest only loans allowed.

Borrowers are required to obtain a maximum first trust loan for which they can qualify according to FHA, VA VHDA or Conventional standards with income/Debt ratios 29/41. Expanded qualifying ratios of 33/45 may be considered on case by case basis with demonstrated ability to pay or save at higher level for a least the prior six months. Borrower is required to have at least $1,000 from personal funds invested in the

purchase transaction for program allowable costs such as earnest money deposit, loan application fee, credit report, home inspection, appraisal and other closing costs as required by first trust financing.

Specific requirements of first trust financing may cause the contribution to exceed $1,000.

Processing fee charged to borrower by the Selling Agency, escalation clauses, purchase offers exceeding the MLS listed sales price, and funding the difference between a low

appraisal and the sales price can not be paid by the Homeownership Program, and can not be considered toward the $1,000 household contribution.

Level of assistance is based on minimum amount required to purchase average priced housing unit appropriate to family size, per current Prince William County board of

Realtors Multiple Listing Service Data.

Down payment/Closing cost assistance from HAP/RAP will be in the form of an interest free, 30 year deferred loan which is secured by a deed of trust in second position

behind the first trust loan. The principal loan amount along with a share in the market appreciation equal to the percent of HAP funds in the original acquisition cost will be due

upon sale, refinance, movement off the property, or any other breach of the deed of trust. If all conditions of the deed of trust are fulfilled, the HAP loan will be entirely

forgiven after 30 years. The rehabilitation assistance will be secured by a deferred deed of trust in third position

behind the down payment/closing cost loan with principal only due upon sale, refinance, movement off the property, or any other breach of the deed of trust.

The loans will not be subordinated for any other loan, or for refinance of the first loan for the purpose of removing equity for any reason (i.e. cash, loan consolidation, debt repayment, home improvement, etc.)

Properties purchased: Must be located within Prince William County Must be existing, or under construction with at least the

foundation in place. Cannot be occupied by a renter at the time the purchase contract

is written. Must remain the principal residence of the purchaser. Must meet or exceed Housing Quality Standards (HQS) at the

time of initial occupancy.

The property must qualify as affordable housing: for acquisition without rehabilitation the initial purchase prince cannot exceed HUD established FHA mortgage limits. For acquisition with rehabilitation the estimated after rehabilitation value cannot exceed HUD established FHA Mortgage limits. The FHA mortgage limits are subject to change upon HUD published adjustments.

Prince William County Office of Housing and Community Development’s (OHCD) two year Transitional Housing program provides decent, safe and sanitary housing with support services for families with children that are homeless, while facilitating movement to independent living and self-sufficiency through the provision of individualized services. These services are aimed at self-empowerment, improved employment potential, increased opportunities for economic betterment, strengthened skills in the area of financial planning and family budgeting and attempts to increase educational levels, and instill effective home management.

All applicants must currently reside in a Prince William Area homeless shelter, and be in good standing with the shelter program.

Must be legally admitted to the U.S. with valid documents. Household income must be less than 80% of Area median Income. Have legal custody of a child or children under age 18. No active use of drug or alcoholic substances with a minimum of 6 months sobriety. Ability to pay the minimum Program Fee, plus electric bill. Current employment or the ability to become gainfully employed within 30 days of acceptance. Motivation as demonstrated by current actions to alleviate their homeless situation. Willingness to participate in the self-sufficiency portion of this program. Within thirty days have either telephone or cell phone service. Must supply a current Criminal Record Check free of drug, violent criminal activity, crimes

against children.

When a unit becomes available, notice is given to area shelters to obtain referrals for the application/selection process. Area homeless shelter coordinators are notified of the opening with applications made

available via email. Shelter coordinators make applications available to shelter residents who meet basic eli-

gibility criteria for the Dawson Beach Transitional Housing Program.

Application form must be completed by the applicant and returned to the Shelter Coordinator. Shelter Coordinator must complete Shelter Referral Form for each applicant, attach to application. Shelter staff must deliver completed applications to OHCD before the application

deadline date. Applications are reviewed by screening committee. Interviews are scheduled for qualified applicants. After interviewing all qualified applicants the screening committee selects the family for

the program. Family selected is notified of acceptance. Shelters are notified of applicants not selected.

The seven acre site contains a Community Center, playground and nine housing units: a 2 bedroom and a 3 bedroom duplex and four 2 bedroom and three 3 bedroom townhouses.

Selected families are required to sign and actively pursue a self-sufficiency agreement that will entail individual, family and group counseling for a period of no more than two years. The monthly Program Fee is based on Thirty Percent (30%) of the household’s gross income with 1/3 of this fee placed in an escrow account. When the family has successfully completed and left the program, these funds are made available to the family. A family would be considered self-sufficient when the following goals are achieved: Living in permanent housing Being employed Remaining together as a family Being able to function at a level acceptable to the community in which they live.
