Manna’s Market co-founders Jayne Flanigan and Dan Hankins(lower right) knew that the Holy Spirit had nudged Dan to devel-op a nonprofit food bank, but they never expected God would

take over and make it grow as much as it has in eight years. Manna’sMarket is a nondenominational, faith-inspired, nonprofit Michigan corpo-ration serving people in a three-county area that covers nearly 1,000square miles. The market provides food, clothing and baby pantry itemsfor those facing circumstances beyond their control. After a relocation andexpansion six months ago (bottom left), the founders are preparing for anew program involving farmers and seed companies. POWER OF ATTORNEY

QUESTION: Why do I need a power ofattorney?

ANSWER: A Power of Attorney("POA") is a legal document by which you(the "principal") give certain powers tosomeone else. This person becomes your"agent" and is authorized to act for you inyour place.

Many attorneys, stores and internet serv-ices provide a general, short-form POA.This type of POA provides general,"one-size fits all" powers to the agent.Unfortunately, I find that for seniors dealingwith Elder Law issues, general POAs maybe either too limiting (not enough powergiven) or too broad (too much power given)to fit the senior's particular situation.

For example, if you are a senior who isconcerned about protecting and preservingyour assets should you need long term carein a nursing home facility, your power ofattorney may need "gifting authority." Thispower states with specificity that your agentis allowed to make transfers of your assets(consistent with your estate plan or not, it isup to you) in order to maximize govern-mental benefits such as Medicaid. Withoutthis specific power, your family may need toask permission from the probate court toprotect your assets. There is no guarantee aprobate court will agree to the request andthe court process will be much more expen-sive than a properly drafted power ofattorney.

Seniors may also be concerned about theiragent having access to their money withouthaving any oversight. If this is a concern,your power of attorney can set forth"accounting provisions." These provisionsrequire the Agent to report quarterly (ormore often, if you wish) to your childrenany time they take action on your behalf.This provision is very helpful for familieswhere multiple children are involved andthere may be concerns about the senior'schoice of the agent.

I recommend a Power of Attorney for allof my elder law clients. Power of Attorneysare inexpensive – but can be the mostimportant planning tool for seniors facinglong term care. However, as noted in thefew examples above, great care should betaken in drafting a Power of Attorney to fityour needs. A "one size fits all" approach toestate planning / elder law issues is never agood idea.
