SECOND READING ON ORDINANCE AN ORDINANCE OF THE TOWNSHIP OF VOORHEES AMENDING CHAPTER 152: ZONING DISTRICTS TO ADD SECTION 152.161 ENTITLED AFFORDABLE HOUSING DISTRICT (AH) OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF VOORHEES Frank Dutton 4 Northgate Drive Mr. Dutton introduced himself and said he was a lifelong resident of Voorhees and former fire chief. He spoke on behalf of himself and his neighbors regarding the change to the proposed change of zone designation to 1223 Haddonfield Berlin Road. He started by requesting a delay on the vote for several reasons. He stated that he and some of his neighbors did not receive their notification until July 5 th and that they also received a planning board notice on July 13 th and some neighbors were confused as to the actual date of the ordinance adoption meeting. He requested that the decision be delayed for one week to allow he and his neighbors time to review the plans that have been submitted by the developer. He added that the property has been an eyesore for decades and added that he has chased people off the site and have had people dump trash, including the owner himself, dumping construction material on the site. Some of the other concerns are based on what they don’t know because they haven’t had time to review this. He heard that the Michael Group is the developer and Mr. Long stated yes, they are. Mr. Ravitz suggested to the Mayor in light of the circumstances of this current meeting, that we should delay the vote to give all the residents time to speak. Mayor Mignogna agreed and said that it is a fair request to delay the vote but wanted to make sure that advertising and timing wouldn’t be affected. He added that the last thing we want is for the residents to be uninformed. Mr. Long stated that notice from here, comes from the Clerk’s office. He added that what we are doing with this ordinance is just permitting an overlay and has nothing to do with the specific application. This doesn’t have anything to do with the application. Mr. Long added that he spoke to Mr. Ward today regarding this issue and we are offering full transparency and we want the residents to understand what this is. He feels that in the end, this will offer a much better use of the parcel.

Mr. Dutton introduced himself and said he was a lifelong resident of Voorhees and former fire chief. He spoke on behalf of himself and his neighbors regarding the change to the proposed change of zone designation to 1223 Haddonfield Berlin Road. He started by requesting a delay on the vote for several reasons. He stated that he and some of his neighbors did not receive their notification until July 5 th and that they also received a planning board notice on July 13th and some neighbors were confused as to the actual date of the ordinance adoption meeting. He requested that the decision be delayed for one week to allow he and his neighbors time to review the plans that have been submitted by the developer. Mr. Platt and Mayor Mignogna stated that we could arrange a meeting with the residents and representatives from the Michael Group in the next week. He added that we will table and carry this ordinance.

AN ORDINANCE OF THE TOWNSHIP OF VOORHEES AMENDING CHAPTER 152: ZONING DISTRICTS TO ADD SECTION 152.161 ENTITLED AFFORDABLE HOUSING DISTRICT (AH) OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF

VOORHEES

BE IT HEREBY ORDAINED by the Township Committee of the Township of Voorhees that

Chapter 152.161 entitled Affordable Housing District be added to the Chapter 152-Zoning Districts of the

Township of Voorhees Uniform Land Development Ordinance. Said addition shall be included as

follows:

Ҥ152-161 Purpose and Intent

The purpose and intent of the AH District is to provide for the development of a 100% affordable project not to exceed 81 multi-family units.

§152-162 Permitted Uses

A. Principal Uses: Multi-family dwellings, townhouses, stacked townhouses.

B. Accessory uses: (i) Recreational facilities including club house, outdoor recreation, tot lot, playground. (ii) Off-street parking facilities.(iii) Utility structures.

§152-163 Conditional Uses

None

§152-164 Area and Bulk Requirements

A. Ownership and control. The tract shall be under one ownership or control by the applicant for purposes of obtaining all required development approvals and committing the tract to the regulations of the AH District.

B. Maximum tract density: 10.125 dwelling units per gross acre (prior to any required dedication of lands) but not to exceed a total of 81 residential units.

C. Minimum tract area: 8 acres (prior to any required dedication of lands).

D. Minimum tract frontage: 500 linear feet.

E. Setback Requirements:

Front yard setback (Haddonfield Berlin Road) = 40 feet.

Side yard setback = 35 feet

Rear yard setback = 40 feet

F. Minimum buffer of 20 feet within the setback area shall be maintained along the side and rear yard of the property.

G. Minimum Distance between buildings:

From side face to side face: 20 feet

From rear face to rear face: 40 feet

H. Maximum number of units per building: Maximum of 10 units per building.

I. Maximum Height: two and half stories but not to exceed 35 feet.

J. Maximum Impervious Coverage: 70 % of the entire tract area.

K. Minimum Open Space requirement: A minimum of 20% of gross tract shall be open space, this may include but not be limited to, passive recreation areas, active recreation areas, natural or planted buffer and any other similar pervious areas. Open space on the tract may be maintained by the owner, a tenant association, or condominium association.

L. Minimum parking requirements. Parking spaces shall be provided in accordance with the requirements of the New Jersey Residential Site Improvement Standards (RSIS). Garden apartment ratios shall be utilized in determining the minimum required number of off-street parking spaces. Off-street parking spaces may be provided in surface parking lots or as garages.

M. Relationships to other sections of this chapter. Where the regulations of the AH Zone conflict with any other regulations of this chapter, the regulations contained in this section for the AH Zone shall apply.

§152-165 Zone specific design standards

A. Lighting.  No light fixture, whether pole or wall mounted, shall be greater than 18 feet in height.

B. Landscaping.  All public street frontages and project entrance drives shall be planted with approved street trees spaced a maximum of 50 feet apart.

C.  Building façades.  The façade of the structures shall be varied in such a manner than no more than two townhouses and no more than four garden apartments shall share the same façade at the building line.  Façades shall be uniform architecturally and shall not consist of disparate materials.  Individual dwellings shall be distinguished from each other only by landscaping, lighting and variation in the building line.

D. Signage:  A sign identifying a multi-family residential development shall not exceed 32 square feet and shall be limited to one sign per street frontage.

E. Laundry Facilities.  Adequate laundering and drying facilities for clothing shall be provided within each structure sufficient to serve its occupants, unless such facilities are individually provided for each dwelling unit.

F. Storage: Each unit should have a minimum of 25-50 square feet of storage space included within each unit’s floor plan.

G. Pedestrian circulation. A pedestrian circulation system shall be provided which connects parking areas, dwellings and recreational facilities in a coherent and comprehensive pattern.  The pedestrian walkway shall be adequately illuminated at night and be surfaced with a durable, dustless, all-weather material a minimum width of five feet.

H. Trash enclosures.  Trash enclosures shall be provided such that no disposal area is greater than 350 feet from the entrance of any dwelling unit unless individual trash storage areas are provided for each dwelling unit.  Trash and recycling pick-up may only occur on weekdays between the hours of 7:00 a.m. and 10:00 p.m. unless otherwise regulated by any State or Federal regulations. Trash enclosures shall be visually screened with evergreen plantings or solid fence enclosure.

I. Utilities.  All utilities servicing the development shall be located underground.”

BE IT FURTHER ORDAINED, that if any section, paragraph, subsection, clause or provision of

this Ordinance shall be adjudged by the courts to be invalid, such adjudication shall apply only to the

section, paragraph, subsection, clause or provision so adjudicated, and the remainder of the Ordinance

shall be deemed valid and effective; and

Be It Further Ordained, that any ordinances or parts thereof in conflict with the provisions of

this Ordinance are repealed to the extent of such conflict; and

BE IT FURTHER ORDAINED, that this Ordinance shall take effect upon passage and

publication in accordance with applicable law.

WHEREAS, the Mayor and Township Committee of the Township of Voorhees, County of Camden,

State of New Jersey, desire to amend the Fee Schedule Ordinance established effective February 2019.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Township Committee of the

Township of Voorhees, County of Camden, State of New Jersey, as follows:

F. GENERAL ZONING FEES

c. Re-inspection

(i) Residential $ 35.00 ($75.00) per each re-inspection.

(a) Rentals $ 35.00 ($75.00) per each re-inspection(If items are not brought into

nine (9) types of matters that may lawfully be discussed in “Executive Session,” i.e. without the public

being permitted to attend; and

WHEREAS, the Township of Voorhees has determined that certain issues set forth below are

permitted by N.J.S.A. 10:4-12(b) to be discussed without the public in attendance were discussed during

an Executive Session held on June 24, 2019 at approximately 7:30 p.m.; and

WHEREAS, the nine (9) exceptions to public meetings set forth in N.J.S.A. 10:4-12(b) are listed

below, and the items to be privately discussed that fall within such exceptions shall be identified and

written, and after each exception is a space where additional information that will disclose as much

information about the discussion as possible without undermining the purpose of the exception as

follows:

“(1) Any matter which, by express provision of Federal law, State statute or rule of court shall be rendered confidential or excluded from public discussion.” The legal citation to the provision(s) at issue is: __________________________ and the nature of the matter, described as specifically as possible without undermining the need for confidentiality is;

“(4) Any collective bargaining agreement, or the terms and conditions of which are proposed for inclusion in any collective bargaining agreement, including the negotiation of terms and conditions with employees or representatives of employees of the public body” The collective bargaining contract(s) discussed are between the public body and the;

“(5) Any matter involving the purchase, lease or acquisition of real property with public funds, the setting of bank rates or investment of public funds where it could adversely affect the public interest if discussion of such matters were disclosed.” The nature of the matter, described as specifically as possible without undermining the need for confidentiality is; “(6) Any tactics and techniques utilized in protecting the safety and property of the public provided that their disclosure could impair such protection. Any investigations of violations or possible violations of the law.” The nature of the matter, described as specifically as possible without undermining the need for confidentiality is;

“(7) Any pending or anticipated litigation or contract negotiation in which the public body is or may become a party. Any matters falling within the

BE IT FURTHER RESOLVED that the Township hereby declares that its discussion of the

aforementioned subject(s) will be made public at a time when the need for confidentiality no longer

exists, or the public’s interest in disclosure is greater than any privacy or governmental interest being

protected from disclosure.

BE IT FURTHER RESOLVED that the Township Clerk/Township Solicitor, shall read aloud

enough of this resolution so that members of the public in attendance can understand, as precisely as

possible, the nature of the matters that were privately discussed.

BE IT FURTHER RESOLVED that the Township Clerk, on the next business day following

this meeting, shall furnish a copy of this resolution to any member of the public who requests one at the

WHEREAS, the County of Camden has agreed to contribute funding for activities or

provide materials set forth in the scope of services of the agreement.

RESOLUTION NO. 181-19

RESOLUTION PROMOTING BICYCLING SAFETY AND PUBLIC AWARENESSOF “SWERVING” ACTIVITIES IN THE TOWNSHIP OF VOORHEES

WHEREAS, the Township of Voorhees has received multiple complaints about a

bicycling phenomenon known as “swerving”, wherein one or more bicyclists intentionally ride

into the paths of vehicles while performing stunts; and

WHEREAS, where youth culture and the bike culture intersect, juveniles often perform

dangerous stunts in traffic bringing about unwelcome change to our streets and neighborhoods;

and

WHEREAS, the Township Committee of the Township Voorhees and the Voorhees

Township Police Department (“VTPD”) are concerned and believe it is in the best interest of the

health, safety and welfare of all Township residents to address this problem head-on; and

WHEREAS, the VTPD routinely receives complaints of bicyclists engaging in this

hazardous behavior upon numerous streets in our community by riders that are juveniles from

Voorhees Township and, at times, surrounding jurisdictions; and

WHEREAS, Police Chief Louis Bordi has issued a directive instructing all officers to

aggressively enforce these types violations when reported or observed; and

WHEREAS, anyone observed riding a bike inappropriately will be appropriately

addressed, parents will be contacted, and the juvenile will be appropriately cited under State

Law; and

WHEREAS, the Township Committee of the Township Voorhees and the VTPD have

issued this formal Resolution which is designed to serve as a message to ask parents to speak

with their children and advise them that this behavior is unacceptable and must stop before a

tragedy occurs; and

WHEREAS, if any resident witnesses your child, or a neighbor or friend’s child riding in

such a manner, we implore you to address the potential consequences of their actions in the

sincere hope that this activity may be eliminated through education as opposed to enforcement,

otherwise the VTPD will have no choice but to strictly enforce existing bicycle laws; and

WHEREAS, New Jersey Law provides that juveniles can be cited for multiple violations

of N.J.S.A. 39:4-10.1: Operating a bicycle by a person under age 17 without a helmet; N.J.S.A.

39:4-12: Improper Riding-Riding in street while “practicing tricks or fancy riding”; N.J.S.A.

39:4-14.2: Every person riding a bicycle should ride in the same direction as vehicular traffic and

all bicyclist must obey all state and local automobile driving laws; N.J.S.A. 39:4-10.11: Every

person riding a bicycle on a roadway shall ride as near to the right roadside as practicable

exercising due care when passing a standing vehicle or one proceeding in the same direction;

N.J.S.A.39:4-11: A bicycle must be equipped with a bell or other audible device that can be

heard at least 100 feet away, but not a siren or whistle; and N.J.S.A. 39:4-10: When in use at

nighttime every bicycle shall be equipped with a front headlamp emitting a white light visible

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Township Committee of

the Township of Voorhees as follows:

1. Anyone observing such activity within the Township of Voorhees is urged to call 911 or (856) 428-5400 and report the aforesaid activity.

2. In conjunction with the VTPD, the Township Committee of the Township of Voorhees is announcing a zero-tolerance policy toward bicycling that intentional creates a clear and present danger upon any State, County or Local roadway within the Township of Voorhees.

3. The traveling public, be it motor vehicle or bicycling health, safety and welfare warrant the adopt of this policy as a means of preventing deterring serious injuries or other catastrophic event from occurring within our Community.

4. A copy of this Resolution shall be posted in all public building and prominent areas throughout the Township including the Township’s webpage.

RESOLUTION AUTHORIZING THE AWARD OF A LAND LEASE AND DEVELOPMENT SERVICE FEE AGREEMENT FOR SOLAR PV GENERATION SYSTEM AT THE BUZBY

LANDFILL TO SOLAREAMERICA

WHEREAS, specifications were completed and bids were properly advertised by the Township of

Voorhees (“Voorhees” and/or “Township”) for Land Lease for Solar PV Generation System at the Buzby

Landfill; and

WHEREAS, the Township furnished detailed bid specifications to potential bidders and bids were

received and opened at the offices of the Township;

WHEREAS, three (3) companies submitted bids for the specified contract as follows: (1)

SolareAmerica; (2) SunEdison and (3) Syncarpha Solar, LLC which were initially evaluated on the basis of a

total fifteen (15) year lease payment with the “lowest responsible bidder” for this project being the bidder

who submitted the highest lease payment to the Township and subsequently negotiated for lump sum

amount; and

WHEREAS, the Township of Voorhees has therefore determined that SolareAmerica, after

intensive negotiations, has submitted the most advantageous proposal as set forth in the Lease Agreement

and Development Service Fee Agreement; and

NOW, THEREFORE BE IT RESOLVED by the Mayor and Township Committee of the

Township of Voorhees as follows:

1. The provisions of the WHEREAS clauses set forth above are incorporated herein by reference and made a part hereof.

2. The Agreements associated with the Solar PV Generation System at the Buzby Landfill are awarded to SolareAmerica and the Mayor, Deputy Mayor, Administrator and Clerk are hereby authorized to execute said Agreements and take any and all actions required to effectuate the purposes of the Lease Agreement and Development Services Fee Agreement, attached hereto and made a part hereof.

RESOLUTION NO. 185-19

APPROVING THE TRANSFER OF CANINE DOG “JOCKO” FROM POLICEMAN MATTHEW BUCHHOFER TO THE VOORHEES TOWNSHIP POLICE

DEPARTMENT

WHEREAS, Police Officer Matthew Buchhofer obtained a pure bred German Shepherd

named Jocko in June 2018; and

WHEREAS, Jocko has successfully completed the required 16 week Basic Police Patrol

Dog Course and a 10 week narcotics detection class with the NJ Police K9 Association in June

2019; and

WHEREAS, the Voorhees Township Police Department has expressed interest in taking

full ownership and responsibility of Jocko for police work as determined by the Chief of Police;

and

WHEREAS, Police Officer Matthew Buchhofer has willfully transferred all ownership

rights of Jocko to the Township of Voorhees; and

WHEREAS, upon completion of this transfer, the Township of Voorhees will indemnify

Police Officer Matthew Buchhofer from the loss by agreeing to obtain the necessary insurances,

which will hold Police Officer harmless resulting from Voorhees Township’s ownership of K9

Jocko.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of

the Township of Voorhees, County of Camden, and State of New Jersey as follows:

1. The provisions of the WHEREAS clauses set forth above are incorporated herein by reference and made a part hereof.

2. The ownership of Jocko is hereby authorized to be transferred to Voorhees Township subject to the conditions set forth herein.

COMMENTS FROM COMMITTEE

Mr. Ravitz spoke regarding the recent influx of reports of children ‘swerving’ their bikes into traffic. He further stated that the schools recently held assemblies for both the middle school children as well as the elementary schools educating them about the dangers of this practice. Notices were also sent home with students informing parents to speak to their children about this dangerous trend. Mr. Ravitz informed the public that the Voorhees Township Police Department will be strongly enforcing all laws regarding the safe operation of bicycles. Mr. Ravitz also spoke regarding the car break ins at Connolly Park. Mr. Ravitz expressed his appreciation to the Voorhees Township Police Department and reassured the public that they are working diligently to address the situation.

Ms. Nocito reiterated Mr. Ravitz’s statement regarding bicycle safety and stated that tickets will be issued to anyone found to be operating a bicycle in a dangerous manner.
