5. Review of assistance received by MOSA since 1993

Since its establishment in 1993, the Ministry of Social Affairs has receivedsubstantial amounts of multilateral (Phare programme) and bilateral (MemberState) assistance (Annex 6).

The Estonian Government will ensure that there is no duplication betweenexisting and past programmes, whether bilateral or multilateral, and thisproject; for future programmes, the same objective will be pursued.

0 1 6. Policy and legal environment for the present project

1) The Ministry of Social Affairs of Estonia (MoSA) has worked out theNational Working Environment Policy (approved on the 2nd of June1998 by the Government of the Republic of Estonia) (Annex 12) as a part ofthe development process of a competitive economic infrastructure. 2. As a result of the National Working Environment Policy

The new Draft Act

of Occupational Health and Safety has been drafted in MoSA and wasapproved by the Government on 2 June 1998 and submitted to the Riigikogu(Parliament), (expected date of the Parliament approval is the end of the IIQuarter 1999) (Annex 13). Pursuant to the draft Act nine secondary legal actshave been drafted. These acts will be enacted after the adoption of the Act ofOccupational Health and Safety and regulate the following issues:• Occupational safety and health requirements for the workplace;• Requirements for personal protective clothing and equipment;• Occupational safety and health requirements for construction sites and

asbestos;• Occupational safety and health requirements to avoid risk to health due to

carcinogenes.

The new Draft Act of Occupational Health and Safety lays the foundationfor a modern working environment in which social partners have substantialinfluence over the development of working environment issues.

3. The new Chemicals Act adopted on 6 May 1998, complements the Draft Actof Occupational Health and Safety and creates a legal basis for preventing orreducing the damage from the chemical substances on human health, propertyor the environment, establishes the procedures for the use of chemicalsubstances and provides a legal basis for regulating the respective economicactivities. Pursuant to the Act eight regulations have been drafted and will beadopted in 1998-1999.

4. In order to implement the two new legal acts described above and to meetthe requirements of the Framework Directive 89/391/EEC on occupationalsafety and health the Occupational Health Programme until 2000 (Annex14) was prepared by the Ministry of Social Affairs based on the guidelinesof the National Working Environment Policy. The programme wasapproved on the 30th of June 1998 by the Government of the Republic ofEstonia. The main objective of the Programme is to reduce or minimise healthhazards resulting from the working environment by establishingOccupational Health Centre and Occupational Health Services. Thisshould help to reduce illness of workers, the number of occupationalaccidents, the costs of working incapacity benefits and treatment, as well asincrease revenues to the GNP.

The main features of the Programme are as follows:• drawing up an action plan for Occupational Health Programme;• setting up the Occupational Health Centre• reorganisation of the Occupational Diseases Clinic

• training of occupational health specialists• setting up an occupational health service• developing applied research work in the field of occupational health• organisation of occupational health informationThe present project under the COP ’99 is drafted on the basis of theOccupational Health Programme until 2000.

5. An analysis of the compliance of the Estonian legislation with the acquis inthe field of equal rights, making recommendations concerning a new legal act(Equal Rights Act) has started within the framework of Project "Promotionof Gender Equality Mainstreaming" supported by UNDP in June 1998.

7. Compliance of the project to EU accession priorities:

Accession Partnership reference:“Support is needed for the particular issues: to develop the appropriate labourmarket structures improving the working environment conditions, focusing onoccupational health and safety, employment and equal opportunities for menand women to bring them into line with EU relevant structures.” (Chapter4:Priorities and Intermediate Objectives).“Legislation must be realigned with Community requirements in such areas asoccupational health and safety, labour law and equal opportunities (…) Activelabour market policies must be developed and jointly reviewed as a preparationfor participation in EU co-ordination. The administrative structures must bestrengthened to ensure effective implementation of legislation.” (AP Annex:recommendations for action).

National Programme for the Adoption of aquis:“The Occupational Health Programme until 2000 which has been prepared witha view to implement the Occupational Safety and Health Act focuses on thedevelopment of a national system of occupational health services for theworkers. Regional occupational services will be located in Tallinn, Tartu,Kohtla-Järve and Pärnu. The role of the Occupational Health Centre is to co-ordinate and provide methodological guidance for the activities of occupationalhealth services.” (Chapter 6.1. p. 142 of the English version: OccupationalHealth and Safety, Short-term priorities)

European Commission progress report (November 1998)“In the field of health and safety at the workplace, the National Policy onWorking Environment has been approved by the Estonian Government. Thepolicy intends to focus on strengthening the supervision and the role of theLabour Inspectorate.There are considerable differences in pay between women and men. Steps tostrengthen equal opportunities within the public administration have beentaken.” (Chapter 3.5 Economic and social Cohesion: Employment and socialaffairs).

“Further efforts need to be made to implement legislation in the area of equalopportunities. Estonia needs to pay particular attention to the establishment of

8. Immediate objectives:

1. To support the Estonian Occupational Health Centre, with a view to establishingadequate regional Occupational Health Services, including the development ofmonitoring, evaluation and prevention systems.

2. Institution Building – twinning for the Working Environment and EqualityDepartments of MOSA.

3. To ensure adequate involvement of social partners and the public in improvement ofthe working environment.

4. To train the Labour Inspectorate in occupational health and equality issues.

9. Description of the project:

The project will provide support to Occupational Health Centre development,establishment of the regional Occupational Health Services, capacity building for theWorking Environment Department (WED) and Equality Bureau of MoSA andawareness raising for social partners and public.

TwinningThe first twinning component of the project will support the Occupational HealthCentre (in Tallinn), allowing it to help update the occupational health developmentstrategy, to participate in drafting new legislation; to advise specialists of occupationalhealth services, to organise specialised training, to gather statistics on occupationaldiseases, to co-ordinate other relevant institutions.This component also involves the establishment of regional Occupational HealthServices (OHS) in Tallinn, Tartu, Kohtla-Järve and Pärnu to cover all regions inEstonia.

The OHS will: assess working conditions and health hazards at workplaces, it willperform examination of the workers health, involve employers in improving workingconditions; organise dissemination of information and training in occupational healthand safety and advise on organisation of first aid services in companies.

The second twinning component of the project is for the Labour Inspectorate, theWorking Environment Department (WED), Equality Bureau of MoSA.

Both twinning components will be accompanied by some training and seminars (to beprovided under twinning).

The Long term Pre-accession Advisor (PAA), who will be established in theMinistry of Social Affairs, will work in close co-operation with the WED. Theadditional counterparts are also the National Labour Inspectorate (NLI) and theOccupational Health Centre (OHC)

The main task of the PAA will be advising the WED, NLI and OHC in introducing thenew occupational health services system and to provide recommendations how to buildthe structure of the OHC and the OHS.

One short-term adviser (4mmonths) will work in co-operation with the Equality Bureau.The task will be to provide assistance and advice in the process of introduction of theEqual Rights Act.Other twinning short-term advisors will deal with technical and legal problemsaccording to the main guidelines of the PAA.

Both twinning components of the project should ensure the involvement of socialpartners and the public in the improvement of the working environment. The seminarsfor social partners will be organized to raise awareness and to provide informationabout their rights and obligations.The annually organized "Occupational Health Day" and the production of informationmaterial will be used to increase public awareness.

InvestmentInvestment is needed to meet Community requirements for occupational healthservices: IT components will be procured, and existing occupational hygiene,physiology and ergonomics laboratories (all located in the Occupational HealthCenter) will be modernised.

Equipment is also needed for the database located in the National Labor Inspectorate.

All equipment will be procured under DIS on the advice of twinning advisors throughthe CFCU.

10. Institutional framework

Structure of the Estonian Working Environment System:In 1997 the National Working Environment Board was reorganised intoNational Labour Inspectorate and Working Environment Departmentwithin the jurisdiction of the Ministry of Social Affairs. The department isresponsible for the overall co-ordination and management of the activities inthe field of occupational health and safety and for drawing up legislative actsregulating occupational health and safety in accordance with European Unionlegislation.There are currently eight people working in the Department.

The objective of the Labour Inspectorate is to supervise the implementationof legislative acts in the field of labour and occupational health and safety.Local labour inspectorates belong to the jurisdiction of the National LabourInspectorate.Staff of the Inspectorate comprises 138 employees including 84 labourinspectors.

TheWorking Environment Council established in July 1997, acts as atripartite body advising MoSA on the following tasks:

• matters of principle (such as the policy of occupational health and safetyetc);

• new legislation and development activities, including planning, follow-upand evaluation;

• General guidelines and goals, objectives and allocation of resources inorder to promote occupational health and safety.

The Working Environment Foundation will be subordinate to the WorkingEnvironment Council. It is foreseen that the foundation will deal withinformation, training and research in the field of working environment, publishbooks and booklets, organise courses, conferences, study trips and lectures onthe subject of working environment.

The Occupational Health Centre performs research, studies and training inthe field of working environment and is responsible for the establishment ofOccupational health Services (OSH), prepares the budget and hires OHS staffand is responsible for the provision of the facilities needed, including roomsand equipment.

The Branch Safety Committees assist enterprises in finding solutions for thespecific working environment problems and issue guidelines for the individualbranches of trade.

Structure of the Ministry of Social Affairs of Estonia :

• The Ministry of Social Affairs has recently moved to improve its internalorganisation, on the basis of recommendations made by the Commission(OMAS Report No.: R/ES/SOC/98028)1. Additional post of the European Integration issues Vice-chancellor has

been introduced and responsibilities of the vice-chancellors of Labourand Social Affairs and of the Health have been revised. This will allowbetter hands-on management of each sector.

2. The European Union Integration and International Relations Departmentwill be divided into two separate departments and at least two additionalfull time specialists will be recruited in the European Union IntegrationDepartment to strengthen the project management capacity.

3. It is also intended to strengthen the European Integration Departmentby recruiting long-term advisor and short term technical assistance(from the COP ’96 II allocation)

4. A Steering Committee for co-ordination of foreign assistance has beenestablished. (It involves some representatives of social partners but notNGOs)

5. Representatives of social partners and NGOs have been included inmost Phare project Steering Committees (especially in those dealingwith occupational safety and health issues).

6. Organisational relationship between OHC, OHS, MOSA, other healthand administrative structures has been clarified (Annex: New Structureof the Estonian Working Environment System).

12. Implementation arrangements

The CFCU is the Implementing Agency responsible for tendering, contractingand accounting. Responsibility for the technical preparation, implementationand control will remain with the recipient institution.

Institution Building:

Institution Building will be realised in accordance with the twinning concept:The general counterpart from the Ministry’s side responsible for the projectimplementation and reporting to the Phare Programme Steering Committeewill be Ms Milvi Jänes, Head of Working Environment Department of theMoSA.

The Steering Committee of the Phare Programme (set up by the Decree ofthe Minister of the MoSA) will be responsible for the overall management andsupervision of the project on the Ministry’s behalf. The Steering Committeewill be chaired by Mr Ahti Kallikorm.

16. Investment criteria:

In the strict sense of the term investment criteria are not applicable to this project asthey are not capital investments but rather focus on building institutional capacity.However, they do provide an element of additionality as they build on existing projectsand can only be sustainable through the combined resources from Phare and, later, thenational budget. As this is investment in state institutions and human resources,competition will be encouraged through Phare open tender procedures.
