The following certificates/clarifications regarding approval of the environment clearance of the above noted area in subject are as under:-

1. Water Supply: -

The water supply of this area will be supplied through water works i.e. already constructed in the adjoining HUDA Sector 19, Sirsa. The drinking water will be supplied @ 135 Ltr. Per capita per day as per HUDA Water Supply Norms.

2. Sewer:-

The sewerage system of the area proposed for Environment clearance will be connected with the Master Service of adjoining HUDA Sectors. In this regard the land for construction of STP has been acquired and the estimate for construction of STP as per required capacity is under process of approval.

3. Solid Waste Management-

The solid waste of the above said area will be maintained by Municipal Council at Sirsa. The site has been already been reserved in the Master Plan of Sirsa Town for the purpose of Dumping of the Solid Waste.

4. Power Supply:-

D-Branch Letter_2018

After development of sector, the power supply will be connected with the DHBVN. However, the site has been reserved in the sector for construction of sub stations. It will be mandatory to the house owners to install the electric fittings after follow the ECDC Norms.

1. AWARD: -

The Harya na Government vide notification No. LAC (H) -

2009 / NTLA/393 dated 15 .01.2008 publjshed in Haryana

Government Gazette (Extra -ordinary) u j s-4 of the Land

Acqu isition Act, 1894· (hereinafter referred as "the Act")

notified that the land measuring 350.53 acres was likely to be

needed for a public purpose i.e. for the Development of

Residential and Commercial Sector-21, 22P, Sirsa under the

Haryana Urban Development Authority Act, 1977 by the

Haryana Urban Development Authority.

Con sequently, declaration ujs-6 of th~Act was issue.d on ~~

14~ 01.2C~/:; ;icie no tification No. LAC(H)-2 009/NTLA/465 vide

which land measur ing 337:47 acres was declared to be needed

for acquisition fo r the aforesaid purpose. Subsequently, the

Land Acquisition Collector, Urban Estate Deptt. Haryana, Hisar

was also directed u j s-? of the Act to exercise powers for the

acq~isition of land in question.

2. AREA OF THE LAND:-

The area of land given in the above decl aration was

33 7.47 acres. As per license No. 63 of 2010, the land measuring

26.522 acres was released and after that the area of land came

to 310.948 acres. A few Khasra Nos. of village Vaidwala and

v111age 1\.na1rpur were wrongiy notified. A corrigendum to this

effect was published and after the corrigendum, the land came

to 310.998 a·cres. The area measuring 1.668 acres was already

acquired vide Award No. 5 dated 15.11.1995. After deducting

this area measuring 1.668 acres, the area came to 309.33 acres.

The measurement at the spot was conducted by the field staff

as required ujs-8 of the Act and it was found that the area of

path (gair-mumkin rasta) in Khasra No. 55 7 was inadvertently

mentioned as 2.437 acres in the notification u/s -6, whereas,

the area of above mentioned path was 0.593 acres, so, after

deducting 1.844 acres, the area came to 307.486 acres. As per

policy of Government and instructions received vide letter No.

"~r2 ~' ·:=P dated 1: .. 8;_.20 1 ~ , the iand measuring 0.276

acres was released and vide letter No. A-3-2011/272 dated

12.01.2011 of Director Urban Estate Deptt. Hry. Panchkula, the

area of land under shops measuring 1.694 acres existing before

notification ujs-4 of the Act including those shops, which exists

in Green Belt on Barnala Road, Sirsa were released from ' acquisition. After deducting the area released~ the area came to

305.516 acres, for which this Award is being announced. The

details of this area are given in the Statement No. 1, which has

been prepared according to para No. 36(1) of the Financial

Commissioner's standing order No. 28 attached with the main

acquisition file of the present Award.

3. CLASSIFICATIO N OF THE LAND: -

The classification of the land under acquisition vide this

Award as per its Jamabandi for the year 2007-08 is as under: -

The land owners and other interested persons who

appeared on 30.12.2010 personally or through duly authorized

agents to state their interest and nature of their respe~tive r

them has produced any aocumentary evidence in support of

their claims .

. 5. STATEMENT OF THE ACQUISITION DEPARTMENT:-

The representative of the Acquiring Department pointed

out that the claims put-up by the land owners were too high

and without documentary proof. The Acquiring Department

req".:. ested that the market value may be determined as per the

rate supplied by the Collector, Hisar, District Hisar.

6. MARKET VALUE: -

'J'~ e n eputy Commissioner-cum-Collector, Sirsa District

was requested to supply the market rate of the land under

ac4 uls ition vide letter No. 688 dated 13.03.2009. The Deputy .

Commissioner-cum-Collector, Sirsa has supplied the market

rate of the land under acquisition vide memo No. 175-78 dated

22.06.2010 @ Rs. 50,00,000 I-per acre for all kinds of land.

I have inspected the land under acquisition along-with

the revenue staff of my office before the announcement of

Award. Keeping in view the location, situ ~:tion and all other l

factors, I observe that the market rate supplied by the Ld.

Deputy Commissioner-cum-Collector, Sirsa, are just, adequate,

reasonable and fair. So, I announce the Award accordingly.

NO LITIGATION AMOUNT:-

It has been decided to pay an additional amount equal to

20% of the basic rate of land determined by the Land

Acquisition Collector (excluding the interest and the Solatium

components) as an incentive for 'No Litigation' to such of the

land owners who opt (a) not to challenge the acquisition of

their land and (b) to accept the compensation amount as

awarded and undertake not to seek a reference ujs -18 of the

Act qua the amount of compensation. This incentive would still

be available in cases where a reference is sought with respect

to other issues i.e. (a) the measurement of land, (b) the persons

to whom it is payable, or (c) the apportionment of the

comp8nsation among the persons interested.

· B. STRUCTURES AND TUBE-WELLS ETC.:-

There are some structures/tube-wells in the land, which

are also being acquired. An assessment of these structures etc.

has been made by Executive Engineer, HUDA Division No. 2,

Hisar and he has supplied the assessment re¥1ort vide his office

memo No. 21472 dated 31.12.2010. I agree with the

assessment supplied by the Technical Authorities and I allow

the same accordingly. The details of acquired structures are

attached with the land acquisition file.

Th ere were some trees in th e acquired land. The

assessment of these trees has been made by the Executive

Engineer, HUDA Horticulture Division, Hisar, which has been

received vide his office memo No. 8285 dated 05.10.2010. I

agree with the assessment supplied by the Technical

Au thoriti es and I allow the same accordingly. The details of the

assessment are attached with land acquisition file.

10. CO MPULSORY ACQUISITION CHARGES AND ADDITIONAL AMOUNT:-

Due to the compulsory nature of acquisition charges at

the rate of 30% admissible under the provisions of the Act are

allowed and the right holders will also get an amount of 12%

per annum from the date of notification u/s-4 of the Act i.e.

15.01.2008 to the date of announcement of Award i.e.

12.01.2011 under the provisions of section-23 (2) & 23 (1-A) of

the Act.

11. POSSESSION OF THE LAND: -

Up-to the announcement of Award i.e. [ 2.01.2011, C.W.P . .

Nn 1 ~834/07 , 16857/10, 23372/10, 23363/10, 9535/09,

3331/10 and 13596/09 have been received wherein stay

dispossession has been granted qua the land in dispute by the

Hon'ble High Court. Any other Civil Writ Petition in which the

Hon'bl e Court has ordered stay from dispossession, the

possession of land involved in those writ petitions has not been

taken vide this Award. The possession of the land acquired vide

this Award, has been taken over vide Rapat No. 148 dated

12.01.2011, No. 150 dated 12.01.2011 and No. 160 dated

12.01.2011 entered in the Rojnamcha Waqyati, Patwari Halqua

of villages Khairpur, Vaidwala and Nejadela respectively,

except of such land for which the land owners/interested

persons have taken stay for dispossession from any court of ~

law till today. As regard the remaining land possession has

been taken over after offering the compensation.

Thus, the land, of which the possession has been taken,

vests in ownership of Haryana Government and on transfer will

be vests in Haryana Urban Development Authority, free from

al! encumbrances from today i.e. 12.01.2011.

12. MODE OF PAYMENT:-

The payment will be made to the land owners and other

interested persons according to their rigb},ts and shares as r

entered in the latest record of rights (Jamabandi year 2007 -08)

and as per the mutations sanctioned thereafter.
