and Conditions

Please read these Terms and Conditions of Use ("Terms", “terms”, "Terms and Conditions") carefully before

using the Hodly mobile application (operated by IQOption Ltd ("us", "we", or "our"). Your access to and use of

the service is conditioned on your acceptance of and compliance with these terms. These terms apply to all

visitors, users and others who access or use the service.

Parties

This agreement is between you ("You" or "Your" in this agreement) and Iqoption Ltd. (“The Company”).

A. Service Offered

The Company operates a software program that enables users to receive, access, store and transfer virtual

currencies, tokens, and cryptocurrencies (collectively, “Cryptocurrency”). This license agreement permits You

to use the Wallet subject to certain conditions, rights and obligations.

B. Deposits and withdrawals

You may deposit funds and/or Cryptocurrencies into your Wallet at any time during the duration of your

contractual relationship with the Company. Funds as means of payment for Cryptocurrencies will be

accepted via, debit/credit card (MasterCard, Visa, etc.) supporting the 3D-Secure protocol and

Cryptocurrency transfer (BTC, ETH, etc.) where the originator is you. The Company does not accept third

party or anonymous payments in favor of your account.

The Company shall perform withdrawals of your funds and/or Cryptocurrencies, upon an application for

withdrawal made via the Wallet.

Upon the Company receiving an instruction from you to withdraw funds and/or Cryptocurrencies from your

account, the Company shall pay/transfer the said amount within one business day, if the following

requirements are met:

a) The withdrawal instruction includes all necessary information;

b) The instruction is to make a bank transfer to your bank account or digital currency to your

blockchain address; and

c) At the moment of payment, your client account balance exceeds or is equal to the amount

specified in the withdrawal instruction including all payment charges.

Withdrawals will only be executed by crediting your personal account. The Company will not effect

withdrawals by transferring the funds to any other third party or to an anonymous account. The Company

reserves the right to decline a withdrawal request when you ask for a specific transfer method and the

Company has the right to suggest an alternative.

All payment and transfer charges will be borne by you and the Company is entitled to debit your account for

these charges.

C. User Obligations

You shall:

be of age of majority in Your local jurisdiction; and,

be responsible for Your own Cryptocurrencies; and,

carefully review the list of supported Cryptocurrencies before engaging in any transactions; and,

ensure that Your device(s) are fully updated and do not contain viruses, malware or otherwise

malicious software; and,

ensure that Your use of the Wallet complies with local laws.

You shall not:

deposit Cryptocurrencies into addresses for Cryptocurrencies that are not supported by the Wallet; or,

use the Wallet in a manner likely to interfere with other Wallet users or servers (e.g. excessive API calls

or network spam); or,

use the Wallet in a manner contrary to the laws of Your local laws.

D. No Control Over Blockchains

The Company is not the creator of, and does not have any control over, any of the Cryptocurrencies that the

Wallet allows You to use. You shall be solely responsible for Your choice of and use of Cryptocurrencies.

E. Transactions

The only authentic record of Cryptocurrency transactions is the applicable blockchain.

The Wallet provides functionality that allows You to send Cryptocurrencies transfer instructions. The

Company does not guarantee that transactions You perform using the Wallet shall be stored in any

blockchain.

You must ensure that Your transactions conform to the applicable rules of the software for the

Cryptocurrencies (especially with smart contract systems like Ethereum).

The Company reserves the right to refuse to process or to cancel any pending Cryptocurrency Transaction

as required by law or in response to a subpoena, court order, or other binding government order or to

enforce transaction limits. The Company cannot reverse a Cryptocurrency Transaction which has been

broadcast to a Digital Currency network. The Wallet services are available only in connection with those

Cryptocurrencies that the Company, in its sole discretion, decides to support. The Cryptocurrencies that the

Company supports may change from time to time. Under no circumstances should you attempt to use

your Wallet to store, send, request, or receive Cryptocurrencies in any form that are not supported by the

Company. The Company assumes no responsibility or liability in connection with any attempt to use the

Wallet for Cryptocurrencies that the Company does not support.

F. Limited Intellectual Property License

The Company licenses the Wallet to You on a personal, non-exclusive, royalty-free, non-transferable,

worldwide-basis, for the purpose of holding and transferring Cryptocurrencies.

You are not permitted to re-distribute the Wallet, modify any code or use any Wallet content, including

images and text, as part of any other software or project of any kind. You must obtain the Company’s written

permission before acting contrary to copyright law or the terms of this clause.

G. Specifically Disclaimed Risks

Using Cryptocurrency-related software necessarily entails many risks. The Company specifically disclaims

and shall have no liability to You for the following risks:

operating system failures (mobile or desktop); and,

interactions between Your hardware, software and the Wallet; and,

cloud backup software (e.g. certain Android distributions) may upload your private files/information to

third party services; and,

malware, viruses or other malicious software on Your device that is able to take control of or interfere

with the Wallet; and,

communication delays between Your Wallet and a node or relay service for a Cryptocurrency (and

vice versa); and,

theft of Cryptocurrencies.

H. No Warranty

The Wallet is provided to You at no cost, “as-is” and without any warranty whatsoever, to the maximum

extent permissible by law. Without limiting the generality of the foregoing, the Company does not warrant

that the Wallet is fit for Your purpose, even if You have previously provided notice of Your intended purpose,

and does not warrant that the Wallet will operate in a bug-free manner.

I. Indemnity

You agree to indemnify the Company against any claims, damages, losses or legal fees incurred due to Your

use (or misuse) of the Wallet.

J. Non-Waiver

No action or inaction of the Company shall be considered a waiver of any right or obligation by the

Company.

K. Amendment

The Company reserves the right to amend, revise, modify, and/or change this Addendum at any time

without prior notice. All changes shall take effect immediately and such updated version of the Addendum

shall be published in the Company's Website.

L. Assignment

You may not assign this agreement.

M. Governing Law

The Agreement and all transactional relations between you and the Company shall be governed by and

construed in accordance with the laws of the Republic of Seychelles and the Parties agree that all disputes

shall be finally settled in the courts of the Republic of Seychelles.

N. Privacy Policy

Your blockchain transactions may be relayed through servers (“nodes”) and will be publicly visible due to the

public nature of distributed ledger systems.

Exchange rates, balances, transactions and other blockchain information may be read from, or relayed to,

third-party servers. We cannot guarantee the privacy of your Internet connection.

Clients who do not agree with any amendment, review and/or change of this Addendum may request to

terminate their user agreement with the Company and close their account.
