A person shall not sell, give, or otherwise supply any tobacco, to- bacco products, alter- native nicotine pro- ducts, vapor products, or cigarettes to any person under twenty- one (21) years of age. 2. A person under twenty-one (21) years of age shall not smoke, use, possess, purchase, or attempt to purchase any tobacco, tobacco products, alternative nicotine products, va- por products, or cigar- ettes. 3. Possession of to- bacco, tobacco prod- ucts, alternative nicotine products, vapor prod- ucts, or cigarettes by an individual under twenty-one (21) years of age does not consti- tute a violation under this section if the indi- vidual under twenty- one (21) years of age possesses the tobacco, tobacco products, al- ternative nicotine pro- ducts, vapor products, or cigarettes as part of the individual's em- ployment and the indi- vidual is employed by a person who holds a valid permit under the Iowa Code or who law- fully offers for sale or sells cigarettes or to- bacco products. 4. a. A person shall not be guilty of a viola- tion of this section if conduct that would otherwise constitute a violation is performed to assess compliance with tobacco, tobacco products, alternative nicotine products, va- por products, or ciga- rette laws if any of the following applies: (1) The compli- ance effort is conduct- ed by or under the supervision of law en- forcement officers. (2) The compli- ance effort is conduct- ed with the advance knowledge of law en- forcement officers and reasonable measures are adopted by those conducting the effort to ensure that use of tobacco, tobacco prod- ucts, alternative nico- tine products, vapor products, or cigarettes by individuals under twenty-one (21) years of age does not result from participation by any individual under twenty-one (21) years of age in the compli- ance effort. b. For the purposes of this subsection, "law of this subsection, "law enforcement officer" means a peace officer as defined in Iowa Code section 801.4 and includes persons desig- nated under this sub- section to enforce this section. B. Penalty: 1. a. A person, oth- er than a retailer, who violates subsection A1 of this section, is guilty of a simple misde- meanor. b. An employee of a retailer who violates subsection A1 of this section, commits a simple misdemeanor punishable as a sched- uled violation under Iowa Code section 805.8C. 2. A person who vio- lates subsection A2 of this section, is subject to the following, as ap- plicable: a. A civil penalty pur- suant to Iowa Code section 805.8C. b. For a first offense, performance of eight (8) hours of community work requirements, un- less waived by the court. c. For a second of- fense, performance of twelve (12) hours of community work re- quirements. d. Motor trucks reg- istered for a gross weight limit exceeding weight limit exceeding ten thousand (10,000) pounds (5 tons) must travel over marked highways when operat- ing in the city and may not depart from such marked highways, ex- cept that any motor truck whose destina- tion is in the city may depart from such high- way at that point on the highway nearest to its destination and then proceed directly to such destination. B. Motor trucks whose trips originate within the city must travel by the most di- rect route to that point on a marked highway nearest to such point of origin. C. Motor trucks en- tering the city on an unmarked highway must proceed to the nearest marked high- way by the most direct route and then proceed to their destination, ex- cept when the destina- tion lies between the point of entry into the city and the marked highway. This prohibi- tion shall not apply to Central Avenue and White Street between 4th Street and 32nd Street from the de-des- ignation of Central Av- enue and White Street as the Iowa Highway 52 motor truck route through the City of Dubuque by the Iowa Department of Trans- portation and continue through December 31, 2022. D. Motor trucks reg- istered for a gross weight limit exceeding ten thousand (10,000) pounds (5 tons) must not travel over the fol- lowing streets: Ice Harbor Drive, from 1st Street to the 3rd Street Overpass. Main Street, from 5th Street to 9th Street. E. The city manager is authorized to desig- nate and establish by appropriate signs alter- nate motor truck routes and to post signs limiting motor trucks registered with a gross weight limit ex- ceeding ten thousand (10,000) pounds (5 tons) from operating on nonhighway streets and the streets desig- nated in subsection D of this section. F. The provisions of this section governing the travel of motor trucks on residential streets do not apply to public or private carri- ers of passengers on tour, fixed demand re- sponse, or dial-a-ride routes or school or church buses. G. The scheduled fine for a violation of this section is fifty dollars ($50.00). ($50.00). Section 2 . This ordi- nance shall take effect upon publication. A person shall notsell, give, or otherwisesupply any tobacco, to-bacco products, alter-native nicotine pro-ducts, vapor products,or cigarettes to anyperson under twenty-one (21) years of age. 2. A person undertwenty-one (21) yearsof age shall not smoke,use, possess, purchase,or attempt to purchaseany tobacco, tobaccoproducts, alternativenicotine products, va-por products, or cigar-ettes. 3. Possession of to-bacco, tobacco prod-ucts, alternative nicotineproducts, vapor prod-ucts, or cigarettes byan individual undertwenty-one (21) yearsof age does not consti-tute a violation underthis section if the indi-vidual under twenty-one (21) years of agepossesses the tobacco,tobacco products, al-ternative nicotine pro-ducts, vapor products,or cigarettes as part ofthe individual's em-ployment and the indi-vidual is employed by aperson who holds avalid permit under theIowa Code or who law-fully offers for sale orsells cigarettes or to-bacco products. 4. a. A person shallnot be guilty of a viola-tion of this section ifconduct that wouldotherwise constitute aviolation is performedto assess compliancewith tobacco, tobaccoproducts, alternativenicotine products, va-por products, or ciga-rette laws if any of thefollowing applies: (1) The compli-ance effort is conduct-ed by or under thesupervision of law en-forcement officers. (2) The compli-ance effort is conduct-ed with the advanceknowledge of law en-forcement officers andreasonable measuresare adopted by thoseconducting the effortto ensure that use oftobacco, tobacco prod-ucts, alternative nico-tine products, vaporproducts, or cigarettesby individuals undertwenty-one (21) yearsof age does not resultfrom participation byany individual undertwenty-one (21) yearsof age in the compli-ance effort. b. For the purposesof this subsection, "lawenforcement officer"means a peace officeras defined in IowaCode section 801.4 andincludes persons desig-nated under this sub-section to enforce thissection. B. Penalty: 1. a. A person, oth-er than a retailer, whoviolates subsection A1of this section, is guiltyof a simple misde-meanor. b. An employee of aretailer who violatessubsection A1 of thissection, commits asimple misdemeanorpunishable as a sched-uled violation underIowa Code section805.8C. 2. A person who vio-lates subsection A2 ofthis section, is subjectto the following, as ap-plicable: a. A civil penalty pur-suant to Iowa Codesection 805.8C. b.
