1. Purpose of the Report

1.1 To report on proposed changes to admission arrangements for 2007-2008 and to ask Cabinet to agree to the consultative processes relating to the 2007-2008 admissions round.

2. Summary

2.1 The report sets out the proposed admission arrangements for community and voluntary-controlled schools for 2007-2008. The co-ordinated schemes for primary and secondary admissions are also set out.

2.2 The oversubscription criteria (admission rules) relating to admission to single sex schools has been reviewed, in order to introduce an element of random allocation. This would offer an equal chance for applicants to obtain a place at a single sex school.

2.3 The Co-educational Priority Area 6 has been reviewed by:

(a) moving Watford Rural parish from Priority Area 6 to Priority Area 11, Borehamwood, Bushey and Watford Rural, in order to enhance the chances of children from Maple Cross and Mill End obtaining places at their nearest community school, Westfield Community Technology College, and

(b) withdrawing the parishes of Northwood (in Hillingdon) and Pinner (in Harrow).

2.4 The combined parish/unparished area and towns of Hitchin and Letchworth Garden City included in the existing single sex Priority Area for Hitchin Boys and Hitchin Girls has been split to offer the same divisions as used for the co-educational priority area.

2.5 The secondary co-ordinated scheme has been developed to reflect the inter-LEA co-ordination which was established for 2005.

2.6 The Published Admission Numbers (PANs) for individual schools have been developed having taken into account the Indicated Admission Numbers (IANs) as derived by the net capacity assessment conducted earlier this year, the recently developed framework for assessing Published Admission Numbers and the forecast demand as identified in the School Organisation Plan.

3. Conclusions

Cabinet is asked to:

3.1 Approve proposals for consultation on nursery, infant, first, primary, junior, middle, secondary (including 6th form) and In-Year (casual) admissions.

3.2 Approve the schemes of co-ordination for primary and secondary schools.

3.3 Approve the framework of key factors to be considered when a Published Admission Number is less than derived by the net capacity.

3.4 Approve the Published Admission Numbers for consultation for 2007 arrangements, noting the comments for 2007 concerning schools where the PAN is less than derived by the net capacity.

3.5 Note the proposed timetable for consultation on admission arrangements for 2007-2008.

1. Background

1.1 The County Council as Local Education Authority (LEA) is required to consult about its proposed admission arrangements by the end of February each year. These admission arrangements should be consistent with any co-ordinated scheme that will operate for the area in the year in question and should include:

admission numbers for any years to which it is intended to admit pupils, including Year 12, and in the case of boarding schools any separate admission numbers for day and boarding pupils;

application procedures and timetables, as agreed locally, including where possible the opportunity to make applications online;

the oversubscription criteria (rules) to be used, and the order in which they will be applied, to allocate places if the school receives more applications than there are places available;

information about any tests for aptitude or ability, if allowed, or details of any additional information required, such as evidence of religious commitment, and of the objective criteria that will be used to judge these aspects;

any separate entry requirements and oversubscription criteria for Year 12 , or nursery places, if applicable;

information about whether a waiting list will be maintained and for how long, plus confirmation that this will be maintained in the order of the oversubscription criteria, as required by the DfES Code of Practice on Admissions;

information about how late applications can be made and will be handled.

1.2 The statutory consultees, when there is an annual consultation about admission arrangements, include neighbouring LEAs, the Governing Bodies of foundation and voluntary-aided schools in Hertfordshire, the Church of England and Roman Catholic church diocesan authorities. The Authority is required to have consulted upon its proposed arrangements by the end of February to determine its admission arrangements by 15th April 2006 and to notify its statutory consultees.

1.3 It is possible, after the determination of admission arrangements, for objections to be made by other admission authorities and various other interested parties, to the Office of the Schools Adjudicator about the arrangements determined by the LEA. Equally, it is possible for the LEA to lodge objections in respect of determined arrangements made by other admission authorities in Hertfordshire and in neighbouring LEAs. Normally, any objection lodged to a determined admission arrangement should be made within 6 weeks of notification of determination of those arrangements.

1.4 Typically, admission authorities are required to consult every year on the admission arrangements they intend to adopt in the following year. The LEA is

the legal admission authority for all community and voluntary-controlled schools, whereas the individual governing body of each foundation and voluntary-aided school is the admitting authority for these categories of schools.

1.5 There was a major review of admission arrangements for community and VC schools in Hertfordshire, which took effect in September 2003. Minor changes have occurred since that time, and there has been a continuing increase in the proportion of families securing admission to a school of their preference.

1.6 In July 2005, the DfES launched a consultation on a revised Code of Practice (COP) on Admission and School Appeals. This consultation finished on 18th October, with the expectation that the revised Codes of Practice would become effective from January 2006, subject to Parliamentary approval. These revised Codes would apply to arrangements that lead to primary and secondary intakes for September 2007.

1.7 The draft Code of Practice on Admissions identifies that some admission authorities have used random allocation as a final tie-breaker, or after other criteria such as siblings, catchment area, feeder schools, etc. It is pointed out that admission authorities need to set out clearly how this will be operated and also how waiting lists would be treated, for example, it would be poor practice to use the results of an earlier round of random allocation when deciding who should be offered a place from a waiting list. This is because this approach would disadvantage those who have applied for a place at the school since the first random allocation was carried out.

1.8 Annex B of the draft COP outlines that all admission arrangements need to have a tie-break clause, in case there are too many applicants in one category. Random allocation is included and it is suggested that this may be used after criteria, such as looked after children and siblings, to decide between applicants as a tie-breaker in place of distance. The DfES has indicated that they consider that random allocation is best used in this way.

1.9 There have been requests to allocate more fairly the limited number of places available from parishes to single sex schools. The scope for allocating places by random allocation is also outlined in this report.

1.10 As part of the annual statutory admissions consultation, it is necessary to consult on the published admission numbers (PANs). In relation to the PANs, background information is available on request. Following determination of admission arrangements, under the School Standards & Framework Act 1998, there is a requirement to publish a notice for every school which has a PAN which is lower than that indicated by the net capacity methodology. It is the responsibility of each admission authority to publish such a notice.

1.11 As is required the full statutory admissions consultation will include the following:

2. Proposed changes to the current arrangements for September 2007

Proposed Change to Single-Sex Admissions Criteria

2.1 Requests have been received to consider alternative, better ways of allocating single-sex places. In March 2004 a petition was presented to the March meeting of the CSF Scrutiny Committee delivered by parents from Bricket Wood complaining about the operation of Rule 6 of the single-sex admission arrangements. For St Stephens Parish, which is to the south of St Albans, the majority of allocations now go to families living in the very nearest part of the parish to St Albans because they are allocated purely on the grounds of distance.

Some of these requests have been based on concerns that the current arrangements favour families living closer to the single-sex school rather than a more even distribution of places within a parish.

2.2 Currently the single-sex rules numbers 6 & 7 are as follows:

Rule 6: Children who live in the priority area. Places will be allocated to each parish or town in proportion to the number of applications made. In the event of there being more applications than places available to a particular parish or town, places will be allocated in the following order:-

i. to those for whom it is their nearest Hertfordshire non-faith maintained school

ii. to those living closest to the school.

Rule 7: Children living outside the priority area who live closest to the school.

These rules are applied in the order they are printed above. If more children qualify under Rules 1 to 5 than there are places available, a tie-break is used by applying the next rule to those children. For rule 6, a tie-break is used based on those children within the parish living nearest to the school.

Proposed Change

2.3 For children who live in the relevant single sex priority area, places would be allocated to each parish/unparished area or town in proportion to the applications made as currently happens. In the event of there being more applications than places available to a particular parish/unparished area or town, places would be allocated on a random basis within each parish/unparished area or town. Based on the pattern of applications and allocations over the last three years approximately seventy per cent of places allocated to each single sex school has been by the Parish rule (Rule 6).

2.4 The effect of randomly offering places would result in them ceasing to be based on distance or closeness to the school and would therefore offer those further away within a parish/unparished area or town an equal opportunity to secure a place. It would have the advantage of allocating places based on applications from parish without reference to home address or school attended.

2.5 It must be borne in mind that in the event of needing to show how the allocations were made, this is unlikely to be possible since some allocations would have been made randomly. This would need to be made clear to parents at the beginning of the process. In the event that it became necessary to re-run the system afterwards, (for example following a recent adjudication, it was necessary to completely restart the allocation processes), the re-running would result in a different outcome and would cause different ripple effects across other school allocations.

2.6 At the continuing interest stage, should places become available, these would be allocated according to the published criteria, and if no applicant met a higher rule, the places available to a parish would again be based on a rerun of the random allocation. Therefore, it would not be possible to prioritise and inform parents of their position on the continuing interest list, unless they met any of the rules above Rule 6.

2.7 Once all applications had been met under the proposed new Rule 6,

“Children who live in the priority area. Places will be allocated to each parish/unparished area or town in proportion to the number of applications made. In the event of there being more applications than places available to a particular parish/unparished area or town, places will be allocated on a random basis for each parish”

children would be allocated from outside the priority area on a random basis, as a revised Rule 7.

3. A consideration of the indicated admission numbers (IANs) derived from the net capacity assessment of 2005, and the proposed published admission numbers (PANs) for 2007 for Community and Voluntary Controlled Schools.

3.1 The Published Admission Numbers (PANs) for individual schools have been developed having taken into account the Indicated Admission Numbers (IANs) as derived by the net capacity assessment conducted earlier this year, the recently developed framework for assessing Published Admission Numbers and the forecast demand as identified in the School Organisation Plan.

3.2 A framework of key factors has been drawn up and considered where the Published Admission Number is lower than that derived from the net capacity for a school, and this is as follows:

(i) the requirement to meet the Key Stage 1 pledge that classes will not exceed 30,

(ii) an increase would compromise equal opportunity principles in terms of equality of access to single sex provision,

(iii) insufficient core, specialist and/or general teaching space to accommodate more pupils than the PAN,

(iv) implications for schools concerning curriculum delivery, class organisation and/or financial projections.

(v) insufficient site capacity for a higher number,(vi) no more places are needed to meet the potential demand,(vii) an interim change is not recommended pending consideration of the

needs across the area,(vii) to balance the places available at linked infant and junior schools or

middle and upper schools,(ix) the ability to integrate pupils from a linked special school or unit,

3.3 Appendix 4 lists the proposed PANs for 2007 for Community and Voluntary Controlled schools, together with information on their PAN 2006 and the IAN 2007.

3.4 For all schools where the proposed PAN 2007 is lower than the IAN 2007, should these numbers subsequently be determined, notices will need to be published. The schools for which the LEA is the admissions authority are listed in the tables below with a comment as to the reasons for setting the PAN below the IAN.

4. A review of Priority Area 6 for co-educational secondary schools.

4.1 It is planned for 2007 admissions to review the Co-educational Priority Area 6 as follows:

(a) moving Watford Rural parish from Priority Area 6 to Priority Area 11, Borehamwood, Bushey and Watford Rural, in order to enhance the chances of children from Maple Cross and Mill End obtaining places at their nearest community school, Westfield Community Technology College, and

(b) withdrawing the parishes of Northwood (in Hillingdon) and Pinner (in Harrow).

Watford Rural Parish

4.2 In looking at the repositioning of Watford Rural parish it is proposed that this option be consulted upon, supporting the need for the LEA to demonstrate its concern to improve access for children from the Maple Cross and Mill End areas to their nearest Hertfordshire community school. Therefore children from Maple Cross and Mill End, if allocated Westfield Community Technology College, would have less far to travel than if allocated to Bushey Hall School, as was the case for admissions in 2005.

At the same time, the LEA has developed an action plan as a result of the conclusion reached by the Office of the Schools Adjudicator following objections lodged by three local primary schools to the Rickmansworth School’s admission arrangements for 2006. The Adjudicator determined that the admission arrangements for entry 2006 should be the same as those used for September 2005.

4.3 The effect, based on the 2005 admissions data, would be that twenty three children (without sibling connections) who live in Watford Rural would be displaced from Westfield Community Technology College and would have been replaced by the following:

Westfield reached its admission number after allocating pupils under Rule 7 (children who live in the priority area). Consequently this could affect the satisfaction levels for parents living in Watford Rural.

4.4 The table below shows examples of distances from Watford Rural parish:

4.5 The effect of this proposal would be that the nearest community school within the priority area for this community is more than seven miles way, although based on the experience of previous years Bushey Hall School (a foundation school), had an agreement for the LEA to allocate children as non-ranked allocations. For some of the displaced Watford Rural children their closest school would be Bushey Hall. Additionally, Francis Combe School (although not in the proposed priority area) has been undersubscribed in recent years and, therefore, is likely to accept applications under rule 9 and the table above illustrates the distance range from Watford Rural parish.

4.6 The advantage of this proposal would be that parents and children from Mill End and Maple Cross could be more satisfied, but there could be balancing

levels of dissatisfaction from residents living in Watford Rural, as the current pattern of preferences indicates that parents rarely consider Francis Combe or Hertswood. For some of the dissatisfied families living in Watford Rural, under this proposal they would have less far to travel to a non-ranked school than currently is the case for those living in Mill End and Maple Cross who receive a non-ranked allocation.

Withdrawal of the parishes of Northwood (in Hillingdon) and Pinner (in Harrow)

4.7 It is proposed to consult upon the withdrawal of the above two “parishes” based on the recent trends over the last two years, where no preferences have been received for community secondary schools from either of these areas.

5. Proposal to split Letchworth Garden City and Hitchin for single-sex allocations

5.1 It is proposed to review the single sex arrangements for Hitchin Boys and Hitchin Girls, to split the existing combined area of Hitchin and Letchworth Garden City, to offer the same division between these towns as used for the co-educational priority areas.

5.2 The advantage of such a change is that it would offer a consistent division between the two towns for both single-sex and co-educational purposes and (particularly if coupled with the proposed change from distance to random allocation) will ensure that each town obtains a fair proportion of places based on the numbers of applications from each.

Consultation arrangements

6.1 The proposed arrangements for the Authority’s consultation on its admission arrangements to take effect from September 2007 are set out in Appendix 1 . An outline timetable is provided.

6. Oversubscription Criteria (Admission Rules)

7.1 The oversubscription criteria (rules) to be used and the order in which they will be applied to allocate places if the school receives more applications than there are places available are set out as follows:

Co-educational community and voluntary-controlled primary, junior, infant and nursery schools (Appendix 2)

Co-educational and single-sex community and voluntary-controlled secondary schools (Appendix 3).

With regard to the admissions criteria for Tring School, we are currently in discussion with the school and will provide a verbal update at Cabinet. Currently the rules are not fully compliant with those in the Code of Practice on Admissions.

7. Sixth Form Arrangements

8.1 Arrangements for admission to the Sixth Forms of community and voluntary-controlled schools have traditionally been administered by the individual schools themselves. The current Admissions Code of Practice introduced a requirement for an appeals system and the determination of an admission number for each Sixth Form.

8.2 The admission number for Sixth Forms will only be applied to students who have not previously attended the school’s Year 11. For example if a school has a Sixth Form admission number of 150 and has 162 applicants from Year 11 who meet its admission criteria all should be offered places. If there are 127 eligible applicants from within the school, then there will be 23 places available for students from other schools. The admission number only applies to admission to the Sixth Form and would not guarantee access to any particular course.

8.3 It is proposed at this stage to consult on the basis of an admission number determined by the school, but recognizing the role of the 14-19 Partnership planning groups within Hertfordshire. A verbal update will be given to Cabinet at its meeting on 12 December 2005. Should this number not be reached from pupils in the school’s Year 11 cohort, then further pupils up to this number who meet the admission criteria will be eligible to join the school from elsewhere.

8.4 A summary of the current criteria, adopted in April 2005, for admission to the sixth form for Hertfordshire secondary schools is set out at Appendix 5.

8. Co-ordinated Schemes of Admission for Primary and Secondary Schools

9.1 The proposed schemes for 2007-2008, incorporating the necessary changes relating to Inter-LEA and Pan-London co-ordination, are attached at Appendix 6.

10. Access to Service Implications

School admission arrangements should work for the benefit of all parents and children in an area. The arrangements should be as clear and as simple as possible for parents to use and help them to take the best decision about the preferred school for their children. THE RULES FOR COMMUNITY AND VOLUNTARY-CONTROLLED NURSERY, FIRST, INFANT,PRIMARY, JUNIOR AND MIDDLE SCHOOLS ARE AS FOLLOWS:

Rule 1 Children who have a Statement of Special Educational Needs which names the school.

Rule 2 Children for whom it can be demonstrated that they have a particular medical or social need to go to the school, and those who are in public care.

A panel of officers will determine whether the evidence provided is sufficiently compelling to meet the requirements for this rule.

Rule 3 In the case of junior schools, children who attend the linked infant school at the time of their application.

Rule 4 Children who have a brother or sister on the roll of the school or linked school at the time of application.

This applies to reception through to Year 5 in infant, junior and primary schools; and from reception through to Year 3 in first schools; and from year 5 to year 7 in middle schools. A sibling means the sister, brother, half brother or sister, adopted brother or sister, or child of the parent/carer or partner, and in every case living in the same house from Monday to Friday.

Rule 5 Children for whom the school is their nearest community or voluntary-controlled school.

These will be measured using ‘the shortest designated route’ which is: a public route with a proper made-up surface, such as tarmac or

concrete; a road which does not need to have a separate pavement; or a cycleway adopted by Hertfordshire County Council (subject to further

consideration of these routes).

The route can be lit or unlit.

Rule 6 Children who live nearest to the school.

We apply these rules in the order that they are printed above. If more children qualify under a particular rule than there are places available, we use a tiebreak by applying the next rule to those children.

An application has not been made until both the main Hertfordshire application form has been filled in and should a voluntary-aided or foundation school require it, that school’s supplementary form.

Rule 5 Children who live in the priority area for the school and who demonstrate an aptitude in the area of the school’s specialism (with those demonstrating the greatest aptitude being given priority). This rule applies to 10% of places in those schools determined by the LEA having regard to the wishes of their Governing Bodies.

This rule will be applied at the request of any Governing Body with an appropriate specialism. No Governing Body has asked for it to be applied in previous years.

Rule 6 Children who live in the priority area and for whom it is their nearest Hertfordshire maintained non-faith co-educational school. Where more children qualify under this rule than there are places available, places will be allocated to those who live nearest to the school.

THE RULES FOR TRING VOLUNTARY-CONTROLLED CO-EDUCATIONAL SCHOOL ARE AS FOLLOWS:

Rule 1 Children who must go to Tring School because they have a statement of special educational needs under the Education Act 1996 which names the school.

Rule 2 Children who can prove that they have a particular medical or social reason why they must go to the school. (Professionally supplied)

Rule 3 Up to a maximum 10 places will be available for children who can prove that they have specific religious reasons for attending Tring School.

Priority will be given to children whose parents have been active Church attendees (eg at least once a month) over a period of time. Applications must be supported by a letter from a Priest or Minister. If there are more than ten applications which meet this criteria, priority will be given to those who live nearest the school.

Rule 4 Children of staff permanently employed at the school in order to reduce recruitment and/or retention difficulties.

Rule 5 Children who have an elder brother or sister at the school at the time of application.

Rule 6 Children who live in the parishes of Tring, Tring Rural, Aldbury, Wigginton and Little Gaddesden.

If there are more children living in these parishes than there are places then we will give priority to those who live nearest to the school.

Rule 7 Children who live nearest to Tring School.

Note: We are currently in discussion with Tring School to consider reviewing the admission arrangements for the school upon which to consult for 2007.

Published Admission Numbers (PAN)

The LEA, as an admission authority, is required to consult on the admission numbers for any years (relevant age group) for which it is intended to admit pupils for the first time, including Year 12, and, in the case of boarding schools any separate admission numbers for day and boarding pupils.

The PAN is set with regard to the assessed Net Capacity of the school.If the PAN is lower than indicated by the capacity assessment, this information must be published and parents/carers have the right to object. A PAN may also be set at a higher level than indicated by the capacity assessment and it is possible under exceptional circumstances to admit pupils above the published number. Normally, however, admission authorities need to consult before setting or amending an admission number.

The following schedule sets out the PANs for Hertfordshire’s Community and Voluntary-Controlled schools for 2007-2008. The LEA is required to have an on-going process of monitoring and reviewing school provision generally and admission numbers in particular. It may be necessary for some adjustments to be made between now and September 2007. The LEA will involve the schools concerned and keep the Admission Forum informed of any such changes.

Hertfordshire has concluded that there are several geographical areas in which the quantity of surplus places in schools are such that a review of school provision is required. Inevitably this may have an impact on the admission numbers of some schools.

The areas which have been identified and the timetables for these reviews is detailed below.

SIXTH FORM ARRANGEMENTS

1.1 Arrangements for admission to the Sixth Forms of community and voluntary-controlled schools have traditionally been administered by the individual schools themselves. The Admissions Code of Practice introduced a requirement for an appeals system and the determination of an admission number for each Sixth Form.

1.2 The admission number for Sixth Forms will be applied only to students who have not previously attended the school’s Year 11and who are therefore being admitted for the first time to the roll of the school in Year 12.

CO-ORDINATED ADMISSION SCHEME FOR PRIMARY SCHOOLS IN THE AREA OF HERTFORDSHIRE LOCAL EDUCATION AUTHORITY

The Scheme of Co-ordination is set out below. This is in accordance with Section 89B of the Schools Standards and Framework Act 1998(SSFA). The dates relating to the admissions process for the school year 2007-2008 are attached within Schedules 2 and 3.

Interpretation1. In this scheme –

“the LEA” means Hertfordshire County Council acting in their capacity as local education authority;

“the LEA area” means the area in respect of which the LEA are the local education authority;

“Primary education” has the same meaning as in section 2(1) of the Education Act 1996;

“Primary school” has the same meaning as in section 5(1) of the Education Act 1996;

“school” means a community, foundation, or voluntary school (but not a special school”) which is maintained by the LEA;

“VA schools” means such of the schools as are voluntary-aided schools;

“Foundation schools” means such of the schools as have foundation status;

“admission authority” means, in respect of any of the schools which is a community or voluntary-controlled school, the LEA and, in respect of any of the schools which is a foundation or VA school, the governing body of that school;

“the equal preference system” the scheme operated by Hertfordshire County Council whereby all preferences listed by parents/carers on the common application form are considered under the over-subscription criteria for each school without reference to parental rankings. Where a pupil is offered a place at more than one school, the rankings are used to determine the single offer by selecting the one ranked highest on the common application form.

“the specified year” means the school year beginning at or about the beginning of September 2007;

“admission arrangements for the specified year” means the arrangements for a particular school or schools which govern the procedures and decision-making for the purposes of admitting pupils to the school(s) during the specified year.

“application form” means the application form supplied by the LEA on paper or electronically;

APPENDIX 6“In-Year (casual) admission” means any application for a school place in primary education that is received after 1 September of the normal admission year or in subsequent years.

“late application” means any application for a school place in primary education that is received in the normal admission round but later than the deadline date stated for receipt of ontime applications stipulated in the scheme.

When an application is received, this is treated as representing the preference(s) from the parent/carer with parental responsibility. Only one application form per child will be accepted.

Commencement and extent2. Application made to a nursery, first, infant, primary, junior and middle school for a

place other than at the normal time of entry for that school will be processed through the in-year admissions procedure. The parent/carer in each case will be informed of this process in writing by the LEA.

3. The LEA will include in its admission arrangements for the specified year the provisions set out in the Schedules 1 to 5 to this scheme, or provisions having the same effect.

4. The governing body of each of the VA and foundation schools will include in its admission arrangements for the specified year the provisions set out in the Schedules 1 to 5, so far as relevant to that school, or provisions having the same effect.

SCHEDULE 1PART 1 - CO-ORDINATED ARRANGEMENTS – PRIMARY

1. There will be a standard application form, supplied by Hertfordshire County Council. Parents/carers will also be able to apply on-line for a school place, at www.hertsdirect.org/admissions

2. The application forms will be used for the purpose of admitting pupils into the first year of primary education.

3. The application form must be used:

(a) as a means of expressing one or more preferences for the purposes of section 86(1) of the School Standards and Framework Act 1998, by parents/carers wishing to express a preference for their child to be admitted to any of the schools for which the LEA’s arrangements under that section should apply; and

(b) as a means of applying for one or more school places,

1. by parents/carers wishing their child to be admitted to any of the foundation or VA schools; and

2. by parents/carers resident outside the LEA area wishing their child to be admitted to any of the LEA’s schools.

4. The application form will –

(a) invite the parent/carer to express a preference – or to apply for a place – by completing the form and by nominating up to three schools;

(b) invite the parent/carer, where they wish to nominate more than one school, to rank their nominations in the order in which they desire their child to receive an offer of a place at the respective schools;

(c) invite the parent/carer to give their reasons for each preference;

(d) explain that the parent/carer will receive no more than one offer of a school place in the LEA’s area in response to the application form;

(e) explain that, where such an offer is made, it will be for the highest ranked school nominated at which a place has been allocated;

(f) explain that, if more than one school is nominated and no order of ranking is stated, or a wish expressed that they be ranked equally, the parent/carer will be regarded as having ranked the schools in the order appearing on the form (the first-mentioned being ranked the highest).

5. The application form will also specify the closing date and where it must be returned, in accordance with paragraphs 8,9 and 10.

APPENDIX 66. The LEA will make appropriate arrangements to ensure –

(a) that the application form is available on request from the LEA; and

(b) that the application form is accompanied by a written explanation of the key features of the co-ordinated admissions scheme and where further explanation about the scheme can be obtained.

7. The LEA will take all reasonable steps to ensure that all parents/carers of children of the appropriate age resident in Hertfordshire receive a copy of the application form (and written explanation) and understand the process.

8. All preferences expressed on the Hertfordshire standard application form (in paper or electronic formats) are valid applications. The form may be returned electronically to the LEA. Otherwise, the paper form may be returned either to one of the ranked primary schools or direct to the LEA.

9. The governing body of a foundation or VA school is entitled to request or require parents/carers who wish to nominate, or have nominated, that school on the application form to provide additional information to the school on a supplementary form. Where this is requested or required, the details and procedural arrangements are entirely at the discretion of the foundation or VA school in question, except that –

(a) the form must not request any information about the ranking which the parent/carer attaches to any school they have nominated or may nominate, except where the school requires the information to apply their own admission arrangements.

(b) A parent/carer cannot be required to collect a form in person.

(c) The arrangements must be such as to enable relevant decisions to be made in conformity with the timing requirements of this scheme.

(d) The information on that form will not infringe any statutory right of the parent or child.

Where such a supplementary form is received, it will not be regarded as a valid application unless the parent/carer has also completed the Hertfordshire standard form. Supplementary forms should be returned direct to the school concerned. Any received by the LEA will be date stamped and passed on to the school.

Processing of Application Forms10. Completed application forms are to be returned to the LEA by the closing date.

11. Completed application forms that are received after the closing date will be considered after all ontime applications up to 22 December 2006 when it is necessary to stop processing late applications to ensure allocations day is met.

12. The LEA will process all application forms. Any completed application forms must be treated as a confidential communication. VA and foundation schools will, however, be provided with a list of relevant details of those pupils for whom they are a preference.

13. The process of allocating places at schools that have not been given as a preference on an application form (i.e. those pupils for whom it has not proved possible to

APPENDIX 6allocate a place at a school of preference) will be carried out after all ranked applications have been considered, including those received after the closing date.

14. All processing and notifications in the following paragraphs must be completed in accordance with the written timetable.

Determining offers in response to the application form15. The LEA will act as a clearing house for the allocation of places by the relevant

admission authorities in response to the application form. Except where acting in its separate capacity as an admission authority, the LEA will not be making any decision with respect to the offer or refusal of a place in response to any application form.

16. Where a foundation or VA school is listed on the standard application form, the LEA will forward the appropriate details to the Governing Body, including the relevant supplementary information. The admission authority for each school will then provide the LEA with a list of pupils indicating the order in which places should be allocated under each criterion. This list will exceed the school’s admission number by 25% for each criterion listed and will include only pupils for whom the LEA received an application form.

17. The Hertfordshire standard form cannot be used for application to a school in

another LEA. Such applications must be made on the application form from the maintaining LEA.

18. Following the allocation process, the admission authority for each school will provide the LEA with a continuing interest list of nominations for which they were not able to allocate a place provisionally.

19. No decision by an admission authority on any nomination shall pay any regard to the ranking expressed by any parent/carer (except as provided in paragraph 9).

20. During the allocation process, the LEA will match the provisional allocations of places against each parent’s/carer’s ranking and proceed as follows:

Where a parent/carer has been provisionally allocated a place at the school which they ranked first – the allocation will become firm. The LEA will then withdraw any provisional allocation of a place for that parent/carer at schools which the parent/carer ranked second or third or remove the parent’s/carer’s nomination from a school’s continuing interest list (as the case may be).

Where a parent/carer has not been provisionally allocated a place at the school which they ranked first, but has been provisionally allocated a place at the school which they ranked second – the LEA will hold the provisional allocation for that parent/carer, pending further rounds, and will withdraw any provisional allocation of a place for that parent/carer at the school which the parent/carer ranked third or remove the parent’s/carer’s nomination from the school’s continuing interest list (as the case may be).

Where a parent/carer has not been provisionally allocated a place at the school which they ranked first or second, but has been provisionally allocated a place at the school which they ranked third – the LEA will hold the provisional allocation for that parent/carer, pending further rounds.

21. When a provisional allocation is withdrawn, the LEA will provisionally allocate the place instead to one of the nominations on the waiting list in accordance with the over-subscription criteria for that school and their ranking against those criteria. The processes in paragraph 19 will then be repeated and will continue until the LEA is unable to withdraw any provisional allocations. The LEA will require additional names (25% above the admission number for each criterion listed) at the start of the process, so that schools will not need to be contacted at each iteration.

22. All allocations then in existence will become firm allocations of a place at the school concerned and parents/carers will be offered those places accordingly. All parents/carers whose nominations then remain on the continuing interest list for a school will be treated as having been refused a place by the admission authority for that school.

23. At the end of the allocation process, all admitting authorities will receive from the LEA an audit trail demonstrating how the final allocations were made through the iterative process.

Children who have not been allocated a place in the iterative processes24. The LEA will match:

(a) those children of parents/carers resident in the LEA area that require to be admitted in the specified year but have received no offer of a place under the above procedure, against

(b) those of the schools that, on the basis of their published admission number, appear to the LEA likely to have places remaining unfilled after the procedure above.

25. The criteria used by the LEA for matching will allocate pupils to their nearest suitable available school using the shortest designated route, unless that route would require transport to be provided on safety grounds and there is an alternative school on a safe walking route, which is under the statutory distance for entitlement to free transport. Then, this school will be allocated instead.

26. The LEA will notify each of the schools in paragraph 24 (b) of the children which it has matched to that school.

27. The admission authority for the school will consider each of the children notified under paragraph 25 for a place at the school on the same basis as if the LEA’s notification were an application (or preference) made by the child’s parent/carer falling within section 86 of the 1998 Act. The admission authority will notify the LEA of the children to whom it has allocated (or refused) a place.

28. Further rounds of the procedure in paragraphs 24 to 27 will be undertaken if necessary.

Notification to parents/carers29. The LEA will communicate to all parents/carers to whom offers can be made,

notifying them of an offer of a place:

a) at one of the schools nominated on their application form; or

b) at another school – in addition in such a case they will provide the parent/carer with a list of other community or VC schools with suitable Primary places available and of any foundation or VA schools that have notified the LEA that they have places available.

Continuing Interest30. After parents/carers have been notified of the offer of a school place, it is open to

them to accept that place but also to indicate continuing interest at a school that they rank at a higher preference. This could mean that in iterations immediately following dd.mm.yy, a place at their preferred school could become available and a subsequent offer made. This process does not take away the parents/carers right of appeal to an independent appeal panel.

The right to appeal31. The LEA’s communication will give parents/carers appropriate information about their

right of appeal against any refusal of a place by the admission authority for a school under the procedures in this scheme.

Co-ordinated scheme32. This scheme of co-ordination relates to all primary schools listed in Schedule 5 of

this document.

SCHEDULE 1 – PRIMARY CO-ORDINATIONPART 2 – IN-YEAR (CASUAL) ADMISSIONS: THE PROCEDURE AFTER THE

NORMAL DATE OF TRANSFER

Community and Voluntary-controlled Primary SchoolsThe responsibility for dealing with such applications is delegated to individual primary, junior and middle schools in Hertfordshire.

Parents/carers will be required to complete a standard Hertfordshire form.

In some areas of the county, primary school provision within a locality has to be looked at with a view to reorganisation and rationalisation of places. Under these circumstances there is a need for the management of a planned and orderly transfer of pupils to any new schools. We anticipate that in future, local frameworks will be drawn up and that the arrangements will need to be operated in place of the normal continuing interest processes.

Places will be allocated on the basis of the rules (over-subscription criteria) which apply for the main round of admissions. The highest priority therefore will be afforded to children with statements of Special Educational Needs naming the school and children in public care.

Where there is a vacancy, and there is no child on the continuing interest list with a higher priority, a place will be offered and the LEA notified.

Where the school does not have a vacancy, or there are other children on the continuing interest list with a higher priority, the parents/carers will:

Receive an appropriate letter of refusal Be referred back to the LEA in order to seek information about places at another

primary school Be informed of their right of appeal to an independent appeal panel Be offered the option of a place on the continuing interest list

Foundation or Voluntary-aided Primary SchoolsThe parent/carer will be required to complete a standard Hertfordshire form in addition to documentation required by the school.

Where a foundation or VA school receives a direct application and there is a vacancy with no other child on the continuing interest list with a higher priority, a place will be offered and the LEA notified.

Where the school does not have a vacancy, or there are other children on the continuing interest list with a higher priority, the parents/carers will:

Receive an appropriate letter of refusal Be referred back to the LEA in order to seek information about places at another

primary school Be informed of their right of appeal to an independent appeal panel Be offered the option of a place on the continuing interest list

APPENDIX 6

CO-ORDINATED ADMISSION SCHEME FOR SECONDARY AND UPPER SCHOOLS IN THE AREA OF HERTFORDSHIRE LOCAL EDUCATION AUTHORITY

The Scheme of Co-ordination is set out below. This is in accordance with Section 89B of the Schools Standards and Framework Act 1998(SSFA). The dates relating to the admissions process for the school year 2007-2008 are attached at Schedule 2.

Interpretation

1. In this scheme –

“the LEA” means Hertfordshire County Council acting in their capacity as local education authority;

“the LEA area” means the area in respect of which the LEA are the local education authority;

“home LEA” means the LEA in which the applicant is resident.

“secondary education” has the same meaning as in section 2(2) of the Education Act 1996;

“secondary school” has the same meaning as in section 5(2) of the Education Act 1996;

“school” means a community, foundation, or voluntary school (but not a special school”) which is maintained by the LEA; “VA schools” means such of the schools as are voluntary-aided schools;

“Foundation schools” means such of the schools as have foundation status;

“admission authority” means, in respect of any of the schools which is a community or voluntary-controlled school, the LEA and, in respect of any of the schools which is a foundation or VA school, the governing body of that school;

“the equal preference system” the scheme operated by Hertfordshire County Council whereby all preferences listed by parents/carers on the common application form are considered under the over-subscription criteria for each school without reference to parental rankings. Where a pupil is offered a place at more than one school, the rankings are used to determine the single offer by selecting the one ranked highest on the common application form.

“the specified year” means the school year beginning at or about the beginning of September 2007;

APPENDIX 6“admission arrangements for the specified year” means the arrangements for a particular school or schools which govern the procedures and decision-making for the purposes of admitting pupils to the school(s) during the specified year.

“application form” means the application form supplied by the LEA on paper or electronically;

“In-Year (casual) application” means any application for a school place in secondary education that is received after 1 September of the normal admission year or in subsequent years.

“late admission” means any application for a school place in secondary education that is received in the normal admissions round but later than the deadline date stated for receipt of ontime applications stipulated on the scheme.

When an application is received, this is treated as representing the preference(s) from the parent/carer with parental responsibility. Only one application form per child will be accepted.

Commencement and extent

2. Application made to a secondary or upper school for a place other than at the normal time of entry to that school will be processed through the in-year admissions procedure. The parent/carer in each case will be informed of the process in writing by the LEA.

3. The LEA will include in its admission arrangements for the specified year the provisions set out in the Schedules 1 to 3 to this scheme, or provisions having the same effect.

4. The governing body of each of the VA and foundation schools will include in its admission arrangements for the specified year the provisions set out in the Schedule 1 to 3, so far as relevant to that school, or provisions having the same effect.

SCHEDULE 1 – SECONDARY and UPPER CO-ORDINATIONPART 1 - CO-ORDINATED ARRANGEMENTS

1. There will be a standard application form, supplied by Hertfordshire County Council. Parents/carers will also be able to apply on-line for a school place, at www.hertsdirect.org/admissions

2. The application form will be used for the purpose of admitting pupils into the first year of secondary or upper education in the specified year.

3. The application form must be used:

(a) as a means of expressing one or more preferences for the purposes of section 86(1) of the School Standards and Framework Act 1998, by parents/carers wishing to express a preference for their child to be admitted to any of the schools for which the LEA’s arrangements under that section should apply; and

(b) as a means of applying for one or more school places, by parents/carers wishing their child to be admitted to any of the foundation or VA schools.

4. The application form will –

(a) invite the parent/carer to express a preference by completing the form and by nominating three schools;

(b) invite the parent/carer to rank their nominations in the order in which they desire their child to receive an offer of a place at the respective schools;

(c) invite the parent/carer to give their reasons for each preference;

(d) explain that the parent/carer will receive no more than one offer of a school place in response to the application form;

(e) explain that, where such an offer is made, it will be for the highest ranked school nominated at which a place has been allocated;

(f) explain that, if more than one school is nominated and no order of ranking is stated, or a wish expressed that they be ranked equally, the parent/carer will be regarded as having ranked the schools in the order appearing on the form (the first-mentioned being ranked the highest).

5. The application form will also specify the closing date and where it must be returned, in accordance with paragraphs 11 and 12.

6. The LEA will make appropriate arrangements to ensure –

(a) that the application form is available on request from the LEA; and

(b) that the application form is accompanied by a written explanation of the key features of the co-ordinated admissions scheme.

APPENDIX 67. The LEA will take all reasonable steps to ensure that the parent/carer of children

resident in the Hertfordshire LEA area of the appropriate age receive a copy of the application form (written explanation) and understand the process.

8. All preferences expressed on the Hertfordshire standard application form (in paper or electronic formats) are valid applications. (Hertfordshire cannot accept forms from other LEAs, which will be returned to the home LEA. Where an application for a Hertfordshire school is made on their home LEA’s form by an out-county applicant, this will also be considered to be a valid application. Hertfordshire residents must use the Hertfordshire form and return it to Hertfordshire. The principle is that the home LEA’s form is used – even where the application is for an out-county school).

9. The governing body of a foundation or VA school is entitled to request or require parents/carers who wish to nominate, or have nominated, that school on the application form to provide additional information to the school on a supplementary form. Where this is requested or required, the details and procedural arrangements are entirely at the discretion of the foundation or VA school in question, except that –

(a) the form must not request any information about the ranking which the parent/carer attaches to any school they have nominated or may nominate, except where the school requires the information to apply their own admission arrangements.

(b) A parent/carer cannot be required to collect a form in person.

(c) The arrangements must be such as to enable relevant decisions to be made in conformity with the timing requirements of this scheme.

Supplementary forms should be returned direct to the school concerned. Where such a supplementary form is received, the parent/carer should also have completed the home LEA standard form.

10. Any secondary school which operates criteria for selection by ability or aptitude must ensure that its arrangements for assessing ability or aptitude are such as to enable decisions to be made on nominations in conformity with the timing requirements of this scheme.

Inter-LEA Co-ordination

11. The LEA will manage allocations in line with the Pan-London Co-ordinated Admissions System (this comprises thirty nine local authorites and and adjacent to London, further further information please contact [email protected]). Application data relating to applications to schools in other English LEAs will be forwarded via S2S (S2S is a website designed to transfer data between LEAs and schools securely)` or the Pan London Register as appropriate.

12. Information will be exchanged by LEAs via S2S or the Pan London Register in order that each child receives the highest ranked school place possible. As far as reasonably practicable, all offers of secondary school places will be made on 1 March.

APPENDIX 6Processing of Application Forms

13. Completed application forms are to be returned to the home LEA by the due date.

14. Applications on the Hertfordshire standard form received directly by schools should be date stamped and passed onto the LEA. Similarly, supplementary forms returned to the LEA will be date stamped and passed on to the relevant school.

15. Completed application forms that are received after the closing date will be considered, except that the procedure must not prevent the proper processing under the scheme of application forms received on time.

16. The LEA will process all application forms. All completed application forms must be treated as a confidential communication. VA and foundation schools will, however, be provided with a list of relevant details of those pupils for whom they are a preference. In addition information relating to parents/carers ranking of a non-faith school or one of a different faith may be provided to those church schools where such ranking is a criterion.

17. All ranked applications received by the deadline will be considered before any ranked applications received after this deadline.

18. The process of allocating places at schools which have not been given as a preference on an application form (i.e. those pupils for whom it has not proved possible to allocate a place at a school of preference), will be carried out after all ranked applications have been considered, including those received after the closing date.

19. All processing and notifications in the following paragraphs must be completed in accordance with the written timetable.

Determining offers in response to the application form

20. The LEA will act as a clearing house for the allocation of places by the relevant admission authorities in response to the application form. Except where acting in its separate capacity as an admission authority, the LEA will not be making any decision with respect to the offer or refusal of a place in response to any application form.

21. Where a foundation or VA school is listed on the standard application form, the LEA will forward the appropriate details to the Governing Body, including, if necessary, relevant additional information (see para 16 above). The admission authority for each school will then provide the LEA with a list of pupils indicating the order in which places should be allocated under each criterion. Wherever practicable, this list will exceed the school’s admission number (25% above the admission number for each criterion listed), and will include only pupils for whom the LEA received an application form. This information will be provided to the LEA by the specified date.

22. In any instance where a school in another LEA is listed on the standard Hertfordshire form, details will be forwarded to that LEA. (See paras 11 & 12 above).

23. Following the allocation process, the admission authority for each school will provide the LEA with a waiting list of nominations for which they were not able to allocate a place provisionally.

APPENDIX 624. No decision by an admission authority on any nomination shall pay any regard to the

ranking expressed by any parent/carer (except as provided in paragraph 9).

25. During the allocation process, the LEA will match the provisional allocations of places against each parent’s/carer’s ranking and proceed as follows:

Where a parent/carer has been provisionally allocated a place at the school which they ranked first – the allocation will become firm. The LEA will then withdraw any provisional allocation of a place for that parent/carer at schools which the parent/carer ranked second or third or remove the parent’s/carer’s nomination from a school’s waiting list (as the case may be).

Where a parent/carer has not been provisionally allocated a place at the school which they ranked first, but has been provisionally allocated a place at the school which they ranked second – the LEA will hold the provisional allocation for that parent/carer, pending further rounds, and will withdraw any provisional allocation of a place for that parent/carer at the school which the parent/carer ranked third or remove the parent’s/carer’s nomination from the school’s waiting list (as the case may be).

Where a parent/carer has not been provisionally allocated a place at the school which they ranked first or second, but has been provisionally allocated a place at the school which they ranked third – the LEA will hold the provisional allocation for that parent/carer, pending further rounds.

26. When a provisional allocation is withdrawn, the LEA will provisionally allocate the place instead to one of the nominations on the waiting list in accordance with the over-subscription criteria for that school and their ranking against the criteria. The processes in paragraph 28 will then be repeated and will continue until the LEA is unable to withdraw any provisional allocations. The LEA will require additional names (25% above the admission number for each criterion listed) at the start of the process, so that schools will not need to be contacted at each iteration.

27. All allocations then in existence will become firm allocations of a place at the school concerned and parents/carers will be offered those places accordingly. All parents/carers whose nominations then remain on the waiting list for a school will be treated as having been refused a place by the admission authority for that school.

28. At the end of the allocation process, all admitting authorities will receive from the LEA an audit trail demonstrating how the final allocations were made through the iterative process.

Late Applications

29. Late applications will be processed after the admission rules have been applied to all ranked applications received on time.

APPENDIX 6Children who have not been allocated a place in the iterative processes

30. The LEA will match:

(a) those children of parents/carers resident in the LEA area that require to be admitted in the specified year but have received no offer of a place under the above procedure, against

(b) those of the schools that, on the basis of their published admission number, appear to the LEA likely to have places remaining unfilled after the procedure above.

31. The criteria used by the LEA for matching will allocate pupils to their nearest suitable available school using the shortest designated route, unless that route would require transport to be provided on safety grounds and there is an alternative school on a safe walking route, which is under the statutory distance for entitlement to free transport. Then, this school will be allocated instead.

32. The LEA will notify each of the schools in paragraph 28 (b) of the children which it has matched to that school.

33. The admission authority for the school will consider each of the children notified under paragraph 30 for a place at the school on the same basis as if the LEA’s notification were an application (or preference) made by the child’s parent/carer falling within section 86 of the 1998 Act. The admission authority will notify the LEA of the children to whom it has allocated (or refused) a place.

34. Further rounds of the procedure in paragraphs 30 to 32 may be undertaken if necessary.

Notification to parents/carers

35. The LEA will communicate with all parents/carers to whom offers can be made, notifying them of an offer of a place:

a) at one of the schools nominated on their application form; or

b) at another school – in addition, in such a case they will provide the parent/carer with a list of other community or VC schools with secondary places available and of foundation or VA schools that have notified the LEA that they have places available. (As the home LEA, Hertfordshire will notify all Hertfordshire applicants of the offer of a place – even where that place is at an out-county school).

Continuing Interest

36. After parents/carers have been notified of the offer of a school place, it is open to them to accept that place but also to indicate continuing interest for a maximum of three schools. This could mean that in iterations immediately following 1 March, a place at their preferred school could become available and a subsequent offer made. This process does not take away the parent’s/carer’s right of appeal to an independent appeal panel.

SCHEDULE 1 – SECONDARY and UPPER CO-ORDINATIONPART 2 – IN-YEAR (CASUAL) ADMISSIONS: THE PROCEDURE AFTER THE

NORMAL DATE OF TRANSFER

Parents/carers will be sent the necessary information (In-Year [Casual] Admissions Pack) within 5 working days of the LEA receiving the request.

Community and Voluntary-controlled Secondary and Upper Schools

Parents/carers will be required to complete the standard Hertfordshire form and return it to the LEA.

Places will be allocated on the basis of the rules (over-subscription criteria) which apply for the main round of admissions. The highest priority therefore will be afforded to children with statements of Special Educational Needs naming the school and children in public care.

Where there is a vacancy, and there is no child on the continuing interest list with a higher priority, a place will be offered. If this is not possible, other schools nominated on the standard form will be considered in ranking order.

Where one or more schools nominated on the form is a foundation or VA school, the LEA will liaise with the school and forward appropriate information as necessary.

If no place is available at a school for which a preference has been expressed, then a place will be offered at the nearest appropriate school with a vacancy.

Children who have not been offered a place at a preferred school may have their name placed on a continuing interest list for the school. The continuing interest list will be ranked according to the school’s oversubscription criteria.

Parents/carers will receive an offer letter detailing the place to be offered and the reasons why a higher ranked school could not be offered (if appropriate). Parents/carers will be informed of their right of appeal to an independent appeals panel.

Foundation or Voluntary-aided Secondary and Upper Schools

Where a foundation or VA school receives a direct application and there is a vacancy with no other child on the continuing interest list with a higher priority, the place can be offered and the LEA notified.

Where the school does not have a vacancy, or there are other children on the continuing interest list with a higher priority, the parents/carers will:

Receive an appropriate letter of refusal Be referred back to the LEA in order to seek a place at another secondary school Be informed of their right of appeal to an independent appeal panel Be offered the option of a place on the continuing interest list

Hertfordshire County Council is in the process of developing a Hard to Place Protocol, and it is expected that this will be in place shortly in order to meet the forthcoming guidance that will be contained within the new Code of Practice on Admissions. The Hard to Place Protocol covers the admission of hard to place pupils beyond the normal point of admission, which may result in a school being asked to take a pupil above their PAN (published admission number).
