InstallationHargreaves customer service team and regional sales managers can answer many frequently asked questions related to installation of our products; our technical team can offer additional support. Installation documentation can be provided on request. In the interests of performance and safety we recommend that all installation work is carried out to applicable regulations and codes of practice’.

MaintenanceDue to the many beneficial properties of cast iron, minimal maintenance is required for Hargreaves castings. We recommend annual inspection of rainwater, soil or drainage systems for clearance of debris and blockages. Painted surfaces should be cleared of any contamination and any deterioration of paint should be touched up.

EnvironmentWe work to ensure that our business activities comply with, and where possible surpass, applicable environmental standards and legislation. We aim to implement processes and practices which help to minimise risk and protect the local environment and eco systems from environmental impacts of our manufacturing processes. It is the policy of Hargreaves Drainage to continually improve our environmental performance and where possible to prevent pollution at source. We will reduce to a minimum the environmental impacts of our production activities and develop a pro-active approach when taking in to account our local community.

Our Halifax Soil & Drain Systems has been certified as meeting all the requirements of BS EN877 by both BSI (Kitemark No; KM684754) and BBA (Certificate No; 06/4401). The above system also meets the Construction Products Regulations (CPR) and is CE marked accordingly.

At time of delivery clear access to site and suitable equipment and personnel to offload the consignment should be available unless mechanical offload or specialist delivery has been specified. BespokeHargreaves Drainage UK operations and production are located on one site in Halifax, West Yorkshire. We have the experience and capability to manufacture bespoke casting and fabricated products to support our comprehensive standard ranges.

The Halifax site comprises of the pattern making shop, foundry and fabrication facilities with a 55,000 sq. ft. distribution centre, carrying over £2m stock at any given time, which enables us to manufacture bespoke items to meet your requirements. Our customer service team will manage your order throughout each stage of the process; ensuring the most cost effective production options are selected and quality standards and delivery deadlines are met in full.

Many bespoke commissions start with a client who is trying to reproduce a casting in the style or shape of a pattern which is no longer available. Hargreaves’ in house technical team will be able to work with either a sample from site to replicate an existing casting or a detailed drawing to create a product to a completely new design.

Renovation or extension of a period property can require, for example, radius gutters to match the specific curvature of the building and design of gutter or ornamental hopper heads to match existing installations like for like. In most cases drawings are not available, our technical support will work closely with the client at any stage of the project until we have a new casting which is compliant with current building regulations and listed building consent where applicable.

Standard products can also be altered to provide a specialist solution for your project. For example, fixing ears can be added to rainwater and soil fittings; pipe and gutter fittings can be made to specific angles and projection dimensions; and castings can be customised with dates or embellishments.

Features • Round rainwater pipes in a choice of 65mm, 75mm, 100mm and 150mm diameters and in standard lengths

of 0.6m, 0.9m, 1.2m and 1.8m. Produced by the centrifugal cast method which offers uniformity of shape and thickness.

• With the introduction of the H16 gutter, the Premier standard rainwater range now includes 8 gutter profiles in a variety of different sizes with capacities up to 3 litres per second.

• Our selection of standard rainwater heads now includes the H1 and H1A designs.

• Rainwater diverter kits allow rainwater harvesting through facilitating connection to a water butt, they are supplied with comprehensive installation instructions. Offered in 3 sizes as standard, bespoke diverter kits can also be made to fit any pipe.

• New design loose pipe sockets with spigots enable cost saving through utilisation of pipe offcuts.

• Half round gutter jointing kits consisting of 10 EPDM rubber gaskets, bolts, nuts & washers provide time saving at point of installation.

Strength / Durability • Premier pipes are highly resistant to distortion caused by accident or vandalism.

• Cast iron gutters are able to withstand the weight of ladders for roof maintenance.

• Gutters will not bend and sag when subjected to heavy snow and storms.

Long Life • Correctly installed and maintained Premier rainwater systems can last in excess of 100 years.

• Long life expectancy makes cast iron the cost effective choice.

• Annual Maintenance checks should be carried out – occasional repainting may be required after the annual maintenance checks. This is especially important within coastal areas or areas of high pollution.

• 100% recyclable at the end of its life.

Quiet in operation • Low noise levels due to the sound deadening properties of cast iron.

• Very little expansion and contraction in extreme temperatures therefore no noisy clicking, creaking or permanent deformation of gutters.

• Gutters will not rattle in high winds.

Bespoke • Specialist castings and fabrications can be created to fit the specific requirements of your building (pattern

charges may apply).

• Ears can be added to any standard rainwater fitting on request.

• Radius curved gutters can be made to match any of the standard profiles.

• Standard rainwater heads can be customised with dates or embellishments.

Quality • Premier rainwater products are manufactured in accordance with BS460.

• Our traditional range of cast iron rainwater goods is primed in standard grey metal primer with rust inhibitors .

• The standards for rainwater goods have been in existence for a significant period of time which means that replacing or integrating with an existing system can, in most cases, be completed with ease.

• Our Premier Extra gloss paint has been developed specifically for use with Hargreaves cast iron rainwater products.

Hargreaves Premier rainwater systems are available in four levels of paint finish; Premier Grey Primed, Premier Extra Black Gloss, Premier Extra RAL Coloured and Premier Coastal.

Premier Grey Primed - an anti corrosive high build primer, applied in factory conditions and ready for painting on site.Premier Extra (PX) Black Gloss - 2 pack Polyurethane High Solids Finish.Premier Extra (PX) RAL Colours - 2 pack Polyurethane High Solids Finish.Premier Extra Coastal – 2 pack Polyurethane High Solids Finish.

Premier Extra pre-painted systems provide the following additional benefits: • Quicker installation saving up to 50% on installation time and therefore reducing costs • No need for hazardous material on site and no delays where poor weather prevents painting or curing • Our factory applied 2 pack polyurethane finish has a life expectancy of 10 years. This is subject to annual

maintenance and correct installation procedures being followed, especially as far as cutting and retouching is concerned. • Delivered wrapped to provide protection during transit and on site.

Premier Coastal has been developed in response to the rigours of a marine environment, which is known to be much harsher on all external materials used in construction. Our standard Premier Extra (PX) Black and Premier (PX) RAL Colours will not provide suitable protection. Our standard 10 year life expectancy (see above) does not apply to coastal and marine environments. We recommend any location within 5Km of the sea should choose our Coastal finish.Premier Extra RAL Coloured and Premier Extra Coastal require more time than Premier Primed and PX Black Gloss so please check on lead times when ordering.

The Premier sand cast rainwater range provides an extended offering of gutters, pipes and hopper heads to meet the needs of conservation and heritage projects and can be used to complement Premier standard rainwater systems. No other material offers the aesthetic appeal of cast iron and one which can satisfy all the requirements of traditional architecture. It is the only logical choice for listed properties, conservation areas and heritage work.

The unlimited design capabilities of cast iron and Hargreaves’ in-house foundry and fabrication facilities allow us to offer bespoke castings to match original samples or existing installations using our reproduction service.

lengths of 0.6m, 0.9m, 1.2m and 1.8m. • Ornamental earbands available in 8 designs to fit all sizes of Premier round, square and rectangular pipes, or

can be made to unique bespoke designs. • Ornamental hopper heads in excess of 50 patterns in various sizes to suit all architectural styles. • 29 gutter profiles in a range of different sizes to meet most project requirements.

Strength / Durability • Premier pipes are highly resistant to distortion caused by accident or vandalism. • Cast iron gutters are able to withstand the weight of ladders for roof maintenance. • Gutters will not bend and sag when subjected to heavy snow and storms..

Long Life • Correctly installed and maintained Premier rainwater systems can last in excess of 100 years. • Long life expectancy makes cast iron the cost effective choice. • Annual Maintenance checks should be carried out – occasional repainting may be required after the annual

maintenance checks. This is especially important within coastal areas or areas of high pollution. • 100% recyclable at the end of its life.

Quiet in operation • Low noise levels due to the sound deadening properties of cast iron. • Very little expansion and contraction in extreme temperatures therefore no noisy clicking, creaking or

permanent deformation of gutters. • Gutters will not rattle in high winds.

Hargreaves Premier rainwater systems are available in four levels of paint finish; Premier Grey Primed, Premier Extra Black Gloss, Premier Extra RAL Coloured and Premier Coastal.

Premier Grey Primed - an anti corrosive high build primer, applied in factory conditions and ready for painting on site.Premier Extra (PX) Black Gloss - 2 pack Polyurethane High Solids Finish.Premier Extra (PX) RAL Colours - 2 pack Polyurethane High Solids Finish.Premier Extra Coastal – 2 pack Polyurethane High Solids Finish.

Premier Extra pre-painted systems provide the following additional benefits: • Quicker installation saving up to 50% on installation time and therefore reducing costs • No need for hazardous material on site and no delays where poor weather prevents painting or curing • Our factory applied 2 pack polyurethane finish has a life expectancy of 10 years. This is subject to annual

maintenance and correct installation procedures being followed, especially as far as cutting and retouching is concerned. Hargreaves Foundry Drainage cannot be liable for poor standard or incorrect installation on site.

Premier Coastal has been developed in response to the rigours of a marine environment, which is known to be much harsher on all external materials used in construction. Our standard Premier Extra (PX) Black and Premier (PX) RAL Colours will not provide suitable protection. Our standard 10 year life expectancy (see above) does not apply to coastal and marine environments. We recommend any location within 5Km of the sea should choose our Coastal finish.Premier Extra RAL Coloured and Premier Extra Coastal require more time than Premier Primed and PX Black Gloss so please check on lead times when ordering.

Hargreaves’ Premier LCC Soil range provides a comprehensive offering of traditional socket & spigot pipes and fittings for soil and waste installations on the external facade of buildings with the added option to commission bespoke fabrications to special order.

Supplied ready to fit with a black bitumen finish as standard, the cast iron system offers the ideal solution for conservation and heritage projects where a pipe system is required to blend sympathetically with the building.

Availability

Most of our Premier soil products are ex-stock, however selected items are manufactured on request. Ornamental earbands to fit LCC soil can be produced within an agreed time scale dependant on the size of the order.


Features • Pipes available from 50mm to 150mm diameters in standard lengths 0.6m, 0.9m, 1.2m and 1.8m. • All products are based on imperial dimensions so ensuring compatibility with existing installations when

replacing or extending pipework. • Ornamental earbands are available in 8 standard designs to fit all sizes of Premier LCC soil pipes.

Jointing • Cold caulked joints can be made with 6mm caulking cord and black joint sealant both available from stock. • This method removes the requirement for using naked flames to melt lead on site. • Approximately 4m of caulking cord and a quarter of a cartridge of sealant would be required to make a joint in

4” diameter system.

Strength / Durability • Premier pipes are highly resistant to distortion caused by accident or vandalism • Pipes and fittings are coated in a black bituminous coating.

Long Life • Correctly installed and maintained Premier soil systems can last in excess of 100 years. • Long life expectancy makes cast iron the cost effective choice. • Minimal maintenance requirements- occasional painting approximately every 10 years (inland areas). • 100% recyclable at the end of its life.

Quiet in operation • Low noise levels due to the sound deadening properties of cast iron.

Paint finish

We supply our LCC soil pipes and fittings with a black bitumen finish conforming to BS 416.The main components of Bitumen paint are naptha (petroleum) based. Bitumen has always been the choice for traditional soil drainage due to its resistance to moisture and good coverage of uneven surfaces. Normally this type of finish can’t be overpainted with other paint types, because not only will harder materials used for over coating tend to crack or glaze, but there is also the possibility that the Bitumen will bleed through.

If the colour is important to your project we recommend our Traditional Express system.

Third-party certification is one of the best ways to seek assurance that products meet the requirements of a standard. The BSI Kitemark (No. KM 684754) and BBA Agrêment certificate (No. 06/4401) covering the Halifax Soil & Drain system, should give customers the confidence to choose our BS EN 877 system. It should be noted that only products which pass both initial type testing and rigorous ongoing tests, can claim all requirements of this standard.

HALIFAX SOILINTRODUCTION

Halifax Soil is a comprehensive range of socketless pipes and fittings in 50mm to 200mm diameters suitable for internal soil, waste and rainwater installations.

The certified system is particularly suitable to high rise projects. An extensive variety of couplings and brackets offer flexibility to satisfy most designs. Typical applications include public buildings, apartments, offices, hospitals, hotels and car parks.

Availability

A selection of Halifax Soil products are ex-stock but most items are factory coated to order within an agreed time scale.


Jointing

• Socketless pipes and fittings can be jointed using a choice of 3 coupling types; no specialist tools or equipment are required for installation.

• Pipes do not require expansion joints due to the low coefficient of expansion. • High Performance Couplings are available for use on our system in sensitive area’s eg. Computer Rooms etc.

Features • Socketless pipes are available from 50mm to 200mm diameters in 3m lengths. • Choice of both ductile iron and ferritic stainless steel (Grade 430ti) couplings to satisfy most designs. • A large selection of brackets to support and brace pipework in both vertical and horizontal situations.

Strength / durablility • Halifax Soil Pipes are highly resistant to distortion caused by accident or vandalism. • Fit and forget installation.

Long life • Correctly installed and maintained Halifax soil systems can last in excess of 100 years. • Long life expectancy makes cast iron the cost effective choice. • 100% recyclable at the end of its life.

Quiet in operation • Low noise levels due to the sound deadening properties of cast iron. • Alternative materials that do not possess sound deadening properties require costly sound insulation.

Fire safety • Cast iron is non-combustible which means the Halifax Soil installations do not require costly fire protection

collars. • In the event of fire cast iron will not emit dangerous toxic fumes; unlike PVC.

Quality • All Halifax Soil products have been manufactured to meets all of the requirements of BS EN 877. • The system up to 200 mm diameter has been tested and approved by the British Board of Agrément (BBA)

Certificate No. 06/4401 for pipes and fittings. • Pipes and fittings are manufactured in grey cast iron to meet the requirements of BS EN 1561 Grade EN-

GJL150/EN-JL1020. • Halifax Soil products will be supplied in accordance with CE markings regulations.

Applicable standards and codes of practice • BS EN 877 – European Standard for cast iron pipework. This covers above ground soil, waste, rainwater and

buried drainage systems and performance requirements in the various applications. • ISO 6594 – International Standard for socketless drainage systems in cast iron. • BS EN 681 / ISO4633 – Specification for elastomeric seals for joints in pipework and pipelines. • BS EN 12056 – Code of practice for gravity drainage systems inside buildings – sanitary pipework and

drainage of roofs. • BS EN 752-1 Code of practice for drain and sewer systems.

Paint finish

The Halifax system pipes are lined internally with a two part epoxy finish which provides improved performance when exposed to aggressive substances. The pipes in this system are coated with an average of 40 microns external and an average of 130 microns internally. Fittings are also epoxy coated and provide a similar level of performance.Halifax Soil coatings have been tested successfully for resistance to attack by salt spray, waste water, hot water cycling and solution of acid at PH2 and alkalis at PH12. Hargreaves’ internal quality control procedures ensure the integrity of the coating is maintained through process monitoring and final inspection of coating thickness and adhesion.

HALIFAX DRAININTRODUCTION

Halifax Drain is a comprehensive range of socketless pipes and fittings in 100mm to 200mm diameters suitable for below ground drainage situations. The cast iron system provides greater resistance to ground movement than PVC or clay systems; an important consideration when building on made-up land.

A choice of ductile iron or stainless steel couplings to satisfy most designs and facilitate connection directly to our Halifax Soil above ground soil system. Typical applications include drainage pipes below public buildings, hospitals, hotels and exposed bridge drainage.

Availability

A selection of Halifax Drain products are ex-stock but most items are factory coated to order within an agreed time scale.


Features • Socketless pipes are available from 100mm to 200mm diameters in 3m lengths. • Lightweight pipes and fittings for speedy installation to reduce time on site but with the inherent strength of

traditional cast iron pipe systems. • Choice of either ductile iron or stainless steel couplings to satisfy most designs require no specialist tools or

equipment for installation.

Strength / Durability • Halifax Drain pipes are highly resistant to sheer loads. • Low risk of settlement damage. • Where extra loading is likely other drainage materials may need additional protection in the form of a

concrete surround. Less embedment means that normally cast iron requires no extra protection saving time and money.

• High resistance to distortion which reduces chances of damage when more vigorous rodding is required.

Long Life • Correctly installed and maintained Halifax Drain systems can last in excess of 100 years. • Long life expectancy makes cast iron the cost effective choice. • 100% recyclable at the end of its life.

Quality • All Halifax Drain products have been manufactured to meets all the requirements of BS EN 877. • Pipes and fittings are manufactured in grey cast iron to meet the requirements of BS EN 1561 Grade EN-

GJL150/EN-JL1020. • Halifax Drain products will be supplied in accordance with CE markings regulations.

Applicable standards and codes of practice • BS EN 877 – European Standard for cast iron pipework. This covers above ground soil, waste, rainwater and

buried drainage systems and performance requirements in the various applications. • ISO 6594 – International Standard for socketless drainage systems in cast iron. • BS EN 681 / ISO4633 – Specification for elastomeric seals for joints in pipework and pipelines. • BS EN 12056 – Code of practice for gravity drainage systems inside buildings – sanitary pipework and

drainage of roofs. • BS EN 752-1 Code of practice for drain and sewer systems.

Paint finishThe Halifax system pipes are lined internally with a two part epoxy finish which provides improved performance when exposed to aggressive substances. Fitting are also epoxy coated and provide a similar level of performance.

Halifax Drain pipes are finished with a two part epoxy grey coating with an average dry thickness of 170 microns. Pipes internally coated with a two part epoxy coating yellow ochre colour, average dry thickness of 130 microns and fittings with an average thickness of 150 microns.

Mech 416 Soil is a mechanically jointed range of socketless pipes and fittings in 50mm to 150mm diameters suitable for above ground soil & waste installations. The Mech 416 System is especially suitable for the refurbishment of apartments, offices and multi-storey car parks.

TRADITIONAL EXPRESS SOILINTRODUCTION

Traditional Express soil is an industry leading push fit soil system designed for a lifetime performance. The contemporary cast iron system provides the aesthetic appearance of traditional cast iron soil systems and is suitable for listed properties and conservation projects.

The push fit system provides substantial savings in labour for each joint. Full installation instructions can be provided on request, no specialist training is required.

Availability

Most Traditional Express Soil products are ex-stock but some items are factory coated to order within an agreed time scale.

Features

• 50 & 100mm diameter socketless pipes are available in 1.5m, 1.8m & 3m lengths and supplied pre-painted in a black gloss finish.

• Compared to traditional LCC soil systems the Traditional Express soil system is lighter and easier to handle but still retains all the inherent qualities of cast iron including strength and longevity.

• The push fit sockets faithfully replicate the appearance of a traditional LCC soil pipe system but incorporate EPDM rubber sealing rings providing a quick and efficient installation. Our specially design gasket relaxing tool and gasket lubricant are the only tools required for jointing - see page 82.

• Significant cost savings compared to caulked jointed socket and spigot pipes.

• Installation completed in a fraction of the time required for conventional systems.

• Ease of use on site creates cost savings through reduced labour requirements.

• Traditional Express pipes are highly resistant to distortion caused by accident or vandalism.

• BS 416 part 2 – Soil, waste and ventilating pipes and fittings.

• BS EN 681 – 1 Synthetic rubber gaskets.

• BS EN 12056 – Codes of practice for gravity drainage systems, internal buildings.


TRADITIONAL EXPRESS COLOURS

Pipes and fittings are supplied ready to install with a two pack gloss paint exterior finish as standard, suitable for internal and external installations. All pipes also have a yellow ochre two pack polyurethane internal coating.

Standard Traditional Express black products are available from stock and due to our recently completed on-site painting facility, push fit soil systems are also available in Traditional Express Coloured finish. Traditional Express Coloured offers Traditional Express soil items supplied pre-painted to match any RAL or BS colour reference. We are able to offer a Colour Match service taken from an existing sample.

Traditional Express systems are pre-painted as standard which provides the following benefits:

• Quicker installation and reduced costs; can reduce installation time by up to 50%.

• No requirement for hazardous materials on site and minimal down time caused by inclement weather conditions delaying painting.

• Factory applied two-pack epoxy coated finish has a life expectancy of 10- 15 years (inland areas).

• Delivered protectively wrapped to provide whilst protection in transit and on site.

Antony Gormley Bollards

Individually numbered and supplied with a certificate of authentication the bollards offered exclusively through Hargreaves are highly desirable pieces of contemporary art whilst also fulfilling the traditional role as functional street furniture.

Cast in iron and allowed to oxidise the bollards have a startling orange rust colour which shows the true natural beauty of cast iron and is a finish that Antony has used for many of his successful fine art sculptures.

FERROUS ELITE COLOURS

Most Ferrous Elite castings are supplied ready to install with a two pack gloss paint finish as standard. Some Ferrous Elite castings are supplied in a black bitumen paint finish. If the paint finish is critical please enquire about the specific items.

Street furniture castings are also available in Ferrous Elite Coloured finish. Ferrous Elite Coloured offers street furniture products supplied pre-painted to match any RAL or BS colour reference; we are able to offer a Colour Match service taken from an existing sample.

Logos, lettering and embellishments on street furniture can be hand painted in gold or any specific colour on request (additional charges will apply).

Ferrous Elite products are pre-painted as standard which provides the following benefits:

• Quicker installation and reduced costs; can reduce installation time by up to 50%.

• No requirement for hazardous materials on site and minimal down time caused by inclement weather conditions delaying painting.

• Factory applied two-pack epoxy coated finish has a life expectancy of 10- 15 years (inland areas).

Q. What are the benefits of cast iron? A. Cast iron is robust and durable offering a ‘fit and forget’ drainage solution; over time it will retain its shape, alignment, cosmetic appearance and water discharge function. The unrivalled life span combined with low maintenance requirements makes a cast iron system cost effective compared to other materials. Many listed buildings require genuine cast iron for refurbishment; replica systems cannot retain the strength, character and integrity of an original system. Q. What are the life expectancy and maintenance requirements of cast iron? A. Cast iron offers longevity for rainwater, soil or drainage solutions; installations have been proven to last well in excess of 100 years. Minimal maintenance is required for Hargreaves castings, annual inspections are recommended but if systems are correctly installed, only periodic painting should be required.

Q. I need an unusual product that I can’t find in the book, can you make it for me? A. Yes. Unique castings can be created by our skilled craftsmen to bespoke designs for special requirements. Made to order castings can include radius gutters or ornamental rainwater heads. All standard products can be altered to exact specifications: extended offsets, unusual angles and special bracketry for example can be catered for by our in house fabricators.

Q. I am unsure of the parts I need, can you advise me? A. Yes, our contracts office can offer a drawing take off service or site survey where required. Drainage calculations can be completed on your behalf to identify the optimum size for your rainwater, soil or drainage system.

Q. I would like some installation advice, can you help? A. Yes. Our experienced sales team can answer many frequently asked questions related to the installation of our products; our technical team can offer additional support. We have a number of specific installation data sheets which can be emailed on request. Hargreaves Drainage catalogues also provide general installation guidance; these can be downloaded at www.hargreavesdrainage.com

Q. Can I open an account? A. Hargreaves Drainage supply through a network of merchants and therefore accounts cannot be opened for contractors, installers or private individuals. Merchants and distributors can contact our sales office to request an account application form, applications are subject to approval.

Q. Can I have my order delivered to a different address?A. Yes. Hargreaves Drainage offers a direct to site delivery service. We will need a full site address including postcode and a site contact name and telephone number. You will also need to provide details of any site access restrictions, special offload or booking in requirements and site opening hours.

In these conditions “the Company” shall mean Hargreaves Foundry Drainage Limited, “the Goods” shall mean the product supplied by the Company, and “the Customer” shall mean the company, firm or person buying the goods from the Company.

1. Application of Conditions (See Terms & Conditions of Sale).Refer to www.hargreavesfoundry.co.uk. These terms and conditions govern the supply of goods sold by Hargreaves Foundry Drainage Ltd. (3428346) of Water Lane, South Parade, Halifax, West Yorkshire HX3 9GH (Seller) to the customer (Buyer). This enclosed document General Condition of Purchase, and Terms and Conditions constitute a legally binding contract between both parties.2. QuotationsAll quotations given by the Company are subject to acceptance by the Company on receipt of the Customer’s order and a contract will only be formed when the Company has accepted the Customer’s order. All such acceptances by the Company are subject to the availability of the necessary materials and to the Company being able to obtain any necessary authorisationand/or licences and to the same remaining valid. Whenever the Company is requested by the customer to give a series of quotations within the same contract, each and every quotation is to be construed as the subject of a separate agreement and the provision of this clause will apply to each quotation given by the Company. Lead times are quoted in working days. The Company reserves the right not to supply goods to individual contracts without instructions referring to the contract quotation.3. Accuracy of Description of GoodsThe Company has made every effort to ensure that the information contained in any publication is, to its knowledge, accurate at the time of print. The Company does not accept any responsibility for any errors within its literature. The Company strives to continuously improve its products and therefore reserves the right to change, without prior notice, any of the data contained in its publication.4. Prices & VATAll prices quoted are the Company’s current prices at the time of quotation and are net ex works and exclusive of VAT which shall be added at the rate in force at the time the Goods are invoiced, where applicable unless otherwise stated. The price payable for the goods shall be the price ruling at the date of despatch and the Company shall be entitled to adjust the price of the goods at any time between the date of confirmation of order and the date of delivery of the goods, to take account of any increase in costs incurred by the Company or changes to its price lists. DeliveryDelivery shall be deemed to have been effected when the goods leave the Company’s premises. Haulage ChargesHaulage charges will be calculated on an individual basis and will be levied in line with the Company’s policy in force at the date of despatch. PaymentAccount Customer’s shall be invoiced including VAT, and payable due on the 30th day of the month following the month of delivery (see point 5 above), or to specific pre-arranged agreement. If payment is not made when due, interest is payable at the rate of 4% above the minimum lending rate of Barclays Bank PLC. (See Terms and Conditions.)8. TerminationThe Company may suspend supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of obligation hereunder or you become unable to pay your debt when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you. (See Terms & Conditions.)9. RiskRisk in each consignment of the Goods or in each consignment of the Goods where the Company has elected to make deliveries by instalment pursuant to Delivery Clause shall pass to the Customer when the Goods are delivered or collected by the Customer or its agent.10. PropertyNotwithstanding the passing of risk under Clause 9 above, unless and until payment shall have been made to the Company in respect of all the Goods delivered or to be delivered to the Customer and comprised in the contract and in respect of all and any Goods supplied or to be supplied by the Company under this contract or under any other contract between the customer and the Company in accordance with Clause 8, property in an title in such Goods shall remain with the Company. In all cases where the Customer complains of defects or shortages,

the Company shall without prejudice to the question of liability generally be under no liability in any event if it has not been given an opportunity to inspect the goods before they have been used by the Customer. In respect of damage to all or part of the Goods or loss of part of the Goods comprised in the Contract notification must be made to the Company within 5 working days of delivery of the Goods (which will normally be stated on the Carrier’s consignment note) and separately to the Carrier within the period stipulated by the Carrier’s terms of carriage for claims against the Carrier.12. WarrantyThe Company warrants that it has title to and the right to sell the goods. No representation or warranty is given by the Company as to the suitability or fitness of the Goods for any particular purpose and the Customer shall satisfy him in this respect and shall be totally responsible therefore.13. Liability/ExclusionsUpon notification of a problem with the goods, we will either make good any shortage or nondelivery; replace or repair any goods that are damaged or defective upon delivery; or resolve the financial element of the cost of material. We will not be liable to you for any loss of profit, administrative inconvenience, disappointment, indirect or consequential loss or damage arising from any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting in our negligence. (See Terms & Conditions.)14. IndemnityThe Customer shall keep the Company indemnified against all costs, claims, demands, expenses and liabilities of whatsoever nature made by third parties caused in whole or in part or arising out of any act or omission of the customer in connection with the use or storage or sale of the Goods.15. Design etcWhere the goods are made to a specification, instruction, or design supplied on or on behalf of the Customer; the Customer is responsible for the suitability and accuracy of the specification, instruction, design or drawing (even where finally produced by the Company); the Customer shall indemnify the Company against infringement of any third party’s intellectual property rights in the specification, instruction, design or drawing. Copyright, design, right and any other intellectual property rights in the drawings, designs and the like prepared by or for the Company vests in the Company and the Customer undertakes not to copy any Goods supplied by the Company.16. AssignmentThe Customer shall not assign nor transfer nor purport to assign or transfer any contract to which these conditions apply or the benefit thereof to any other Company or person whatsoever.17. Force MajeureThe Company shall have no liability for any failure to perform, for any delay in the performance of any obligations under the Contract arising wholly or in part by reason of any factor beyond its direct control.18. CancellationOrders may only be cancelled with the consent of the Company. Cancellation will not be accepted where the goods have been made to the Customers special order. In the event of cancellation the Customer will indemnify the Company fully against all expenses incurred by the Company together with liquidated damages of 25% of the contract price.19. ReturnsGoods returned to the company will be accepted only at the companies commercial discretion and will be subject to restocking charges. All returns must be expressly agreed by Hargreaves Foundry Drainage prior to return. Please refer to our Returns Policy which is available via our office or website.20. Time and IndulgenceThe whole rights and remedies of the Company in terms of these conditions shall not be prejudiced or derogated from in any way by the failure of the Company whether on one or more occasion to exercise any of said rights and remedies, or by its agreement whether on one or more occasion not to exercise any of said rights and remedies.21. SeverabilityIn the event that any part of these conditions shall be determined to be invalid, unlawful or unenforceable to any extent such condition or provision shall be severed from the remaining conditions which shall continue to be valid and enforceable to the fullest extent permitted by law.22. NoticesAny notice, consent, notification, acknowledgement, authority or agreement required or referred to in the contract shall be: in writing and given to the party for whom it is intended at their registered or main office or last known address, and given by registered or recorded delivery post, e-mail or telefax and shall be deemed to have been received 5 days after posting or 1 day after transmission as the case may be.23. JurisdictionAll contracts between the Company and the Customer shall be governed and be construed in accordance with English Law and all disputes arising in relation to such contracts shall be submitted to the jurisdiction of the English courts.
